Variance Request Applications *Planner Genatossio entered the meeting. 7.40 P.M. - Ford - to create a non -conforming lot - Willow Street The applicant of this variance request is Ronald and Sherylann Ford. The variance is for a lot at 216 Willow Street, owned by Gerald G. and Patricia L. Moothard, said lot having less than 100 foot frontage which is non -conforming in a Residence A Zone. The applicants own this property subject to approval of obtaining this variance, there is no building on the premises at the present, and the proposed use of the premises is for a single family home. The applicants approached the Board and stated that the variance is for approximately 10 feet of frontage for Lot B. Planner Flynn asked the Board if they were going to have to come back for a second variance for the sideyard when they want to build the house. Clerk Brugliera stated that the applicants will just have to build the house so that it conforms to the lot so they will not have to go for another variance. Motion: To send a positive recommendation to the Zoning Board of Appeals based on the facts presented at this meeting. (Boldrighini - Brugliera - All in favor) 7.50 P.M. - Brugliera - to reduce the lot's frontage - Heather Lane *Clerk Brugliera left the meeting. The applicant of this variance request is Joseph Brugliera. The variance is for a lot at 18 Heather Lane, said lot having less than 120 foot front- age, which is non -conforming in an Agricultural Zone. The use of the premises is not going to change, the reason for this variance is to change the property line to where the line was thought to be. The neighbors are in agreement. Landscaping, shrubs, fruit trees and maintainence has all been done in accord with an incorrect property line. This variance was previously approved in September, 1982, but was not recorded. The front- age of this lot is being reduced from 120 feet to 114 feet, the lot line is being shifted. Motion: To send a positive recommendation to the Zoning Board of Appeals based on the facts presented at this meeting. (Boldrighini - Doucette - All in favor) Planning Board's Minutes April 3, 1985 Page 6 7:50 P.M. - Rea - to reduce the lot's area - Heather Lane The applicant of this variance request is David Rea. The variance is for a lot at 14 Heather Lane, said lot containing less than 30,000 square feet, which is non -conforming in an Agricultural Zone. The use of the premises is not going to change, the reason for this variance is to change the property line to where the line was thought to be. The neigh- bors are in agreement. Landscaping, shrubs, fruit trees and maintenance has all been done in accord with an incorrect property line. This variance was previously approved in September, 1982, but was never re- corded. Motion: To send a positive recommendation to the Zoning Board of Appeals based on the facts presented at this meeting. (Boldrighini - Doucette - All in favor) 4. Minutes of March 27,_ 1985 *Clerk Brugliera re-entered the meeting. Motion: To approve the Minutes of March 27, 1985. (Doucette - Brugliera - All in favor) Planner Flynn noted that in the minutes on Page 9, under Copeland Drive discussion for rezoning petition, it should be stated in -the letter to the Town Clerk concerning the Planning Board's recommendation on this article to be read at the Annual Town Meeting, all the facts which were presented at the public hearing. She stated that the actual facts should be put in the letter, not just the fact that other facts were presented at the public hearing. Planning Director Mannarino stated that these facts were written in the letter which is to be read at the Annual Town Meeting. 5. Variance Request Applications 8:05 P.M. - Webster - dential lot for The applicant of this variance request is Ronald Webster. The variance is for the proposed use as a commercial building and parking area, said lot located in Residence A and General Business Zones, said use being non -conforming in Residence A Zone. There is a 24' X 26' building pre- sently on the property which is to be removed, which is used as resi- dential. The grounds for this variance is that the present zone line divides the lot into two separate zones. The applicants seeks a var- iance to place parking and building within a portion of the lot zoned Residence A. Mike Trowbridge, RIM Engineering, approached the Board with the applicant of this plan and stated that a brook divides this property, on one side it is zoned Residence A and on the other side it is zoned General Business, 1/3 of the proposal is within a Residence A zone. He also stated that this brook that divides this parcel of land is going to be rerouted, and that much of the surrounding area is businesses such as what they are proposing. Planner Flynn stated that she believes this should go to Town Meeting because of the location of where the inter- section with Route 140 is, and that the congestion in this area is bad enough as it is right now without adding additional professional offices. Motion: To send a positive recommendation to the Zoning Board of Appeals based on the facts presented at this meeting. (Brugliera - Doucette - Boldrighini - Fiore) (Flynn and Genatossio opposed to this motion) (Bachman abstained) Planning Board's Minutes April 3, 1985 Page 7 8.15 P.M. - Kirby - Appeal regarding a garage - East Street The applicant of this appeal from the decision of the Inspector of Buildings