Planning Board's Minutes April 23, 1986` Page 2. Chairperson Flynn stated that she would like to know if this letter was sent to the Inspector of Buildings. Planning Director Callinan stated that it has not been sent, but he has spoken directly to the Inspector of Buildings about this matter. However, he will have a letter sent to him in order that it can be documented, Planner Genatossio stated that on Page 6 of these minutes, under the dis- cussion of Foxboro Terminals, the Planning Director was supposed to check on the matter of Attorney Gelerman contacting Whitman and Howard to arrange for expert testimony with regard to the proposed use on the drinking supply as well .4s the noise impact of the project. She stated - that she had thought the Board wanted to contact Lycott on this matter. Planning Director Callinan stated that Lycott was eventually chosen, but then the matter was put in a pending status and, therefore, it was not pursued any further. Minutes of March 31, 1986 Motion: To approve the Minutes of March 31, 1986. (Genatossio - Annino - All in favor) Planner Genatossio had a question as to who signs the Board's letters. Planning Director Callinan stated that the Chairperson signs all decisions of the Board, but as far as the other letters are concerned, it is really up to the Board members. *Planner Fiore entered the meeting at this point. Minutes of April 2, 1986 Motion: To approve the Minutes of April 2, 1986. (Genatossio - Quinn - All in favor) Minutes of April 9, 1986 Motion: To approve the Minutes of April 9, 1986, as amended. (Genatossio - Annino - All in favor) Planner Annino stated that on Page 6 of these minutes, under the dis- cussion of the buffer article, it should read that the plan shall be stamped by a registered landscape architect, not just a registered ar- chitect. There was discussion about how this would be worked into the regulations because although the Board felt that this was a good idea, they did not know how exactly it should be worded. Therefore, the Board decided that the section within the Bylaw dealing with the site plans should be revised. This item will be placed on the work list for the Planning Board. Chairperson Flynn stated that on Page 5 of these minutes, under the dis- cussion of the buffer article, it should be stated that Planning Director Callinan has no problem with the 25 foot buffer requirement because a buffer is definitely needed; it should not read that Planning Director Callinan has no requirement with the 25 foot buffer requirement because a buffer is definitely needed. Chairperson Flynn would also like to know if the Planning Director has received a letter from Town Counsel regarding Planning Board's Minutes April 23, 1986 Page 3 the definition of a bedroom and if a rough list of requirements and con- cerns of the Board regarding the Planned Residential Developments was drafted by the Planning Director. Planning Director Callinan stated that he has not received a response from Town Counsel and that the rough list has not been drafted as yet. The Board discussed the amendment which they are making to this plan regarding the regulation only being valid for a period of 12 months and how this could be enforced. After considerable discussion, Chairperson Flynn stated that she would like a written re- sponse from Town Counsel on the time period of which the regulation would be effective, the definition of a bedroom and the rough list of require- ments regarding the Planned Residential Developments for the Board in order that* it can be reviewed for the Town Meeting. Minutes of April 16, 1986 Motion: To approve the Minutes of April 16, 1986. (Genatossio - Annino - All in favor) Planner Genatossio stated that the Planning Board has hired Attorney Gelerman for the matter of Foxboro Terminals. She stated that the Board of Selectmen have now obtained Attorney Gelerman's services in dealing with the matter of Tighe Trucking. She would like to know where the money to pay Attorney Gelerman is coming from to pay this expense. Planning Director Callinan stated that the money is coming from the allocation for Town Counsel. Planner Annino would like to know what action was taken on the site plan which the Planning Board reviewed last week. Planning Director Callinan stated that the Building Inspector spoke to the applicant and the plan has become inactive. Planner Genatossio would like to know if the "Form A" (ANR) plan which the Planning Board approved last week for the Twin Oaks Associates ran into the wetlands that are near this property. Planning Director Callinan stated that the plan did not show the wetlands and the only reason that the Planning Board is notifying the Zoning Board of Appeals and the Build- ing Inspector is because this land was issued a Special Permit and the intensity of the site was reviewed at the time of the granting of this Special Permit. Planner Genatossio stated that she would also like to notify the Conservation Commission about this matter in case there should be any problems on this site. Planning Director Callinan stated that he will notify the Conservation Commission. 