Adjournment 1 PLANNING BOARD'S MINUTES MARCH 27, 1985 Present: Chairman Fiore*, Clerk Brugliera Planners: Doucette, Genatossio*, Flynn and Bachman Planning Director Mannarino 1. Meeting called to order at 7:00 P.M. 2. Motion: To have Planner Ronald Doucette be temporary Acting Clerk. (Flynn - Bachman - All in favor) 3. Discussion of Environmental Impact Study *Planner Genatossio entered the meeting. Paul Folkman, President of The Folkman Company, approached the Board and stated that the developers have talked this study over amongst themselves and decided between three possible consultants which are Vanasse/Hangen, Fae Spofford, and Beta, and would like to hold meeting with the Planning Director and these consultants next week and discuss time and cost elements. The developers would then make a decision and come to the Board next week with their final decision. All the Planning Board members were in agree- ment with this procedure. 4. "Form A" plans Walmark Corporation - Fruit Street - Lots 1-3, 25-29 This "Form A" plan consists of a parcel of land located on the south- westerly side of Fruit Street, bounded on the south by other land of the applicant, on the southwest by land of the Town of Mansfield, and on the north and northeast by Fruit Street. The applicant of this "Form A" plan is the Walmark Corporation. The reason this plan does not constitute a subdivision is because there is sufficient frontage and are on a public way. James, Dunn, engineer of this land, approached the Board and stated that the applicant would like to withdraw this "Form A" plan in order to allow them to reshapethe lots and then resubmit this to the Planning Board. Planning Director Mannarino pointed out to Mr. Dunn that the "Form A" must either be approved or disapproved, it cannot just be with- drawn, but it can be resubmitted if it is disapproved. Motion: To reject this "Form A" plan due to lack of information. (Doucette - Flynn - All in favor) *Chairman Fiore entered the meeting. *Planner Ronald Doucette to resign as acting clerk and acting chairman Brugliera will return to the clerk's position. Planning Board's Minutes March 27, 1985 Page 2 Walmark Corporation - Fruit Street - Lots 1-3, 25-29 This "Form A" plan consists of a parcel of land located on the south- westerly side and northeasterly side of Fruit Street, bounded on the south by other land of the applicant, on the southwest by land of the Town of Mansfield, and on the north and northeast by other land of the applicant. The reason this plan does not constitute a subdivision plan is because it has sufficient frontage and area on a public way. James Dunn, engineer of this plan, stated that this plan is a continuation of the plan which was rejected for Fruit Street earlier this evening. The checklist is complete. The engineer stated that there does not seem to be water on this parcel of land as there is on the other parcel of land, which was a main concern of the Planning Board. Motion: To sign the "Form A" plan. (Doucette - Flynn - All in favor) Walmark Corporation - Fruit Street - Lots 1-3 25-29 This "Form A" plan consists of a parcel of land located on the south- westerly side and northeasterly side of Fruit Street, bounded on the southwest by other land of the applicant, on the north by other land of the applicant; on the east by land of the applicant and the Norton/ Mansfield town line, and on the south by land of Dennis Locke. The reason this plan does not constitute a subdivision is because the lots have sufficient frontage and area on a public way. The applicant of this "Form A" plan is the Walmark Corporation. The checklist is complete with the exception of No. 13 which refers to the existing water bodies and wetlands compliance. There was some question from the Board as to if this plan could be approved because all the frontage was not in Mansfield. Planner Genatossio asked the Planning Director how this land could be a buildable lot when it doesn't have the required frontage in Mansfield under the Zoning Bylaw and she believes that it must go under a variance. Planner Bachman stated that he does not feel comfortable signing this "Form A" plan and that he believes it needs much more con- sideration and thinking before the Board signs it. Planning Director Mannarino stated that he believes the lot need only have frontage on a public way even though it is split between two towns. However, he will talk to someone concerning the plan. Motion: To sign this "Form A" plan. (Doucette - Brugliera - DEFEATED) 5. Public Hearing for East Street - Rezoning from Agriculture to Business The public hearing for the rezoning article on East Street to rezone from Agriculture to General Business began at 7:35 P.M. The hearing was closed at 7:50 P.M. A copy of the transcript is available in the Planning Department office. 6. Variance Applications Gickas - to construct an addition - side yard set back - Lawndale Road This variance application is to construct an addition to an existing single family dwelling at 6 Tanya Drive, said addition having less than Planning Board's Minutes March 27, 1985 Page 3 a 40 -foot front yard which is non -conforming in an Agricultural Zone. The applicants of this variance application are Dennis and Deborah Giokas. The size of the existing building is 36' X 24' X 40' X 24'. The size of the proposed building is 25' X 26' to be used as a garage under and a family room above. Motion: To send a positive recommendation to the Zoning Board of Appeals. (Brugliera - Doucette - All in favor) Notartomaso - to construct an addition - side yard set back - Winter Street This variance application is to construct an addition to an existing single family dwelling at 223 Winter Street, said addition having less than 25 foot sideyard, which is non -conforming in an Agricultural Zone. The applicants of this variance application are Robert and Barbara Notartomaso. The size of the existing building is 36' X 26'. The pro- posed building would be 22' 6" X 23' to be used for a breezeway and a garage attached to the house. The grounds for exception, permit, or variance is that the foundation for breezeway and garage was poured be- fore purchase and was approved by the Building Inspector. The garage is approximately 6 feet from the lot line. He is asking for a variance to attach the garage to the house with a roof over the eleven foot breezeway which would