OFFICE
Present: Jess Aptowitz, Chairman; Frank DelVecchio, Vice - Chairman, M.; hael Trowbridge,
Clerk; George Dentino, Steve Schoonveld, and William Ross, Town Manager.' .10" 7 A i0 31
Chairman Aptowitz called the meeting to order at 7:00p.m. The Chairman reminded everyone that
the meeting is being broadcast live and taped for future broadcast on Mansfield Cable. He asked if
there were any members of the audience recording, to which there was no one.
At this time Chairman Aptowitz distributed to the Board and Mr. Ross the Town Manager
Evaluation for review and to discuss later in the meeting.
2. , Presentation Of Check From Proceeds Of, Senior Spectacular By',Represeutative r
Elizabeth Poirier To Council On Aging Director Gale Farrugi,a
Present before the Board is Representative Elizabeth Poirier and Council On Aging Director Gale
Fanugia.
Representative Poirier is here to present proceeds from the fourth annual Senior Spectacular where
Ms. Farrugia was a very important part of the committee. There were over 1,000 seniors in
attendance that received information from over 100 vendors. The committee received assistance
from Representative Jay Barrows and 150 high school volunteers. Each of the three senior centers
that Representative Poirier services received $3,300.
Ms. Farrugia stated it is such a privilege to work with Representative Poirier as she has learned so
much over the past four events.
Chairman Aptowitz was very appreciative of Representative Poirier's efforts and representation of
the Town of Mansfield, he also thanked the Board for the Council On Aging. Each Board member
was crateful for Representative Poirier's hard work and renresentation.
Chairman Aptowitz explained this discussion stems from some outstanding items not yet
completed with regards to Public Safety at the Xfinity Center. A letter had been sent to Jeff Mann,
General Manager, Xfinity Center, noting the failure to complete and fulfill the requests.
Mr. Ross noted the outstanding requests, included: security cameras but notably the need for a
better observation tower for the lawn area for Public Safety to operate from. It was noted this was
discussed during the licensing process where Mr. Mann, Lieutenant Frank Archer and Sergeant
Roy Bain actually scouted the area for a location but now understands that Corporate is pushing
back on the request.
Lieutenant Frank Archer is present as he is Acting Chief while Chief Sellon is away.
Lieutenant Archer went through the negotiation process for the Xfinity License where Public
Safety requested items it felt were important with respect to Public Safety. One particular and
important request with regards to lawn operations where there is a need for an elevated platform so
that the Lawn Commander and officers designated to the area to operate from. The request
originated after Sergeant Roy Bain and Lieutenant Sam Thompson were able to tour concert
Board Of Selectmen's Meeting June 22, 2016
Page 1 of 10
venues last year in the off season where it was felt would be an asset for Xfinity operations.
Lieutenant Archer stated the Town was told that the platform would be possible but as of today has
not been completed.
Mr. Trowbridge asked for Public Safety operating procedures for the lawn. Lieutenant Archer
noted Public Safety for the lawn area has evolved over the past years addressing concerns and
needs each year. He explained it has gone from a squad /platoon response (reactive with minimal
officer availability) to having more of a presence (specially trained officers (Metro Unit)
referencing tactical unit supplemented with trained Mansfield officers) and to be more proactive.
The reason behind the platform is to have an overview of what is going on in the area rather than
being eye level.
Mr. DelVecchio asked if the platform was part of the Xfinity License Agreement to which Mr.
Ross explained it to be a "hand shake agreement" at the end of negotiations and that requests have
always been filled in this manner. Mr. DelVecchio felt it was proactive to tour other venues and
asked if there have been any discussions with other Public Safety departments. Sergeant Bain was
present explaining at least in Florida, where he toured, operations of arrests /protective custodies
are handled differently than Massachusetts due to different regulations.
Mr. Dentino would like to hear from Jeff Mann, General Manager, Xfinity Center. Mr. Mann
approached the Board and corrected an earlier statement that two cameras have actually been
installed and have met the request of Public Safety. He noted it is a small system but has the
capacity of 360 degree view and zoom capability. The cameras have been installed in the front gate
area. Mr. Mann noted that the platform request was introduced late in the process and he has done
his best to accommodate the request but did have reservations which included the tower making
Public Safety a target and that the tower would lend to a "prison atmosphere" appearance and is
not the message Xfinity wants to send. Mr. Mann noted he counter offered with speeding up the
process for additional three cameras (to be installed tomorrow, June 23`d on the fagade of the roof)
covering the lawn and open seating area to be operated by Xfinity personnel /security from the
unified command center and has the ability to expand to a larger system. Mr. Mann referenced
also establishing a better grid system for the lawn. Chairman Aptowitz noted the Board would
have to defer to the experts.