3, .8:05 P.M. - Public Hearing - "Massapoag states" - 99 lots off Maple Street The public hearing for the "Massapoag Estates" definitive subdivision plan began at 8:05 P.M. At 9:10 P.M., this hearing was continued until Wednes- day, April 30, 1986, at 8:00 P.M. A copy of the transcript is available in the Planning Department office. The following people spoke at this public hearing: Paul Folkman - The Folkman Company - applicant Ralph Maloon - RIM Engineering Co. - engineer Ernest Cohen - 1046 Maple Street, Mansfield Edward Rebello - 218 Massapoag Avenue, Easton Gary Ellis - Easton John Cuddy - Bird Road., Mansfield Planning Board's Minutes April 23, 1986 Page 4 4. .9:10 P.M. Meeting with the Board of Selectmen regarding the Growth Management Council I Before speaking with the Board of Selectmen, the Planning Board briefly discussed the matter of the Growth Management Council. The general con - census of the Board was that a Master Plan Committee would be set up and there would be a Growth Management Council which would be a subcommittee of the Master Plan Committee. The concern which Planning Director Calli- nan had was that the Council itself should decide how to break up in to different subcommittees because it does not matter how it is broken up as long as the job get done, Upon entering the Board of Selectmen's meeting, Chairperson Flynn informed the Selectmen that the Planning Board just resolved this matter. She stated that since the Master Plan Committee is the more important of the two (2) committees, this committee will be set up by the Planning Board. There will be subcommittee of this committee to be set up as the Growth Management Council which will deal with the affordable housing aspect of this plan. Planning Director Callinan stated that the comprehensive plan project will have to be completed within the next couple of months and the other project is to be conducted along with the Town of Norton and the City of Taunton dealing with the affordable housing. Therefore, he stated, this is really two (2) separate projects. The first project 'dealing with the comprehensive plan will be funded by the money which was appropriated at Town Meeting last year. The second project will be funded by the grant money which was awarded. He stated that the Growth Management Study and the Comprehensive Plan are one and the same; the funding which was received is for a joint project which is to address housing issues within the community and addressing articles that will affect the housing issues within the community. He stated that this is necessary since the housing issue is part of the Comprehensive Plan. He stated that between the two (2) projects, everything will be addressed such as housing, transportation, environment and Downtown development* it will address the various issues of the Master Plan. Clerk Quinn stated that the Master Plan Committee and the Growth Management Council will be separate be- cause the Master Plan is the more important of the two (2) matters. Richard D'Onofrio stated that he does not feel that the Master Plan is the overall plan, he feels that the Comprehensive Plan is the overall plan because it gives the Town an actual working plan. Planner Genatossio pointed out to Mr. D'Onofrio that the Comprehensive Plan and the Master Plan are one and the same. Chairperson Flynn stated that the Planning Board is very concerned that the $25,000 which was appropriated at Town Meeting is being used in order to get the grant money and they feel this is not appropriate because the Master Plan addresses more issues than just affordable housing. The Selectmen had a question as to how much money is needed in order to correctly finish the plan. Planning Director Callinan stated that in terms of the project that he proposed, between $20,000 and $38,000 will be needed. However, Planner Boldrighini pointed out that in order to properly complete the Master Plan or update it more money is needed. Selectman Harrington stated that the plan should not just look at affordable housing, it must also look at the ramifi- cations growth will have on the services within the Town. He would like to know how much additional funding would be needed to do this project correctly. Planning Director Callinan stated that $25,000 at the most would be needed additionally to finish the plan. There was a question as to how long this plan would take to be complete. Planning Director Callinan stated that it would take at least 18 months to complete the plan because you are talking Planning Board's Minutes April 23, 1986 Page 5 bout a larger scope of services. Clerk Quinn stated that the Master Plan Committee should be properly funded by Town Meeting vote and then the Growth Management Council will be a subcommittee of the Master Plan Committee and the Council will work with the money which was received from the grant. Selectman Harrington stated that under this proposal, the consultant will be working directly with the Planning Director; he does not feel that this is the best way to approach the situation be- cause he feels that the people within the Town should get actively in- volved in updating this plan because they are more'familiar with the Town than a consultant would be. Planning Director Callinan stated that the consultant and himself would be speaking and interacting