4. Discussion on modifying industrial subdivision - David Grant (C,C,&F)
*Planner Boldrighini entered during this discussion.
Acting Clerk Genatossio read the memoranda from the Fire Chief and the
DPW Director concerning the modifications for this subdivision, and they
have stated that the developer should complete the proposed loop of the
12" water main to West Street to assure good pressure and fire flow in
this area. Chairman Fiore asked Planning Director Mannarino if there would
be a problem with blockage of the roads in an emergency. Planning Director
Mannarino replied that if the roads do get blocked at some point, there is
still access through the parking lots; so that doesn't appear to be a pro-
blem. Vern Johnson, applicant, stated that before they bring this plan in
at the definitive stage, they will have to figure out a way in which to ex-
tend the water line so that it is coming in from both sides as the DPW
Director suggested; they will have to obtain an easement in order to extend
the line. Planning Director Mannarino stated that this plan will need to
go to the definitive stage and a public hearing before it can be officially
approved.

5. 8:00 P.M. - Public Hearing - Westview Woods definitive subdivision plan
11 lots off West Street - deadline May 6, 1985
The public hearing for Westview Woods definitive subdivision plan, an
11 lot proposed subdivision off of West Street, began at 8:00 P.M. The
hearing was closed at 9:00 P.M. A copy of the transcript is available
in the Planning Department office.
6. Discussion of Environmental Impact Study
Planning Director Mannarino presented the Agreement for Engineering
Services for the Environmental Impact Study for Proposed New Developments
in the Franklin/Maple/Winter Streets Area to the Planning Board and stated
that Town Counsel has reviewed the document and it appears to be proper.
A gift account will be set up by the Town Tresurer to pay for this study;
the developers will give the Treasurer the funds and when the study is
completed, the Town will pay the consultant in full. Planning Director
Mannarino stated that the DPW Director and himself met with the consultants
earlier this week and there has been some changes made in the study as
discussed at this meeting; he explained all these changes to the Board which
were all agreed upon. Planning Director Mannarino also stated that the
Town will be supplying the consultants with all available information con-
cerning this area. Ronald S. Bonvie, President of The Bonwood Corporation,
asked the Planning Board how long it would take to get this information to
the consultants. Planning Director Mannarino stated that the consultants
could have the information within a few days. The study could not begin
until the gift account is fully funded. Paul J. Folkman, President of The
Folkman Company, stated that he would like to take Massapoag Estates be-
cause it is being revised and there may be a loss of lots, and he would like
to have the revised plan looked at instead of the one that is submitted at
the present moment. Planning Director Mannarino stated that he must leave
the plan which is submitted, but that he can present another sheet with the
plan, such as an overlay, to show the consultants what you are planning to
do with this plan. The Board and the developers were pleased with the way
in which this study will be handled.
Motion: To approve the Scope of Services subject to Town Counsel's
approval and a gift account being set up for payment of this
study, and also to send a memorandum to the Board of Selectmen
stating the facts involved in the study.

7. Extensions

The Planning Board received a request for an extension on the preliminary
plan of Massapoag Estates until June 1, 1985, from Paul J. Folkman, Pres-
ident of The Folkman Company.
Motion: To accept this extension request until June 1, 1985.

of The Bonwood Corporation, stating that he would like an extension on
the subdivision entitled "Austin Farms" until June 1, 1985.
Motion: To accept this extension request until June 1, 1985.

Fuller Estates definitive subdivision plan

would like an extension of time for consideration of the subdivision
plan entitled "Fuller Estates" until June 1, 1985.

8. Discussion of placement of a sign and fence at Fairfield Park Townhouse Project
Ronald Bonvie, President of The Bonwood Corporation, approached the Board
and stated that he is placing a fence around the Fairfield Park Townhouse
project because of a letter received by a Mrs. Grundy which requested that
this fence be erected, and also to keep vandals off the property. Mr.
Bonvie stated that he would like permission to place a sign at the entrance
of this project which reads "Fairfield Park - Developed by The Bonwood
Corporation", the size of this sign is 6' by 4' and it is hand carved;
he stated that there is really no regulation for this type of sign to be
erected. Planning Director Mannarino stated that this sign would fall
under a Special Permit. The Board members were concerned about the block-
age of site distance when this sign is erected. Mr. Bonvie assured the
Board that the site distance would not be effected by the sign. Planning
Director Mannarino stated that the location of the sign can be sited with-
out interference to traffic flow.
Motion: To allow a 6' by 4' sign to be erected providing that it
doesn't block site access and to also allow the fence to
be erected around the property, subject to the Planning
Director's approval.

