Planning Board's Minutes February 26, 1986 Page 2 Minutes of February 12, 1986 Motion: ToN-,approve the Minutes of February 12, 1986, as amended. (Genatossio, - Quinn - All in favor) Planner Annino, would like to know if, on Page 5 under the discussion of the "Eastbrook Estates" preliminary subdivision plan, where it is stated that this proposed development is off of East Street is is supposed to be Route 106. Planning Director Callinan stated. that this proposed development is off of Route 106, but in 1971 the Selectmen from the Town of Mansfield and the Town of Easton voted to name the portion of Route 106 from where East Street ends to'the Easton Town line "Eastman Street". This will be changed in the minutes for clarification purposes. Planner Genatossio stated that when the Board was discussing the proposed sub- division road widths, it was stated that the Board informed Mr. Carl Nelson that the reason that the roadway length for a cul-de-sac is 650 feet is be- cause of public safety reasons. She would also like it stated in the minutes that the Board was considering having two accesses for roadways that are longer than 650 feet. Acting Chairperson Flynn asked if, on Page 3 under the discussion of reviewing the Subdivision Regulations, it stated that the top coat and base coat were to be clarified and she would like to know if this has been clarified. Planning Director Callinan stated that this has been clarified so that it will be stated in both the Subdivision Regulations and the accompanying Cross -Section that it is required to have li inches of top course and 2 inches of base course. Acting Chairperson Flynn asked if the Planning Director has had a chance to talk to the people from Ly'cott regarding their services for the "Foxboro Term- inals" case as requested by Attorney Gelerman. Planning Director Callinan stated that Joseph Campo, Town Engineer, has spoken with these people briefly. Acting Chairperson Flynn also would like to conf irm that the Inspector of Buildings has been notified that at last years Annual Town Meeting there was an amendment that stated if that if he makes a different determination than the Planning Board on a site plan, he must notify the Board within seven (7) days. Minutes of February 19, 1986 Motion: To approve the Minutes of February 19, 1986, as amended. (Quinn - Annino - All in favor) Acting Chairperson Flynn noted that after she had left this meeting there was a great deal of discussion regarding a "Form A" (ANR) plan on Route 106 and she would like to know if this "Form A" (ANR) plan was approved. Planning Director Callinan stated that this plan was just discussed and it will be acted upon this evening. I Planner Boldrighini stated that on Page 4, under the discussion of "Robyn Estates' he would like to know if the Town Engineer had any comments on the plan because all the minutes show is that he has no problems with the proposed drainage system. Planning Director Callinan stated that the Town Engineer did make comments and stated that this plan will not adversely affect Mr. Grady's septic system. Planner Boldrighini stated that he believes the applicants should propose a different de- sign or move it further away from the septic system. Planning Director Callinan stated that this design meets good engineering practices. Planning Board's Minutes February 26, 1986 Page 3 4. 7:45 P.M. - Review a Site Plan for a -Proposed Restaurant on Oakland Street Bob Scott, etkgineer, stated that the applicants are proposing an eighteen (18) foot addition to the present building, there will only 'be minor changes to the inside of the building, the driveway will remain as it presently exists, the parking in the lower area will be expanded in order to meet the requirements of the Bylaw, there will be shrubbery placed around the building for landscaping purposes and they have provided three (3) handicapped parking spaces and wheel- chair ramps. Planning Director Callinan stated that thparking spaces which are delineated as 17, 18, 25 and 26 may have to be eliminated for circulation purposes, additional parking spaces will be needed for the beauty shop which is to remain where it presently exists on the lower level of the building and drainage should be provided where new paving is proposed. The applicants stated that the beauty shop is going to remain where it is for the time being, but they do not know how long it will remain and they will eventually be using it to ex- pand their business or for storage. Planner Annino stated that he does not believe that the 16 feet between the parking spaces is wide enough for circula- tion purposes and he feels it should be widened. Mr. Scott stated that the only way that this can be widened would be to eliminate parking spaces. Mr. Scott also stated that the applicants had not planned on having drainage for the new paving area because they do not feel it is necessary. However, they are proposing concrete curbing at their property line to prevent the water from other property flowing onto their property. Planner Genatossio, would like to know if the applicants will again have to come before the Board if they decide to expand their parking area at a future date. Planning Director Callinan stated that they may have to come to the Board for this, but they would at least have to conform to the buffer requirements to the abutting property owners. Motion: To send a positive recommendation to the Inspector of Buildings stating that the Board has the following concerns with this plan: on-site drainage should be provided for the lower parking area, there may be a problem with the circulation within the parking area which may require that parking spaces number 17, 18, 25 and 26 be removed and provided for in a different area of this property, there is a need for additional parking (1-2 spaces) due to the beauty shop which is to remain in business, the Board feels that parking space number 10 should also be removed due to circulation problems, if additional parking is proposed in the future the applicants must provide for a landscaped buffer along the lot line of Oakland Street and land of Riccio, the dumpster must be screened and as additional parking is proposed there must also be additional lighting required. (Genatossio - Boldrighini - All in favor) 5. 