Minutes of March 5, 1986 Motion: To approve the Minutes of March 5, 1986, as amended. (Quinn - Genatossio - All in favor) Planner Genatossio stated that on Page 3, under the discussion of "Shamrock Heights" Subdivision, she did not vote in favor of approving this plan with conditions. Planner Fiore also stated that under this discussion, he abstained from voting due to the fact that he was not present at the public hearing and, therefore, cannot vote. Planner Genatossio stated that the Board received a letter from Bill Fitz- gerald of Norton thanking the Planning Director for sending him the proposal for the Planned Residential Development; she would like to know if he realizes that this proposal was drafted by a developer and if it was a requirement for the Board to send this proposal to surrounding towns. Planning Director Callinan stated that this is not a requirement, but that Mr. Fitzgerald is conducting a seminar on Planned Residential Developments which is the reason for sending him this proposal. He also stated that Mr. Fitzgerald does rea- lize that this proposal was drafted by a developer. Planner Genatossio asked if there was a letter received from Mr. James Grady regarding the legal reasons the Planning Board cannot reconsider their ori- ginal vote on the "Robyn Estates" Subdivision. Planning Director Callinan stated that it was not a letter, it was a copy of a court case which basically states that the Planning Board must conduct another public hearing to recon- sider their original vote. He stated that he has forwarded this court case to Town Counsel. Planner Genatossio would like a letter written to Town Coun- sel requesting a copy of this court case for the Planning Board's review. Planner Genatossio stated that under the discussion of the Hatheway and Patter- son site plan, she had asked Mr. Bill Haynes whether his company had resolved their problems with the DEQE becaus*e she was concerned about DEQE's involvement at this site. She also stated that she wanted the Fire Chief and the Health Agent aware of the proposal in order to make sure that they had no problems with the site. Planner Fiore stated that on Page 4. under Additional Correspondence, there is a motion to send a letter to the Board of Selectmen regarding access to Town Counsel, but there is no vote. This should be amended to read the Planner Quinn made the motion and Planner Fiore seconded it and all were in favor. Chairperson Flynn stated that they received a letter from a gentleman re- questing information about the Great Woods Performing Arts Center and she would like to know if anything has been done with this matter. Planning Director Callinan stated that the Board of Selectmen have received the same letter and responded to the gentleman. Planning Board's Minutes March 12, 1986 Page 4 Chairperson Flynn stated that they had received a memorandum last week from the Town Manager requesting to be notified of the date of the public hearing for the Board%bf Selectmen's article for 60,000 square foot lot within the Water Supply Protection District. Planning Director Callinan-'stated that a memorandum has been sent to the Town Manager notifying him of the date and the time of this public hearing. Chairperson Flynn stated that under Around the Table,9 Planning Director Calli- nan was going to review the fire safety conditions on Route 106 (Eastman Street); she would like to know if anything has been done with this yet. Planning Director Callinan stated that he has not checked into this matter as yet, but he will do so and keep the Board informed on this matter. Chairperson Flynn stated that when the Board was discussing the possible re- consideration of "Robyn Estates" they did not decide who was to pay f or the readvertising of this public hearing. Planning Director Callinan stated that it was agreed upon to have the applicant pay for the readvertisinge 3. Review "Austin Farms" Performance Bond Estimate The Planning Board received a copy of a letter from Albert H. Andrews, Jr., Construction Inspector for the Department of Public Works, to Mr. Ronald Bonvie, The Bonwood Corporation, regarding the "Austin Farms" Performance Guarantee. This performance guarantee has been calculated to be $903,763.03 which includes a 10% contingency. Motion: To approve the calculated performance guarantee in the amount of $903,763.03 for the "Austin Farms" Subdivision Plan. (Genatossio - Fiore - All in favor) 4. Eugene Reilly - National Development Associates, Inc. Eugene Reilly approached the Planning Board to present this project. He stated that the land is adjacent to the Sheraton Inn and there would be a shared access with the Sheraton Inn which provides the best possible access to the site. They are proposing three (3) buildings on this site; one (1) two-story building and two (2) three-story buildings. They will begin con- struction in the spring for the two-story building and the construction for the remaining two (2) buildings is unknown at this time. The first building will be used for office space and potentially some light industry. There is no problem with the sewer or the water in this area. They will maintain post - development run-off at the same level as exists in pre -development through the use of leaching catch basins and a retention system. They will be sub- mitting an approval -not -required plan to