directly with the public regarding this plan in order that they can obtain public input. After further disucssion on this matter, it was decided that there was not sufficient funding or sufficient detail as to what a Com- prehensive Plan needs in order to go forward and as much as a Master Plan is needed, the components have to be known beforehand; more details are needed on this matter. The Board of Selectmen would like more de- tails from the Planning Director as to what he wants to address and how this fits into the Comprehensive Plan because further information is needed in order to have the plan properly completed. It was discussed that if this information is available before the end of the Town Meeting, the additional funding may be able to be appropriated for this year and, in that manner, will avoid any further delay. Both the Planning Board and the Board of Selectmen felt that the Finance Committee should be noti- fied of this matter, 5. Discuss "Wind Chime Acres" Subdivision I Chairperson Flynn stated that a few weeks ago, the Planning Board received a letter from the residents at the "Wind Chime Acres" Subdivision regarding the completion of the roadway work. The Board decided to have the appli- cant of this subdivision come in and speak with the Board on this matter, Paul Folkman approached the Board and stated that approximately one month ago, he purchased the remaining lots in this subdivision from Ronald Bonvie. At this time, he agreed to finish the work on the roadway; he hired'Peter DeGirolamo to finish the roadway. Mr. Folkman outlined the work that needs to be completed and stated that he hopes to have this portion of the work done in May of this year. He also stated that an easement has been granted to Cablevision in order that all the houses which are already built will have an opportunity to install cable in their homes. Planner Genatossio had a question regarding the pond which is on this site. Mr. Folkman stated that they will be pumping down the pond and that they have not started ex- cavating it yet, but they hope to have in done in conjunction with the sub- division; Mr. Brunnelle will continue to do the work on this pond as he had started the work when Mr. Bonvie was the owner of the subdivision. Planner Genatossio had a question as to the stipulations which were placed on the development of this pond from the Conservation Commission; she feels that some research should be done on this matter. Chairperson Flynn stated that the various members of the Board can come in during the week and review the plan since it is so large and they may have more concerns regarding this matter. Mr. Folkman stated that some of the light poles are up in this sub- division, but there are no lights on the poles as yet; he stated that he believes the fire alarm box has been installed and is in proper working con- dition. Chairperson Flynn thanked Mr. Folkman for coming in and asked him to keep the Board informed of all matters regarding this subdivision, Planning Board's Minutes April 23, 1986 Page 6 6. Review a Site Plan for National Developmerit Gene Riley, Project Manager, approached the Board and stated that this site is adjacent to the Sheraton Inn on Hampshire Street in Mansfield. Mr. Riley outlined the utilities, grading and drainage plan for the Board. He stated that this particular lot will have a proposed 107,000 square foot research and development building; there will be a shared entrance with the Sheraton Inn which will have the required easements, there are four (4) travel lanes - two lanes on each side with an island in the middle. There is a second access to the property which is direct- ly across, from the Codex building on Cabot Boulevard, this entrance will basically be used for truck traffic. The total lot coverage is 73% on a 5.3 acre lot. He stated that perc tests have been performed in this area and the material is very sandy; they dug through 22 feet of sand and gravel before they hit the water table. Mr. Riley briefly outlined the drainage system for the Board. Planner Genatossio would like the appli- cants to make sure that all the truck traffic comes in from the second access off of Cabot Boulevard rather then the access off of Hampshire Street because she feels that the less trucks that go in through Hampshire Street, the better off the site will be as far as congestion is concerned. Mr. Riley stated that signs will be erected in order that the trucks will be directed to that entrance, he also pointed out that there will not be much truck traffic to this building, there will only basically be normal deliveries and the moving in of the people in the building. Mr. Riley pointed out to the Board that the drainage system was reviewed by the Conservation Commission and Cabot, Cabot and Forbes and was approved by both of these bodies. He stated that the pre -development run-off and the post -development run-off are relatively equal and if there is an overflow of the drainage, there is an easement that would catch this overflow and empty out near Route 495. Clerk Quinn read the comments from the various department heads. Mr. Riley stated that in response to the Town Engineer's comment regarding the drainage detail and