Minutes of March 27, 2007
Present:
Chairman David McCarter, Vice Chairman Louis Amoruso, Clerk George
Dentino, Selectman Michael McCue. John D'Agostino, Town Manager
Town Counsel Robert Mangiaratti and Town Engineer John Sullivan also
present
The Board of Selectmen's meeting was called to order at 9:00pm
Motion: To convene to Executive Session to discuss pending litigation. (McCarter/Dentino)
3:0 passes. Roll call vote to go into Executive Session: Chairman McCarter aye, Vice Chair
Amoruso aye, Clerk Dentino aye. Selectman McCue came in 9:05pm after session convened
Brief overview of case by Robert Mangiaratti. History of Rt. 106 project with compaction
issues discussed. Money was held back and the contractor started to fix trenches.
4 out of 5 compaction tests failed at 3 ft below grade. The 2000 contract with Couglar
was terminated on May 19th. Surety Company completed work and funds were released to
them.
Couglar filed lawsuit against the Town in 2003. Judge Agnas presiding over case.
Discussion of proposed settlement at $117,500, original request was over $313,000.
Funds were withheld in September of 1999 and interest goes back to late 1999/2000 @
12%. Per statue, interest figure at $690,000. (Maybe a month or two off).
On the video, there were boulders the size of Bob's garage. Evidence wasn't going our way
with judge.
Motion: That the BaS authorize Town Counsel to settle the case at $117,500.
