Conservation Commission Meeting
November 13, 2006
06 NOV 29 PH 5: 32
Present: Colin Cauldwell, Chair; Paul Boyden, Vice Chair; Carole ~lthiril flD
Monachino; Cindy Ostrowski; Jack Smith; Jerry St. Hilaire; Michele MWi~~CHUSETTS
Conservation and Environmental Planner.
Eagle Scout Dan Dalton wants to build a footbridge over a brook in the Great Woods
Conservation area on the White Trail. Colin asked when the project needed to be
completed. Dan will be helped by other scouts and would have 11/2 years to complete.
The framing will be done with pressure treated lumber with plastic decking on patio
blocks. Dan has a price list from National Lumber; they do not give donations but will
give Dan a discount. Colin thinks Dan should search out other places such as Home
Depot and Cape Cod Lumber for donations.
Another scout wants to complete the trail. This part of the trail would involve NRT land.
r
Cindy was concerned about the chemicals from the pressure treated lumber leaching into
the wetlands. She wondered if cedar would be a better wood to use for the framing.
Colin told her structurally cedar and non-treated lumber are not a good idea-it will not
last as long as the pressure treated lumber. He told her pressure treated lumber is no
longer treated with Arsenic but is treated with Chlorine. He and Michele said the
Audubon Society uses pressure treated lumber.
Cindy: With the patio blocks, the pressure treated lumber will not be in the water.
Colin: The water levels in the stream fluctuate so at times the frame will be in the water.
Dan told the Commission he would make all the wood cuts in his yard so there will be no
residue from the lumber.
Michele will send Dan a letter giving Conservation approval for the project.
Dan will transport all materials needed to the site by ATV. Since motorized vehicles are
not allowed on Conservation land, the Commission asked that Dan call Michele to let her
know when he would be transporting materials to the site.
Paul would like pictures taken at the start of the project and when it is finished. He
would also like Michele to include in the letter to Dan the information about transporting
the materials to the site.

When the bridge is completed and the other scout completes the other end of the trail,
Colin would like to have a dedication ceremony and name the trail after Harry Chase,
who was a scoutmaster for many years.
Paul made the motion to accept Dan's proposal for a footbridge to be constructed in the
Great Woods Conservation area on the White Trail. Michele will send a letter to Dan
Dalton giving Conservation approval of the project. Dan will also let Michele know
when the materials are to be transported to the site.
Jerry seconded.
Passed 5-0.
Janice McIntoch, the project manager was present. Janice explained the Notice of Intent
was filed for the removal of approximately 8,900 sq. ft. of contaminated soil fill on
residential property belonging to Thomas and Dawn Ryan of 15 Dane Street and on Sasol
property on North Main Street.
She explained 600 tons of contaminated soil was removed and then exploratory
samplings were taken on the Ryan property. More contamination was found and an
additional 500 tons of soil was removed. After more samplings were taken, an additional
300 tons was removed. Samplings then showed no contamination.
r
Janice told the Commission the area was then backfilled and 8 to 12 trees and bushes
were replanted.
Michele performed a site walk on November 6, 2006. Michele said the replanting was
nicely done and the area has been re-established.
Colin asked if the Ryans were satisfied with the work. Janice said they were pleased with
the work that was done and the replanting.
Colin wanted to know where the contaminated soil was taken. Janice said the soil was
shipped to Turn Key, a landfill.
Carole made the motion to accept the completion of the project for the removal of
contaminated soil from 15 Dane and 751 North Main Streets, #211-0760, and to issue a
Certificate of Compliance.
Paul seconded.

Michael explained the Goyeas purchased this property recently from the Oldhams who
carne before the Commission for a septic repair in November of 2005.
The Notice of Intent was filed for the construction ofa 16x14.5 ft. addition. The distance
between the closest project disturbance and the associated resource area, Greenwood
Lake, is 25 ft.
Michele performed a site walk and she recommends a hay bale line be established along
the 25 ft. line. No work will be allowed in the 25 ft. no-touch zone. A silt fence with hay
bales will be established along the no work area.
Carole made the motion to accept the plan, dated October 17,2006, as drawn, for an
addition at 260 Plain Street, with hay bales along the 25 ft. line and silt fencing with hay
bales along the no work area and to issue an Order of Conditions.
Paul seconded.
Passed 5-0.
Dave Tammaro of Dave Tammaro Contracting was present, representing Luigi and Lisa
Monaco.
('
The Notice ofIntent was filed for a 24x24 ft. family room to an existing dwelling within
the boundaries of an Estimated Habitat.
Michele told the Commission the addition does not exceed 500/0 of the existing dwelling
(the original footprint of the house is 26x63 ft. and the addition will by 24x24 ft.); the
addition will be on existing lawn and is not within 100 ft. of any other resource areas.
She recommends an Order of Conditions be issued.
The Commission asked Michele to clarify the MESA memorandum-exemptions from
review for projects or activities in Priority Habitat (321 CMR 10.14) which states the
maintenance, repair or replacement, the vertical expansion or additions that do not exceed
50% of the footprint of an existing single family or two family home within existing
paved and lawfully developed and maintained lawns or landscaped areas.
Cindy made the motion to accept the plan for an addition for 31 Sturbridge Drive, dated
October 2, 2006, noting that the plan conforms to state criteria for a Natural Heritage
Area and also satisfies the Mansfield By-law.
Ben seconded.

19 Clementine Drive: The Notice of Intent was withdrawn because the lots do not
conform to the Zoning Board By-law in regards to the required lot size. The lots can be
combined for 1 house lot. The applicant will have to re-apply.
Shaun Kelly, 20 Carol Road: Michele will contact Bob Mangiaratti, Town Council, to
discuss the Enforcement Order issued to Mr. Kelly on April 25, 2006. Mr. Kelly has not
placed the signage along the bordering vegetated wetlands and has not removed the
equipment and debris out of the 50 ft. no touch area.
Steven Borghi, I 02 York Road: Bob Mangiaratti will also discuss the Enforcement
Order issued to Mr. Borghi on June 29,2005. A swimming pool was built and several
loads of fill were placed within a bordering vegetated wetland and within the 25 ft. and
50 ft. no touch zones without a valid Order of Conditions. A hay bale line was recently
established along the driveway but Michele has not heard from the contractor or Mr.
Borghi.
The Commission would like Town Council's opinion on what legal action should be
taken in regard to Mr. Kelly and Mr. Borghi.
Paul made the motion to accept the minutes of October 23,2006.
Cindy seconded.