drainage easement - a 42" drainage easement has been shown on the plan and they have received their sewer connection permit and the detail was shown on the sewer connection plan. Clerk Quinn asked if the Police Chief had been contacted regarding this site. The lanscape architect of this site stated that she has spoken to the Police Chief and he informed her that he feels this is the best use of the site. The Board would like this in writing from the Police Chief. Planning Director Callinan stated that in the Planning Board's recommenda- tion to the Inspector of Buildings, a statement must be made regarding the Planning Board's specific recommendation on the amount of compact car spaces which they are allowing. The Board had no problem with allowing 35% of the spaces for compact cars as is stated on the site plan. Motion: To send a positive recommendation to the Inspector of Buildings regarding the site plan for National.Development for the site located on Hampshire Street and Cabot Boulevard with the follow- ing stipulations: the Planning Director's recommendation re- garding the parking spaces, the recommendation regarding the stop sign, the letter which must be received from the Police Chief and the Town Engineer's comments. (Quinn - Boldrighini - Genatossio - Madan - Annino - Flynn) (Fiore was opposed to this motion) PASSES Motion: To allow 35% of the spaces on this site for compact cars. (Boldrighini - Genatossio - Quinn - Madan - Annino - Flynn) (Fiore was opposed to this motion) PASSES Planning Board's Minutes April 23, 1986 Page 7 7. "Form A" (ANR) Plans - National Development Associates - Hampshire Street The applicant of this "Form A" (ANR) plan is National Development Associ- ates. This "Form A" (ANR) plan consists of an unimproved parcel of land on the west side of,Hampshire Street near Cabot Boulevard. The reason this plan does not constitute a subdivision is because each parcel shown on the plan has adequate frontage under the Zoning Bylaw and Subdivision Rules and Regulations for the Town of Mansfield, Massachusetts, The checklist is complete. Motion: To approve the "Form A" (ANR) plan for National Development, .,.,Associates for Hampshire Street. (Boldrighini - Madan - All in favor) 8. Discuss "Shiloh Estates" Definitive Subdivision Plan Planning Director Callinan stated that Lots 11 and 12 currently have ex- isting structures on the site and, therefore, there may be a problem with enforcing the Subdivision Control Law on these particular lots so he is suggesting that these lots be eliminated from the subdivision and approved under a "Form A" (ANR) plan. Planning Director Callinan also stated that Lot 1 should only have access onto the proposed roadway; if access is to be onto Essex Street, the lot should be approved under a "Form A" (ANR) plan, not the subdivision approval. Phillip Beatty, applicant, had no problem with placing access on to the proposed street and, therefore, keeping this lot within the subdivision approval. Planning Director Callinan stated that a stop sign should be erected at the proposed intersection of Shiloh Drive and Essex Street subject to approval by the proper authorities; the appli- cant had no problem with this matter. Clerk Quinn read the comments from the Town Engineer and the Board informed Mr. Beatty that they would like these comments addressed on the plan with the exception of the comment re- garding the drainage system tying into the existing Essex Street system which the Board is not requesting because at this point it is not feasible. Mr. Beatty agreed to incorporating all the comments from the Town Engineer on the plan with the exception of the tie-in to the existing Essex Street system. The Board read the letter received by the Soil Conservation Service and although this letter stated that an easement was needed around the ditch, after further review of the ditch, the Board found that this easement was not necessary. Motion: To approve the subdivision plan for the "Shiloh Estates" subdivision plan subject to the comments made by the Town Engineer with the exception of the tie-in to the existing Essex Street system; access to Lot 1 should only exist from the proposed street; Lots 11 and 12 should be en- dorsed under "Form A" (ANR) plans and the stop sign shall be erected subject to approval of the proper authorities. (Boldrighini - Annino - Flynn - Fiore - Madan) (Genatossio and Quinn abstained as they were not present at the public hearing) PASSES 9. Discuss "Jason Lane" Definitive Subdivision Plan Planning Director Callinan stated that he has spoken to the Town Engineer regarding the covering of the slopes within this subdivision on the reten- tion area; the Town Engineer stated that the slopes would have to be hydro- s-eeded in order to stabilize the slopes. Chairperson Flynn stated that the Planning Board's Minutes April 23, 1986 Page 8 Fire Chief would like a fire alarm box at Lots 7 and 8 within the sub- division; the Town Engineer would like a note placed.on the plan that "All elevations refer to U.S.0 and G. Datum and referenced to the Town vertical control" and the plan should show the drainage easement area in profile including the retention area and drain outlet and the plan should also