the Board in order to divide this property into three (3) lots for the three (3) buildings; all lots will have adequate frontage on Hampshire Street. The Board had a question as to the reason for the shared entrance way with the Sheraton Inn. Mr. Reilly stated that from a traffic -flow standpoint, it makes better sense to have a shared entrance than to construct an additional separate entrance which would be approximately 150 feet away from the existing entrance. This shared entrance will be two lanes on each side of an island which is to be in the middle. He stated that there will not be a lot of traffic congestion because they have conducted traffic counts and the majority of the traffic congestion exists on Cabot Boulevard, there will be stop signs erected, the entrance way will be widened. The Board had a concern with there only being one access to this property. Mr. Reilly stated that there is a second access Planning Board's Minutes March 12, 1986 Page 5 point which will be across from the existing Codex building on Hampshire Street; this access will be used for fire and other public safety reasons. After com- plete construe -tion, the expected employees will be approximately 900; the loading areas have been screened; they are utilizing 35% of the parking area for compact cars. Richard Callinan, Planning Director, stated that although this project may increase the traffic congestion, he feels the shared access is adequate due to the fact that he would rather have the congestion on-site than off-site. Planner Genatossio stated that she would like a copy of the soil survey which has been conducted on this property; she would also like to know the total lot coverage. Mr. Reilly stated that the total lot coverage for the first building is 66% which includes all paving and the lot coverage of the other two buildings is undetermined at this time.. The Board had a question regarding the traffic lights. David Grant, CC&F, stated that there had been no consider- ation given to traffic lights when the original traffic study was conducted for the CC&F Industrial Park because they were not warranted at that time. Planner Genatossio asked if the drainage ditch had water in it. David Grant stated that it did have water in it so it is like a stream. Mr. Reilly stated that the traffic lanes are 23 feet wide and they will clustering the compact car spaces together. Planner Genatossio informed Mr. Reilly that the percentage of cars was to be approved by the Mansfield Planning Board and also that the location of these compact car spaces are to be determined by the Planning Board. Mrs Reilly stated that he understands this and also stated that there is handi- capped parking provided. He stated that they will come back to the Board at a later date with a better fully engineered plan with the stop signs, the traffic flow and the entrance. They will also speak with the various town officials to get their input into this matter. Chairperson Flynn thanked Mr. Reilly for coming in to speak with the Board. 5. Discuss "Shamrock Heights" Subdivision Plan At the last Planning Board meeting, the Board voted to approve this plan with conditions. Chairperson Flynn stated that she would like to discuss this plan this evening as all the abutters are present at the meeting. Planner Genatossio asked if the Board should inform the applicants of the location of homes on lots submitted for approval -not -required plans when a notation is placed on the plan which states "proposed street". Planning Director Callinan stated that the Board does not have the right to tell an applicant where he must place his house, but the applicant should be informed if he does submit an approval -not - required plan with a notation for a "proposed street" that the houses must be placed so that they are in conformance with the front yard setback. He also stated that the Soil Conservation Service did conduct a soil survey on this land and they have submitted a soil report. He stated that Peter Fletcher of the Soil Conservation District suggested placing an -additional pipe along the perforated pipe in order to collect the ground water within a portion of the street and carry that along to the wetlands. Planner Genatossio stated that there was a concern with the easements which would be needed due to the water that will be flowing onto other people's property. Planner Annino stated that easement would not be needed because the applicant is taking some of the ex- isting water off those properties and carrying it to the wetlands. Planning Director Callinan stated that the Engineer believes that the drainage system will work if the perforate pipe is placed about the ground water level. He also stated that any of the leaching fields on Lots 7 and 8 should be located as far aware from the perforate pipe as possible. Planning Board's Minutes ,March 12, 1986 Page 6 The Planning Board received a request from RIM Engineering to reduce the width of the right-of-way by two (2) feet in order that the Wells' property would be conforming; thoy are also requesting that the roadway pavement width be re- duced to 25 feet instead of the required 30 feet which would give the Town less of a roadway to maintain. Richard Callinan, Planning Director, stated that he does not see any harm in granting these waivers because it will not be affecting the existing