Town of Mansfield
Board of Selectmen
Minutes of June 13, 2007
Present:
Louis Amoruso Chairman, Vice Chairman Sandra Levine, Clerk Ann Baldwin
Selectman George Dentino, Selectman David McCarter
John D'Agostino, Town Manager
The Board of Selectmen's meeting was called to order at 7:30pm, followed by the Pledge
of Allegiance.
. Upcoming coffee hour at COA
· Recap of meeting with Pinnacle Partners reps and Attorney.
· Update on Stearns Ave landfill from Attorney Roberts.
· BOS Meeting with Attorney Roberts and reps from Hercules will be scheduled soon.
· Update on discussion of Hathaway Patterson reuse with the Town of Foxboro.
Foxboro wants to cap and pave the area in their town for commuter parking to the
train station. This would take parking pressure off of the train station lots in
addition to aiding in the clean up of the Hathaway Patterson superfund site.
Jim Lazzara, Jack Goldberg and Jess Aptowitz of the Finance Committee were
present. Mr. Lazzara gave a brief presentation regarding their goals and objectives
for the FY08 year. The critical challenges and recommendations are:
. Salaries and benefits.
. Union contracts negotiations
. Consolidations
· Reserves goal, 5'10 of budget
· Capital projects plan
While the Board agrees with all of these objectives it may be difficult to achieve
some of these goals with a limited budget. Even so, the Board is appreciative that
the FinComm has prepared this list for them so they can work towards these goals
throughout the year. Chairman Amoruso suggests that sub committees are formed
with the school dept. personnel, FinComm members, the Town Manager and
members of the Board to work on these issues throughout the year. Chairman
Amoruso will send a letter to the School Committee.
Board of Selectmen Minutes of June 13, 2007
Bill Clemmey from 875 S. Main St. Trust. They would like to expand the parking spaces
that they can utilize by 100 spaces. When there is a sell out concert at the Tweeter
Center there is a need for more parking. They anticipate that they would use this
additional parking area a few times a year for overflow during sellout events.
Chief O'Neil sent a letter to the Board in opposition to the expansion of this lots capacity.
The area is already congested to the point where it has become a serious public safety
problem and requests that the Board deny the application for 100 more parking spaces.
Mr. Clemmey stated that while he appreciates the efforts of the Police Dept.
The congestion in the area will not really be affected by the few concerts that they would
utilize the extra spaces for. The construction on the bridge could last for years and the
traffic will not increase because there are a few extra spaces available.
Mr. McCarter stated that the Police Chief has sent a very strongly worded letter to the
Board in opposition of any new parking in the area regardless of the parking lot.
Selectman Levine and Baldwin stated that the bridge construction and traffic problems in
the area are affecting public safety and they would not recommend expanding parking at
this time. Perhaps after the bridge work Mr. Clemmey should come back to the Board.
Selectman Dentino stated that the traffic will come regardless of the spaces available and
if more spaces are available in a satellite lot it will help ease the congestion out of the
main Tweeter Center lots. Lt. Seekell stated that Mr. Clemmey's lot is not policed as
heavily as the Tweeter Center lots so sometimes it draws "problem patrons." The police
presence is greater at the Tweeter Center and a command center is set up there to
process patrons that are detained for various reasons. Mr. Clemmey respectfully disputes
this claim and states that their personnel patrol their lot quite frequently and have not
had any arrests this year.
Motion: To deny the additional 100 parking spaces at the Clemmey lot due to public safety
issues. (Levine/Baldwin) 5:0 passes
Attorney Edward Valanzola, Pinnacle Partners Rep. Ted Hopkin and Town Engineer John
Sullivan were present for this discussion.
Mr. D'Agostino stated that he and Mr. Sullivan have met with Pinnacle Partners several
times in the recent past and believes that they have come to an agreement that is
currently being reviewed by town counsel.

Town Engineer John Sullivan has prepared a letter detailing the proposed offer for sewer
connection at 321-339 School St. The basic items are that the sewer connection will be
into sewer manhole SMH 3-3. From there, an 8" lateral will also be provided to the
northern edge of the R.O.W for future tie in of a parcel on that side and a 24" diameter
stub will be provided and capped, for the future sewer extension. Pinnacle will provide
$100,000 for the above construction. The Town will provide an article for the Fall Town
Meeting to abandon Old School Street, while maintaining a 30 foot wide sewer easement.
The Town will also obtain an appraisal of the R.O.W, while maintaining a sewer easement,
and work with the affected parties to also obtain that appraisal value, for the purpose of
continuing the sewer line per the Sewer Master Plan.
Mr. Sullivan recommends that the Selectmen vote to allow Pinnacle to connect into the
proposed sewer manhole, SMH 3-3, which is to be installed approx. 130 feet from the end
of the pipe being installed by Mansfield Crossings. He also recommends acceptance of
Pinnacle's offer of $100,000 for its construction, contingent on completion of a mutually
acceptable written agreement.
Selectman Dentino has questions on the width of the easement on Old School St.
The sewer easement is 30 feet wide and does not seem adequate to Selectman Dentino.
If the project overruns the $100,000 budget proposal the extra amount would come out
of the sewer enterprise account. One of the advantages of closing off Old School St. is
routing traffic from the mall more efficiently.
Given the current agreement under review Mr. Sullivan stated that the pressing question
right now is "Can Pinnacle Partners tie into the sewer line when it is installed?"
Mr. D'Agostino stated that if this agreement and tie in are not approved; it will cost the
town and the rate payers significantly more to install the sewer line at a future date and
repair the temporary pump houses that are currently failing.
The Board does not have any more questions on this issue and thanks staff and Pinnacle
Partners for all their work.
Motion: To allow Pinnacle to connect into propos~d sewer manhole, SNH 3-3, which is to
be installed approximately 130 feet from the end of the pipe being installed by Mansfield
Crossing, in accordance with the Town's Sewer Master Plan. Also to accept Pinnacle's
offer of $100,000 for its construction, contingent on completion of a mutually acceptable
written agreement. (Levine/Baldwin) 4:1 passes
