4. Discuss Workshop Meeting with the Easton Planning and Zoning Board
The Planning Board received a letter from the Easton Planning and Zoning Board
requesting that the Planning Board, Board of Health, Conservation Commission and
Water Department attend a workshop meeting on a Tuesday or Thursday evening or
a Saturday morning between March 18th and 29th to discuss water resources, ground-
water and groundwater protection. Planner Quinn stated that he believes the Town
boards should get together and discuss these matters before attending the Easton
Planning and Zoning Board workshop in order to decide in what direction they would
like to proceed. The other members of the Board did not feel this was necessary
and stated that these boards should attend this workshop meeting and then they can
discuss it in an open meeting with their individual boards. The Planning Board
decided to tentatively schedule this meeting for Thursday, March 27, 1986. A
letter will be sent to the Easton Planning and Zoning Board stating that it has
been tentatively scheduled for this date and a memorandum will be sent to all in-
volved boards asking if they can attend on this evening.
5. Discuss and vote on the Subdivision Regulation Revisions
Acting Chairperson Flynn stated that the Planning Board will wait to vote on
these revisions until there is a full board present at the meeting. This item
will be placed on the agenda for the next Planning Board meeting.
6. "Form All (ANR) plans
Walmark Corporation - Fruit Street
The applicant of this "Form A" (ANR) plan is the Walmark Corporation. This
"Form All (ANR) plan consists of property located on the northeasterly side of
Fruit Street bounded on the west by land nor or formerly of John W. McIntyre,
Trustee; on the northeast by land nor or formerly of John W. McIntyre, Trustee,
and Ernest D. Sweet; and on the east by the Mansfield -Norton Town line. The
reason this plan does not constitute a subdivision is because the lots have
sufficient frontage and are located on a public way (Fruit Street). The check-
list is complete.
Motion: To approve the "Form A" (ANR) plan submitted by the Walmark Corporation.
(Genatossio - Madan - All in favor)

The applicant -.)of this "Form A" (ANR) plan is Stuart W. Sweet. This "Form A"
(ANR) plan consists of property bounded northerly by Gilbert Street, southerl-y
by Bungay Street and westerly by West Street. The reason this plan does not
constitute a subdivision is because all the lots have frontage on existing
streets and conform to the Town of Mansfield Zoning Bylaw. The checklist is
complete.
Motion: To approve the "Form A" (ANR) plan for Stuart Sweet on
Gilbert Street, Bungay Street and West Street.
(Genatossio - Madan - All in favor)
7. 8:10 P.M. - Public Hearing - "Shamrock Heights" - 8 lots off West Street
The public hearing for "Shamrock Heights", an 8 lot subdivision off of West
Street began at 8:10 P.M. At 9:20 P.M., the public hearing was continued un-
til Wednesday, March 5, 1986. A copy of the transcript is available in the
Planning Department office.
8. Discuss "Eastbrook Estates" Preliminary Subdivision Plan
Planning Director Callinan stated that at the last Planning Board meeting, the
Board informed Attorney VanHayhow that this item would be placed on the agenda
for discussion this week. The Board informed Attorney VanHayhow that they be-
lieve that he had to first reach Mr. Taylor to discuss the possibility of
connecting into his subdivision. Planner Genatossio stated that she likes the
second alternative that the applicants are proposing with the elimination of
the cul-de-sac because it would be in close proximity to the wetlands and this
is really not necessary as it will only be serving one (1) house lot. Attorney
VanHayhow stated that the applicants have no problem with eliminating this cul-
de-sac, but he has been unable to reach Mr. Taylor. He has, however, been able
to reach his engineer and was informed that his engineer will speak to Mr.
Taylor regarding the possibility of this connection. Although the Board pre-
fers the second alternative which shows no access onto East Street,, Attorney
VanHayhow stated that the applicants may choose to submit the plan which shows
one access onto East Street and one access into "Echo Hill" in the event that
they cannot contact Mr. Taylor. If this is done, they may wish to approach the
Planning Board at a later date and abandon the roadway which would lead out to
East Street if Mr. Taylor is agreeable to allow them to tie into his subdivision.
Attorney VanHayhow stated that he does have two (2) concerns and they are that
Mr. Taylor will not be agreeable to this subdivision tying into his subdivision
and, if he is agreeable, what his time table for construction will be because
his clients are very interested in having this subdivision approved and con-
struction started on it. The Board discussed the possibility of sending a
letter to Mr. Taylor stating that the Board would like him to speak to the appli-
cants of the "Eastbrook Estates" preliminary subdivision to discuss the possibility
of tying the two subdivisions together, but Planning Director Callinan stated that
the Board should not interject in this process. Therefore, the Board decided not
to send this letter, but instructed Attorney VanHayhow to send a letter to Mr.
Taylor stating that that Board feels it is in the best interest of the parties
involved that he contact that applicants of the "Eastbrook Estates" preliminary
subdivision plan to discuss this matter. Planner Madan stated that if Mr. Taylor
does not respond to Attorney VanHayhow's letter, the Board can send a follow-up
letter to Mr. Taylor.

