Meeting opened at 7:09 pm. 2. New Business: Eagle Scout Project Sweets Pond Area: Nicholas DeLucia, a Life Scout with Troop 51 Mansfield is proposing the cleanup and addition of trail markers on the Red Line Trail for the Sweets Conservation Area on Otis Street. He said he has secured fund raising dates of June 101h and 111h at Stop and Stop, where he will be selling Hilliards chocolates to raise $400.00 for the project; he said the work will be done in July and August. Ms. Gonyer complimented Mr. DeLucia for a very thorough application and presentation. Mr. Roth volunteered to help Mr. DeLucia with the project. Mr. Roth asked about hunting in this area. Ms. Gonyer said the Commission revoked hunting on the Sweets pond Area in 2016. 3. Vernal Pool Certification–Sarah Meadows, Conservation Department Intern: Ms. Meadows has been working with Ms. Gonyer and Norton's Conservation Agent Jennifer Carlino to develop a Vernal Pool Certification Program. 4. Request to Extend Order of Conditions: Town of Mansfield, Fruit Street, DEP SE 211-0912. Ms. Gonyer explained the Order of Conditions was issued on November 20, 2013 for this 3.4 -acre property that was taken by the Town as a Tax Foreclosure in 2013, She said the Town has a permit for a single-family dwelling and the Order, which is about to lapse, needs to be extended; the Order will be extended for an additional three years. Mr. Rieth made the motion to extend the Order of Conditions for the Town of Mansfield, Fruit Street, DEP SE 211-0912 for three years, to expire in November 20, 2019. Mr. Marcheselli seconded the motion. Motion passed 6-0-0. Hearing ended at 7:33 pm. 5. Request for Determination of Applicability: Sarah Woodhouse, 31 Lakeview Avenue, Map 4, Parcel 61 & 62. The RDA was filed to flush cut 10-12 mature trees for safety purposes and install a fence within 100 feet of Inland Bank of Greenwood Lake. Ms. Gonyer met on site with the owner in March after Ms. Woodhouse hired a tree company to come out and assess the trees on her property; the tree company informed Ms. Woodhouse the trees had structural defects, should be considered hazardous and needed to be removed; an invoice was submitted for the ra removal of 10-12 trees on the property. Because a hearing was not held in April and Ms. Gonyer did not want Ms. Woodhouse to wait for the May hearing for approval to remove the trees, she discussed the situation with Chairman Mr. Healey to allow Ms. Gonyer to oversee the removal of the trees as long as Ms. Woodhouse filed an after the fact RDA and she understood she would be required to plant native trees at a 2:1 mitigation with a mix of deciduous trees and a shrub layer for diversity. Mr. Healey suggested Ms. Gonyer work with the applicant to decide the location and the plant species to be planted; he would like to see plantings that would offer shade or habitat at the edge of the lake. Ms. Gonyer said as part of this filing the Applicant would like to install a fence; because there is no wildlife corridor located on the property, Ms. Gonyer does not see any issues with the fence. Ms. Gonyer will review the fence design and location prior to the fence installation. Mr. Hobaica made the motion to issue a Negative Determination for reason #3, work will not alter Resource Area, to Sarah Woodhouse, 31 Lakeview Avenue, Map 4, Parcel 61 & 62, to flush cut 10-12 mature trees for safety purposes and to install a fence within 100 feet of Inland Bank of Greenwood Lake, with the following Special Conditions • The Agent is to review the list of potential trees to be planted (approximately 20 tree saplings and large herbaceous shrub is recommended); • Plantings shall be installed no later than the fall of 2017; • The Agent is to review the planted trees in the Spring of 2018 to ensure their viability; • The proposed fence design and precise location must be determined before the fence is installed; the fence location must be approved by the Agent. Mr. Roth seconded the motion. Motion passed 6-0-0. Hearing ended at 7:47 pm. 5. Abbreviated Notice of Resource Area Delineation: John Stanbrook, (Acting Town Manager) 265 Fruit Street- Fruit Street to Norton Town Line, Map 36, Parcel 15. DEP SE 211-0969 Ms. Gonyer explained this is an ANRAD for a project to extend the Norton/Mansfield Rail Trail; Ms. Gonyer said most of the delineation is within Norton and the filing is to review the resource areas and delineation only. Matt Shute, PE, Beta Group, Inc., said he is requesting, on behalf of the Town of Mansfield, confirmation of the delineation of resource areas within the