Celorio RECEIVED JUL 3 1 2000 TOWN MANAGER'S OFFICE The following letter is in response to your inquiry concerning the above matter. After .- researching the applicable law, I have concluded that the Town Meeting's vote to grant a police candidate an age exception so that he could be hired as a Mansfield Police Officer is a legal nullity, for the reasons hereinafter stated. Pursuant to Massachusetts General Laws, Chapter 31, ~ 58, a municipality cannot hire a police officer or firefighter, if such a person is older than th.irty-two at the final date for filing to take the civil service exam, unless the municipality has accepted the optional provisions of sections 61A and 61B: "No person shall be eligible to have his name certified for original appointment to the position of firefighter or police officer in a city or town which has not accepted the provisions of sections sixty-one A and sixty-one B if such person has reached his thirty-second birthday on or before the final date for the filing of applications, as stated in the examination notice, for the examination used to establish the eligible list from which such certification is to be made." -1- 11 MURPHY, HESSE, TOOMEY & LEHANE, LLP Attorneys At Law John o. D'Agostino July 26, 2000 Page 2 Section 58 will control because the Town of Mansfield has not accepted Chapter 31, ~ 61A and 61B. Chapter 31, ~ 61(A), which states in relevant part that "any municipality may adopt, subject to collective bargaining, stricter in-service health and physical fitness standards... Such standards may take into account the age of the police officer or firefighter." Since the Town of Mansfield, under the authority of ~ 61 (A), has not adopted its own health and wellness program, the age limit for employment set forth in the quoted language of ~ 58 will control. Town Meeting may not, by a vote such as the one taken on May 22, 2000 under Article 67, waive or override a provision of the general laws. Consequently, the vote of Town Meeting to grant Kenneth Wright an age exemption is a nullity and may not be recognized.
