Building Department September Report.
At this time, Chairperson Flynn stated that it has been brought to her attention
that perhaps she is not running the meetings properly. Chairperson Flynn stated
that from this meeting on the meetings will be run properly. She will be going
to the library to get a copy of Robert's Rules. The meetings will be run very
formerly, very explicitly by the rules. There will be no conversation from anyone
in the audience. If anyone wants to speak to the Board, whether it's something
that is pertinent to what is being discussed right now, and they feel they might
have something interesting to say, it does not matter. They will not be allowed
to speak. They will have to wait until the end of the meeting during "Public
Discussion" unless, of course, they are on the agenda. Generally, if someone
in the audience has something to say, sometimes we allow them to speak, sometimes
not depending on how loose the meeting is. It will not be loose anymore as long
as Chairperson Flynn is Chairman. Planner Annino asked what brought about this
decision. Chairperson Flynn stated she had received a phone call and it was brought
to her attention that this was a problem after the interviews with the individual
members of the Planning Board. Chairperson Flynn stated that she was disappointed
that if she was not doing something properly, particular members weren't able to
speak directly to her about this. Chairperson Flynn stated that she makes "no
bones" about the fact that she does not like being Chairman and perhaps this is
the reason. Chairperson Flynn stated that., with the exception of Planner
Genatossio, among the remaining members of the Board, taken at face value,
Chairperson Flynn is the one most qualified to be Chairman and will continue,
especially now, to be Chairman. Chairperson Flynn stated that if anyone has a
problems, suggestions or recommendations, please call her. Chairperson Flynn
stated once again that there would be no discussion from anyone unless they are
on the agenda.
2. Variance Applications
Phadungchai - 526 Ware Street
A hearing will be held on October 7, 1986 on the application of Rachani G.
Phadungchai for a variance to construct an addition to an existing single
family home at 526 Ware Street, said addition to have less than a forty (40)
foot front yard which is non -conforming in an Agricultural Zone.
Motion: To send a positive recommendation to the Zoning Board of Appeals
on the application of Rachani G. Phadungchai for and addition to
an existing single family home at 526 Ware Street,
(Annino-Madan) All in favor. PASSES.
Sousa 1720 West Street
A hearing will be held on October 7, 1986 on the application of Carol Sousa
for a variance to construct an addition to an existing single family home
at 1720 West Street, said addition to have less than a forty (40) foot front
yard, which is non -conforming in an Agricultural Zone,

meeting.)
Genatossio/Annino Appeal
A hearing will be held on October 7, 1986 on the application of Grace M.
Genatossio and Douglas Annino on an appeal from the decision of the Inspector
of Buildings regarding a building permit issued for a car wash at 44 Chauncy
Street, located in the Downtown Business Zone,
Planner Sohn abstains from any vote having previously been employed by
the people doing the construction at this site.
The remaining Planning Board members took no position on this Appeal,
3. The Planning Board reviewed the request from "Hidden Estates" for release
of funds.(The Board approved release of $83,429.06 for excavation and
drainage improvements at the Planning Board meeting of September 24, 1986.)
This request is with regard to water. Initially there had been a problem
with regard to the "Hidden Estates" plumber breaking seals on installed
meters. A memo from John Rhind, Department of Public Works Director, states
that this problem has been resolved. The Planning Board decided to hold
this release of funds until Planning Director Callinan has reviewed it.
4. "Form A' (ANR) Plan
Malcolm B. Post, Trustee, Allied Realty Trust - Erick Road
The applicant of this "Form A" (ANR) Plan is Malcolm B. Post, Trustee,
Allied Realty Trust. This "Form A" Plan consists of a parcel of land
located at 17 and 19 Erick Road, Mansfield, Massachusetts, being comprised
of two apartment buildings containing 34 units each and about 196,000 square
feet of land. The reason this plan does not constitute a Subdivision is
because Lot 7 is being divided into new Lots 7A and 7B. Each of Lots 7A
and 7B has frontage on a public way of at least the distance required by
the Zoning By -Law (120 feet). The checklist is complete with the exception
of Item #8, which is non -applicable,
Motion: To sign the "Form A" (ANR) Plan for Malcolm B. Post for land on
Erick Road.
(Madan - Quinn) All in favor. PASSES.
At this time, Planner Genatossio suggested the Planning Board send a letter to
the people at Great Woods thanking them for inviting the Board to their end -of -
season picnic.
