5. Variance Applications
The Broderick Corporation - Riverside Drive
This variance application is for an existing structure at 45 Riverside Drive
Extension which is less than 10 feet from a detached garage, which is non-
conforming in a Residence A Zone. The applicant of this variance is The
Broderick Corporation. This parcel of land is zoned Residence A and the
roofed -in porch is nine (9) feet to detached garage versus the ten (10)
foot minimum requirement. Planning Director Mannarino informed the Board
that the house and garage are already completely constructed.
Motion: To send a favorable recommendation to the Zoning Board of Appeals.
(Fiore - Bachman - All in favor)
Wilbur A. and Irene Birman - Mill Street
This variance application is to construct an addition to an existing struc-
ture at 21 Mill Street, said addition having a sideyard of less than 15
feet which is non -conforming in a Residence A Zone. The applicants of this
variance are Wilbur A. and Irene Birman. The size of the existing building
is 75 feet by 24 feet, the size of the proposed building is ten (10) feet
by 21 feet. The present and proposed use is for a single family residence
and a part-time auto repair shop. The grounds for exception, permit or
variance are the applicants request a variance from the minimum yard regu-
lations of Section IV (Intensity Regulations), B (Schedule) for a Residence
A Zone. They wish to have a second bay in their garage and cannot add such
a bay to the back of the garage because of the topography of the lot which
drops off severly immediately behind the house and garage and also because
of the soil conditions of the backyard. Planning Director Mannarino stated
that the addition has already been constructed and the variance is to expand
the applicant's home occupation. Since there is no certified plot plan with
the application, it is difficult to determine the exact side yard set back.
Motion: To send a letter to the Zoning Board of Appeals informing them
that the Planning Board is unable to make a recommendation at this
time due to the insufficient information; there is no certified
plot plan with this application and the effects of granting the
variance to add a second bay are unknown.

6. Site plan - Nissan Motors Corporation - industrial building off Plymouth Street
Planning Director Mannarino presented this site plan to the Planning Board
and stated that anything which is done with this site is contingent upon
the abandonment of Rutland Street and that public hearing will be held next
week. He also stated that there is no proponent at this meeting, but they
will be in next week to answer any of the Board's questions on this plan.
Planning Director Mannarino stated that the applicants propose to remove
material to form a pond and use the material from that pond under the foun-
dation of the proposed building. Acting Clerk Genatossio stated that this
should be considered under Pond Development of the Zoning Bylaw. Planning
Director Mannarino informed her that he has checked with Town Counsel and
he is of the opinion that this would not constitute earth removal because
the material would not be leaving the site; he also stated that the appli-
cants need this pond for their drainage system, but there was a question
from the Board if the applicants need that large a pond. Planning Director
Mannarino stated that the applicants will be in next week and the Board
should have the department head comments by that time.

