Discussion - Gravel Removal By-law Enforcement John Dwyer, Town Counsel, approached the Board to discuss Gravel Removal By- law Enforcement at the request of the Planning Board. The Planning Board stated its concerns about gravel removal violators and want to know if some- thing can be drawn up so that the Town has more power. Planner Genatossio asked John Dwyer if the Town could take criminal action against the violators and whether a provision should be put in the Town By-law or the Zoning By- law. John Dwyer stated that the Town can punish the violators as criminals providing that there is some provision in the By-law so that a complaint can be filed in district court and that it should be put in the Town By-law and related to the Zoning By-law. Planner Genatossio was concerned about over- stepping the Planning Board's rights under Chapter 40A of the Massachusetts General Laws. John Dwyer replied that as long as the proposal is accepted at Town Meeting and there is no direct conflict with the state law, the Planning Board is not overstepping their bounds, but the $100 a day fine cannot be raised. The Planning Board asked John Dwyer if he could draft something for them by February 1, 1985, to be put on the warrant for. Town Meeting concerning this matter. Mr. Dwyer responded that he will talk to the Planning Director and Building Inspector and draft something before Feb- ruary 1, 1985, to be presented at Town Meeting. Members of the Planning Board stated that it is both the enforcement of the By-law and the fines which result from violations that have to be looked at in order to solve the problems. Motion: To write a letter to the State Representative and the State Senator complaining about the low fines for gravel removal violations. (Fiore - Flynn - All in favor) B. Around the Table Planner Flynn stated that the Planning Board should be more aware of legis- lation because then the Board may find out that more towns are experiencing the same problems that Mansfield is experiencing. 9.