Mr. Schoonveld noted the security approach has to work for the most trying evenings over the
course of the season referencing last Thursday's performance (Jam'n 94.5). He asked the Mr.
Mann not back off so much on the tower. Mr. Schoonveld noted with over 100 venue locations
there should be a lot this venue could learn from. Mr. Mann noted not one of those locations has a
tower to which Mr. Schoonveld referenced the venue in Florida that Sergeant Bain toured. Mr.
Schoonveld stated it would be nice to see statistics from other locations. Mr. Mann stated he has a
"wide eye" for best practices given his experience and never takes a narrow approach.
Mr. Dentino thanked Mr. Mann for coming and enlightening the Board as he understands things
takes time. Mr. Dentino referenced this Saturday's country show (Keith Urban) and hoped that
Xfinity is taking a close look at that. Mr. Mann noted there has been a ticket increase and has
approved Chief Boldrighini's request for additional assets.
Chairman Aptowitz felt it is always the Board's intention to try to be fair to all parties reminding
( Mr. Mann to contact the Board with any questions or concerns.
Board Of Selectmen's Meeting June 22, 2016

t
Lieutenant Archer agreed to the importance of an open dialog with the end goal to provide a safe
venue for patrons, staff and Public Safety but that the Mansfield Police are not interested in three
cameras supplanting police officers. Lieutenant Archer reminded the Board of the request for
cameras dating back two years where LiveNation agreed to a slow introduction of cameras in the
Compound, in and outside the front gate, lawn area and finally the parking lots as there is a cost
associated to that. Lieutenant Archer stated that cameras do not replace the deterrent that police
officers or a Sergeant trained in crowd control making decisions in real time provides. He agreed
there is a need for cameras but again does not replace a police officer. Lieutenant Archer
maintains a structure is needed to get the Public Safety officers elevated to better seethe crowd and
officers responding.
Mr. DelVecchio asked if there has been an attempt to replicate or model the structure. Sergeant
Bain explained he currently has a limited view with a three step structure but has attempted to
model a structure through use of a lift with the assistance of Xfinity personnel.
Mr. Mann noted in terms of best practices there is no venue (entertainment or sports) that operates
with the use of a tower but focuses entirely on use of cameras.
Mr. Mann asked to address the Board with regards to last Thursday's performance (Jam'n 94.5)
where he felt the level of response did not match the level of issue. Mr. Mann complained that hev
was never notified of the mutual aid call and his first interaction was the After Action report that he
was not privy to until Monday, June 20th where typically it is distributed prior to the end of the
evening. He felt the response to be massive and did not match the issues. Mr. Mann felt Xfmity
reacted responsibly by shutting off beer lines and limiting purchases. He felt the level of response
to be intimidating to patrons and staff referencing armored vehicles, 11 canine patrols out of
vehicles and did not appreciate language within the report intimating gang action.
Lieutenant Archer challenged that the Public Safety response was commensurate with threats
posed to staff, patrons and Public Safety. He furthered the level of fights were everywhere and
with ten officers assigned to lawn there were time that Sergeant Bain was left solo as he had to
deploy all resources into the crowd. Lieutenant Archer went through the response taken by Public
Safety during encounters with the unruly crowd which he felt warranted the need for mutual aid
assistance. Lieutenant Archer vehemently denied the characterization and felt very fortunate that
there were no serious injuries to staff and patrons.
Chairman Aptowitz stated it is incumbent on everyone to work together. Mr. Trowbridge felt the
Town is no worse off than last year with the addition of the cameras and felt a continued dialog is
warranted to figure out the platform issue. Chairman Aptowitz encouraged, with Mr. Ross'
leadership to keep this dialog open. Lastly, Mr. Trowbridge referenced Foxboro's Advisory
Committee made up of seven residence and suggested a future discussion of something of that
nature for Mansfield.
Lee Azinheira, DPW Director is present before the Board. Mr. Azinheira has submitted a memo to
the Board recommending the following:
1) Striping Centerline: installation of permanent centerline from East /West Street to Villa Street.
The rest of North Main Street will have the centerline marked with temporary removable
markings. No parking signage or changes will be made at this time.
Board Of Selectmen's Meeting June 22, 2016
Page 3 of 10
2) Speed Limit: currently there are no signs with posted speed limit. Board will need to take a
formal vote to post the area for 25mph.