8:10 P.M. - Joint Meeting with the Board of Selectmen and Industrial Zoning Committee to Discuss the Articles for the Town Meeting At 8:10 P.M,, the Planning Board attended this meeting to hear the presentation of the Industrial Zoning Committee to the Selectmen and the Planning Board. The Board left this meeting at 9:40 P.M. and returned to their regular meeting. Planning Board's Minutes February 26, 1986 Page 4 Planner Genatossio asked Planning Director Callinan if these articles were legal since they were submitted by an advisory committee and if they will be able to be heard at the Annual Town Meeting. Planning Director Callinan stated that these articles will have to be sponsored by either the Planning Board or the Board of Selectmen and will have to be included in trig Special Town Meeting which is supposed to be called within the Annual Town Meeting. Planner Genatossio, had a concern about when the Selectmen would ca.11 this Special Town Meeting because the Planning Board will have to hold public hear- ings forthesearticles and this puts the Planning Board under tiw:,:-. constraints. She feels that the Selectmen should be made aware of this fact. Planning Di- rector Callinan left the meeting to inform the Selectmen of this fact and was informed that the Selectmen will be calling for a Special Town Meeting within the Annual Town Meeting at their meeting next week. Therefore, the Planning Board will have an adequate amount of time to advertise and hold a public hearing. 6. Discuss and vote on the Subdivision Regulation Revisions Acting Chairperson Flynn stated that this will be voted on next week due to the fact that there are not enough members at this meeting which were present at the public hearing for these revisions. This will be placed on the agenda for next week. 7. "Form A" (ANR) plan - MAC Homes, Inc. - Route 106 The applicant of this "Form A" (ANR) plan is MAC Homes, Inc. This "Form A" (ANR) plan consists of a parcel of land on the northerly side of Route 106, bounded northerly by owner unknown; easterly by Hallet & McIntrye; southerly by Route 106 and westerly by owner unknown. The reason this plan does not constitute a subdivision is because the lots have sufficient area and frontage as per zoning. Planning Director Callinan stated that the Board has discussed this "Form A" (ANR) plan in detail at prior meetings. He stated that the appli- cant is under time constraints and, therefore, is proposing this layout. Planner Genatossio stated that the Board must legally sign this because there is nothing that can be done to prevent it. Planning Director Callinan stated that this is correct. Motion: To sign the "Form A" (ANR) plan for MAC Homes, Inc. on Route 106. (Boldrighini - Quinn - Genatossio - Flynn Madan) (Anniono was opposed to this motion) 8. Schedule Public Hearings for Zoning Articles Planning Director Callinan stated that the Planning BoErd should divide all the articles into three (3) separate hearings which would be as follows: Planning Board articles; all other articles with the exception of the Indus- trial Zoning Committee articles; and the Industrial Zoning Committee articles. The Board agreed to break the hearings down in this manner and will hold the hearings as follows: Monday, March 24, 1986 - Planning Board articles; Wednesday, March 26, 1986 - remaining zoning articles; and Wednesday, April 2, 1986 - Industrial Zoning Committee articles. These hearings will be advertised. Planning Board's Minutes February 26, 1986 Page 5 9. Election of Planning Board Officers Acting Chairperson Flynn handed the gavel over to Planning Director Callinan to conduct these -nominations. Planning Director Callinan asked for nomina- tions for the position of Chairperson. Motion: To nominate Marydee Flynn as Chairperson. (Annino - Genatossio - All in favor) Planning Director Callinan asked for nominations for the position of Clerk. Motion: To nominate Stephen Quinn as Clerk. (Boldrighini - Madan - All in favor) 10. Around the Table Chairperson Flynn asked Planning Director Callinan what was happening with the Special Permit Rules and Regulations which he had drafted. Planning Di- rector Callinan stated that he has placed them on hold for the time being in order that work can begin on the Strategic Planning Grant and organizing the Growth Management Counsel to work on this matter. He stated that he is also working on a request for a proposal for the money which was appropriated at the last Annual Town Meeting for the Master Plan. Clerk Quinn stated that he would like to respond to the Town Manager's letter of February 24, 1986, regarding the manner in which the Planning Director's time is spent. Planning Director Callinan stated that he understands the Board's concern that he will be taken away from Planning Board matters, but he feels that if he can work on matters which are not in the immediate area of the Planning Board, it will enhance the community; he feels that he is re- sponsible to both the Planning Board and the Town not just one or the other. Clerk Quinn stated that it is clearly an interpretation of the Town Manager's on how the Planning Director's time is spent and who his major responsibility is to and Clerk Quinn feels that the Board has an entirely different inter- pretation. He feels that the Planning Director's responsibility is to.the Board and that the Board's needs should be addressed first. Planner Boldri- ghini stated that he does not feel this is necessary. He stated that if the Planning Director has a problem with his time, he can come to the Board and the Board will then speak with the Town Manager at that time. Planner Genatossio stated that the Board is writing this letter to go on record as being opposed to the manner.in which this is being handled. Planner Madan stated that he did not feel this was necessary. Planner Genatossio stated that if the Planning Director does not have the time, he should not have to attend to these matters as the Town Manager has stated. Motion: To have the Planning Board send a letter to Town Counsel asking for clarification of the Town Charter, Section 7.6, determining the Town Manager's authority to divert the Planning Director's activities away from the Planning Board and its matters when the Board feels that the Planning Director's time should be spent with the Board's matters. (Quinn Genatossio - Annino, - Flynn) (Madan and Boldrighini opposed to this motion) PASSES 'Planning Board's Minutes February 26, 1986 Page 6 Chairperson Flynn asked if anything has been done with the matter of "Cabot Pond".