9. Discuss "Robvn Estates" - Possible Reconsideration
Planning Dire -e -tor Callinan stated that the Town Engineer has reviewed this
plan as the Board was concerned with the negative impact the drainage system
may have on Mr. Grady's proposed septic system and he Eound no problems with
the proposed drainage system. Acting Chairperson Flynn stated that the Board
has not received a letter from the applicant requesting reconsideration of
their original vote and, therefore, feels that the Board cannot reconsider
their decision. Planning Director Callinan stated that he will obtain this
letter from the applicant and the Board can reconsider their vote next week
as the Board cannot reconsider their vote this evening in any case because
there are not enough voting members present at the meeting. Mr. James Grady
was present at this meeting and he stated that he is very much opposed to
this subdivision as it will adversely affect his proposed septic system.
10. "Form A" (ANR) plan - Route 106 - MAC Homes, Inc.
Planning Director Callinanstatedthat last week this plan was withdrawn due
to the fact that the applicant was going to submit a different roadway de-
sign so that no driveways would be fronting on Route 106; instead there was
going to be a cul-de-sac roadway off of Route 106 with all the driveways onto
this proposed street. The applicant has resubmitted this plan as it was
originally submitted and will come before the Planning Board at a later for
approval of a definitive plan for the back lots. He suggests that the Board
send a letter to the applicant regarding the Board's preference of the alter-
native design; he also stated that the Board can approve this "Form A" (ANR)
plan with the stipulation that the permanent accesses be on the constructed
roadway, not onto Route 106 because the applicant may be constructing the
roadway at the same time as he is constructing these homes. If the Board
proceeds this way, they will be allowing the applicant to begin construction
on these lot and also be making sure that the lots are safe because the drive-
ways will not be fronting on Route 106; he feels that this is the best way to
handle the situation. Acting Chairperson Flynn stated that this item should
be separate on the agenda and the applicant's engineer should come into the
meeting to discuss this with the Board. Planner Genatossio stated that she
feels that water should be extended out to Route 106 because there is presently
no water there. Planning Director Callinan stated that if the Town can provide
State money as a match for private money, the applicants would be willing to
extend the water out to Route 106.
*Acting Chairperson Flynn left the meeting at this point.
*Acting Clerk Annino to be Temporary Acting Chairperson for the remainder of
the meeting.
Planning Director Callinan stated that he is trying to encourage an alterna-
tive design because he feels this subdivision is going to set the precedence
for the other subdivisions. He stated that the alternative design which was
presented to the Board at their last meeting showed a loss of one (1) lot which
means that this would be a ten (10) lot subdivision with four (4) lots right on
Route 106, but these lots would not have direct access to Route 106 - they
would have access onto the new road which would be constructed. Planner Quinn
stated that this would be a more favorable design and that the applicant would
get more money for each lot sold, but Planning Director Callinan stated that
I U

the applicant is favoring this design with the lots having access on Route
106 because he will be able to build immediately and he is concerned about
delays that will occur when he submits his definitive plan. Planner
Genatossio stated that the definitive plan process would not be delayed if
the applicant- has all his information submitted to the Board in the manrt.,2hr
which it is supposed to be submitted.
11. Around the Table
Planner Genatossio would like to know who instructed Planning Director Callinan
to write the grant application for water and sewer because she does not feel
that he should be writing it. Planning Director Callinan informed her t%,at he
Town. was instructed by the Town Manager to write this grant for the To . Planner
Genatossio does not feel that he should be writing this grant unless there is
time and she stated that he works for the Planning Board, not the Town Manager,
as stated in the Town Charter.
Motion: To send a letter to the Town Manager quoting the section of
the charter which states that the Planning Director works
primarily for the Planning Board and, if time permits, he
works for the Town Manager and any other Boards or Committees.
The Planning Board does not feel that they can give the
Planning Director over to other projects at this time due
to the great number of projects which are before the Board
at this time. A copy of this letter will go to the Selectmen.
(Genatossio - Quinn - Annino)
(Madan opposed to this motion)
Planner Madan stated that he feels it is important that the Planning Director
get involved with these grants because they are needed by the Town. Acting
Chairperson Annino stated that he feels the Town Manager should first ask the
Board if there will be a problem with the Planning Director doing projects be-
fore they are assigned to him. Planning Director Callinan stated that he feels
it enhances the Board if they get involved in various aspects of community
development; he also stated that he works for the Town of Mansfield, not just
the Planning Board. Planner Genatossio stated that this is a different inter-
pretation of the Town Charter and that the Board has had the same problem in
the past with the Planning Director being instructed to do work by the Town
Manager. Planning Director Callinan stated that he understand the Board's con-
cern with him being taken away from Planning Board work.
12. Public Discussion
Alan Johnson asked the Board if they were against sewering the Town. Planner
Genatossio informed Mr. Johnson that that is not the Board's opinion, it is
just her personal opinion.
Alan Johnson asked the Board what the letter to the Town Manager was going to
say and whether the Board was going to monitor the Planning Director's time.
Planner Genatossio informed Mr. Johnson of the motion and stated that if the
Town Manager would like the Planning Director to work on a certain project, he
should come to the Board first and ask them if there will be a problem. The
Board will then discuss the matter with the Planning Director and decide what
to do from that point.

Joseph Zeneski asked the Board if they have set hearing dates for the zoning
articles for the Town Meeting and was informed that they have not been set,
but will be get at the next meeting. He informed the Board that there are
a number of articles, especially those submitted by the Industrial Zone Study
Committee, ee, which are under question as to if they were legally submitted. He
stated that John Dunn, Selectmen, is going to seek Town Counsel's interpretation
on these articles. He stated that the Industrial Zone Study Commit -tee has
worked hard on these articles and he would hate to think that they will fail
due tool-egal problems; he feels the Board should become informed of the entire
situation. Planner Quinn stated that he would like a copy of the response
which John Dunn get from Town Counsel regarding his interpretation on this
matter. Planning Director Callinan stated that he will get this copy and that
he is sure that these matters will be addressed before the articles get to
the Annual Town Meeting.