connect the house and the garage, which means that the house would have to be 25 feet from the sideyard. When the garage is detached, the sideyard only has to be five feet because this is con- sidered an accessory building. In reviewing this application the Planning Board members found that the foundation for this garage was placed before the house, and a,ccording,tp the Zoning Bylaws, an access- ory building must be placed in the year of the house to be-.conformig;,.; The Planning Board members informed the applicant that they would point this out to the Zoning Board of Appeals to see if they can remedy this problem. Motion: To send a negative recommendation to the Zoning Board of Appeals pointing out the problem the Board found with the garage being before the house. (Flynn - Genatossio - All in favor) King - to construct an addition - side yard set back - Lawndale Road This variance application is to construct an addition to an existing single family dwelling at 159 Lawndale Road, said addition having less than 25 foot sideyard which is non -conforming in an Agricultural Zone. The applicants of this variance application are Kevin and Linda King. The size of the existing building is 24' X 34' house, 9' X 12' parcel (which will be removed). The size of the proposed building is 16' X 24' family room, and a 24' X 28' garage. The structure will be eleven feet from the property line. The Board pointed out to the applicant when he approached the Board that he would not need a variance for the side yard if he would either eliminate the family room and just build the garage or place the family room to the back of the garage, there- fore, this is not seen as a hardship. Motion: To send a positive recommendation to the Zoning Board of Appeals. (Bachman - DEFEATED FOR LACK OF A SECOND.) Motion: To send a negative recommendation to the Zoning Board of Appeals because there is no hardship shown on this land. (Genatossio - Flynn - Fiore - Doucette - Brugliera) (Bachman opposed to this motion) Planning Board's Minutes March 27, 1985 Page 4 7. The applicant of this "Form A" plan is Rite F. Goddard. The reason this plan does not constitute a subdivision is because the lots have sufficient area and frontage as per the Zoning Bylaws. The checklist is complete. This is one lot being divided into three lots. Motion: To sign the "Form A" plan. (Genatossio - Doucette - All in favor) "Form A" plan - Ora and Koukal - South Main Street This "Form A" plan consists of a parcel of land located on the westerly side of South Main Street and bounded southerly by Norman A. and Gloria A. Vickery; westerly by Clifford B. Jr, and Beverly Turner; northerly by Lloyd Kenneth and Lori Ann Anderson and easterly by South Main Street. The applicant of this "Form A" plan is Estate of May Ora and Rudolph J. Koukal, The reason this plan does not constitute a subdivision is because Lot 1 conforms to zoning, Lots 2 and 3 to be conveyed to abutting ownership. The checklist is complete. Motion: To sign the "Form A" plan. (Doucette - Flynn - All in favor) 10. Discuss the following zoning petitions Rezoning petition - Fruit Street - Agriculture to Residence C Motion: To recommend against this article being rezoned from Agriculture to Residence C at Town Meeting because it would intensify the development of this area, the area is zoned Agriculture and the rezoning of this parcel would have a detrimental effect on the surXounding area and the roadways do not lend themselves for a large potential for that particular parcel of land. (Bachman - Doucette - All in favor) Planning Board's Minutes March 27, 1985 Page 6 11. Planning Board's Minutes March 27, 1985 Page 5 Rezoning petition - Ware Street - Industrial to Residence C Motion: To recommend against this article being rezoned from Industrial to Residence C at Town Meeting because it would intensify the development of this area, the area is zoned Agriculture and the rezoning of this parcel would have a detrimental effect on the surrounding area and the roadways do not lend themselves for a large potential for that particular parcel of land. (Genatossio - Doucette - All in favor) Rezoning petition - East Street Agriculture to General Business Clerk Brugliera stated thet he sees no problem with rezoning the land since all the surrounding parcels of land are businesses which have been placed there under the variance process. Planner Genatossio believes that if this parcel is rezoned it would be strip zoning, she believes that each of these parcels should be looked at individually, which means that the Zoning Board of Appeals should review this land under a variance. Planning Director Mannarino pointed out to Planner Genatossio that the individual parcels of land could be looked at through the Special Permit process which the Planning Board would have control over. Motion: To recommend against this article being rezoned from Agriculture to General Business at Town Meeting because there is a possibility of spot zoning, the rezoning of this area may cause problems within the area for traffic and density of development. (Genatossio - Bachman - Flynn) (Doucette and Brugliera were opposed to this motion) PASSES Zoning Bylaw Amendment - Section V Subsection 1-2 (Wetland Protection) Motion: To recommend against this article to revise the Zoning Bylaw under Section V (Special Requirements), Subsection 1-2 (Wetland Protection), because the impacts on this area are not known should this article be passed. (Flynn - Genatossio - All in favor) Zoning Bylaw Amendment - Section I General, Subsection E Planning Director Mannarino stated that the passing of this Zoning Bylaw Amendment would restrict Adult Bookstores and Adult Motion Picture Theaters to one certain area of Town, which would be Reservoir Street and a portion of School Street because these are the only parcels of land in Town which are zoned Special Business; however, he would like the Planning Board to amend the definition section of this amendment at Town Meeting to be more restrictive, so that it will read "An establishment used for presenting a substantial of significant portion of material distinguished by an emphasis on matter depicting,...." Motion: To recommend in favor of the article to amend the Zoning Bylaws by adding to Section I General, Subsection E Definitions, at I Town Meeting alond with the Board's amendment to this article.