Motion: To send letter thanking people of Great Woods for inviting the Planning
Board to their end -of -season picnic.
(Genatossio - Annino) All in favor. PASSES.

50 -8:00 P.M. - Continuation of Public Hearing _- Special Permit - Kennel - Sohn
Chairperson Flynn opened the continuation of the public hearing for the
Special Permit at 619 East Street for Expansion of Existing Animal Hospital
to add Boarding Kennel and Associated Services and Sale of Products.
Attorney Gary Lilienthal, representing Dr. and Mrs. Stanley Sohn was present
for this public hearing.
Michael Trowbridge, Engineer, was also present for this hearing.
Motion: To approve the Special Permit request by Dr. Sohn under Section
III.E.b.2 (Use Regulations, Agricultural).
(Genatossio - Annino) All in favor. PASSES.
Motion: To approve the Special Permit request by Dr. Sohn under Section
III.K.2 (Use Regulations, Water Supply Protection District
(Genatossio - Annino) All in favor. PASSES.
6. Planner Annino had a Site Plan Review Checklist which he asked to discuss
with the Planning Board at this time. In particular, Planner Annino referred
to the Zoning By -Laws for the Town of North Attleborough, effective July, 1974.
(Copies will be mailed to Board members for further discussion at a future
meeting.) In effect, the By -Law gives authority for final approval of site
plans to the Planning Board. Planner Genatossio stated she was Chairman of
the Planning Board at a time when a similar change was proposed for the Town
of Mansfield and that she received a lot of criticism at Town Meeting from
various members. Planner Genatossio stated that one of the comments made
at that time was "What is it? You people don't have any faith in the Building
Inspector that you want to take over this control." Planner Annino stated he
feels it would take a lot of pressure off the Building Inspector and give the
Planning Board a lot more leeway in looking at things that are going on in the
town. Planner Genatossio stated that., yes, it does take the pressure off and
it doesn't fall on one person to make that decision. Planner Genatossio stated
that she is sure that the Building Inspector is busy enough inspecting buildings.
What the Town needs is a Zoning Enforcement Officer. Planner Annino feels
that what is being reviewed now is nothing and that the Planning Board should
enforce the checklist and give the applicant provisions and guidelines to go
by. Chairperson Flynn asked if the Building Inspector was involved at all
in North Attleboro. Planner Annino stated that he is involved to some extent,
but the Planning Board holds a public hearing in order for the applicant to
get a permit and their regulations are pretty tough. Planner Genatossio
stated that the Town of Foxborough holds a couple of public hearings. One
is with the Planning Board and one is with the Board of Selectmen. The
Board -of Selectmen make a recommendation after all the public hearings are
held to the Building Inspector and he may issue the permit after this
particular review has taken place. What Foxborough is saying is not that
they could deny the permit, but they could make it difficult if a person
does not want to follow all the regulations, it would be difficult for him
to get the building permit. Clerk Quinn asked if site plan approval forms
-5-

can be changed by the Planning Board or if it has to go to Town Meeting.
Planner Genatossio stated it has to be done at Town Meeting,
Planner Sohn asked if the Board could set aside some time at each Board
meeting every week or once a month to discuss items for the annual Town
Meeting. Chairperson Flynn stated that the Board has always tried to
do this. Planner Madan requested that the Board schedule time on the
agenda at least once a month and perhaps have a workshop. Planner
Genatossio suggested 8:30 to 9:30 P.M. for the last Wednesday of every
month (or Tuesday if the schedule should be changed),
7. 8:30 P.M. - Joint Meeting with Board of Selectmen
This meeting has been canceled until 10/8/86 at 8:45 P.M. This was to be
held jointly with Zoning Board of Appeals and Mr. Paul Folkman relating
to what Mr. Folkman is planning to do with the land at High Street if the
proposed Zoning Article passes at the Special Town Meeting,
Planners Sohn, Madan and Quinn will represent the Planning Board at
the meeting with the Board of Selectmen on 10/8/86,
Clerk Quinn stated that one of the things he discussed with the Selectmen
when he met with them was lack of communication. Clerk Quinn stated that
in his opinion, and the Board of Selectmen did not agree with him, when it
comes to a major article on Town Meeting floor, the more confusing the
issue, the less people are likely to vote for it. Clerk Quinn stated at
the last Town Meeting the Selectmen and the Planning Board each sponsored
separate articles and nothing passed. Clerk Quinn stated that while he
was a member of the Finance Committee, the Fin/Com always had a workshop
before Town Meeting with the Board of Selectmen. Generally they agreed
on about 99% of what would be in the budget. What was not agreed on, they
agreed to fight out on Town Meeting floor. Clerk Quinn stated this created
good communication without misunderstandings, suspicions, conspiricies or
whatever. Chairperson Flynn stated she feels it was more appropriate for
the Finance Committee. to meet with Selectmen than for Planning to meet with Select-
men. Clerk Quinn stated he disagrees because if the Selectmen constantly
take a negative attitude in what the Planning Board approves or pushes for,
or sponsor alternative legislation, the Planning Board ends up with nothing.
