This request was written Planning Board's Minutes July 9, 1986 Page -4- on June 17, 1986 and had not been voted on previously by the Board. As a result, this preliminary plan must be voted on tonight. This preliminary plan is for a subdivision off of Bird Road and opposite proposed opening for "Bird Hill Estates" which came before the Board a few weeks ago as a preliminary plan. Homefield Drive connects to Massapoag subdivision. However, Planning Director Callinan stated there is a tremendous cut, a natural valley, and is, in part, going through wetland. The preliminary application is dated April 14, 1986, putting it under the new Subdivisiion Rules & Regulations. Motion: To deny because the "Homef ield Farms" Preliminary plan does not meet the new Subdivision Rules & Regulations. The following concerns must be addressed: 1. Developing road over wetlands. 2. Cutting and filling in this subdivision. 3. Improvement of Bird Road must be addressed. 4. Sight visibility at Bird Road and Homefield Drive must be addressed. 5. Lots 1 and 8 should be "Form A" because they have sufficient frontage on an existing road. 6. Pursue alternative access to Massapoag Estates. 7. Callinan to the Engineering Department regarding request from The Folkman Company for partial release of funds for "Highland Avenue" subdivision in the amount of $40,322.00 for the installation of water and drainage improvements. Planning Director Callinan stated that last week the Planning Board voted to approve the release of approximately $13,000.00 for excavation which the engineers could make comments on. The remaining amount was involved with the water, which is inspected by the Water Department and was approved by Bob Albertini. Motion: To release $26,487.00 for water for the "Highland Avenue" subdivision. (Madan - Boldrighini) All in favor. PASSES. The Planning Board and Planning Director Callinan held a discussion regarding the resignation of Mr. Grady from the Master Plan Advisory Council, Acting Chairperson Genatossio asked if the Board should send a letter to the Board of Selectmen and the Housing Authority stating that they could appoint a person to represent them on the Master Plan Advisory Council, but according to Town Charter, an elected official cannot serve on more than one board. The Selectmen chose four people to serve on the Master Plan Advisory Council along with one member from the Board of Selectmen. Acting Chairperson Genatossio stated that since it has been pointed out to the Planning Board that the Town Charter does not allow this to take place, then the Board should request that the Selectmen and Housing Authority please appoint someone to represent the Selectmen. Planning Director Callinan and Planner Boldrighini feel that the Selectmen should check out the fact that Town Charter does not allow an elected official to serve on another board. Motion: To send a letter to the Board of Selectmen that it has come to the attention of the Planning Board through Mr. Grady's letter, which the Selectmen received a copy of, that elected officials cannot serve on another board and the Planning Board would like an idea whether this is according to Town Charter or not. (Boldrighini - Lantz) All in favor. PASSES. Acting Clerk Lantz asked if anyone would be attending the Open House for the Mansfield Cooperative Center. Planner Genatossio stated she would attend. 10. Around the Table Planner Madan asked if the Board could get clarification on their regulations as far as fire hydrants in areas where there is no water to make sure the Board is acting correctly. Planning Director Callinan stated this is what -5- Planning Board's Minutes July 9, 1986 Page -7- Acting Chairperson Genatossio stated that at one time the Planning Board received copies of the minutes of the meetings for both Conservation and Board of Health and requested that the Planning Director send a letter to each of these boards requesting copies of their minutes in the future. . Acting Chairperson Genatossio mentioned a list of subdivisions that Al Andrews had done listing the ongoing subdivisions, when they were approved, how much is completed and whether the "As Built" has been completed. 