Meeting opened at 7:03 pm. 2. Notice of Intent: Kevin Dumas, City of Attleboro - Water Department, Blake's Pond Dam at 250 Balcom Street, Map 3, Parcel 94. DEP SE 211-0968 Derek Schipper, GZA GeoEnvironmental, Inc., representing the City of Attleboro, outlined the proposed rehabilitation of the dam, which was constructed in 1957 and owned and maintained by the City of Attleboro, and is now in poor condition. The proposed work will be done within 100 feet of Inland Bank, Bordering Vegetated Wetland, Land Under Water, Bordering LSF and 200 -foot Riverfront Area. He said the elevation of the new spillway will match what is currently there. Mr. Schipper said another part of the project is the walking path on the right side of the property located off Balcom Street; the path will be widened for access to the dam by clearing brush to make a stone access pad with a gate to deter people from entering the site. Erosion controls will be installed. Mr. Healey asked about adding rip rap to the downstream side. Mr. Schipper said rip rap can be added. Mr. Maxwell asked Mr. Schipper to explain the process of building the second dam with the existing dam in place and operating. He asked if they would have to section off some of the areas so they will dry out or will the work be done in the water. Mr. Schipper explained they can drive the sheets to depth without any water control. Mr. Maxwell asked if the area where the concrete pad is located would need to be de - watered. Mr. Schipper said some localized water control will be needed when the concrete pad (stop log bay) is put in place. Mr. Hobaica asked if the concrete pad is cast in place or pre -cast. Mr. Schipper said it is cast in place. Ms. Gonyer said she reviewed the project with Richard Alves, Town Engineer, regarding the elevations and construction. She said more details of the rehabilitation process as well as a detailed sheet for the new stop log will need to be submitted. Mr. Schipper said he will keep Ms. Gonyer involved as the work is being done. Mr. Hobaica asked if GZA will be monitoring the process. Mr. Schipper said GZA is under contract to perform construction phase services; GZA will review submittals, there will be weekly site meetings and a monitor will be in the field full time. Mr. Schipper said the work will start at the end of summer, early fall, for a total of approximately two months. Mr. Maxwell asked if a Stormwater Pollution Plan (SWPPP) and NPDES (EPA's General Permit for Stormwater Discharges from Construction Sites) were needed. Mr. Schipper said this will be a publicly bid job and, if required, the contractor will apply for the SWPPP and NPDES permits. Mr. Maxwell asked that a copy of the SWPPP be sent to the Commission for review. 1 Mr. Roth asked when the path is widened will there just be cutting of brush or will a substrate be put down to maintain the path. Mr. Schipper said because they do not want to disturb the buffer zone and the path is for emergency purposes only, it will not be a gravel driveway. Ms. Gonyer was concerned about the walking and dirt bike trails and asked if some type of barrier could be installed in certain places to make people aware of these issues. She also said when widening certain areas, they need to make sure they don't go to close to the side of the river. Mr. Schipper said he will add this to the specs. Ms. Gonyer said because of the integrity of the dam, this is a necessary project; she will draft a detailed Order of Conditions. Mr. Maxwell asked about pollution from the sheet pilings. Mr. Schipper said the pilings would be made of the same material that is currently in place. Ms. Gonyer asked Mr. Healey to poll the Commission to make sure all outstanding issues and concerns have been addressed; Mr. Rieth, Mr, Roth, Mr. Hobaica, and Mr. Maxwell said they have no concerns. She will draft and pass the Order of Conditions along to GZA for review; once the draft is approved by GZA, it will be presented to the Commission for approval and the hearing will be closed out. Mr. Rieth made the motion to continue the hearing for Kevin Dumas, City of Attleboro —Water Department, Blake's Pond Dam at 250 Balcom Street, Map 3, Parcel 94, DEP SE 211-0968, to July 17, 2017. Mr. Hobaica seconded the motion. Motion passed 5-0-0. Hearing ended at 7:46 pm. Continued Hearings: 3. Abbreviated Notice of Resource Area Delineation: John Stanbrook, 265 Fruit Street — Fruit Street to Norton Town Line, Map 36, Parcel 15. Resource Area Delineation. DEP SE 211-0969 Ms. Gonyer is working with Norton Conservation Agent Jennifer Carlino to review the delineation. Matthew Shute, BETA Group, Inc., has requested a continuance to July 17'h in order to allow for adequate field review to be completed. Mr. Rieth made the motion to continue the hearing for the Abbreviated Notice of Resource Area Delineation for John Stanbrook, 265 Fruit Street — Fruit Street to Norton Town Line, Map 36, Parcel 15, DEP SE 211-0969. Mr. Hobaica seconded the motion. Motion passed 5-0-0. Hearing ended at 7:50 pm. 4. Abbreviated Notice of Resource Area Delineation: Stanley Feck, 177 Old Elm Street, Map 6, Parcel 35. Resource Area Delineation. DEP SE 211-0965 Ms. Gonyer explained the Commission saw this application last fall. She visited the site to review the flags but found it difficult to discern what was upland and what was wet. At that time her recommendation was to continue the hearing until spring 2017 so she could use the vegetation and hydrology to get a better understanding of the wetland delineation. In May 2017 she walked the entire line with Nicole Hayes, Goddard Consulting, and adjustments were made to the flagging; Ms. Gonyer agreed with the delineation as shown on the revised plan dated May 23, 2017. Ms. Gonyer noted this land is under Chapter 61 Forestry Land and the land was selectively harvested 