property* Planner Genatossio stated that the Planning Board grants waivers when it is beneficial to the community and she does not see where the benefit to the community is if this waiver is granted. After consid- erable discussion with the abutters of this property regarding the conflict of the lot lines, Planning Director Callinan suggested that the Board require the applicant to conduct a survey on this property, but Planner Fiore stated that it is not the Board's duty to inform the applicants that a survey should be con- ducted. This plan was approved ---with conditions and the conditions have not been met, he asked what the time limit was to meet these conditions. Planning Direc- tor Callinan stated that the applicant has two (2) years to meet the conditions of the approval. He stated that although the applicant has not yet met the conditions of the approval, the Board cannot disapprove the plan without holding another public hearing to rescind their original vote. The Board felt that this was the best way to'handle this matter since there was so much concern over the subdivision. Motion: To hold a public hearing on Wednesday, April 16, 1986, to rescind the Planning Board's original approval with condi- tio*ns on the subdivision plan of "Shamrock Heights". (Quinn - Annino - Flynn - Madan) (Genatossio and Fiore abstained from voting) Motion: To send a letter to Judith Scott, Town Clerk, informing her that the Planning Board will be conducting another P ublic hearing on the "Shamrock Heights" subdivision due to the fact that, the conditions of the approval have not been met. Copy to go to the applicant and the engineer. (Quinn - Annino - All in favor) 6. Review the f ollowing site plans. Hatheway and Patterson - off Howe Street Paul Folkman, representing Bill Haynes, stated that last week he came before the Board to present a preliminary review of this plan. He stated that last week,, they met with the various department heads to discuss this plan; there were items which the Town Engineer and the Construction Inspector of the Department of Public Works wanted placed on the plan. Although they are willing to comply with all the comments that the Town would like placed on the plan, they have not had the opportunity to do this as yet due to the lack of time. The items which still must be placed on the plan are as follows: the drainage profiles, more detail on the rip -rap, typical catch basin and manhole. He was also unsure as to whether the Board wanted him to have the oil/water separator remain on this plan even though it is not required because this site is not within the Water Supply Protection District. The Board was ingeneral concensus that they would like the oil/water separator to remain on the plan. Mr. Folkman stated that it is difficult to determine the exact loca- tion of theparking and loading areas due to the fact that these may change in the future and he would just like to have the Board aware of that fact because the location shown on the plan may not be the exact location they are placed, Planning Board's Minutes March 12, 1986 'Page 7 but the parking and loading areas will conform to the Zoning Bylaw. Planner Genatossio would like to know how the paving is to end on the property. Mr. Folkman stated%-.wthat there will be a Cape Cod flare-up berm which conforms to the requirements of the Zoning Bylaw; he also stated that the details will be more defined as the property progresses. He stated that the water concern for fire safety issues in this area was a concern of the Town Engineer and the Construction Inspector. Clerk Quinn read the comments from the Fire Chief and the Board informed Mr. Folkman that the site would have to conform to the Fire Chief's concerns. Planner Genatossio,-asked if the Health Agent was also the Hazardous Waste Coordinator and she would like to know if he had any con- cerns with the plan. Planning Director Callinan stated that the Health Agent is the Hazardous Waste Coordinator and he had no -concerns with the property. Bill Haynes presented a copy of the report from the DEQE regarding the adja- cent property to the Board. He stated that they have also notified the DEQE that they are expanding this business and they will become involved under the wetlands filing. There was a comment from the Town Engineer stating that the engineer's stamp is not on the plan. Mr. Folkman stated that the stamp was on the original plans and he will bring in additional plans with the stamp in place. Planner Genatossio stated that in the letter which Mr. Haynes presented to the Board, it is stated that at the time of the inspection with the DEQE, there were no problems, but she would like to know since this is a five-year expansion project, will they be changing their rating. Mr. Haynes stated that their rating will be changed, but it will be changed to a lower level, not a higher one. Planner Genatossio would like this in writing from the DEQE. Motion: To write a letter to DEQE stating that the Planning Board is currently reviewing a site plan for the expansion of the Hatheway and Patterson site and they would like to be informed by the DEQE of the conditions of this site and any concerns they may have regarding this site. (Genatossio - Madan - All in favor) Mr. Folkman stated that he agrees to all the conditions which the Town Engineer, Construction