Meeting called to order at 7:30 P.M. 2. 7.30 P.M. - Kelton Potter - discussion of rezoning proposal off Branch Street Planners Fiore, Genatossio and Boldrighini entered during this discussion. Elliot Fine, Attorney for the applicant of this proposal, approached the Board and stated that Kelton Potter is proposing that a parcel of land off of Branch Street which is currently zoned Agricultural and Residence A be rezoned in order to make the entire parcel Residence A. He is pro- posing a 74 lot subdivision if this parcel if rezoned to Residence A, he stated that he would like to keep this land consistent instead of having two different zones in the subdivision. This is a 49.9 acre parcel of land and 39 acres would be used if this proposal passes, the applicant is discussing the possibility of giving the Town a portion of this land which abuts land already owned by the Town. This land would be placed on Town sewer. Mr. Fine stated that he would like some feedback from the Planning Board on this proposal in order that they may know whether to go with the rezoning proposal or to go through the variance process with the Zoning Board of Appeals. The Board stated that they do not believe that the Zoning Board of Appeals would grant a variance on such a large parcel and they believe that the Board of Appeals would tell the applicant that this parcel of land must go through the rezoning proposal process. The Board asked the applicant why he was not rezoning the remaining portion of land which is on this plan. Mr. Potter stated that he does not own this portion and he would have to talk to the people that do own this land to see if they would want their land rezoned to Residence A along with the land that is already proposed. The Board also asked the applicant why he wasn't re- zoning this land to Agricultural instead of Residence A. Mr. Fine stated that if this land was rezoned to Agricultural than the applicant would only end up with about 50 lots instead of the proposed 74 lots and that the configuration of the roadway would have to be changed. The length of the proposed roadway is approximately 2000 feet, which is a loop with a cul-de-sac off one side. Mr. Potter stated to the Board that there are other uses for this land, but that he has talked to the abutters in this area and they stated that they would rather have this type of proposal than anything that was proposed. Planner Bachman asked the applicant why this proposed roadway could not also have a roadway going out to East Street. Mr. Potter stated that a roadway couldn't go out to East Street because he does not own the land. The Board stated that they would like to review this with the Planning Director before making any type of a decision on it. Planning Board's M¢nutes May 22, 1985 Page 2 3. Maplewood Estates Phase II preliminary plan - 9 lots off Maple Street The Board received a letter from Donald A. Baker, Trustee of Maple Street Mansfield Realty Trust, requesting an extension of 30 days on Maplewood Estates Phase II proposed subdivision. Motion: To accept the extension request of 30 days until June 21, 1985. (Flynn - Bachman - All in favor) 4. Mansfield Manor Estates definitive subdivision plan - West Street Planning Director Mannarino stated in his note to the Board that he is waiting for additional information on the test holes and soil report and he is also waiting for comments from the Soil Conservation Service. He asked if the Board had any comments after walking the site on Saturday, May 18, 1985. Planner Boldrighini stated that the land is very wet in a lot of areas. Planner Flynn stated that the land was flat and low and it didn't seem to have any slope. Planner Genatossio stated that this was questionable land. Planner Boldrighini also stated that the applicant is not going to end up with the amount of lots that he has proposed because of the wetlands that are on this property. The Board stated that they would like to continue discussion of this proposed subdivision until next week when they can get some input from the Planning Director regarding their concerns. 5. Chambers Court definitive subdivision plan - West Street Planning Director Mannarino stated in his note to the Board that the comments from the department heads should be reviewed and the Board should also send the applicant their comments. Planner Boldrighini stated that the Board has to know which way the applicant is going to go with his drainage and that the way he goes depends on what the Town is going to do with the drainage on West Street. The Board stated that the applicant should talk with the DPW Director and the Town Planner concerning this problem. Motion: To send a letter to the applicant of "Chambers Court" definitive subdivision plan asking for an extension and stating that he should meet with the DPW Director and the Planning Director to discuss the drainage. (Flynn - Boldrighini - All in favor) 6. "Wind Chime Acres" subdivision - partial release of performance guarantee Clerk Doucette read the memorandum from the Planning Director regarding the partial release of the performance guarantee for Wind Chime Drive subdivision roadway. The Department of Public Works has inspected this work and is satisfied with construction of items which are listed on the memorandum. The total amount to be released is $59,762.00. Motion: To approve the partial release of the performance guarantee in the amount of $59,762.00. (Fiore - Bachman - All in favor) 7. Fairfield Park partial release of performance guarantee Clerk