(Bachman abstained from voting)
9. Discussion of Surplus Material - Unger - Franklin Street
The Planning Director presented the topographic and grading plan map to
the Planning Board, and stated that Mr. Unger seems to really be serious
s. about creating a tree farm„ on this property. Chairman Fiore stated that
he should not have to take material off of the site if he is just planting
trees. Planning Director Mannarino stated that the reason that material
is being removed from the site is because there is no place on the property
Planning Board's Minutes
April 10, 1985
Page 5
in which to move the material because of the planted areas. Planning
Director Mannarino stated that no trucks have been leaving the property
and that there have been no complaints from neighbors, Mr. Unger has
never really submitted an application for surplus material and that the
Board will have to ask him how much material he is planning to remove
from the site. The question is whether this would be surplus material
removal or a commercial operation which requires a special permit by the
Planning Board. Planner Boldrighini calculated that there is approximately
24,000 cubic yards of material to be removed from this site. The Board
members felt that because of the extent of the project it is a commercial
gravel removal operation.
Motion: To send Mr. Unger a letter stating that the Planning Board dis-
cussed his tree farms on Wednesday, April 10, 1985, and reviewed
his topographic and grading plan of this land; the Board decided
that no earthen material can be removed from this property until
a special permit is granted.
(Boldrighini - Flynn - All in favor)
John G. Walsh, Jr.
Planning Director Mannarino stated that the Building Inspector has ordered
Mr. John G. Walsh, Jr., to Cease and Desist all activity relating to earth
removal on his property located on Elm Street. This operation was being
run under a 1978 special permit issued by the Board of Appeals, but was
supposed to be renewed in 1981 if needed; however, this permit was never
renewed. Therefore, there is no permit and Mr. Walsh must now submit an
application for a special permit to the Planning Board. Planning Director
Mannarino also stated that Mr. Walsh has extended this operation into other
property which may be owned by the Town of Mansfield. Planning Director
Mannarino informed the Board that before the Town could take any action,
it must establish the bounds by hiring a land surveyor. Chairman Fiore
asked Planning Director Mannarino what happens with all the gravel that
Mr. Walsh has already removed. Planning Director Mannarino replied that
that issue was a mitigating point, the person who removed the gravel will
have to take care of restoring this area; and that he will talk with Town
Counsel and the Town Manager on this issue.
10. "Form A" plans
Shhool Street - 3 lots - Collins
The applicant of this "Form A" plan is Robert E. Collins. This "Form A"
plan consists of a parcel of land bounded westerly by School Street,
northerly by Mathias, Pangburn and Fallon and Goodwin and easterly and
southerly by J & S Realty Trust. The reason that this "Form A" plan does
not constitute a subdivision is because all three (3) lots have frontage
on an existing street and conform to the Town of Mansfield Zoning Bylaw.
Planner Flynn stated that she believes this "Form A" plan goes against
the intent of the Zoning Bylaw. Planning Director Mannarino stated that
it meets all the technical requirements of the regulations. Chairman Fiore
stated that this lot was non -conforming in the beginning and if this is
approved than it will be creating a more non -conforming use.
Motion: To disapprove this "Form A" plan because it makes the existing
lot more non -conforming and it derogates from the intent of
the Mansfield Zoning Bylaw.

