Minutes of January 29, 1986 Motion: To approve the Minutes of January 29, 19860 (Genatossio, - Annino - All in favor) I Planner Genatossio stated that she would like the Board to review the variance application for GATRA prior to the public hearing being held by the Zoning Board of Appeals even though the Planning Board did make a recommendation on this application prior to all the information being submitted. Acting Chairperson Flynn asked if Planning Director Callinan had an opportunity to speak with Town Counsel regarding the discussion of Route 106 subdivisions. Planning Director Callinan stated that he has and he will get his response in 0 wri t i ing. Planning Board's Minutes February 5, 1986 Page 2 4. Review Subdivision Regulations Revisions Planning Dir*tor Callinan stated that he has revised some of the amendments for the Subdivision Regulations due to the discussions which the Board has had during the public hearing. He stated that "loop streets" was deleted en- tirely from the revisions. There was discussion on who the Board would handle if someone came in with a cul-de-sac street and there was an island in the middle and the street loops around the island. Planner Fiore stated that he feels this is a safety issue. Planning Director Callinan stated that in order to address the safety issue the Board should regulate the number of accesses directly to the number of houses with -in the subdivision; he feels that this would be a better way to address this issues because the Board cannot really put a definition on loop streets. After much discussion about whether the Board should regulate the size of the island in the middle of a cul-de-sac or regulate the size of the cul-de-sac, the Board decided to have Planning Director Callinan work on a requirement for the number of accesses being di- rectly associated with the number of houses which are allowed in that sub- division. Planning Director Callinan outlined the rest of the revisions to the Sub- division Regulations which were directly related to the Board's discussions regarding them and the Board was in agreement with the remainder of the re- visions which were to be made. Planner Genatossio stated that she would like the following phrase placed under Section IV. A. l.: "altering of wetlands and/or the established 100 -year flood plan boundary". The Board agreed to add this phrase to this section. Planner Genatossio asked if the Board was deleting "dead-end streets" from the Regulations entirely. Planning Director Callinanstatedthat this could be deleted, but even if the Board left it in the people would still refer to the definition for a cul-de-sac street, Planner Genatossio would like the following added to Section V. B. in order to avoid any problems in the future: lithe base coat of asphalt (2 inches) and the top coat of asphalt (lJ inches)", she would like this added to all streets, not just unaccepted streets. The Board agreed to this being added, Planner Genatossio stated that under the section dealing with the Storm Water Drainage, the Board was discussing adding "under the Water Supply Protection District there will be a net zero increase in total run-off and a net zero in- crease in the peak flow rate for all subdivisions." She also stated that devices may include detention facilities, not basins. The Board decided to consider retention basins rather than infiltration basins because the infil- tration basins fall under retention basins. She stated that the post -develop- ment peak flow should be shown for both the 25- and 100 -year storms. The Board was in agreement with all of these revisions being added to the Regula- tions. Acting Chairperson Flynn asked for a concensus of the Board. The Board was in agreement with all the changes with the exception of the "loop streets" which will be taken up next week after Planning Director Callinan works on a pro- vision for this matter. This matter will be placed on the agenda next week. Planning Board's Minutes February 5, 1986 Page 3 5. Discuss "Canoe River Estates" Subdivision - Michael Loughlin Michael Loug4in and Douglas King were present at this meeting to discuss the matter of the "Canoe River Estates" Subdivision. Acting Clerk Annino read the letter received from Michael Loughlin stating that it is still their intention to complete the work at the subdivision, but the nature of the work prevents it from being completed at this time of the year. They would like to make arrangements to complete the work as soon as conditions allow. Mr. Loughlin stated that if the Board does not feel that there is enough money being held in the bond, they will be happy to post an additional amount which will be set by the Board; he outlined the work that still had to be completed on this subdivision. Planning Director Callinan stated that he believes the bond which is presently being held is adequate, but he would like to recheck this with the Town Engineer. The Board had no problems with this, but informed Mr. King and Mr. Loughlin that they would like a work schedule submitted to them and that when they get confirmation from the tele- phone and gas companies, they should inform the Board as to when they will be working. Acting Chairperson Flynn stated that she feels it is very good that Mr. King came in to speak with the Board on this matter and she stated that Planning Director Callinan will get in touch with them regarding the matter of the bond. 6. Review the following subdivisions: "Maplewood Estates Phase II" Definitive Plan Leo Glover, land surveyor of this property, approached the Board with a set of revised plans for this subdivision. He stated that the Planning Director commented that the proposed street being located 110 feet away from Langley Drive is in violation of Section IV. A. 2a., the reason for the location of this street was based on the water already being placed for the proposed road prior to the construction of the two houses. He stated that the waiver request for the sloped granite was actually not necessary because according to the Subdivision Regulations, s--Iope-d granite is allowed. Richard Callinan, Planning Director, stated that the applicant must request a wiaver for the roadway and the sidewalks because as they appear on the subdivision plan, they do not con- form to the Subdivision Regulations. Mr. Glover stated that this was recom- mended in the Environmental Impact Statement, but the Planning Director would like the applicants to cite the particular section because he cannot locate it. Planner Genatossio stated that in the past, the Board has approved waivers for sidewalks and roadways because it was recommended by the Environmental Impact Statement. Mr. Glover stated that the legend was placed on the plans as re- quested, further details were provided for the drainage basin (on the last page of the drainage calculations) and the street has been given a name (Lewis Drive). Acting Clerk Annino had a question regading the slope of the driveways and asked Mr. Glover if it would be possible to bring these slopes down to at least five percent (5%). Mr. Glover stated that this will be done. Planning Director Callinan stated that the Town