11. Public Discussion Joseph Zeneski, 842 East Street - Spoke to Al Andrews regarding "Camelot Estates" subdivision about the sewer extension that Mr. Broderick is proposing to run from "Camelot", across the swamps to Plymouth Street. Mr. Zeneski stated that the comment made by Al Andrews was that if Mr. Broderick wanted to put sewers in his subdivision, then it would be his business. Mr. Zeneski stated that perhaps Mr. Broderick is putting sanitary sewarage in the Camelot subdivision and wonders if (a.)is that the reason Mr. Broderick had to dig up all the drain pipes and (b.) if he is really doing that, isn't that a change in the subdivision that should come before the Planning Board. Planning Director Callinan stated that Mr. Broderick would only have to come before the Planning Board would be the alignment of a road. Mr. Broderick did come before the Planning Board and told the Board that he is putting in sewerage at "Camelot". Planner Boldrighini asked if this was being inspected and Planning Director Callinan stated the work was being inspected. Acting Chairperson Genatossio asked if the Board had a cross section showing this system and Planning Director Callinan stated that there is such a plan. Acting Chairperson Genatossio stated that Marydee Flynn had requested that the Board send a letter to John Drew regarding Great Woods and thanking them for inviting the Board to attend their Gala Opening, congratulate them on giving an excellent party and best of wishes in the future for continued success. 12. Meeting adjourned at 11:00 P.M. Clerk Date Planning Board's Minutes July 9, 1986 Page -6- the regulations say. This is a specific regulation. Acting Chairperson Genatossio stated that on the Maple Street, the developer who was building there at the time did not have water and said he would put in dry hydrants. When water became available to his area, he would connect at that time. The developer could not develop until there was water in the area. Planner Madan stated that he did not like the idea of putting dry hydrants in the Rte. 106 area and then hooking up to water when it comes around. Planning Director Callinan stated that under the rules and regulations, fire hydrants must be approved by the Fire Chief and the American Insurance Association. Planner Boldrighini stated that suppose there is no water in a certain area and a developer wants to build in that area. He would have to put wells in for every house for drinking water. He would not have fire protection. Planner Boldrighini's question is, can the developer still build in that area. Planner Boldrighini states he feels that the developer would be able to build by putting the water mains in and marking the fire hydrants as being dry so that at a future date, when the water does come in, they just hook into that line. Planner Boldrighini asked if the developer would have to put in that subdivision water mains and fire hydrants. Acting Chairperson Genatossio stated a developer could P ut the hydrants in but that the Board could possibly deny the plan until water comes to the subdivision. Planning Director Callinan stated the regulations read "Public water mains shall be of Class 150 cement line, cast iron pipe, or proved to be equal by the Mansfield Water Department and shall not be less than 8" in diameter. A hydrant shall be located at each street intersection and not more than 500' apart." Planner Boldrighini stated that a developer could do exactly what the regulations say, put all the pipe in, all the hydrants, will have no water protection, but the well water would be just for drinking and not for fire. Acting Chairperson Genatossio stated that at least the Board has some control over the subdivisions, but none when a "Form A" comes before the Board. Planner Boldrighini asked the Board to discuss "Fieldbrook Estates" relating to the Planning Board's right to not approve that set of plans because of safety because of the location. Planning Director Callinan stated that the Planning Board does not have a specific regulation which states that a sub- division must be compatible to the area. This would be more of a Zoning issue. Acting Chairperson Genatossio mentioned that she had been to "Cedar Meadows" subdivision in East Mansfield and noticed that Squire Avenue looks like it is fairly complete. Ephriam Drive is questionable. Acting Chairperson Genatossio stated the Board had a problem with this a couple of years ago and had a reconsideration of that subdivision. The applicant was requested to come in because the Board was considering rescinding the subdivision and the applicant did come in. Acting Chairperson Genatossio stated that there is still a great deal of work to be completed. There is a mortgage loan in effect for approximately $23,000.00 and the bond was written up with sidewalks listed. Acting Chairperson Genatossio stated that there are no sidewalks in this road. Planner Boldrighini asked if there was one going in off of East Street and Acting Chairperson Genatossio stated there is a sidewalk off East Street but none at the street off Mill Street. Acting Chairperson Genatossio stated there is a street post, but no light. Several things seem to be missing and they have had more than enough time to complete the project and she would like to have Al Andrews check the area and make a list of things to be completed.