Clerk Quinn would much rather sit down and talk with the Board of Selectmen
and discuss proposals ahead of time rather than going to Town Meeting cold
not knowing who will say what. Chairperson Flynn stated that she is thinking
of last year with the Water Protection Article and that she would not talk
to the Board at all, Chairperson Flynn said she might ask them as
individuals to see how they felt about it, but to get an edict from them,
as far as she is concerned, they do not have any basis nor the background
that the Planning Board has to take a position as a Board. Planner Genatossio
commented that the Selectmen did take a position and that Selectman Dunn stated
the Board of Selectmen's case for the article at the public hearing. When
the Planning Board had the opportunity at public hearing to make Planning's
case for the article, the Selectmen could have worked with the Planning Board
and the Planning Board with the Selectmen - and they did. The Planning Board,
at Town Meeting, voted for the Selectmen.

The Board held a discussion concerning arranging to meet with the Board
of Selectmen prior to the special Town Meeting to discuss the Zoning Articles
proposed for Town Meeting. Clerk Quinn suggested possibly meeting with the
Selectmen on a weekend. This would be a posted meeting, open to the public.
Chairperson Flynn asked Clerk Quinn to arrange a meeting with the Selectmen,
Motion: To invite the Selectmen to meet with the Planning Board, hopefully
before Special Town Meeting for a workshop.
(Quinn - Madan) All in favor. PASSES.
Planner Madan stated that when the Master Plan Advisory Council was -originally
due to disband at the Annual Town Meeting of 1987. The Advisory Council has
requested a vote stating that a time limit not be put on when the Council
disbands because the do not want the pressure of having to get everything
done within a certain time.
Motion: To have the Master Plan Advisory Council remain in existence until
their job is complete,
(Madan - Quinn) All in favor. PASSES
Planner Genatossio began her presentation of the subdivision procedures she
had drafted for the Planning Board to review. This was done in the hopes that
when an applicant submits a preliminary plan to the Planning Board that the
plan gets proper review by various department heads and the Planning Director
so that the applicant is headed in the proper direction for drawing up his
definitive plan. Once the plan has been submitted, the Planning Director
should get the checklist started so that the Board can determine what is
missing and what is necessary to be added to the plan. After it has been
submitted, on the next Wednesday the Board should go over the plan and go over
the checklist. If there are items missing from the checklist that can be easily
remedied, because these are only technical requirements according to the
regulations, that the applicant be given the opportunity to take the plan back
and add those to the plan. Chairperson Flynn stated that it seems that the
purpose of the checklist is, when the Planning Director looks at the plan,
if the checklist is not complete then he returns it to the applicant and tells
the applicant to -complete this checklist before the plan is shown to the Planning
Board. Planner Genatossio stated this was a problem a few months ago with a
plan. There were things missing from the checklist and the applicant was in
the audience and immediately removed his plan from the Planning Department
without the Board's permission to remove it. Once the application is stamped
by the Town Clerk's Office, the Planning Board has only sixty days to act on
it. Clerk Quinn suggested submitting the preliminary plan first to Conservation
or Board -of Health. Planner Genatossio stated they do give comments on
preliminary plans. Chairperson Flynn stated it cannot be a qualification of
the approval or the plan. Planner Genatossio stated it can be a qualification
for drawing up the Environmental Impact Statement. Comments are needed from
Conservation, Board of Health and other department heads to scope the EIS.

Letters do go to all the departments stating there is a preliminary plan in
the office and the Planning Board would appreciate their comments.