3) Later in the summer to pave a 106 feet section of Old Colony Way which will add 18 parking
spots with additional temporary lighting along with better signage directing to parking.
4) Heavy Commercial Vehicle Exclusion: study trucking traffic through the area and see if it meets
MassDOT standards for restrictions.
5) Traffic Counts: work with Police, SRPEDD and consultant to obtain counts and refine parking
plan taking into consideration both short and long term improvements.
Chairman Aptowitz noted the Board needs to be conscious of the concerns that the business
owners previously noted with regards to parking too close to curb cuts and the potential loss of 26
spaces. The Board was in agreement that 26 spaces are too much.
Mr. Schoonveld in reviewing the recommendation noted it will be a net six spaces with the
addition of 18 spaces on Old Colony way but both he and Mr. Azinheira noted it will affect
businesses differently. Mr. Schoonveld appreciated residents' suggestions (designated 30 minute
parking in certain areas). Mr. Azinheira will research that and give a recommendation to the
Board. He greatly appreciated the posting of the speed limit. Mr. Schoonveld then read from the
2011 SRPEDD highlighting the recommendation of improvements /signage for bike path parking
and designated downtown employee parking. This report can be located on SRPEDD's website.
Mr. Azinheira agreed that better signage and lighting are needed to direct customers to parking.
Mr. Dentin felt a good hard look needs to be expended to keep large trucks from entering the
downtown. He felt that would alleviate issues for everyone. Mr. Azinheira is looking into that
issue noting it would still need to allow for deliveries.
Chairman Aptowitz felt driveway setbacks are the first order of business and suggested to refrain
from marking parking spaces where Mr. Azinheira stated there will be no argument to, at least on a
trial basis, to not mark the spaces.
Mr. DelVecchio felt the 18 additional spots are great but does not really assist the main street. He
questioned if the Town can truly not mark spaces as he felt that to be disconcerting. Mr. Azinheira
felt it to be reasonable to mark only the distance for the curbing. Chairman Aptowitz would
however like to see markings and space numbers on Old Colony where commuter rail parking lies.
Motion: To post signage for 25mph on North Main Street from Route 106 to West Street
(Trowbridge /DelVecchio) PASSES 5:0
Debra Britt (Black Doll Museum)— would like to make the Board aware that losing 26 spaces is
devastating as she has been trying for the past two years to have signage but is already not meeting
the State's requirement due to parking. She referenced having to schedule tours on Sundays.
Yvonne (Tratorria Della Norma) — appreciated not painting spaces at this time and asked if the one
way circle could be extended to go down Rumford and to come up Villa so as not to lose spaces.
Mr. Azinheira noted it could be done but that the impact to the entire circulation (neighborhoods
and other streets) would be greater, referencing residential area of Rumford. There was also a
concern with parking on Old Colony as residents already complain about pedestrian traffic to their
properties.
Board Of Selectmen's Meeting June 22, 2016
Page 4 of 10
Kay Harney (Mansfield Shredding) — was concerned that driver's will go above the 25mph to
which the Chairman noted that Public Safety will be informed of the new posting. Mr. Schoonveld
asked Mr. Azinheira to provide recommendations for pedestrian crossings other than just painted
markings to which he could review and then provide additional markings for those that are of most
concern. With regards to Old Colony Way parking, the Town needs to provide a safe and direct
pathway (paved and lit) from parking to Main Street, especially for seniors. Chairman Aptowitz
requested filling pot holes immediately in that area, and Mr. Azinheira was hoping within the next
two weeks.
Bobby Murray — would like to keep spots in front of barber shop noting a new dance studio is also
opening, noting customers are typically in and out in 30 minutes.
Kenny Picciandra — noted that no lines have worked perfectly well but speeding has been the issue.
He noted there is a need for one way sign at North Main Street and the beginning of High Street as
driver's are not adhering to the one way.
Louis Guarino — is a new building owner in the area and asked not to lose too many spots as it
would affect the property valuations. Chairman Aptowitz was comfortable there would not be a
great loss but would be some. Mr. DelVecchio felt it would be a lot less than 26 with the addition
of 18 spots on Old Colony.
Rich Golemme (Bead Cache) — loss of spots is significant as he has lost customers due to losing
spots due to the commuter rail. He asked if the Board could look at the speed limit could be
extended to the other side of North Main as well. Chairman Aptowitz asked for Officer Kinahan to
investigate that area.