Inspector and the Fire Chief and they will be placed on the plan; however, he would like a recommendation on this plan this evening. Planning Director Callinan stated that his initial concerns were with.the overall impact, but these have been addressed* The abutters which were present at this meeting had a concern with the tractor trailer trucks which would be parked on the roadside overnight due to the fact that the plant is closed at this time, the contents of the storage tanks in this area and the chemicals which are being used in this area. Bill Haynes stated that all operations on this site are in complete compliance with all federal and state regulations, there is not much they can do about the trucks parking on the street because they do not own these trucks; the storage tanks which are on the tracks are not Hatheway and Patterson's; but there are no plans to expand this; these are under the DOT's and the Federal Railway's jurisdiction. Planner Genatossio would like these concerns also addressed in the letter to the DEQE; the contents of the tank cars and how the river is being protected from a possible spill in the tank cars and about how the spills would be handled. She would also like to know if there is an evacuation plan in case any of the tank cars blow up. Mr. Haynes stated that there is not a plan, in fact, they have requested a plan and it is being constructed at the moment. Planner Fiore stated that he understands the abutters' concerns and they will get a letter to the DEQE about the evacuation plan and the concrete pad underneath the tanks which should be provided. Planning Board's Minutes March, 12, 1-0486 Page 8 Mr. Folkman stated that they would like a recommendation tonight from the Board and they will get back to the Board as to when the various details areplaced on%tohe plan in order that the Board will be informed that all the criteria has been met. Motion: To send a positive recommendation to the Building Inspector regarding this site plan subject to the comments of the Town Engineer, the Planning Director and the Fire Chief. (Madan - Fiore seconded for discussion) (Fiore - Flynn - Genatossio - Quinn - Annino opposed) Motion: To send a negative recommendation to the Building Inspector regarding this site plan stating that it is lacking the information requested by the Town Engineer and the Construc- tion Inspector of the Department of Public Works regarding the drainage profile, the rip rap detail, the catch basins and manholes and the oil/water separators, there is a con- cern regarding the parking and the roadway which should be paved according to the regulations, there should be some type of curb or berm to end the parking area so that the drainage flows into a catch basin, the concerns of the Fire Chief should be addressed regarding the water pressure, there is a concern regarding the traffic problem - the Board feels that the Police Chief should be made aware of and work out a solution with the applicants regarding the parking of trucks, particularly overnight parking. (Genatossio - Quinn - All in favor) Mansfield Assembly of God - West Street James Dunn, Engineer, approached the Board and stated that this site is on West Street and the Wading River runs through the property; the site is eight (8) acres. The proposed building has a capacity of 250. The utilities are coming across the property from West Street. Mr. Dunn pointed out the loca- tions of the catch basins and also the oil/water separator. There is a retention/detention basin which has been sized for both a 10 and 100 year storm; the drainage has been designed to help control the groundwater situ- ation. Mr. Dunn stated that they have presented this plan to the Conserva- tion Commission and it has been accepted by that commission. There are 63 parking spaces required according to the Zoning Bylaw, but 76 have been pro- vided. They have shown a plant schedule which is on the plan. There is a 27 building coverage; the total lot coverage with paving is approximately 15%. The high water mark is 158; there will be standing water in this retention/ detention basin - approximately two feet in a 10 -year storm and approximately five (5) feet in a 100 -year storm. Planner Genatossio stated that she has a concern for the safety of the children in this area, particularly because this will be so close to West Street; she would like to know if a fence is proposed and who would maintain this area. Pastor Theerman stated that a fence is not proposed and they will be maintaining this basin as it is on their property. Mr. Dunn stated that they are putting in a drainage system in order to avoid run-off to existing properties which are abutting this land. They are building up the area which the septic system is proposed in; the ground- water is three to five feet in this area which is the reason for this build up. Pastor Theerman stated that they will be putting up two signs; one by Planning Board's Minutes March 12, 1986 Page 9 the street and one by Interstate 95, these signs will conform to the Zoning By -Law requirements. He also stated that there is a location proposed for the hydrant and he spoke with the Fire Chief who approved the location of this hydrant. Mr. Dunn stated that handicapped parking has been provided. Chairperson Flynn stated that she would like to know about the sloping of the entrance