Doucette read the memorandum from the Planning Director regarding the partial release of the performance guarantee for Fairfield Park roadway improvements. The Department of Public Works Director and the Planning Director inspected the roadway and found the items which are Planning Board's Minutes May 22, 1985 Page 3 listed on the memorandum satisfactorily completed. The recommended amount to be released is $45,085.29. Planner Fiore stated that he does not be- lieve the Board should release the $5,000 for the work done on the Top Course Asphalt because the Planning Director has on the memorandum that only a portion of this work is finished and he also stated that he does not believe any of:,the money for that particular item should be released until the whole thing is completed. Motion: To approve the partial release of the performance guarantee in the amount of $40,085.29. (Fiore - Genatossio - Bachamn - Brugliera - Flynn) (Boldrighini was opposed to this motion.) 8. Westview Woods definitive subdivision plan - 11 lots off West Street Ralph Maloon, RIM Engineering, approached the Board and stated that the applicant proposes to eliminate the retention area altogether and put the water directly back into the ground. Joseph Zeneski, DPW Director, stated that many towns in the area use the type of drainage system which the applicant is proposing and they seem to have no problems with it; but he stated that he has just received the calculations for this drainage and he has not been able to review them yet. Ralph Maloon stated that they have left the bulb at the end of the road- way as originally proposed, it is 100 foot radius and the island in the middle is a 60 foot radius which will be landscaped with bushes and trees. The pavement around the island is 30 feet. Ralph Maloon also stated that the cut of the roadway is going to remain the same, the cut of the road would allow the applicant to place the type of houses he wants to build on this property. Planner Genatossio stated that the Planning Board should not be concerned with the type of houses that the applicant wants to place on this property, they are concerned with the roadway and she feels that so much gravel should not be taken out of this property. Ralph Maloon stated that the total amount of gravel to be taken out of the site is to be approximately 8,000 cubic yards. Planner Flynn stated that the least disturbance to the property and the soils is best because of the proximity of the town well. Planner Fiore stated that. he believes it is arbitrary because he does not see what it is hurting because the water is going back into the ground anyway. Planner Boldrighini stated that he doesn't see what it is hurting, he asked what the difference would be in the grade that presently exists and the finished grade. Planner Genatossio stated that it is better from an environmentalist view to have less material removed from the site. Planner Bachman stated that the more material that the water filters through the better it will be. Joseph Zeneski stated that the applicant should cut enough of the roadway to satisfy his needs for the site and he should use the material on the site and he should not be able to take the material off the site. Mr. Broderick stated that he has planned to use the material from this site for one of his other sites. Planner Bachman asked Mr. Zeneski if there would be a maintenance problem { with the bulb at the end of the roadway. Mr. Zeneski replied that he would like to see pine trees and woodchips in this area instead of having a grassy section. Chairman Brugliera stated that he would like the Board to speak to the Planning Director before making a decision on this plan, but that the Board thought the proposed drainage was a good idea. Planning Board's Minutes May 22, 1985 Page 4 Ralph Maloon stated that the hydrant location is the same as it was previously, but that the pavement is now on the outside of the hydrant instead of the inside. Planner Cenatossio stated that the Fire Chief should look at the plan and see if he will have any problems with it, she would also like him to look at the location of the fire alarm box. Mr. Broderick submitted a request for an extension until June 7, 1985, on this subdivision. Motion: To accept this extension request until June 7, 1985. (Flynn - Bachman - All in favor) 9. "Form A" plan - The Folkman Company Inc. - Morrow Street The applicant of this "Form A" plan is The Folkman Company, Inc. This "Form A" plan consists of a parcel of land on Morrow Street, bounded northerly by Robinson Brook; easterly by Rumford River; southerly by The Folkman Company and westerly by Morrow Street and The Folkman Company. These lots have sufficient area and frontage as per the Zoning Bylaws. The checklist is complete. Motion: To sign the "Form A" plan for Morrow Street. (Boldrighini - Fiore - All in favor) 10. Public Discussion Mr. Ronald Bonvie approached the Board and stated that on his partial release of the performance guarantee on Fairfield Park he has a letter releasing a portion of this job and it does not seem to be included in the money that the Planning Board just released. Planner Fiore stated that only the Board has the jurisdiction to release money for subdivi- sions, that the Planning Director only makes recommendations on the amount to be released. The Planning Board also told Mr. Bonvie that he should talk to Planning Director Mannarino about this problem and this item should be put on the Board's agenda for their next meeting. 11.