Motion: To create the additional parking spaces behind Old Colony (Trowbridge /Schoonveld)
Discussion:
Chairman Aptowitz reiterated that the area has to be paved first. Mr. Azinheira explained that as
the Board has asked for a comprehensive parking plan it would be too soon to pave the entire area
considering the Northeastern students' proposal and Fales Oil recommendation. The consensus
was to at least fill the pot holes in order to be safe and the sooner the better.
Motion: To create the additional parking spaces behind Old Colony (Trowbridge /Schoonveld)

Mr. Ross explained the current lease, which has expired, was for the YMCA for $1 per year. Mr.
Ross noted he and Mike Ahern, Buildings and Special Projects, have been working to bring the
proposals /lease into compliance with State law. The Town is trying to set the RFP up so that the
group that would be leasing the building is a community oriented group that would provide
services to residents of Mansfield and be responsible overall for the maintenance of the building
and grounds. Mr. Ross noted the Town is required by law to get the best price. A draft of the lease
Board Of Selectmen's Meeting June 22, 2016
Page 5 of 10
has been reviewed by Rod Hoffman, Town Counsel, where Mr. Ross would like to begin the
process of getting the RFP out there.
Mr. Trowbridge asked for the following:
• list of improvements over the past 20 years as well as any assistance from the Town
rough idea of rent
Mr. DelVecchio asked for the process of the RFP to which Mr. Ross noted it will be posted in
central register, advertised in local papers as well as sending a notice to the two interested parties:
YMCA and Montesorri School. Mr. Ross stated applicants will have 30 days to respond/submit
and the Town has 30 days to make a recommendation.
Mr. Schoonveld noted the draft language states "quality programs for Mansfield Youth" and
questioned if the language should include the senior population. Mr. Ross noted it could be
altered.
Motion: To approve the RFP with the exclusion of item 4 on page 8 and change language to
"proposes plan to provide quality programs to Mansfield residents" (Schoonveld/Trowbridge)
PASSES 5:0
Mr. Ross reported that it came to light, through review by Mr. Schoonveld in the past week, that
the initiative on the upcoming ballot this fall has a clause that those who have applied for a medical
marijuana license has first call on recreation permits. He furthered that a community cannot limit
the ability of the operation to do that but has found that communities have been attempting to limit
that through the negotiation of the original host agreement to limit the ability. Town Counsel has
reviewed the DRAFT agreement and amended to include that language. Mr. Ross has informed
the applicants where they then questioned if the Town would want that additional revenue to which
Mr. Ross explained that is a decision for the Board.
Mr. DelVecchio, in his review, did not like the mechanism of funding, and felt the Town should
specify they cannot sell for recreational purposes. Mr. DelVecchio felt it appears the Town has
gone from a tough stance with regards to revenues back to what other communities have done
without trying to negotiate. Mr. Ross stated that nothing is set in stone.
Mr. Schoonveld questioned how the Town estimates the cost to serve this business. He felt it to be
appropriate to pause in order to identify the push and pulls and to learn more about the ballot
initiative and how gather more information on how other communities are handling the issue.
Mr. DelVecchio felt it to be essential to have language that this is not for recreational purposes and
felt the Town needed to be more aggressive in negotiating the fees.
Chairman Aptowitz agreed with Mr. Schoonveld that the recreational language is a whole new ball
game where Mr. Schoonveld suggested language that the agreement is to be void if recreational
usage is introduced.
Mr. Trowbridge suggested running language limiting recreational use by Town Counsel to ensure
it is legal and also noted he too was surprised by the negotiation of numbers /revenue. Mr.

Trowbridge took issue with the monies going to a Gift Fund feeling it should be earmarked for
some tune of police /school account.
The purchase and sale and deed has been drafted by Town Counsel and is ready for signing upon
the Board's approval. The property is being purchased by Mansfield Housing Corporation for
$28,090.75, which is what the Town is in for in terms of back taxes, fees, ect.
Motion: To move forward on the purchase and sale for Columbine Road

9. , Discussion Of Town Manager's Evaluation, I Establish Goals For Next Evaluation
Period, Discuss And Approve Elimination Tool
Chairman Aptowitz went through the Town Manager's Evaluation noting that Doug Annino and
Olivier Kozlowski's evaluations were incorporated. A tally sheet of the average was included with
the five evaluations where Mr. Ross was graded on: Legislative Relations, Public Relations,
Budget Preparation, Managerial Skills, Direction/Supervision, Personal/Professional Growth and
Overall Rating.
The Board went through each question, grade and comments. Overall Mr. Ross received an 8.97
with all five evaluations and for the three sitting Selectmen received an 8.56.