WRC Properties Inc. - West Street - 2 lots
The applicants of this "Form A" plan is WRC Properties, Inc., c/o Cabot,
Cabot & Forbes. This "Form A" plan consists of a parcel of land located
on the southerly side of West Street, bounded northerly by West Street;
easterly by Wynn, Turner, Lajoie and Jones; southerly by the New England
Mutual Life Insurance Company; and westerly by The Foxboro Company. The
reason this plan does not constitute a subdivision is because lots 576
and 578 have frontage on an existing street and conform to the Town of
Mansfield Zoning Bylaw. The applicants are dividing this parcel into two
lots in order to allow a building to be erected in the back. The check-
list is complete.
Motion: To sign this "Form A" plan.
(Boldrighini - Doucette - All in favor)
Cross - Morrow Street - 3 lots
The applicant of this "Form A" plan is Gladys S. Cross. This "Form A"
plan consists of a parcel on the easterly side of Morrow Street bounded
northerly by HPC Realty Trust; easterly by Nordberg, Travers, Canty,
Jorden & Libbey; southerly by Pavadore, Commonwealth of Massachusetts
& Moore; westerly by Morrow Street. The reason this plan does not con-
stitute a subdivision is because Lot A and B have sufficient frontage
and area on an existing street. Lot C is an existing lot created by the
Town of Mansfield Rumford River taking. The checklist is complete.
Motion: To sign the "Form A" plan.

11. Around the Table
Planner Genatossio asked Planning Director Mannarino if he has heard
anything concerning Cabot Pond, Planning Director Mannarino replied
that he has not obtained any further information.
Chairman Fiore stated that the Planning Board will have to decide who
they will want as Chairman for the next year because they will have to
choose a member in approximately two (2) weeks and he would like the
Board to start thinking about candidates.
Planning Director Mannarino presented the Planning Board with "Chambers
Court", a definitive subdivision plan off of West Street for the pro-
posal of seven (7) lots; and also with "Mansfield Manor Estates", a
definitive subdivision plan off of Fruit Street for the proposal of
thirty-eight (38) lots. Planning Director Mannarino stated that the
Board has to hold public hearings on both of these plans.
Motion: To hold both public hearings on May 1, 1985.
(Boldrighini - Flynn - All in favor)
Planning Director Mannarino stated that he would like all the members
of the Planning Board to attend the Annual Town Meeting on Monday,
April 22, 1985, because the zoning articles may be brought up and he
would like the Board to speak as a group on these articles and to
support the Planning Board's proposals.
Planning Board's Minutes
April 10, 1985
Page 7
Planning Director Mannarino stated that on the article for James Grddy
for abandonment of a portion of Old Maple'Street, the Board of Selectmen
do not support this article unless the parcel is abandoned and sold at
fair market value; he stated that the Planning Board voted last week to
support this article, but did not have a stipulation on the sale price.
Motion: To send a letter to Judith F. Scott, Town Clerk, concerning
the article of James Grady for abandonment of a portion of
Old Maple Street and stating that the Planning Board supports
this article, but believes that the parcel should also be
sold at fair market value.
(Boldrighini - Doucette - All in favor)
Planning Director Mannarino stated that on the article to sell the
Spaulding School, the Board of Selectmen took the position that they
do not want to sell it at this time because it could be used for auxilliary
use for the Town. Chairman Fiore stated that if this proposal is turned
down at Town Meeting, then the Planning Board should take more control
over recommendations made for the Spaulding School. Planner Flynn asked
the Board if this proposal does pass at Town Meeting, will it be used for
commercial use? Planning Director Mannarino stated that it would be used
for commercial use and that fact would be stated at Town Meeting, but that
it is not part of the original article that was put in the warrant; it was
an amendment which the Planning Board decided upon: he also stated that
the parking would have to conform to the Mansfield Zoning Bylaw according
to Schedule B.
Planning Director Mannarino stated that on the article for the Master
Plan money, he has still not heard anything from the State as to whether
or not the Town of Mansfield has been awarded a grant, but is supposed
to hear from them by Monday, April 15, 1985. Planner Flynn asked the
Planning Director whether this article was going to be taken out of order.
Planning Director Mannarino replied that he will speak to the Board of
Selectmen and the Finance Committee to take this out of order at the Town
Meeting. Chairman Fiore stated that the Planning Board should request
the $20,000 just in case the Town of Mansfield is not awarded the grant
from the State.