shown two (2) handicap ramps on.the radii. Planning Direc- tor Callinan stated that he would like a stop sign placed in the appro- priate location subject to approval by the proper authorities and the date of the pertinent rules and regulations should be placed on the plan. He also stated that access to lot 9 be through the proposed street only. If not, this plan will have to be endorsed under a "Form A" (ANR) plan. Motion: To approve the "Jason Lane" definitive subdivision plan subject to the fire alarm box being installed at the proper location, the comments from the -Town Engineer are incorpor- ated on the plan; the stop sign is placed at the appropriate location subject to approval by the proper authorities; the date of the pertinent rules and regulations should be placed on the plan; access to Lot 9 must be through the proposed street only; the slopes of the retention area must be hydro - seeded. (Fiore - Annino - Boldrighini - Flynn - Madan) (Genatossio and Quinn abstained from voting as they were not present at the public hearing) PASSES *Planner Fiore left the meeting at this point, 10. Correspondence The Planning Board received a bill from Gelerman and Cashman, Attorneys at Law, regarding the professional services rendered on behalf of the Mans- field Planning Board regarding the Foxboro Terminals Company. The total amount of this bill is $1,072.00. Motion: To forward this bill to the Board of Selectmen for proper payment. (Madan - Boldrighini - All in favor) The Planning Board received a letter from the Easton Planning and Zoning Board regarding a scheduled workshop meeting regarding water resources, grounwater and groundwater protection to be held on Thursday, May 15, 1986, at 7:30 P.M., in the town office building. The Easton Planning and Zoning Board would like the Mansfield Board of Helath, Conservation Commission, Wat6er Department and Planning Board to attend this meeting. Chairperson Flynn stated that she would like memoranda sent to the applicable people regarding this workshop meeting. This will be done. The Planning Board received a letter from Ralph I. Maloon, RIM Engineering, regarding the "Camelot at Mansfield" Subdivision, He is requesting a surplus removal permit for 9,200 cubic yards to be removed from this site. After considerable discussion, the Board decided to state that the hours of opera- tion should be from 9:00 A.M. until 2:00 P.M., Monday through Friday. There was a question as to whether the specific route should be stated or not. The Board decided not to specify the route. Motion: To send a positive recommendation to the Inspector of Buildings on this surplus removal application. It shall be stated in the letter that the hours of operation are from 9:00 A.M. to 2:00 P.M. (Boldrihgini - Madan - All in favor) Planning Board's Minutes April 23, 1986 Page 9 11. Around the Table Planner Genatossio stated that at Town Meeting it was brought up that there is surplus material being removed from the fish and game area. When she questioned this, she was told that there was no permit needed for the Town to conduct this operation. She was informed by the Town Manager that the Town is exempt from the regulations governing surplus removal. She feels that the proper procedure should be followed for the removal of this material. Motion: To send a letter to the Town Manager with a copy to the Building Inspector and the Board of Selectmen stating that if, in fact, there is surplus material that is being removed from this site, then the process listed in the Zoning Bylaw must be followed for the removal of this material. (Genatossio - Quinn - Flynn - Madan - Annino) (Planner Boldrighini was opposed to this motion) PASSES Planner Genatossio would like to know if the Special Permit for Fair- field Park is complete because there were a lot of loose ends the last time that the Board reviewed this project. She would like Planning Director Callinan to check into this matter and report back to the Board. She stated that this is one of the concerns that the Board has had in the past with granting Special Permits and now, if the Planned Residen- tial Development article passes at Town Meeting, Special Permits will have to be granted for that also. She stated that in the Fairfield Park matter, the Planning Board felt that their hands were tied and they had no other alternative but to grant the Special Permit. She does not want to get into the same type of situation with Planned Residential Develop- ments. Planning Director Callinan stated that the Board had the discretion at the time of the granting of the Special Permit to not allow this project directly up to the lot line because even though this is within the Downtown district and there is no requirement for setbacks, since this fell under the Special Permit provision so additional items can be required. He also stated that the enforcement of these, Special Permits has to be followed through by the Building Inspector in order to get the best results from these Special Permits because it takes constant monitoring of the develop- ment from the Building Inspector, Planner Genatossio stated that she would like the Planning Director to work on a list of subdivisions that have been approved in the past, how they are progressing, what work has been completed and general informa- tion dealing with the subdivision. Planning Director Callinan stated that he will get this list to the Board. 