Chairperson Flynn stated that the Engineering Department is not commenting
on preliminary plans at this time. Planner Genatossio stated that the
Engineering Department should be made aware that the Planning Board now
scopes the EIS before the definitive and in order to scope it properly the
Engineering Department comments are necessary at the preliminary stage.
Planner Annino asked if the EIS could be broken down and pertinent sections
sent along to the Engineering Department. Planner Genatossio stated a copy
of the EIS could be sent with the pertinent sections underlined concerning
the Engineering Department. Planner Madan mentioned that the Fire Chief
had commented that preliminary plans are not sent to him and that the Fire
Chief reviews the plans at the town hall. The Fire Chief would rather have
the plan sent along to his office for review. Planner Genatossio stated that
at one time plans were sent to all the department heads for review. Eight
copies of preliminary plans are supposed to be submitted with applications.
One copy should be sent to each of the following departments: Water, D.P.W.,
Police, Fire, Board of Assessors, Engineer, Board of Health and the Planning
Board. Chairperson Flynn asked the secretary to be sure that the Planning
Director (who is on vacation this week) is made aware of the fact that each
of these departments should be receiving copies of preliminary plans. Planner
Sohn commented that she thought definitive plans that come before the Board
had to have been preliminary at some point in time. Planner Genatossio stated
this was not necessarily so. Planner Sohn stated that if a definitive plan
comes before the Planning Board and it has a lot of wetlands she feels it
should go before the Conservation Commission before coming to Planning,
Planner Genatossio stated this does not happen and technically, if Conservation
receives a subdivision plan that has been approved by the Planning Board,
Conservation may make determinations that certain lots should not be built
on. Planner Annino asked why the plan is not returned to Planning after
Conservation has seen the plan. Planner Genatossio stated it is the choice
of the applicant where the plan goes first and where it goes last. Clerk
Quinn stated the Planning Board should try to change the rules. Planner
Madan stated that the applicant couldn't go to Conservation first if Planning
has not approved a road. As Planner Genatossio stated, the Planning Board
has turned down subdivisions because of roads going through wetlands. Clerk
Quinn suggested that representatives from the Board of Health and Conservation
be invited to one of the Planning Board's meetings. Chairperson Flynn stated
that it is State Law that the applicant has the choice,
8. 9:00 P.M. - Continuation of Public Hearing - "Pine Terrace Estates"
Chairperson Flynn continued the public hearing for "Pine Terrace Estates"
at 9:00 P.M.
Richard Maloon of RIM Engineering was present for this public hearing.
Chairperson Flynn stated that she had spoken to Atty. Fine earlier in the
week and that Atty. Fine had mentioned that Ralph Maloon would have the
revised plan present for the Planning Board this evening.
Attorney Fine was delayed in arriving for this hearing.
Motion: To suspend the hearing until Attorney Fine arrives.

9. 9:15 P.M. - Site Plan Review
2-4 Bristol Street - Phillip Finer
Clerk Quinn read correspondence from various department heads regarding
this site plan.
Checklist is complete with the exception of Item "D".
Motion: To send a negative recommendation to the Building Inspector
as this plan does not conform to the Mansfield Zoning By -Laws.
The following are concerns of the Planning Board:
1. Lack of aisle and maneuvering space; parking area being
directly off of Shawmut Avenue.
2. Ten foot landscaping buffer should be shown in front yard
for parking lot.
3. Location of sight lighting should be shown on plan.
4. Location of rubbish disposal should be shown on plan.
5. Connections to utilities should be shown on plan.
6. Plantings should be shown on plan.
7. Walkways should be shown on plan.
8. Lack of information on utility services, sewer, water and
drain.
9. Plan does not address current sidewalk and curb conditions.
10. Hydrant locations not shown on plan.
11. Fire and Police Chief state strong concerns regarding traffic
congestion.
12. Parking bumpers not shown on plan.
13. Location of available parking at Fales Fuel should be shown
on plan,
(Annino - Quinn) All in favor. PASSES.
14 Church Street - J. Colella & Sons
Vinal Applebee, P.E. of Norwood Engineering was present for discussion
regarding this site plan along with Mr. Jack Colella.
Planner Genatossio mentioned that having once submitted this site plan
which the Planning Board was not pleased with, Mr. Colella withdrew the
plan, went back to the drawing board and did this site plan over. Planner
Genatossio stated that Mr. Colella is to be commended.
Motion: To send a positive recommendation to the Building Inspector.
