5. Review revised site plan - Chauncy Street - Webster
The Planning Board received a memorandum from Joseph Zeneski, DPW Director,
regarding this revised site plan and stated that his primary area of concern
is the proposed relocation of the unnamed stream into the piped system from
Chauncy Street to the back of the lot. Failure of this drain pipe will cause
a backup of storm water across Chauncy Street. Ronald Webster, applicant,
stated that this concern should have been brought up at the Conservation
Commission meeting and not the Planning Board meeting; he also stated that
he has talked to the Building Inspector and ws told that a fence is not
needed on this property to serve as a buffer. The Planning Board informed
him that according to the Bylaw a fence or plantings is required and that
since the Planning Consultant has not had a chance to look at this site plan
because the date of submission was August 13, 1985, the Board should hold
the discussion on this plan until next week when the Planning Consultant will
have had a chance to review the plan. Acting Clerk Genatossio stated that
she believes it is a good idea to hold off on the discussion of this site plan
because the Planning Board should also get the comments from the various
department heads as to if they have any problems with the plan. Acting
Clerk Genatossio and Planner Flynn also had a concern about the amount of
lot coverage and how the lot coverage is determined - building and parking,
or building only.
Motion: To look into the issue of the lot coverage and make any changes
that are needed to clarify this issue.
(Genatossio - Flynn - All in favor)
6. Aldo Paglia - Granada Park
The Planning Board sent Mr. Aldo Paglia a letter asking him to attend a
Planning Board meeting to discuss the unfinished items at the Granada Park
Subdivision. Mr. Paglia stated that the only items which have to be com-
pleted, he believes, are the retaining wall, a section of the sidewalk and
the lot bounds. Acting Clerk Genatossio stated that the best time to com-
plete these items is now, before the winter.
Motion: To send a letter to Mr. Aldo Paglia and request that the retaining
wall, the lot bounds and the sidewalk be completed by November 1,
1985, so that this construction is in at least a full winter before
the Town will even consider accepting the street.

7. "Form A" plans
Fram - Bird Road
The applicant of this "Form A" plan is Ralph Fram. This "Form A" plan con-
sists of property located on the westerly side of Bird Road, bounded on the
south by land of Michael Pifalo and Jess Realty Trust, on the west by land
of Home Developers, on the north by land of Joseph Donovan, Town of Fox -
borough, Montaup Electric Company, Town of Foxborough, Town of Sharon and
Edward A. Jerome. The reason this plan does not constitute a subdivision is
because it is an existing lot on an existing way. The checklist is complete.
Acting Clerk Genatossio had a concern about how the Fire Department and
Police Department would get to these lot in case of an emergency because the
whole road is not going to be paved. Planner Boldrighini stated that there
is nothing that the Planning Board can do because this case has been to
court and the judge has ruled on it.
Motion: To sign the "Form A" plan for Bird Road.

Dustin - East Street
The applicant of this "Form A" plan is George F. Dustin. This "Form A"
plan consists of a piece of land, designated Lot A, on the southwesterly
side of East Street bounded northwesterly by lands belonging to Dustin &
Spier, northeasterly by East Street, southeasterly by the Town of Mansfield,
and southwesterly by the Town of Mansfield; and a piece of land, designated
Lot B and Lot C on the southwesterly side of East Street, bounded north-
westerly by land belonging to the Town of Mansfield, northeasterly by East
Street, southeasterly by land belonging to Hovey and southwesterly by land
belonging to the Town of Mansfield. The reason this plan does not constitute
a subdivision is because the lots have sufficient frontage on existing streets.
The checklist is complete.
Motion: To sign the "Form A" plan for East Street.
(Genatossio - Boldrighini - All in favor)
The Folkman Company - Shannon Lane
The applicant of this "Form A" plan is The Folkman Company. This "Form A"
plan consists of a parcel of land on the easterly end of Shannon Lane
bounded northerly by The Folkman Company, easterly by Hallet, southerly
by The Folkman Company and westerly by Shannon Lane. The reason this plan
does not constitute a subdivision is because the lots have sufficient area
and frontage as per zoning.
Motion: To sign the "Form A" plan for Shannon Lane.