12. Discussion of "Cabot Pond" Planning Director Callinan stated that Mainline Construction is in the pro- cess of buying a portion of this pond and Mr. Allen Willis has spoken to the Building Inspector regarding his portion of the pond. The Building Inspector informed the parties involved that they must submit a work schedule to him for the pond. The Building Inspector informed the Planning Department that the pond should be completed by the end of August and Planning Director Planning Board's Minutes April 23, 1986 Page 10 Callinan informed the Building Inspector that the Planning Board would like this project started as soon as possible. The.Building Inspector stated that.if this project is not started soon, he will take the applicants to court. Chairperson Flynn had a question regarding the bond on this pond, Planning Director Callinan stated that the bond which is being held is not of a large enough amount to complete the pond and he feels that the Board should try to get the applicants to finish the project. If the applicants do not finish the pond, they should be taken to court to be made to complete the project, Motion: To send the Inspector of Buildings a letter stating that the Board appreciates the work which he is conducting on this matter and they would like to be kept informed of the issues regarding this matter. (Madan - Quinn - All in favor) 13. Around the Table Planning Director Callinan stated that he will be drafting an article for the Town Meeting to withdraw the Planning Board's original article for the 60% lot coverage as the Planning Board had voted at an earlier meeting. Chairperson Flynn stated that she would like the Board to reconsider their vote on this article because she is trying to work on information regarding this article. Planner Madan stated that the Board drafted this original article and now they still do not know what direction they would like to go; he feels that this issue needs more study. Chairperson Flynn stated that she would like this item placed on the Planning Board's work list for further study. Planner Genatossio stated that she would like the Planning Director to send each of the members a copy of the buffer article in order that they can re- view it for the next session of the Town Meeting. Planning Director Calli- nan stated that he will send the members each a copy of this article, but that the first paragraph in this article may have to be amended because of the manner in which it would affect residential property. Chairperson Flynn stated that the Board should list the concerns of the Board on this matter and address them to Town Meeting because she feels that this will give the article a better chance of being passed. The Board decided to meet at the High School on Monday, April 28, 1986, at 7:00 P.M., immediately before the Town Meeting to discuss this article. Chairperson Flynn stated that she does not know if she can address the Board's positive recommendation on the Planned Residential Development to the Town Meeting because she was opposed to this recommendation. Planner Madan stated that Chairperson Flynn should just state the facts when presenting the recommendation to Town Meeting. After that, she can address the Town Meeting as a private citizen with her concerns. Planning Director Callinan stated that he would like the Board to be aware that he has expressed his own personal comments on Planned Residential Developments to the Mansfield News (which are basically positive), so there may be an article in the paper this week. Planner Genatossio asked him what other articles he gave an opinion on to the Mansfield News. Planning Director Callinan stated that he only gave his comments on Planned Residential Developments, Planning Board's Minutes April 21, 1986 Page 11 14. Public Discussion Nelia Phillips, 285 Hope Street., approached the Board and presented them with pictures that she has taken regarding the trucks which are coming from the Tighe Trucking site down Hope Street, She stated that she has a concern with this because they are not following the stipulations which the Planning Board has set down as far as the hours of operation and the route which these trucks must travel. The Planning Board pointed out to Ms. Phillips that the Inspector of Buildings makes the final decision on these matters and that the Planning Board can only make a recommendation as to what they see is correct in these operations. Planning Director Callinan stated that he has spoken to the Building Inspector and he is of the opinion that in the Zoning Bylaw, it is stated that earth removal is between the hours of 7:00 A.M. and 3:00 P.M. which is the reason that he issues the permit for these hours. After considerable discussion, the Board decided that the issue of the surplus material permits has to be reviewed and, therefore, this item will be put on the Planning Board's work list, 15. Date of Next Meeting is Monday, April 28, 1986, at 7:00 P.M. in the High School, 16. Meeting adjourned at 12:05 P.M. IV1f 301e(o DATE