abandoned railroad right-of-way, beginning at Fruit Street and proceeding approximately 2,900 feet to the Mansfield/Norton Town Line, resulting in a four -mile extension of the Mansfield World War II Veterans Trail from Fruit Street, northerly up to Crane Street in Norton. Lenore White, PWS with Wetland Strategies, Inc., summarized the delineation of the resource areas. She noted this is just an application to confirm the boundaries; she said at some point Beta Group will be back before the Commission with the actual design and plan for the continuation of the bike path. Ms. Gonyer said she has questions about the delineation but at this point there is no scope of work, just the delineation. She said there should be further investigation of the potential vernal pools and she would like to revisit the site, either independently or with Ms. White. She asked that a plan be submitted which shows 3 more clearly the resource areas, making sure no work is within the 25 -foot areas and the right performance standard is met. She recommended the hearing be continued. Mr. Rieth made the motion to continue the ANRAD hearing for John Stanbrook, 265 Fruit Street— Fruit Street to the Norton Town Line, Map 36, Parcel 15, to June 19, 2017, DEP SE 211-0969. Mr. Smith seconded the motion. Motion passed 6-0-0. Hearing ended at 8:14 pm 6. Notice of Intent: Hugh Boyd (International Brotherhood of Electrical Workers 104), 900 South Main Street, Map 16, Parcel 13. DEP SE 211-0967 The Notice of Intent was filed for grading and parking associated with a commercial office building within 100 feet of Bordering Vegetated Wetland Resource Area and Land Under Water Bodies, Norton Reservoir. Ms, Gonyer explained she walked the site in 2015 with the Land Surveyor and advised that a wetland scientist flag the site. Ms. Gonyer said the delineation was completed and she agreed with most of the flagging. She noted the resource areas are Inland Bank of Norton Reservoir and associated Bordering Vegetated Wetland and a portion of the delineation is located in Norton. She contacted Jennifer Carlino, the Norton Conservation Agent, who said she would defer to the Mansfield Commission since no work is proposed in Norton. Ms. Gonyer said currently there is an existing single-family house and horse enclosure on site. Michael Trowbridge, Hutchins -Trowbridge Associates, Inc., said the Applicant is proposing a commercial building with a parking area and stormwater management system on this site. He said the original proposal for the building has been downsized and the building will be on town sewer, gas and water. Mr. Trowbridge said this is a large site and a good portion of the property between the Norton Reservoir and the building will remain untouched. He said there will be some tree cutting on the site. Ms. Gonyer said Richard Alves, Town Engineer, has review and commented on the application (memos dated May 10, and June 6, 2017); there are no big issues, calculations are fine and the Order will be held until all Mr. Alves' comments are addressed. Mr. Hobaica asked how large the parcel was. Mr. Trowbridge said it is a 2.25 acre parcel with a 5,000 square - foot building. Mr. Trowbridge said there would be 100 -foot strip of land, which will not be cleared, between the building and the resource area. Ms. Gonyer said any work to be done between the limit of work and the resource area would require the Applicant to come back before the Commission. Mr. Healey asked if Mr. Alves had any comments on the Operation and Maintenance of the drainage system. Ms. Gonyer said any comments on the wetland line and stormwater application were addressed in a meeting with Mr. Trowbridge and Mr. Alves. Mr. Trowbridge said the Applicant will be going before the Planning Board for a special permit. Ms. Gonyer asked if the area between the back of the parking area would be mowed or left in a natural state. Mr. Trowbridge said the area would continue to be maintained as previously done. Mr. Gonyer said there is evidence of grass clippings being dumped by the former owner and this should be addressed with a special condition. Mr. Hobaica made the motion to issue an Order of Conditions to Hugh Boyd (International Brotherhood of 2 Electrical Workers 104), 900 South Main Street, Map 16, Parcel 13, DEP SE 211-0967 for grading and parking associated with a commercial office building within 100 feet of Bordering Vegetated Wetland Resource Area and Land Under Water Bodies, Norton Reservoir in accordance with "Site Plan International Brotherhood of Electrical Workers Local 104 Bldg.
