The Commission discussed the site visit and voted 5-0 to hire Peter Fletcher to perform
an independent review of the site.
The Commission members reviewed a letter to Steven Borghi, 102 York Road, notifying
Mr. Borghi the Commission is turning this matter over to Town Council and the
Department of Environmental Protection for enforcement and that a fine of $300.00 a day
will also be imposed starting from the date of the Enforcement Order, June 29, 2005,
until he has complied with the conditions set forth in the Order.
Mr. Borghi was issued an Enforcement Order on June 29, 2005 for an existing in-ground
pool without a valid Order of Conditions and for placing fill within a bordering vegetated
wetland and within the 25ft and 50 ft. no touch zones.
r Mr. Borghi was told to pull the fill out and back at least 8 ft., have a Professional
Wetland Scientist delineate the wetlands, hire a Professional Engineer to prepare a plan
with a proposed wall to strengthen the side driveway to prevent erosion and file a Notice
of Intent for the illegal construction of the pool. He was to attend the July 11, 2005
meeting to discuss the enforcement. Mr. Borghi did not attend.
A second letter was sent September 15, 2005 to Mr. Borghi after receiving no response.
The new letter, dated September 28,2006, Will be sent to Mr. Borghi by certified mail
and by regular post.
The Commission members were given the Chapter 25 Stormwater Management By-law.