(Genatossio -Annino) 'All in favor. PASSES.
10. 9:45 P.M. - Reopen Public Hearing - "Pine Terrace Estates"
Attorney Elliot Fine, representing Mr. Kelton Potter, arrived for this
continuation of the public hearing at this time and the hearing was continued
by Chairperson Flynn at 9:45 P.M.
Motion: To accept an extention for "Pine Terrace Estates" to October 31, 1986.

Mr. Salem, Traffic Engineer, was also present for this public hearing.
Motion: To continue this public hearing to October 21, 1986.
(Madan - Sohn) All in favor. PASSES.
Acting Chairman Quinn continues the public hearing for "Pine Terrace
Estates" at 10:30 P.M. until October 21, 19860
11, At this time, the discussion continued regarding Planner Genatossio's
proposed subdivision procedures. Planner Madan suggested that the Board
wait until Planning Director Callinan is present. Planner Genatossio
stated that she would rather discuss this now and if there is something
to add or talk about, the Board can do this when Planning Director Callinan
is present and then vote to accept it. (Consensus of the Board was to
discuss this evening.)
Planner Genatossio stated that the next item on the list would be to have
the plan reviewed by the Board at their next meeting and the checklist would
be reviewed. At that time, a letter is sent to the applicant regarding
the items in the checklist that might be missing and request that the
applicant add these particular items. Then letters are sent to Town depart-
ments for review and request comments for the EIS. Planner Sohn asked if the
EIS was supposed to come in for review with the application and was told that
it did not. The EIS is scoped after approval of the preliminary. Planner
Madan brought to the Board's attention the fact that some of the departments
just do not have the time to review preliminary plans at this time. Planner
Genatossio stated that if the department heads are made aware of the
importance of the EIS in the preliminary stage perhaps they would take the
time to make the comments. Planner Madan asked if it would be possible for
the applicant to request sections of the EIS be waived in the preliminary
stage from information presented by the department head. Planner Genatossio
stated that yes, this could be done with the correct information from the
department head so that the Board knows it is not leaving out a section that
is important to a particular department. Planner Genatossio stated that what
is in the EIS are general statements and must be expanded on. The Board held
a lengthy discussion as to whether the EIS should be more specific when the
application first comes in or if each plan should be addressed individually.
Planner Genatossio stated that the next item would be to hold an informal
public hearing within thirty (30) days of submittal on all -preliminary sub-
divisions to help s✓ope the EIS. The Town would pick up the cost of this.
This way, at the public hearing new information is not being added by the
public of which the Board is not aware of (i.e. gravesites).
Next item, to approve with conditions or disapprove and give the reasons why.
-Scope---the EIS,* specify concerns and - weigh the areas not applicable,
A discussion was -held -'regarding Defin-itive-review procedures.
Review by the Planning Director of the checklist.
EIS submitted for review by departments and Boards.
Plan is reviewed by the Board at the next scheduled meeting so that the
Board is not seeing the plan for the first time at a public hearing.
Date of the hearing set within thirty (30) days, when possible.
Site walk should be walked, with the Planning Director and the majority of
the Board, if possible, scheduled before the public hearing.

Letters sent to department heads and boards regarding concerns about the
plan as determined by review and site walk and any concerns about the area.
Comments submitted to the Board one week before the hearing to be discussed
and proper changes made.
At the public hearing, requests for waivers are discussed and voted at the
hearing so they can be added to the plan when it comes in for approval and
the public is aware of what waivers the Board is granting and why.
Public hearing is continued if more information is to be submitted.
Public hearing may be closed if all information has been given.
If the Bo ' ard closes the public hearing and new information is given, they
may not use this information for approval or disapproval of the plan.*
Transcript of a public hearing be available before approval of a plan so
the Board members can review the comments if necessary. Planner Genatossio
stated she was not sure if this was feasible at this time due to the amount
of public hearings that have been held recently.
Approval with conditions. Note on the plan that if conditions have not been
met within the twenty (20) day appeal period, the plan will be denied.
Disapproval - state why specifically, quoting subdivision regulations or
State Law.
Disapproved plans may be approved when conditions are met after public hearing
is held,
Planner Sohn asked if, because of lack of this kind of organization, so many
plans are continued week after week. Planner Genatossio feels that if the
Board sees the plan before the public hearing and walksthe site, a lot of
questions that arise at the public hearing may be cut down,