of the driveway away from West Street as Planning Director Callinan suggested. Mr. Dunn stated that they have provided swails, so that the water will not run off the property, but if that is what the Town would like, he has no problem with it and it will be changed. Motion: To send a positive recommendation to the Inspector of Buildings regarding the site plan for the Mansfield Assembly of God pro- viding that certain conditions are met before a building permit is issued. These conditions are as follows: the fire hydrant must be placed on the plan, the concerns of the Planning Direc- tor regarding the sloping of the driveway entrance, the aisle requirement must be met, the Health Agent's concerns regarding complying with stump dumps and Title V. (Genatossio - Quinn - All in favor) 7. Review "Lindsey Acres'preliminary subdivision plan Planning Director Callinan stated that the Board had reviewed this plan at a prior meeting and was concerned with this subdivision only having access through North Attleboro; they had a concern because the homes would have to be serviced by Mansfield, but there was no access through Mansfield. The applicants were going to conduct further field work on this property and come back to the. Board, but they have not as yet and, therefore, the Board must vote on this plan this evening. He also stated that the North Attle- boro boundary line is not shown on the plan. Motion: To deny the preliminary for "Lindsey Acres" due to the lack of information., The Board's concern regarding the utilities, fire and police services being serviced from Mansfield, but only having access through North Attleboro. (Genatossio - Quinn - All in favor) 8. "Form A" (ANR) Plans Chauncy Realty Trust - Chauncy Street The applicant of this "Form A" (ANR) plan is Chauncy Realty Trust. This "Form A" (ANR) plan consists of property located on the southerly side of Chauncy Street bounded on the east by land of Arthur W. Anderson, Trustee; on the south by land of WRC Properties, Inc. and on the west by land of Richard J. Madigan. The reason this plan does not constitute a subdivision is because the existing lot has sufficient area and frontage on a public way (Chauncy Street. The checklist is complete. Motion: To approve the "Form A" (ANR) plan for Chauncy Realty Trust on Chauncy Street. (Genatossio - Quinn - All in favor) Walmark Corporation - Fruit Street The applicant of this "Form A" plan is the Walmark Corporation. This "Form A" (ANR) plan consists of property located on the northeasterly side of Fruit Street bounded on the west by other land of Walmark Corporation; on the north- Planning Board's Minutes .Nie.-rch 12, 1986 Page 10 east by other land of the Walmark Corporation; and on the east by the Mansfield - Norton town line. The reason this plan does not constitute a subdivision% -Is because the lots have sufficient frontage and are lo- cated on a public way (Fruit Street). The checklist is complete. Motion: To approve the "Form A" (ANR) plan for the Walmark Corporation for Fruit Street. (Genatossio - Madan All in favor) The Walmark Corporation - Fruit Street The applicant of this "Form A" (ANR) plan is the Walmark Corporation. This "Form A" (ANR) plan consists of property located on the northeasterly side of Fruit Street bounded on the west by other land of the Walmark Corporation* on the northeast by other land of the Walmark Corporation and on the east by other land of the Walmark Corporation. The reason this plan does not con- stitute a subdivision plan is because the lots have sufficient frontage and are located on a public way (Fruit Street). The checklist is complete. Motion: To sign the "Form A" (ANR) plan for The Walmark Corporation on Fruit Street. (Quinn - Genatossio - All in favor) 9. Around the Table No comments at this time. 10. Public Discussion Karen Galanti, Franklin Street, stated that she had just attended the Board of Selectmen's meeting and they would not recognize her when she asked a question so she would like to inform the Planning Board of what she was going to ask. She stated that.she spoke to Don Schmidt, EOCD, regarding the zoning articles that were submitted by the Selectmen for the Annual Town Meeting re- garding the sidewalk on Pratt Street and the 60,000 square foot lots within the Water Supply Protection District. Mr. Schmidt informed her that all articles had to be submitted by either a vote of the Board or by a petition of ten re- gistered voters in order to be submitted legally; these articles were submitted by one of the Board of Selectmen prior to the Board taking a vote on the ar- ticles. She does not believe that the Planning Board can conduct a public hearing on an article that was not legally submitted to the Town Clerk, there- fore, she is requesting that the Board get a statement in writing from the EOCD stating that these articles must be submitted by either a vote of the Board of Selectmen or by a petition of ten registered voters prior to the public hearing being held by the Planning Board. The Board instructed Planning Direc- tor Callinan to write a letter to the ECOD requesting this in writing and he stated that he will speak with Don Schmidt, EOCD, and also write a letter to him. Motion: To send a letter to Don Schmidt, EOCD, regarding articles submitted for the warrant for the Town Meeting. (Quinn - Madan - All in favor) 11.