7. "Westview Woods" definitive subdivision plan - revised
Planning Director Mannarino informed the Board that, according to state
law, if a subdivision plan is denied by the Planning Board the applicant
can come back to the Board for approval once all the requirements are on
the plan. Mr. Broderick approached the Board with a plan and stated that
he has resubmitted and revised this plan and that he believes it meets
the Board's requirements; he raised the elevation of the road,(lifeet) from where
the cut was the deepest and he has submitted an alternative plan to the
swale because of the Board's concerns and he believes that these altera-
tions minimize the disruption of the site and addresses the Board's con-
cerns from an aesthetic.point of view. Chairman Brugliera informed Mr.
Broderick that the road is still at quite a lower elevation than the
Board recommended and Planning Director Mannarino stated that Mr. Broderick
should work with the site instead of working against it.
Motion: To stop discussion of this definitive subdivision plan.
(Boldrighini - Fiore - All in favor)
Motion: To remain with the original motion to disapprove this definitive
subdivision plan and have it be stated that the newly revised
plan does not meet the requirements of the Planning Board as
stated in the original motion.
(Genatossio - Fiore - Bachman - Brugliera)
(Boldrighini opposed)
PASSES
8, "Form A" plans
Moothart - Willow Street
The applicants of this "Form A" plan are Gerald G. and Patricia Moothart.
This "Form A" plan consists of a parcel of land on the northerly side of
Willow Street bounded northerly by The Broderick Corporation; easterly by
Monnett; southerly by Willow Street and westerly by Willis. The reason
this plan does not constitute a subdivision is because Lot A conforms to
Zoning, slid Lot B has a variance granted for insufficient frontage. The
checklist is complete.
Motion: To sign the "Form A" plan for Willow Street.
(Genatossio - Fiore - All in favor)
Allen - Essex Street
The applicants of this "Form A" plan are Douglas and Valeria Allen. This
"Form A" plan consists of Lot D on thPwesterly side of Essex Street,
bounded easterly by Essex Street; southerly by Dorsett and Allen; westerly
by Allen; and northerly by McGrath. The reason this plan does not con-
stitute a subdivision is because the lot shown has frontage on an existing
street and conforms to zoning. The checklist is complete.
Motion: To sign the "Form A" plan for Essex Street.
(Fiore - Boldrighini - All in favor)
9. Discussion of Environmental Impact Study
Planning Director Mannarino stated that he has reviewed this study and he
believes that the traffic study is complete; there appears to be some de-
sign changes in the roadways needed at the moment, but even with the
Planning Board's Minutes

proposed development, there doesn't appear to be a problem. The biggest
problem in the area of development appears to be the culverts, though he
still has questions as to why there will be no changes with the proposed
developments, there needs to be clarification on this matter. The water
quality issue is being reviewed by the DPW Director. The consultants
didn't really highlight the problems with Whiteville Pond and the Board
should get Faye, Spofford and Thorndike to obtain more information on the
pond such as the water quality of the pond being effected from the pro-
posed developments; the study also states that the inflow to Whiteville
Pond will be increasing from the development, but this statement does not
coincide with the statements concerning the culverts and the Board believes
this needs clarification. Planning Director Mannarino stated that if the
Board asks for clarification on these facts, the concerns of.the DPW Director
and the concerns of the developers,; that it should clarify parts of the study.
Planner Boldrighini stated that the Board should ask the consulting firm what
the impact of all these developments would be on the pond if the Whiteville
Pond Association cleans out this pond. Planning Director Mannarino informed
him that he doesn't believe this is within the scope of work that the con-
sulting firm was hired for, but the Board could ask them a general question
on the pond - whether it would become worse or better.
Chairman Brugliera asked Planning Director Mannarino how far away the Board
is from getting the Subdivision Regulations changed and holding a public
hearing so that the Board will not have to deal with roadway widths through
this study. Planning Director Mannarino stated that the Board should hold
another work session and then hold the public hearing. Planning Director
Mannarino stated that he will send Faye, Spofford and Thorndike his concerns,
the DPW Director's concerns and the developers' concerns about the study and
the Board will discuss it again next week.
10. Around the Table
Acting Clerk Genatossio stated that in last week's minutes, it was stated
that the Board is supposed to appoint a member to the Downtown Advisory
Committee.
Motion: To appoint Planner Al Boldrighini to the Downtown Advisory
Committee.
(Genatossio - Fiore - WITHDRAWN)
Planner Bachman stated that he does not believe that the Planning Board
should be appointing anyone to the Downtown Advisory Committee because their
work is completed and he also stated that the Planning Board should contact
the Committee and see if they are going to continue their work.
Motion: To send a letter to the Downtown Advisory Committee stating that
the Planning Board feels that it is impractical to make new
appointments to the Downtown Advisory Committee and would like
the Committee to come into the Board's next meeting to discuss
it.

Chairman Brugliera stated that the Planning Board should start thinking
about a summer schedule for the end of July and'the whole month of August.
Planner Boldrighini stated that the Board should wait until the middle of
July and then decide what the summer schedule should be due to the amount
of work the Board has to accomplish. Chairman Brugliera stated that if
the Board doesn't look at a schedule now, they will never have the time
to set one up.
Motion: Not to have a meeting on July 3, 1985, and starting on July 17,
