Meeting called to order at 7:30 P.M. 2. 1 Site Plan-;Performinq Arts Center Clerk;Brugliera read the comments from department Joseph Zeneski's comment was that he has reviewec ing arts center plans with the design engineer ar design satisfactory. His only concern is over tl the groundwater and whether the retention basins" gads. ie perform- _inds the iepth':of regards to where the water table is, it it were to be higheri to drain. We can dig pits to determine where that is. We are at the edge of a fairly steep, down grading to the river, and I suspect that we are well above the water table. In this case, we have a wetland very chose to us. I am right at the ground level in this case and relying ;on a berm to create the basin. I am relying on the containment to cause the-detension characteristics we are seeking. In both of "these instances, 1 am not digging out anything. '.Edward Sliney, Fire Chief's, comments were as follows: (1) Gravel access road around perimeter of facility for emergency vehicles' only.; (2) Access` yc Y -;y avee ;-i tau. \/ vase uivtc hydrant by V. I. P. parking area. This has been added. ;(4) Master fire alarm box on building (with internal system to be i determined at later date). This will come in the architectural drawings. (5) Two man detail at each event in main amphi- theater (EMT's and fire truck). C The applicants have not had a chance to talk to him about this. The applicants were 'going to provide their own people, but Edward Sliney would like to see his own men there. Electric Light Director's comment is three ;phase power available at entrance. No apparent problems.' Conservation Commission's comment is a notice of intent is to be submitted for the approval. There is a hearing scheduled for the 13th: Police Chief's comment is that he Planning Board's minutes Page 2 July 25, 1984 Performing Arts CenterContinued forsees no insurmountable problems with the facility. However, I would suggest that the following items be addressed:' (1) Access roads, closed to the public, down both sides of the facility leading` towards the rear for unimpeded access by emergency vehicles. (2) Possibility of the developer absorb- ing the bsorb-ing,the costs of signs; that will be required on S. Main St. and all adjoining roads, i.e., "No parking during performing arts center events - Tow away zone." They seem to meet all the criteria on the site plate checklist. The proposed pond will be changed to basin so it will hold water year round. All of the Planning Director's comments have been addressed. He has been working with the applicants for the past couple of weeks, and they have revised the plan according to the criteria and comments which were made at their meetings. He finds every- thing on the plan to meet the zoning regulations. The applicants do not have an exact number of trees to be cut. The, tree cutting ILL C L11G :. It has been suggested to them affln fancy to rni- nff (i -ha nnica frnm renin, across. There will also be a`noise <fence all across the back of the hill. The pump station will ;be the; developer's responsi- bility. They will have town water coming, in for drinking water, bathrooms, and fire protection. They would also dike to have wells on the site in the event that there was a water problem at some point down the road. PlanningBoard's minutes at Page 3 July 25, 1984 Performing Arts Center Continued There was discussion reqarding not allowing the creation of ponds on site. Motion: To approve the revised site plan for the Performing Arts Center incorporating all the comments that were read this evening. An original plan shall be submitted to the Building Inspector. (Brugliera - Doucette, all in favor) VOTED At this point, the applicants thanked the staff for all their time. They also noted that they are lin the process of contact- ing Norton.` 3.' Margot Jellinek -'Wedgewood Estates Subdivision Mrs. Jellinek advised the Board that for many years, she used to accompanv the Planning Board on site walks. She also said than in the by-law is states tnat uie rsamiaiy na, obtain all the imput possible on a plan. She reviewed the Wedgewood Estates, Subdivision plan and feels this is a very sensative area. She said that this is the area that Chadwick` Maurer wants to create a new well. The Planning Director said that this plan is not located in the flood plain. It is in :the C zone. Margot Jellinek said that this is not in the flow. It is in the basin, and it is within the Water Supply Protection District. She again noted that she feels this is a very sensitive area and requested that the Planning Board request a soil determination from Raynham. She feels very strongly about obtaining an environmental impact study on this. She also said that the Town has no civil engineer and no hydroligist. 4, Gravel Removal -'Tree Farm - Franklin Street The Planning Director presented the Board with the map which was presented to him. Mr. Unger shows the ,area where he would like to remove the material to build the roadway. He came before the Board in 1983, and he presented the sane plan only he showed another area that he was going to excavate. The Planning Director did not receive any deep holes to determine` where the water table is, and he does not have a'topographic plan. The Planning Director said this seems not just to be an excavation of .'gravel, but he thinks since this is in the Water Protection District and close to the wells, that he should provide the Board with'a little more detail on the plans. Motion: To request Mr.` Unger to provide the Board with topographical map and test wells to be put in as specified by the Planning Director because of our concern of the Water Protection District and his proximity to the town well. 1CPnatnccin - Flvnn. all in favor) VOTED Planning Board's ,minutes ;I Page 4 July 25, 1984 5. ]Riverside Drive - Performance Guarantee The Planning Board went on a site walk to Riverside; Drive. The Planning Director said that every thing is built in the subdivision except to the portion adjacent to the pond. Mr. Broderick is now purchasing this from Mr. Smith, and it is approximately; 380 feet of roadway that he would like ; to construct. What is in the subdivision is bituminous upright berm through the whole subdivision; and in the cul- de-sacs, he has upright granite. What he would like to do, he is asking for a waiver, is to continue the bituminous concrete to about 8'feet from the radious and then use sloped ;f granite curbing, rather than the upright. This is mainly ± because of cost. The Planning Board went out and looked at it. You have to vote now whether to grant a waiver or not. This is just a cost, for him. The other parts of the subdivision are done the way the by-law reads, and don't think this is really a hardship. It is not