Eagle Scout Joseph Cavanaugh had presented a project to clear a nature trail from the Mansfield Public Library/
Council on Aging to Memorial Park. With the help of scouts and volunteers, Mr. Cavanaugh started the project on
August 8, 2016 and completed the work on October 5, 2016.
Ms. Gonyer said the trail comes out beyond the access drive for deliveries to the library and there are safety
concerns in this location. She asked the Commission to make a motion to issue funds for signage to alert people
to the pedestrian trail.
Mr. Rieth made the motion to allocate funds to add signage to the pedestrian walkway at the Mansfield Public
Library, funds not to exceed $300.00. Mr. Hobaica seconded the motion. Motion passed 4-0-0.
Hearing ended at 7:11 pm.
3. Request for Determination of Applicability: William & Janice Walsh, 1781 West Street, Map 2, Parcel 362.
Property owner William Walsh was present.
Ms. Gonyer explained this application is for a septic system upgrade to replace the existing cesspool with a new
tank and pump chamber within 100 feet of the Inland Bank of Greenwood Lake. The limit of work is shown on the
plan. She recommended the typical Special Conditions be added to the Determination: siltation control,
disturbed areas to be seeded as soon as possible and Agent to be notified when project is completed and lawn
has been seeded.
Ms. Gonyer asked when the work would be done. Mr. Walsh said the work will be done in December. Ms.
Gonyer asked Mr. Walsh to make sure to protect the area from erosion if the disturbed areas are not able to be
seeded right away.

otice of Intent: James Lazzara, 130 Spring Street, Map 28, Parcels 164 & 165. DEP SE 211-0964
This filing is for the construction of a 12 -unit Residential Building for an over -55 community with associated
driveway, parking, drainage, water, sewer and utilities within 100 feet of Bordering Vegetated Wetland and 200 -
foot Riverfront Area of the Rumford River.
William Buckley, Jr., Bay Colony Group, Inc., representing Grove Building Realty Trust, and Lauren Gluck, P.W. S.,
Pare Corporation, Senior Environmental Scientist, were present.
Mr. Buckley presented the project for a 12 -unit, over -55 community with associated driveway, parking, drainage
and utilities and discussed the infiltration system needed for the driveway. He explained the two parcels of land
with 11.4+ acres are located on the south side of Spring Street. He said the site contains multiple resource areas;
Riverfront Area, Bordering Vegetated Wetlands, an Isolated fresh water wetland, and Bordering Land Subject to
Flooding. He said the area is heavily disturbed with very little top soil and vegetation.
Mr. Buckley discussed the access issues for the parcel, the design of the driveway and the Stormwater
Management system. He said the site would be served by municipal sewer and water, to be located within the
driveway. Erosion Control, which will be 12" diameter mulch silt socks, will be placed around the portions of the
site within 100 feet of wetlands to prevent siltation from entering any resource areas.
Mr. Buckley said he will meet with Richard Alves, Town Engineer, to discuss the Flood Zone delineation and
'elevations. Heasked if there was additional information needed regarding the project and if the Commission
would like to do;a site walk. The Commission asked for more information on the proposed wall and driveway, the
limit of work on the south side of the property and grade stakes for the parking area.
IvvlS. Gluck discussed the existing, conditions of the site and the impact areas within the 25 -foot No Disturb Zone
and the Buffer Zone, as well as the restoration of the proposed site.
2
Mr. Maxwell noted the discrepancy in the application; the two lots combined do not total 11.4 acres. He said the
plan shows the total to be closer to 8 acres and it appears a parcel of land on the other side of the Rumford River
was included in the total acreage. Mr. Buckley said Bay Colony did not do the survey of the land. He will have the
correct acreage for the two parcels at the next meeting.
Mr. Maxwell said in the Alternative Analysis it was noted there were no other comparable properties in Mansfield
to use for the project. He said one of the things to consider would be to reposition the building, driveway and
parking closer to the abutters, putting everything farther away from the resource areas. Mr. Maxwell asked if the
building would have basements and if there are setback requirements for driveways, parking and buildings. Mr.
Buckley said the building would be on a slab and there are buffer zones for this type of project as well as
landscape requirements for parking when you are adjacent to a residential area.
Mr. Maxwell noted the applicant is providing 2.4 parking spaces per unit, where 2 spaces are required. He asked
if the parking could be reduced to the required 2 spaces per unit, which would lessen the disturbance in the
resource area.
Ms. Gonyer said she will meet with Mr. Buckley and Mr. Alves to discuss the stormwater management and
suggested scheduling a site visit for the Commission.
Mr. Buckley will walk the site with the Commission and submit the following information for the next meeting:
A revised plan showing the layout for the walls, the limit of work on the south side corner of the parking
lot and the building and grade stakes
Plan will show limit of work, even in areas where there will be no hay bales; construction fencing will be
installed in these areas
A landscaping plan with substantial plantings to include woody shrubs, not just a seed mix, especially in
areas south of the building
• Include the correct acreage