8. Discussion of Environmental Impact Statement
Acting Clerk Genatossio stated that the Planning Board met on Saturday,
August 10, 1985, to discuss this study and they decided at that meeting
to send a letter to the developers asking them to endorse the Planning
Board's decision to release the money to the consultant who performed this
study. She stated that the Board also discussed the issue of water - all
subdivisions within the area of study should not change the amount of
runoff for that particular subdivision. The Board is satisfied with the
study and believe that the consultant has finished his scope of work.
9. "Massapoag Estates" preliminary subdivision plan
Paul Folkman, applicant, approached the Board and stated that he has sub-
mitted another preliminary plan on Massapoag Estates and would like the
Board to review this plan very briefly and decide which plan they would
rather deal with, the original submission or the second submission. The
Planning Board stated that the Planning Consultant has not had a chance
to review this plan yet as it had just been submitted on August 12, 1985;
Joseph Zeneski, DPW Director, stated that the Board should go through the
checklist to make sure that it is complete, and if it is not the plan
should be returned to the applicant stating that it has not been properly
submitted. The Board reviewed the checklist, and with the exception of
a few minor items, it is complete. Mr. Folkman stated that something has
to be done with the original plan.
Motion: To deny "Massapoag Estates" preliminary subdivision plan dated
January, 2, 1985, due to the fact that the applicant has submitted
a new set of plans.

Mr. Folkman stated that there is still a lot of survey work to be done on
on this site and he wants to work with the Board and get their input into
this plan once he has a definite design after the surveying is done. There
was discussion regarding whether Mr. Folkman should wait until all the work
is done before getting the Planning Board involved. Planning Consultant
Mannarino stated that when the plan is done in this manner there is a better
working environment and he doesn't believe that there will be any major
changes with the plan even after the work is done. Planner Boldrighini
stated that he would like this plan to be brought up again after Mr. Folkman
receives his data and after the Planning Board receives the Department Head
comments.
10. "Green Acres" definitive subdivision
The Planning Board received a request for an extension of fourteen (14)
days for the decision on this subdivision. Planning Consultant Mannarino
stated that no comments have been received as yet from the applicant.
Motion: To accept the extension request of fourteen (14) days until
September 9, 1985.
(Flynn - Boldrighini - All in favor)
11. "Westhaver Farms" definitive subdivision
Acting Clerk Genatossio read the memorandum from the DPW Director stating
that he suggests that this subdivision be approved; he also stated that
the pavement width should be reduced to 25 feet and the sidewalks should
be waived surrounding Lots 21 and 29 and should be placed from Franklin
Street to Winter Street, as was done on Highland Avenue. There was some
discussion from the Board as to waiving the pavement width and the side-
walks. Bill Vernon, Franklin Street, approached the Board and stated
that the citizens on Franklin Street are concerned about the public safety
on this street because there are no sidewalks and it would be appreciated
if the Board would consider the placing of sidewalks on this street. Mr.
Folkman stated that he has no problems with either of these requests if
it is what the Board wishes, but if the Board wishes the applicant to place
sidewalks on Franklin Street, it will have to be with the stipulation that
these sidewalks will not have to be constructed until the subdivision is
started which may not be for a few years. There was concern from the Board
that construction will not start within the two-year period which is stated
in the regulations; and if it is not started within the next two years,
Mr. Folkman may have to come back to the Planning Board to make sure that
the plan still conforms to the regulations which are in effect at that
time.
Motion: To approve the subdivision plan for "Westhaver Farms" including
the waiver for the roadway pavement width of 25 feet due to the
fact that this subdivision is within the Aquifer Protection Dis-
trict.
(Boldrighini - Flynn - RESCINDED)
Planner Bachman felt that the Board should not start granting waivers, they
should follow the Subdivision Regulations and approve/disapprove the plan
F on that basis. Chairman Brugliera stated that if the Subdivision Regulations
are revised and construction has not started at that time, Mr. Folkman can
come to the Planning Board for a waiver of the pavement width.
Motion: To approve the subdivision plan for "Westhaver Farms" as it
has been submitted to the Planning Board.
(Boldrighini - Flynn - Bachman - Brugliera)