1-2 years ago; she said the land is rebounding. Mr. Maxwell asked about Chapter 61. Ms. Gonyer said a forestry plan is submitted with a general permit and the site is logged. Mr. Rieth said under Chapter 61 the land is taxed at a different rate but if the land is not forested in a certain time frame, it comes under a different tax rate and the land can possibly be developed. Mr. Rieth said with Chapter 61, you have to harvest the land periodically to maintain the area. Ms. Hayes reviewed the delineation; the Plan of Record, dated May 23, 2017, shows all the field changes. Ms. Hayes said the abutters were re -notified and if there is any work within jurisdictional areas or buffer zones, the Applicant will come back with a Notice of Intent. Ms. Gonyer said if the Commission is satisfied with the methodology and the plan, she would recommend the Order of Resource Area Delineation be issued for 177 Old Elm Street. Ms. Hayes said if there is any proposed work or construction near or in the wetlands that would impact a resource area, they will do a very detailed analysis. Mr. Rieth made the motion to issue an Order of Resource Area Delineation to Stanley Feck, 177 Old Elm Street, Map 6, Parcel 35, DEP SE 211-0965. Mr. Maxwell seconded the motion. Motion passed 5-0-0. Hearing ended at 8:00 pm. 5. Correspondence: 6. New Business: Administrative Review Fee: Ms. Gonyer said Administrative Reviews (AR) were started two years ago and have been very successful procedures, eliminating some of the need for Request for Determination of Applicability (RDA) filings. She said the Commission might want to require a fee for an AR because there is a site review and field work involved. She noted the fee for an RDA for a single-family lot is $100.00. She suggested $50 - $75.00. Ms. Gonyer said the Administrative Review can be used for previously developed single family lots for any new structure less than 200 square feet and located over 50 feet from a resource area; an above -ground pool less than 26' in diameter; tree and vegetation removal; and repairing existing decks with the installation of new footings. She explained the procedure for Administrative Reviews; the Applicant would submit the paperwork with a fee and she would review the request; once the work is completed, the Applicant would contact Ms. Gonyer and she would follow up with pictures and close out the Administrative Review request. E Ms. Gonyer said she would ask the Commission to ratify all Administrative Reviews monthly and any fees collected would go into the town's general fund. Mr. Maxwell suggested a $100.00 fee. Mr. Healey said the intention of the Administrative Review is to stream line the process but still maintain some control. Ms. Gonyer said for an RDA filing the homeowner would submit the application with a $100.00 fee and would pay for the advertisement, but with the AR an advertisement would not be necessary because the activities would be covered under "exempt minor activities" so it would not need to be posted as a formal hearing. Mr. Hobaica suggested the fee be $75.00. Mr. Hobaica made the motion to set the fees for the Administrative Review process for "minor activities" at $75.00. Mr. Roth seconded the motion. Motion passed 5-0-0. 7. Old Business: Update of town -wide active projects: 1. Wood Avenue (Terminus of Wood Avenue), SE 211-0921: The limit of work was moved. Ms. Gonyer met on site with the contractor and the wetland scientist. The 633 square -foot area will be replanted; the area still has not been re -seeded so Ms. Gonyer asked that additional erosion controls be added to stabilize the area as soon as possible. She said she will meet with the wetland scientist at the end of summer to review the plantings for restoration of the area. She noted the stormwater management in the back is doing fine and the site has been cleaned up. 2. 8 Jewell Street, SE 211-0951: Ms. Gonyer went out to the site today — a shed has been added. She will revisit the site. 3. 140 Williams Street, SE 211-0952: Ms. Gonyer reported the wall around the driveway has been installed; the elevation of the garage slab was elevated five feet, creating the need for the wall. She said the site is in good shape. The patio under the proposed deck is now gravel. She will look at all the square-footages. She said an as -built as not been submitted so there has been no final review. The septic area has been opened for approximately seven months and silt has settled into the bottom of the hole but this is out of Conservation jurisdiction. Board of Health Agent Amy Donovan -Palmer is aware of the situation and is having the owner remove the silt. Ms. Gonyer said she will work with the owner to get the back of the site stabilized, finish the final grading and get an as -built plan. 4. Rtes. 140/106: Ms. Gonyer has concerns with this site because a chain link fence was installed at the 25 -foot line but trash is collecting in the space between the fence and a wall; Ms. Gonyer said something needs to be done to prevent the trash from accumulating in this area. The area in the back was to be left to naturalize but the drainage was never correctly hooked up so now there is scouring; this area is now overgrown with knot weed and other invasive species, which now need to be removed, but will be left alone until there is a plan for the restoration of the area. The owner can do additional mitigation and if necessary, they can be brought back before the Commission. Ms. Gonyer said there is an active Order of Conditions. 4 5. 41 Lakeview Avenue, SE 211-0954: Ms. Gonyer said there have been some minor changes to the patio and walkway areas. The property is now being landscaped. 8. Adjournment: Motion to adjourn at 8:23 pm (Hobaica/Rieth) Passed 5-0. Next meeting will be July 24, 2017. L k S Michael Healey, Chairman /-Z i% Date