is Ruth and William Kirby, 1407 East Street, regarding a garage at 1399 East Street, used for storage and repair of electronic and computer equipment. The zoning district is Agricultural. There is a garage located in the rear of 1399 East Street which is 39 feet wide, 98 feet long, and 16 feet in height which is used as a business for the storage and repairs of electronic and computer type equipment. The applicants approached the Board and stated that the building was originally given a permit to be used for Agricultural use to store farm equipment, but then was sold a few years later and is now being used as a business, which they do not consider to be a customary home occupation as determined by the Building Inspector and Town Counsel, the applicant believes this business should be closed down and the use should go back to what the permit was originally issued for, Agricultural use. The applicants also stated that there are tractor trailer trucks going in and out of this property during the course of a day, and they believe this whole business should be cleared up. Chairman Fiore stated that the Planning Board has to look at what the definitions were at the time this use was granted a permit for a customary home occupation, and the definition of a home occupation when;:this permit was granted did not state specifically where the customary home occupation had to take place, in the home itself or in an accessory building, or what actually was considered a home occupation. Planning Director Mannarino stated that he believes this is an existing non -conforming use and that the building in- spector has to enforce the Bylaw the way in which it is actually written. The applicants believe that this is a nuisance to them because the drive- way is only 100 feet from their driveway, there are not trees to block the view of this operation from their backyard, the trucks are constantly running. Planning Director Mannarino asked the applicants if they wanted to shut down this business or if they would be satisfied if there was some regulations and restrictions placed on this business, such as the way in which to handle the trucks, the hours of operation, etc. Chairman Fiore stated that he believes this could be settled through the regulations pro- cess and in that way it would solve the problem for everyone. Planning Director Mannarino stated that if this building was sold now, then it could be used under a non -conforming use under the old Zoning Bylaw which was in effect at the time this building was erected. Planner Genatossio stated that some work must be done at that part of the Bylaw which covers Customary Home Occupation so as to protect the people of the Town from having a sit- uation such as this occur again. Planner Boldrighini disagreed with the fact that this wasn't a customary home occupation because it is being con- ducted by the inhabitants of the dwelling and it is in an accessory building. Motion: To support the appeal of the applicants, Mr. and Mrs. William Kirby, because the Planning Board believes that the intent of the Zoning Bylaw at the time when this permit was granted would not have deemed this operation a customary home occupation and they also believe that it is a detriment to the neighbors. (Genatossio - Bachman - Flynn - Brugliera - Fiore - Doucette) (Boldrighini was opposed to this motion.) Motion: To send a letter to the Zoning Board of Appeals stating that this situation should be reconciled between the two parties by the regulation process. (Doucette - Boldrighini - Fiore - Brugliera) (Flynn - Bachman - Genatossio 6pposed to this motion) PASSES Planning Board's Minutes April 3, 1985 Page 8 6. David Grant (C C & F) - Discussion on modifying industrial subdivision David Grant and Vern Johnson approached the Planning Board to discuss modifying an industrial subdivision. They stated that someone is interested in buying a particular 20 acres of this subdivision in order to erect a business and that the 20 acres which this person would like to purchase would interfer with Cambridge and Rutland Road which would mean that these roads would have to be eliminated from the subdivision. The reason the person wants this particular parcel of land is because it is good ex- posure to Route 495. Cambridge and Rutland Roads are no longer needed for the frontage as they were originally planned. David Grant and Vern Johnson stated that a dead end will probably be left there, but that it really doesn't apply to this subdivision because it is industrial and not residential and there are many dead ends in this particular subdivision, but there is still access to get out of this property in emergencies if needed. Planning Director Mannarino stated that he would like to talk to the Town Engineer about this plan and to check inot what the original Master Plan stated, but that there doesn't seem to be a problem with this proposal. The applicants will leave these plans with the Planning Board so all the various department heads can comment on this proposal to see if any problems arise. 