(Flynn - Doucette - All in favor) Planner Flynn noted that on Page 3, under the discussion of "Westview Woods" definitive subdivision plan, it should be noted that where it is stated that "Planner Boldrighini stated that since some of the Board members are concerned with the trucking which would be involved inithis operation," it should be amended to state Planner Boldrighini stated that since some people are concerned with the trucking which would be involved in this operation,". 4. "Westview Woods" definitive subdivision plan - 11 lots off West Street Clerk Doucette read the correspondence pertaining to this subdivision. Planner Flynn stated that she had to leave the room and would like the Board to either hold the discussion or hold the vote on this definitive subdivision plan until she returns. The Board will hold the entire discussion until Planner Flynn returns to the room. 5. "Form A" plan - Riccio - First Street The applicant of this "Form A" plan is John and Barbara Riccio. This "Form A" plan consists of a parcel of land on the southerly side of First F. Street bounded northerly by First Street; easterly by Souza; southerly by the Town of Mansfield and westerly by Dane Street. This plan does not constitute a subdivision because all the lots have sufficient area and frontage as per the Zoning Bylaws. The checklist is complete. Motion: To sign the "Form A" plan. (Genatossio - Doucette - All in favor) 6. "Mansfield Manor Estates" The Planning Board received a letter from Angelo Pasqualino, Pasco Con- struction, requesting an extension of thirty (30) days for the Planning Board's decision on the "Mansfield Manor Estates" subdivision. Motion: To accept the request for an extension of thirty (30) days from June 5, 1985. (Genatossio - Boldrighini - All in favor) 7. "Fox Street" definitive subdivision plan - off Atwood Street - 3 lots Planning Director Mannarino presented this definitive subdivision plan to the Planning Board and stated that a public hearing date has to be set up. He also stated that the Board has had a preliminary subdivision plan before them for this parcel of land and that the applicant is supposed to have the drainage plans worked out and a sewer line connection. The Planning Board decided to hold this public hearing on July 10, 1985. 8. Site plan - Industrial Building - Foxboro Terminals - Frances Street Planning Director Mannarino stated that he believes this building is for a warehouse truck terminal and that a public hearing must be held because it is in the Water Protection District requiring a Special Permit. The Planning Board decided to hold this public hearing on July 10, 1985. Planning Board's Minutes June 5, 1985 Page 4 9. "Chambers Court" definitive subdivision plan - 7 lots off West Street Clerk Doucette read the memorandum to the Planning Board from the Planning Director concerning the summary of the department head comments. Michael Trowbridge, RIM Engineering, stated that there was no water on each of these lots and that there is a note on the contour sheet that they have been mon- itoring the water on this land when the front lots were being done. Planner Boldrighini asked what the amount of surplus material was and what the max- imum depth cut is to be on this land. Planning Director Mannarino stated that there is no surplus material and that the maximum depth cut is one (1) foot. Michael Trowbridge stated that they will have to strip some down and bring some material in,.approximately about two (2) feet. Planning Director Mannarino asked what the DPW Director stated concerning the drain- age. Michael Trowbridge stated that the DPW Director stated that at a future date he would extend the pipe up to West Street and that he wanted a 15 inch pipe provided and put it deeper into the ground, the only that has changed in the drainage is the size of the pipe, it has been changed from a 12 inch pipe to a 15 inch pipe. There was some question about the easement which was requested from the DPW Director being a gravel roadway with fencing or plantings. The Planning Director stated that he doesn't believe it should be a gravel roadway and that there should be plantings rather than fencing. The default note should be placed on the plan which states that no report was sent to the Planning Board from the Board of Health. Planning Director Mannarino stated that the crushed stone should be placed in accordance with the DPW Director's comments regarding the infiltration basin. Everything has been changed according to the comments except for the issue regarding the width of pavement. Motion: To note on the plan that the infiltration basin should be con- structed at least three (3) feet above high groundwater with at least six (6) inches of 3/4 inch crushed stone over at least one (1) foot of gravel to inhibit plant growth and windblown dust, this should be noted on the plan for the infiltration basin. (Genatossio - Doucette - All in favor) Chairman Brugliera asked the Board if the Board wanted to waive the Sub- division Regulations pertaining to the roadway width. Planner Boldrighini stated that he does not want to waive the width of the pavement, he wants to stay with the Subdivision Regulations. Motion: To stay with the Subdivision Regulations, that we don't make the changes in the roadway width. (Boldrighini - Doucette - All in favor) Planning Director Mannarino stated that everything else seems to be in order on this plan. Motion: To approve the subdivision entitled "Chambers Court" and any of the changes that have to be made to the plan be made prior to the signing of the plan. Densely planted landscaping along the peri- meter of the retention basin. Landscaping to identify the drainage easement for the roadway. A note on the plan that the 3/4 inch crushed stone be placed according to the DPW Director's requirements. A note on the plan that the Board of Health has defaulted. Fire Alarm box at the jundtion of lots 6 and 7. (Genatossio - Boldrighini - All in favor) Planning Board's Minutes June 5, 1985 Page 5 10. Partial release of performance guarantee - Morrow Street The Planning Board received a letter from Paul J. Folkman, President of The Folkman Company, requesting the release of funds for the installation of the underground electric power line with street