1. Minutes January 24, 2007
Motion: To approve as submitted (Torman-Annino) All in favor. PASSES
2. ZBA application for Variance - 8 Partridge Lane - sideyard setback
The application states there was an error in the plot plan, which was not found until
after the garage was built. Mr. Burke explained that without the variance, it would be
difficult to sell the house later. Mr. Annino said there should have been a plot plan
showing the dimensions of the original house; Mr. Burke said there was, but it
showed the wrong dimensions. He suggested sending a positive recommendation.
Motion: To send the ZBA a positive recommendation (Armstrong-Feck)
Five in favor. DeMassi opposed. Holmes Abstained. PASSES
3. ZBA application for Variance - 91 Branch Street - sideyard setback
Two-car garage and family room addition. Mr. Armstrong noted the application does
not address any of the statutory requirements for a variance and suggested the garage
could be smaller. Mr. Burke suggested sending a negative recommendation.
Motion: To send the ZBA a negative recommendation because there is no hardship
r shown and because there are alternatives for the construction
(Torman-Armstrong) All in favor. PASSES
4. ZBA application for Variance - 94 Park Street - frontage, area and lot width for a
new lot. Mr. Burke said this happens frequently with family land that has been held
in common ownership. He suggested a negative recommendation and said while it
may be disappointing to find out the lot you thought you had doesn't exist, there is an
obligation on the part of the landowner to make sure the lots don't become married
through zoning. Mr. Armstrong said he doesn't think this application meets the
requirements for a variance.
Motion: To send the ZBA a negative recommendation
(Armstrong-Annino) All in favor. PASSES
5. Meeting notices - Easton, Norton, Plainville
The clerk read a request from the applicant to continue the public hearing to February 28,
2007 at 9:00 p.m.
Motion: To continue the public hearing to February 28, 2007 at 9:00 p.m.

developments. He asked the board to look at the amendments and make comments. He
said he is concerned about the large, pre-fabricated, inexpensive metal buildings that are
becoming more popular. Mr. Annino asked about storage pods that are placed in
driveways. Mr. Burke said the town doesn't regulate them and they are being used more
frequently as accessory structures. Mr. Feck asked about barns; Mr. Burke said those
aren't regulated separately.
Mr. Burke said he has spoken with representatives from WS Development about Building
I at Mansfield Crossing. They would like to offset the door of the Best Buy store by
about 20 feet. Mr. Burke said this is not a major change that doesn't significantly alter
the f~ade, and the same materials will be used. He asked if the board wants to
see the applicant. Consensus was not to have the applicant come in.
Motion: To approve the proposed change (Tonnan-Armstrong) All in favor. PASSES
Mr. Burke said he met with Mass Highway about the West Street bridge over the Wading
River. There was a weight limitation on the bridge, and the town recently reinforced it
with steel. The town has now proposed to Mass Highway that the bridge be replaced;
Mass Highway has done some design options for repair, replace and relocate. It was
suggested that when they have a more definite set of plans, they contact the Planning
Department to schedule agenda time, since West Street is a scenic road in that area. Mr.
Burke said one of the possibilities is straightening the road and building the new bridge
further up the street. Dr. Torman said he would like to see that curve straightened out
because it is very dangerous.
r
Dr. Torman asked about CIP; Mr. Burke said no meetings have been scheduled yet.
Dr. Torman said he would volunteer to serve on the committee.
Mr. Armstrong asked about the sale pending sign on the former pig farm on East Street.
Mr. Burke said a number of people have been in the office recently, but he doesn't know
who bought it. He said it is an odd-shaped parcel, but there are two large, empty parcels
adjacent to it, which may have wetland and access issues.
Mr. Holmes said he has sent Mr. French a letter of resignation. He said he is at night
meetings several nights each week and has had to miss a number of Mansfield Planning
Board meetings, and he is missing a lot of time with his family. He said he has sold
his house and would like to stay in town, but will temporarily be staying in Canton until
they buy a home. The board wished Mr. Holmes well and thanked him for his service.
Motion: To adjourn at 8:45 p.m. (Torman-DeMassi) All in favor. PASSES