7. Site Plan - School Street - expansion of an industrial use - DeLong The applicant of this Site Plan is the Acorn Manufacturing Company, Inc. This expansion is to be used for an addition to store equipment, the applicant stated that he is not increasing the number of staff for this operation at the moment, but he may increase that in the future. The Planning Director stated that he meets the requiremnets for parking and that this building is totally buffered from School Street. The parking lot is all gravel: this is a presently existing non -conforming use so all the items on the checklist do not Apply to it, and if the parking lot was paved there would be an increase in the run-off. Planning Direc- tor Mannarino stated that he does not believe this plan has to be sent to the various department heads for their comments because there is not ex- pected to be any additional employees resulting from the addition. Motion: To send a postive recommendation to the Building Inspector regarding the site plan for the expansion of the Acorn Manufacturing Company, Inc. (Doucette - Boldrighini - All in favor) 8. "Form A" plans Clare - Copeland Drive - 2 lots *Clerk Brugliera left the meeting before this discussion began. The applicants of this "Form A" plan are Edwin and Erma Clare. The "Form A" plan consists of property located on the easterly side of Copeland Drive and the westerly side of Central Street and is bounded on the south by land of Charles Mathews, land of Frederick Conford, and land of John Shaver, Jr., on the west by Copeland Drive and on the north by the land of Token Enter- prises, Inc., and land of Paul F. Boyden, containing a total area of 37,065 square feet. The property has sufficient area and frontage on an approved street. The checklist is complete with the exception of Number 3, which is the dimensional requirements. The Planning Director has noted that Lot One Planning Board's Minutes April 3, 1985 Page 9 lacks the proper frontage in a Residence A District. This plan was before the Planning Board last week and was denied because of the lack of frontage in a Residence A District. James Perkoski, attorney for the applicants, and James Dunn, Engineer of the plan, approached the Board and stated that they have done some research on this parcel and have found that the front- age has always been on Central Street because this house existed before Copeland Drive was ever put in and before zoning came into effect; the frontage was never on Copeland Drive as was believed. Planner Bachman had a question about creating a non -conforming lot. Chairman Fiore pointed out to Planner Bachman that according tothe information which has been submitted, this lot has always been non -conforming, but would like the engineer to put a note on the plan which states that the lot is non -con- forming because it existed prior to zoning. Motion: To sign the "Form A" plan, and to send a letter to the Town Clerk stating that after listening to the applicant, the Board decided to sign the "Form A" plan. (Doucette - Boldrighini - Fiore - Flynn - Genatossio) (Bachman opposed) *Planner Flynn was Acting Clerk for this "Form A" plan. *Clerk Brugliera re-entered the meeting after this discussion. 9. Discussion of Environmental Impact Study *Planner Flynn left the meeting during this discussion. Planning Director Mannarino stated that a meeting was held with the devel- opers and two of the consultants which were being considered for this study: Beta, and Faye, Spofford & Thorndike. The developers would like to see a negative penalty clause in the contract when it is signed stating that if the study is not done in the amount of time which is stated in the contract the consultant will forfeit some of the money which is being paid from the developers. Planning Director Mannarino stated that the consultants will be paid in full when the project is complete, but the consultant is opposed to this clause. Ronald Bonvie, President of The Bonwood Company, stated that the developers talked about having the money in a passbook up front which the Town Clerk would hold until the study is completed. Joseph Zeneski, Town Engineer, believes that the money should be set up in a gift account with the Town and that way no one can back down if the study doesn't live up to their expectations. Planning Director Mannarino stated that if a negative clause is going to be put in the contract then a positive clause should also be put in, and that if the consultants need a little extra time to complete the study than the Planning Board and the developers would get together at a meeting and approve an extension just as they would with a subdivision. Ronald Bonvie stated that the percentage figures which the Planning Director proposed for the study to be paid by the linear footage of the roadway was the way the developers wished to pay for the study. Planning Director Mannarino will check with Town Counsel on which way to set up the method of payment for the consultants so the town doesn't become liable at some point. Chairman Fiore stated that if this consultant has questions or needs further information, the consultant will contact the Planning Director who will be designated as the project manager. The developers want Faye, Spofford, and Thorndike to perform this study; there was objection from some of the Board members who wanted Lycote to perform this study. Chairman Fiore polled the people who were present at the meeting who will deal with this study: those in favor of Faye, Spofford, Planning Board's Minutes April 3, 1985 Page 10 and Thorndike: Ronald Bonvie, Paul folkman, Planning Director Mannarino, Planners Doucette, Planner Boldrighini and Clerk Brugliera; those in favor of Lycote: Joseph Zeneski, Town Engineer; Planner Genatossio, Planner Bachman and Chairman Fiore. The vote was six (6) in favor and four (4) opposed to Faye, Spofford and Thorndike performing this study; therefore, they will conduct this study. The form of payment will be worked out be- tween the developers and the Planning Board at their next meeting. 