a'hardship on the land. This would not blend in with the area. Motion: Not to grant the waiver on the extension of the subdivision and to have it conform to the existing subdivision with the upright bituminous and also upright granite on the radious. incl: Cat Mot: r Man' Letter from the Town Engineer regarding the negot upgrading the culvert under Maple Street. This 1 that his 20 acre subdivision represents 11.76, per total 170 acre drainage area. The cost to the to replace the drain would be $1,700; therefore, Mr. be $200, which Donald A. Baker has agreed to 'cont The applicant will extend" the fir from Maple/Winter to the entrance of Langley'Driv lights will be constructed in the subdivision, in with the locations designated by the Light Depart applicant has complied with the DPW Director's re drainage system improvements. Cabot Pond Town 'Counsel's Recommendation Letter from 'Town Counsel to Chairman Fiore. Town 'Counsel reviewed the file as requested by the: Board." He noted that numerous extension have been granted on the Special Permit. The last of 'which 'expired on June 1, 1984. His recommendation is to recall the performance securities to be used by the Town to complete this project. He also recommended releasing ;the security posted by John P. Smith, who was to assume Robert Chavaree's responsibilities on the pond. Town Counsel also referenced the lack of cooperation from the applicants. The Planning Director has only heard from Mr. Willis. The Planning Direbtor`noted 'that there really aren't any alterna- tives left. The Board has tried to negotiate with all the parties, and this has dragged along too far.Positive action must be taken. Planner Flynn noted that this project goes back to when Chadwick Maurer was the Planning Director. The Planning Director noted that there will be alot of work when the bond is 'recall. The Board will have to meet with a number of department heads. The Planning Director will have to meet with the DPW Director and the Town Manager to find out what action to take next. There are alot of piles of loam. Clerk Brugliera said he thinks the: Board should get the points of process going;. ( There is not much :that can be done this year. We could start gearing to be ready for next spring and put out bids. Planner Boldrighini said it is the Board's obligation now to get the X30,000 to the Town. However, he does not feel itis the Board's obligation to do any of the work or get involved in it. This is between the 'Town Manager, the Planner., and the Director of Public Works:. The 'Planning Director noted that he feels the Planning Board will have to oversee it as it is under a special permit to make sure that the plan is being complied with. It was noted that the town may not be doing the work. It may be an outside developer. it was noted that the Board tried very hard to coordinate this project., Motion: To start :the procedures necessary to pull the bond and obtain the ;$30,000. (Genatossio - Doucette, all in favor) VOTED The method of starting this procedure will be a letter to Robert Chavaree and Allen Willis and John Smith, as well as the banks to be written by the Planning Director, signed by the Planning Board. 8• Form A - Fireside Realty Trust - Old Elm/School Street This Form A'is located on the westerly side of the intersection ? of Old Elm and School Street. Lots shown have frontage on an existing street, and they conform to zoning. All items on them Form A checklist have been complied with. Motion: To sign (Doucette - Boldrighini, all in favor) VOTED I Planning Board's minutes Page 6 i July 25,1984 9. Form A - Dustin - 'East Street This Form A`consists of a piece of land designated Lot A on the southwesterly side of East Street; and a piece of land designated Lot B and Lot C, on the southwesterly side of ,East Street. The Planning Director would like to do some research on the land 'regarding what is existing out there whether they nave given the town a right-of-way by changing something. If this is the case, this is not a buildable lot because there would not be enough frontage. The Board still has another week to act on this. It was the concensus of the Board to wait until next week on this plan. 10. Correspondence Copy of a legal notice from the Foxboro Town Hall. A hearing will be held on July J1, 1984, at 7 P.M. in the office of the Building Commissioner before the Site Plan Review Board on the application of Bird Street Realty Trust to construct a motel on property located on the corner of Fisher Street and Rt. 140. The above will also be reviewed by the Board of Selectmen on August 7, 1984, at, 7:45 P.M. Letter from 'Town Counsel to the Chairman regarding his recom- mendation for Cabot's Pond. Memorandum to distribution from Jacquoline Wilkins regarding the Performing Arts Center - Environmental Notification Form. Letter from the DPW Director to the Board regarding his negotiations with Donald Baker on Maplewood Estates. Copy of a notice from the Zoning Board of Appeals in Attleboro on applications they have coming up August 2, 1984. Copy of the 'Board's letter to Allen Willis regarding Gloria Estates Subdivision. Copy ;of the Planning Board's minutes of July 18, 1984. Minutes of 'July 18, 1984 Motion: To approve (Genatossio - Doucette, all in favor) VOTED 11. Around the 'Table Planner Flynn noted that the hearing notices from Attleboro, none of them abut Mansfield. Planner Doucette said he feels that a member or members from the Mansfield Planning Board should attend the hearing in Foxboro regarding the motel as Fisher Lane is very close to Mansfield. The Planning Director informed the Board that Witch Pond Estates public hearing is also being held in Foxboro tomorrow night. He checked the files and the Board never received a legal notice on this. 4 Planning Board's minutes Page 7 { July 25, 1984 12. Public Discussion j Margot Jellinek said that she was in Foxboro and reviewed this subdivision. This is a'definitive plan, and the plan states, "Division of land in Mansfield at the rear of Lots Nos. 8, 9, 10, 11, 12, 13, 14, and 15" which will be shown on a plan sub- mitted to the Planning Board of Mansfield. The building, on these lots will be located along the rear lot line. Shelsug- gested that a representative from the Mansfield Planning; Board attend the meeting. She said the plan is much more substantial than the preliminary plan the Board has seen. The Board has not received a copy of the definitive plan yet. She also sug- gested requesting buffer zone behind the above lots. She noted that it does not indicate the amount of surface water run-off on the plan. She again requested that a member of the Board attend this meeting.' 13.Date of Next Meeting is Wednesday, August 1 1984, at 7:30 P.M. 14.' Adjournment 1 a') !<d L} K i DATE a