Replace/repair existing concrete foundation, install new foundation as needed and associated grading on existing
house within 100 feet of the Inland Bank of Greenwood Lake.
Ms. Gonyer said this is a follow up to a hearing that was.a request from homeowner Kevin Boyden to repair his
foundation by accessing his neighbor's property at 41 Lakeview Avenue, where Ronald and Susan Quintiliani have
an open Order of Conditions to remove the existing house and construct a new house and garage.
Mr. Boyden had been working with Mr. Quintiliani to draft an arrangement and agree to utilize their property for
access to the side of his dwelling, which is in need of a foundation repair. The hearing was opened two hearings
ago and the Commission had requested additional information, including a narrative, a limit of work, specifically
the limit of machinery to be used on the Quintiliani's property; the Commission has received this information
along with the signed agreement; a plan has been submitted showing the drainage.
Because the Applicant or a Representative was not present at tonight's hearing, Ms. Gonyer recommended the
hearing be continued to November 21, 2016.
Mr. Quintiliani said other properties on the lake have been mandated to add drywells to prevent runoff into the
lake and now that the hearing will be continued he would like to see a drywell added to the plan to prevent any
runoff onto his property and into the lake.
Mr. Quintiliani said the private agreement with Mr. Boyden has a deadline of November 30, 2016.
Mr Rieth made the motion to continue the hearing for Kevin Boyden, 37 Lakeview Avenue, Map 4, Parcel 54, to
ndation, install new foundation as needed and associated grading on existing
replace/repair existing concrete fou
house within 100 feet of the Inland Bank of Greenwood Lake, DEP SE 211-0962, to November 21, 2016. Mr..
Hobaica seconded the motion. Motion passed 4-0-0.

of Conditions: Hemze Sengaba, 140 Williams,Street, Map 6i Parcel 101. Request to
I for the construction of a new single-family dwelling with landscaping within 100 feet
atland, DEP SE 211-0952.
Hemze aril Homan Sengaba were present.
Ms Conyers "d at the September meeting Hemze and Homan Sengaba discussed a field change to the site, They
explained the'slab rt egarage had been poured approximately 4 feet higher than what was approved; the site
was suryeyed;by the engineer and an As -Built plan has been submitted with the changes. Ms. Gonyer noted this
Was a significant change. She said the driveway was to remain at grade with drainage to flow from the street; the
driveway is nbw elevated because of the higher slab. Because of the changes, the Commission requested that the
Applicant fileian Amended Order so abutters could be notified. After the September hearing, Ms. Gonyer said she
went out to the site, and in addition to the slab elevation, she observed some issues with regrading in the back of
the property; on the original plan there were no proposed contours shown. She said there were concerns about
the proposed drywells; she said the pits had been excavated too deep considering where the groundwater is. She
spoke with Mr. Mr. Sengaba on site, explaining the drywells were to be no deeper than 3.5 feet. She said the pits
have now been backfilled with gravel. Ms. Gonyer issued a stop work order because of the changes and regrading;
once the work was stopped she asked RIM Engineering to do detailed spot elevations. Since the stop work order
was issued she has been working with RIM Engineering and Mr. Sengaba and, because the driveway is now an
elevated structure opposed to being on grade, she asked that the driveway be pulled in toward the house so they
can safely back out of the driveway. Ms. Gonyer noted this is a very disturbed site that was used as a landfill.
By choice, Mr. Sengaba has included a catch basin at the top of the driveway to catch any water and make sure
the wall itself is draining out to a drywell. A french drain will be installed at the street end of the driveway,
drainage to be captured to a swale running parallel to the elevated driveway to a 4 -foot trench that will be
discharge to a drywell.
Mr. Sengaba will relocate the shed and decrease the landscaping at the left rear side of the property; Mr. Sengaba
has offered to add more trees to make a more natural delineated line in the back on the right side of the property.
Mr. Sengaba said the roof and foundation drywells are already in place and are shown on the revised plan dated
October 4, 2016 and he will likely eliminate the second drywell.
The Commission discussed the changes to the site not approved under the Order of Conditions and what can and
should be done to correct the unapproved changes.
Mr. Hobaica said going forward there should be some controls in place; whether the changes were intentional or
not, there have been so many liberties taken on this site.
Ms. Gonyer, asked if Mr. Sengaba still planned to use pavers for the patio. Mr. Sengaba said no he will use crushed
stone.
Mr. Turnbull said he had issues with the amount of fill brought in to the site, more then was permitted, but at this
point it would not be worth the disturbance to remove the fill. He said he does not see how it would be
l advantageous to build the wall.