Engineer still must review this information. Acting Chairperson Flynn asked Mr. Glover if he was authorized to request an extension of the Board on this subdivision and Mr. Glover informed the Board that he was not, therefore, Acting Chairperson Flynn explained the entire situation of the deadline of February 12, 1986, and that the Board does not have enough informa- tion to approve this plan. She would like to know if Mr. Glover could contact the applicants of this plan by telephone and ask for authorization to request an Planning Board's Minutes February 5, 1986 Page 4 extension; Mr. Glover replied that the applicants of this subdivision cannot be reached at this time. The Board informed him that a lot of this information still must be-'-eviewed by the Town Engineer because it was just submitted this evening and they feel that they really have no other alternative but to deny the plan. Planner Genatossio stated that further technical information is needed re- garding the high water mark within the retention area, a gravel roadway to the retention area (not just to the oil/water separator) and the water table must be verified, there should also be a size on the drainage easement. Planning Di- rector Callinan stated that according to 81U of the Massachusetts General Laws, when the Planning Board denies a plan they must state the specific reasons for denial and if the applicant comes back and addresses all the concerns in that denial letter, the Board must then approve the plan. He stated that the problem that the Board has is that they do not know the conditions such as the pervious material and the earthen dam because no one has reviewed the revised plans. There was discussion at requesting the Town Engineer to review this plan and then meet- ing before February 12, 1986, in order to review the plan and make a decision on it, although there may be a problem with obtaining a quorum because the only mem- bers that can vote on this plan are Flynn, Genatossio, Annino and Boldrighini. The Board decided against meeting an additional night. Planner Annino stated that he believes the dimensions to the lot lines should be shown on the plan for the existing houses which are incorporated on the plan. The Board would still like the Town Engineer to review this plan and if the applicant complies to the plan as specified, the Planning Board can discuss it next week for possible re- consideration. Motion: To deny the definitive plan for "Maplewood Estates Phase II" due to the fact that more information is needed for the en- gineer; the Board would like the roadway to the retention area shown on the plan; the Board has a concern about the depth of the retention basin; the Board has a concern about Lot 30 con- forming to the minimum buildable area requirement; the Board believes there may be problems with the earthen dam and are concerned because this has not been reviewed by the Town En- gineer. The Board would like the high water mark within the retention area shown on the plan. It shall also be stated in the letter that the revised plan was just received from the applicants this evening. (Boldrighini - Genatossio - Annino - Flynn) (Fiore abstained as he was not present at the public hearing.) "Robyn Estates" Definitive Plan Acting Clerk Annino read the comments from the Town Engineer which stated that this subdivision conforms to the Subdivision Regulations specifically Section V., Subsection C. 9. The public had informed the Board at the hearing that there may be some historical significance to this site and, therefore, the Board had contacted the Historical Commission. no response has been re- ceived, but Andrew Barr, a former member of the Historical Commission, informed the Board that the houses which are on this property do have historical signif- icance. He does not know, hoever, if the tower which is on the property has any significant value. Michael Trowbridge, engineer, stated that if the tower does have value, the applicants will make provisions for it; he also stated that the applicants have no intention of removing the houses which are on the property be- cause they are very well -kept and they do have historical value. The Board had a big concern regarding the traffic because this was a major concern of the people present at the public hearing; the Police Chief also stated that this area of Franklin Street is a hazard and he feels if this subdivision is added, it will Planning Board's Minutes February 5, 1986 Page 5 make the problem worse since there are no sidewalks on Franklin Street for the people to walk on and the traffic flows at high speeds. Planning Director Callinan stats4d that this subdivision has adequate site distance, however, he feels that a sidewalk is needed in that area, but that is an issue that the Town will have to address. The Board discussed the possibility of waiving a sidewalk on one side of the road within the subdivision and having the applicant place that amount of sidewalk on Franklin Street to the corner of Maple Street to at least provide an area where the people can walk. Although it may be a little more expensive, the Board felt that they should ask the applicant to pro- vide this sidewalk on Franklin Street. Mr. Trowbridge stated that he will con- tact the applicant and approach them with this idea and then he will get back to the Board. He presented the Board with a request for an extension until February 14, 1986. Motion: To approve the request for an extension for the "Robyn Estates" Definitive Subdivision until February 14, 1986. (Boldrighini - Fiore - All in favor) *Acting Chairperson Flynn left the meeting at this time. Motion: To have Planner Fiore be Temporary Acting Clerk. (Genatossio - Annino - All in favor) 7. "Form A" plan - The Foxfield Corporation The applicant of this "Form A" plan is the Foxfield Corporation. This "Form A" plan consists of a parcel of land on the northerly side of West Street bounded northerly by Route 495; easterly by Rose; southerly by West Street and westerly by Khosatefeh. The reason this plan does not constitute a subdivision is be- cause the lots have sufficient area and frontage as per zoning. The checklist is complete. Motion: To sign the "Form A" plan for The Foxfield Corporation for West Street. (Fiore - Genatossio - All in favor) 8. Additional Correspondence The Planning Board received a letter from the Easton Planning and Zoning -Board regarding a workshop meeting that they would like to host regarding water re- sources, groundwater and groundwater protection. They would like this meeting to be held between March 18th and 29th. The Board will take up this matter next week at their meeting. The Planning Board received a memorandum from John Dunn stating that the next meeting of the 5 -year Planning Committee is scheduled for Thursday, February 13, 1986, at 7:30 P.M. The Planning Board must appoint someone from the Board to be on this committee; it was decided to appoint Acting Chairperson Annino to this committee. The Planning Board received a letter from Richard A. Gelerman, Gelerman & Cashman, regarding Foxboro Terminals. The Planning Board will take up this matter at their next meeting.