light, drainage pipe, catch basins and manhole, gravel base and binder course of asphalt within the Morrow Street Subdivision. Clerk Doucette read the memorandum from Planning Director Mannarino concerning this partial release of funds for this subdivision which states that a memorandum has not yet been received from Mr. John Larch, Light Department Manager, for the transformers, junction box, and the street lights stating that these items have been inspected. Planning Director Mannarino stated that there appears to be no problem with releasing $16,329.80 for improvements which have been inspected by Mr. Joseph Zeneski, DPW Director. Planner Bachman stated that he does not believe that part of this performance guarantee should be released, he believes the Board should wait until the Planning Board receives a memorandum from the Light Department. Motion: To release $16,329.80 for the work done at the Morrow Street Subdivision as stated in the Planning Director's memorandum. (Genatossio - Doucette - Brugliera - Flynn - Boldrighini) (Bachman opposed) 11. "Westview Woods" definitive subdivision plan - 11 lots off West Street *Planner Marydee Flynn entered the meeting before this discussion began. Planner Genatossio stated that she was the only member on the Board who questioned Dr. Carr's certification as a professional hydrologist and that she was unaware of the fact that he became a certified hydrologist in December, 1984. Clerk Doucette read the letter which was sent to Mr. Edward Broderick regarding the requests of the Planning Board regarding this sub- division plan and also read the Planning Director's memorandum regarding the department head comments. Max Volterra, Attorney ,for the applicant, approached the Board and stated the Mr. Broderick has complied with all the requests which the Planning Board stated in their letter with the ex- ception of the road cut and if he did comply with this request he would not be able to place the type of houses he wants to build in this subdivision and this is an integral part of the subdivision. Chairman Brugliera stated that the Planning Board's concerns when reviewing a subdivision is not what type of houses will be placed here. Edward Broderick stated that all the comments from the Planning Board's letter have been incorporated onto the plan with the exception of the road elevation. Planner Boldrighini stated that he does not believe there is a problem with the cut of the roadway. Planner Flynn and Planner Genatossio feel that there should be minimal re- moval of material from the site and that the Board should not be concerned about what type of house will be built in this subdivision if approved. Planner Flynn also stated that if Mr. Broderick really wants to build the type of houses that he is talking about, there must be another alternative to allow him to do this rather than cutting eight (8) feet down in the road in an area that is less than one-half a mile from the well site. Motion: To sign the plan as is. (Boldrighini - Doucette seconded for discussion) (Genatossio - Flynn - Brugliera - Doucette opposed) (Bachman abstained) Planning Board's Minutes June 5, 1985 Page 6 Clerk Doucette stated that the DPW Director did not appear to be very concerned with the cut of the road, he seemed concerned with the concept of the drainage. Planning Director Mannarino stated that he believes the DPW Director is concerned with the cut of the road because he stated in his memorandum that the Planning Board should only allow minimal road cuts to a depth that will make the site work; and that the Board does not know what the minimal cuts are because an alternative plan has not been submitted. Planner Genatossio stated that the land can be developed the way it exists now without having to cut all the material which is proposed. Planning Director Mannarino also stated that it is unnecessary to make the kind of cut which is proposed to develop the land; the applicant has stated that the material which is to be removed will be used on a different site he is developing, so the reason for the removal of material is not for the roadway and that if the applicant wishes to build the type of houses which he is proposing, he could bring material into the site instead of cutting the road. Planner Bachman stated that the width of the roadway should remain as stated in the Subdivision Regulations, the Planning Board should not waive this regulation as the DPW Director has suggested. Edward Broderick stated that the plans which the Board is reviewing are the same plans with the exception of the DPW Director's requests concerning the drainage, but the Planning Director informed the Board that he has not re- viewed these plans yet because they have just been submitted by the appli- cant. The Board had a concern over;the size of the swale, it was supposed to be four (4) feet deep, but on this plan it was shown as ten (10) feet deep, the Board does not believe the DPW Director has had a chance to review the size of this swale. Edward Broderick stated that at the last meeting, the Board was satisfied with the drainage on this plan. Chairman Brugliera stated that the Board was satisfied with the concept of the drainage, but that the Board does not remember discussing the size of the swale. Edward Broderick stated that if the Board does not want the swale there, then it can be removed from the plan, but that he thought the Board agreed to leave it on the plan. Planning Director Mannarino stated that this swale was part of the drainage system which was reviewed by the Board, but that the Board was under the assumption that the swale was to be four (4) feet and that he hasn't reviewed the plan with the ten (10) foot swale. Motion: To disapprove the "Westview Woods" definitive subdivision plan and list the Planning Director's and the DPW Director's concerns and especially reference Pages 17 and 20 of the Subdivision Regulations stating that it doesn't meet the criteria of these pages and elaborate on the proximity of the Town wells. (Flynn - Doucette - Brugliera - Genatossio - Bachman) (Boldrighini opposed to this motion.) PASSES 12. Environmental Impact Study - review and comment The Planning Board will have a work session next week to discuss the comments on this study. 13.