Ms ,Gonyer discussed the slate pile and said a more detailed plan for the removal should be submitted. She
suggested gnother type of barrier, such as a permanent split rail fence, not just plants, to delineate the 35-foot
hmlt'of work. She said the area on the right side of the property where there are piles of wood, car parts, stumps,
etc.; is to be left to naturalize. The debris is outside the wetland and the limit of work: She said part of the Order
wds Yq clean
Up-It hedebris and reseed this area and if it is biological/organic material she recommended it be left
as is She sa'Id the Applicant would need conservation approval before any machinery can be used in this area
and 5he'wilI meet on site with the Applicant to discuss the removal of the slate and approve how and what is to
beronioved.
Mr. Turnbull asked if Richard Alves, Town Engineer, had any comments concerning the Swale. Ms. Gonyer said
she was on site with Mr. Alves when the original discrepancy was brought to her attention, but Mr. Alves has not
seen the proposed design of the Swale; she will discuss the drainage plan with Mr. Alves.
Mr. Turnbull was concerned with the proposed french drain because they tend to clog. Ms. Gonyer said an 0 & M
Plan should be considered.
Mr. Hobaica asked if the Building Inspector had seen the wall design. Mr. Sengaba said a building permit will be
required because the wall is over 4 feet in one section.
Mr. Maxwell said he would prefer a grass swale instead of a stone swale.
Ms. Gonyer said an Amended Order can be issued, allowing the work to proceed. Mr. Maxwell said a new plan
should be submitted before the Applicant is allowed to move forward and suggested the hearing be continued.
The following should be included on the revised plan:
• Split rail fence
• More wall details (specs for building permit)
• _ Removing drywell (#2) and piping of drywell (#1)
• Details of what will go in for the RDF
• Add detail of hooded catch basin for driveway
• Add the proposed contours where grade meets foundation
• Top elevations
• Proposed playa rea information
• The front left area will be left to naturalize
• Define the patio area
f • Other than the mulch bed along the swale and behind the shed, but inside limit of work, will be lawn;
mark limit of lawn versus the limit of natural.
• Proposed stone wall along public way

Mr. 11 Flobaica made the motion to continue the hearing for Hemze Sengaba, 140 Williams Street, Map 6, Parcel
101, DEP SE 211 0052, with the conditio11 n the Commission will partially release the stop work order to allow the
Applicant to pour the footings for the deck and the shed (footprint of shed is not to change), with the new
location of the shed called out on the new Plan of Record, and to partially backfill the left rear corner of the frost
wall/foundation.
Mr. Rieth seconded the motion. Motion passed 4-0-0.
Hearing ended at 10:00 pm.

• Update of Enforcement Order — 300 West Street
Ms. Gonyer said she met on site with the landscaper hired to remove the stone placed within the 100 -foot Buffer
and stake out where the stone could be removed by small machinery and the areas that would require removal by
hand. She said the work was supposed to start October 1, 2016 but this landscaper is no longer going to do the
work because the homeowner has hired another landscaper. She said there are actions to take with the
Enforcement Order such as a $50.00 fine per day until the work is started. Mr. Maxwell said the fine should be
until the work is completed.
Ms. Gonyer will notify the homeowners on Monday, October 24, 2016, that there will be a fine of $50.00 per day
until they have complied with the terms of the Enforcement Order.
Mr. Maxwell made the motion to enforce fines as of October 24, 2016 for non-compliance of work under the