Mr. Ross appreciated the Board's comments. He referenced picking up and doing his weekly
report again as it has fallen by the wayside given the busy nature of the office. He also is proposing
a Manager's Blog on the new Town website. Chairman Aptowitz's only concern was information
on the Blog before the Board knowing. Mr. Ross pointed out that, in terms of financing, there are
service demands in the community that need to be met and felt that the finances have straightened
out. Mr. Ross would like to move the Budget to be more performance based and looked forward to
having goals established by the Board.
Motion: To accept the summary evaluation (DelVecchio /Dentin) PASSES 3:0:2 Schoonveld,
Trowbridge ABSTAIN
Mr. Ross noted that Patti Firing, HR Director, created the Performance Appraisal. Mr. Trowbridge
asked where the template /guideline came from to which Mr. Ross did not know. Mr. Trowbridge
suggested a numerical numbering system with five being outstanding and one being poor. The
Chairman was appreciative that Mr. Ross was amendable to the new format and suggested
instituting a guideline to complete the evaluation process prior to the end of March of each year.
Mr. Ross felt that the end of March/early April to be acceptable. The Chairman surmised that the
evaluation period for FYI would cover May, 2016 through March 31St and conduct the evaluation
before the end of April. Mr. Trowbridge noted Mr. Ross' contract would need to be amended
which Mr. Ross would work with Town Counsel.
Motion: To accept the evaluation tool applying a numerical scale of five being outstanding and
one being Door (Trowbridge /Schoonveld) PASSES 5:0
Chairman Aptowitz noted that he has had a conversation with Paul DeRensis, Town Counsel,
(who is present) who wanted to convey to the Board that he is very appreciative of the opportunity
to work with the Town and felt it to be an honor and a privilege. The Chairman also noted that Mr.
Board Of Selectmen's Meeting June 22, 2016
Page 7 of 10
Ross is happy with the work provided by Mr. DeRensis and his peers. The intention of the
discussion is to review the history of the firm, services provided and its desire to continue the
relationship.
Mr. DeRensis would like to continue the working relationship with the Town noting he is not
seeking any change in rate and has enjoyed working with all Town employees.
Mr. DelVecchio confirmed this did not need to go through an RFP process.
Mr. Trowbridge noted the first time he had seen the contract was in his packet and felt hiring of
Town Counsel is a big job where he has not been provided with what the Town has spent or an
comparative analysis of what other communities are paying. He felt the Board needed to look at
the total picture of what the Town pays in total as he has a fiduciary responsibility.
Mr. Ross noted that working with staff and Deutsche Williams has put the Town in the position to
avoid major litigation.
Mr. DelVecchio agreed that the Board needs to do its due diligence as it has not been presented
with the details of the process.
Chairman Aptowitz recommended, given the lateness of this discussion, continuing the
relationship and entering into a one year contract and then vet the process. Mr. Schoonveld agreed
noting the Town cannot vet the process in two weeks time and needs Counsel in place for July 1,
2016. Mr. DelVecchio asked if the Board could receive additional information ie comparative
analysis and what the Town has paid to date. Mr. Trowbridge felt uncomfortable voting on
anything without having that information, suggesting to put this on next week's agenda. Mr. Ross
felt an extension to be in order to have Counsel in place for July 15t where in the meantime his
office could put together a thorough and extensive analysis to begin some time in February. Mr.
Trowbridge simply asked for what the Town has paid to date in legal fees to which Mr. Ross would
supply. It was agreed to continue this to next week's meeting. Mr. DeRensis noted he would
never leave the Town hieh and drv.

from $1,000 to $1,500 for seniors. This will require Town Meeting approval.
Mr. Schoonveld was surprised by Foxboro's AAA Bond Rating with hopes the Town of Mansfield
will see that soon.

Mr. Schoonveld inquired if the Town has received any word in terms of State recognition with
regards to approval of the policies. Mr. Ross had sent a letter to the Lieutenant Governor as well as
i" Shawn Cronin. The Chairman noted the Board was not carbon copied on the letter.
Mr. Schoonveld asked if there was a plan to update the SRPEDD Study. Mr. Ross agreed there
should be a discussion especially given that the Fire Station will be moved. Mr. Schoonveld also
noted he attended the IDC meeting where they are looking forward to attending a BOS meeting in
July.
Mr. DelVecchio noted that the IDC would appreciate seeing Mr. Ross attending a future meeting.
He noted the IDC does have an active Main Street Committee.
Mr. DelVecchio looked for the status of applications for Boards /Committee where it was noted the
deadline for applications was pushed to June 30" for Fates, Finance and Planning. The Board will
schedule those interviews for its first meeting in July.