10. "Form A" plan - Barrows - Gilbert Street The applicant of this "Form A" plan is William Barrows. This "Form A" plan consists of a parcel of land on the easterly side of Gilbert Street between Otis Street and the railroad. The reason this plan does not constitute a subdivision is because it conforms with the frontage and area requirements for the Zoning Bylaw. The checklist is complete. Motion: To sign the "Form A" plan for Gilbert Street. (Brugliera - Doucette - All in favor) "Form A" plan - Walmark Corporation - Fruit Street The applicant of this "Form A" plan is The Walmark Corporation. This "Form A" plan consists of property located on the southwesterly side and northeasterly side of Fruit Street, bounded on the southwest by other land of the applicant, on the north by other land of the applicant; on the east by land of the applicant and the Norton/Mansfield town line, and on the south by land of Dennis Locke. The reason this plan does not constitute a subdivision is because there is sufficient frontage and area on a public way. This "Form A" plan was in front of the Board last week and it was denied because there was some question from the Board members as to if the plan had to have all the frontage in the same town and this "Form A" plan has frontage in both Mansfield and Norton for one of the lots. Planning Director Mannarino has talked with SRPEDD concerning this matter and Mr. Tierell, Attorney, stated that all the frontage does not have to be in onea town, but the applicants may have a difficult time obtaining a building per- mit for that particular lot because the frontage is in two separate towns and it may not conform to either Zoning Bylaw. Motion: To reconsider the vote of the Planning Board last week to deny this "Form A" plan. (Doucette - Brugliera - All in favor) Motion: To approve this ':.Form A" plan. (Brugliera - Doucette - All in favor) 11, Discussion of Annual Town Meeting Articles Planning Director Mannarino stated that he hasn't heard from the State Department of Community Affairs as to whether of not the Town of Mansfield has been awarded a grante for the Master Plan and the Board must decide what to do with the article on the warrant for the Annual Town Meeting. A gentlement entered the room and informed the Planning Board that the Board of Selectmen are going to support the article for Master Plan unanimously at the Annual Town Meeting. Planner Genatossio asked the Planning Director if the Board was going to request that this article be taken out of order. Planning Director Mannarino recommended that the Board discuss that Monday night at the meeting. ' Planning Board's Minutes April 3, 1985 Page 11 Article 41 Planning Director Mannarino stated that he has received a letter from James P. Grady concerining Article 41 on the warrant for the Annual Town Meeting stating that he needs this for his driveway and his access be- cause the shape of the land and the way it was designed he will have no access to this property. He would like the Town to abandon a triangular strip of land which abuts this land that is no longer used for highway purposes, being on the easterly end of Old Maple Street. *Planner;Genatossio left the meeting. Motion: To make a positive recommendation to the Annual Town Meeting concerning the abandonment of this roadway. (Boldrighini - Doucette - All in favor) Article 30 Planning Director Mannarino asked the Planning Board how they wish to recommend on the article for the Airport Commission to borrow in anti- cipation of State and Federal grants for safety improvement projects at Mansfield Municipal Airport. He stated that he believes the land around the airport will be used as a buffer zone, and that the neighbors may be against this article. Chairman Fiore stated that if this article does not come up at the Annual Town Meeting, they should ask Alan Willis, Chairman of the Airport Commission, to come into the next Planning Board meeting to explain what exactly this land would be used for. Otherwise the Board has no position on the article at this time. ArH of a 47 "To see of the Town will vote to sell the Spaulding School located on Crocker Street in the Downtown section of the Town of Mansfield." Planning Director Mannarino stated that if this school is sold, the Town has to make sure that it will have the required parking for whatever use it is going to be used for, a stipulation must be brought up at the Annual Town Meeting and to the Board of Selectmen's attention. Chairman Fiore stated that this school should be used for commercial rather than residen- tial use. Motion: To make a positive recommendation to the Annual Town Meeting concerning this article to sell the Spaulding School, but noting that it must be used for commercial rather than residential use and whatever use it is used for it must have the required parking as required for that use under the Mansfield Zoning Bylaw. (Boldrighini - Doucette - All in favor) 12. Around the Table Planning Director.Mannarino asked the Board if they would like to start having work sessions twice a month in order that they can update the Subdivision Regulations and the Master Plan.