12. "Fuller Estates" definitve subdivision plan
Planning Consultant Mannarino stated that the applicant has chosen to increase
his bond estimate to encompass the rock which was found in the cul-de-sac. All
the comments from the department heads concerning this plan have been incorpor-
ated on the plan and there appears to be no further problems with the plan.
Motion: To approve the subdivision plan for "Fuller Estates" as it has
been submitted to the Planning Board.
(Flynn - Boldrighini - Brugliera - Bachman)
13. "Hidden Estates" definitive subdivision Plan
The Planning Board denied this definitive subdivision plan on Wednesday, August
7, 1985, but the applicant has addressed all the comments for why the plan was
denied and he is now resubmitting it to the Board. Joseph Zeneski, DPW Director,
and Joseph Mannarino, Planning Consultant, have not had a chance to review these
plans. Michael Trowbridge, Engineer of the plan, stated that the Board should
take this plan up next week rather than at this meeting so that Mr. Zeneski and
Mr. Mannarino have a chance to review the plans.
14. Camelot at Mansfield - Road Material List
The Planning Board received a letter from Mr. Edward Broderick, The Broderick
Corporation, asking for a calculation for the bonding for the first 650 feet
of Lancelot Lane in Camelot at Mansfield. There was a concern from the Board
as to whether Mr. Broderick has to come back to the Planning Board because this
plan was approved such a long time ago. Planning Consultant Mannarino stated
that after this plan has gone to the Conservation Commission, the Board will
have to determine what steps to take from that point. The Planning Board felt
that a bond estimate should not be calculated until the Conservation Commission
finishes with this plan and it comes back to the Board.
Motion: To send a letter to Mr. Edward Broderick stating that the Planning
Board will not calculate a bond estimate until the plan is submitted
to the Board for review after the Conservation Commission approves
the changes.
(Genatossio - Boldrighini - All in favor)
15. Court Order - Fram - Bird Road
Motion: To send a letter to Jack Dwyer, Town Counsel, asking for an explanation
of this court order.
(Genatossio - Flynn - All in favor)
16. Around the Table
Planner Boldrighini stated that the Planning Board should get the letter which
Anthony Fiore drafted on Foxboro Terminals to Jack Dwyer, Town Counsel, as soon
as possible so that Mr. Dwyer can come into the Planning Board's next meeting.
Also state in this letter that the Planning Board would like Mr. Dwyer to respond
immediately to these concerns.
Motion: To amend this letter to state that the Planning Board requests that
Mr. Dwyer attend the next meeting on Wednesday, August 21, 1985, to
discuss this matter. If Mr. Dwyer does not have the time to review
the regulations on this matter, he can postpone attending the Board's
meeting until Wednesday, August 28, 1985.

Planning Board's Minutes
August 14, 1985

Planner Boldrighini asked what was happening with the position of Planning
Director. Chairman Brugliera stated that three applicants have been chosen
to come in for interviews; these interviews will be held on Saturday, August
24, 1985. Joseph Mannarino, Chairman Brugliera, Joan Cutillo - Acting Town
Manager, and Joseph Zeneski - DPW Director, will be conducting the interviews.
Planner Flynn stated that she would like another member of the Planning Board
to be included in these interviews. Planning Consultant Mannarino stated that
there should not be that many people conducting the interviews and he believes
that the four which are conducting interviews will be adequate. He also stated
that he would like a list of questions to ask the applicants at the interviews
and that this list should be obtained from the Town Manager.
Planner Flynn stated that she would like Foxboro Terminals to be on the Agenda
next week to discuss the covenants on Ryan & Elliott.
Planner Bachman stated that he does not believe the Board should have to be
going through the checklist at the meetings, he believes these lists should
be done before the plan comes to the Board and if the list is not done, the
discussion of the plan should be held off for another week. Acting Clerk
Genatossio stated that since there is no Planning Director at the moment, the
Board will have to review it, so that if there are any problems with the plan
the Board will know before the deadline is near and extensions have to be
granted.
Acting Clerk Genatossio stated that she would like to have the Board do a site
walk on Massapoag Estates. Planner Boldrighini stated that the Board should
wait on walking this site until Mr. Folkman receives his further information
and submits it to the Board.
Chairman Brugliera asked what the deadline date for the completion of Cabot Pond
was, according to the letter the Board sent the Applicant. Planning Consultant
Mannarino stated that the deadline is October because the applicant stated that
he was going to begin work in August and end in the middle of September.
Chairman Brugliera would like this put on the agenda for next week and would like
the letter to be taken out of the files to verify the deadline.
Acting Clerk Genatossio asked if all the items at Fairfield Park were completed.
Planning Consultant Mannarino stated that he doesn't believe all the items are
complete and that the Board should send the applicant a letter stating the the
Board would like all items completed by a certain date.
Motion: To send a letter to Mr. Ronald Bonvie, applicant, stating that the
Planning Board would like all the items that are not completed at
Fairfield Park completed by at least October 1, 1985, all the items
should be outlined in this letter.
(Genatossio - Boldrighini - All in favor)
Chairman Brugliera stated that he would like the Pending Business and the Agenda
to include all the members which were present at the public hearing for these
subdivisions so that the Board knows who can vote on the plans.
17. Public Discussion
Joseph Zeneski, DPW Director, stated that he has inspected both Norfolk Street
Extension and Maplewood Estates and he will be getting memorandums to the Board
on both these bonds for the money that should be released. He also stated that
he would like the Board to start working on the Subdivision Regulations again
so that a public hearing can be held on these changes. The Subdivision Regulations
will be placed on the agenda next week for discussion to summarize the changes.
