L.. ,,- >' ""\.,) 'e., r '. .. , ",', Present: Town of Mansfield Board of Selectmen 06 AUG 3 I AM 10: 0 I Minutes of August 16, 2006 1"iANSFIELD MASSACHUSETTS Vice Chairman David McCarter, Clerk George Dentino, Selectman Louis Amoruso and Selectman Michael McCue John D'Agostino, Town Manager r- The Board of Selectmen's meeting was called to order at 7:30pm, followed by the Pledge of Allegiance. There were no questions or comments. Town Accountant Bea Kearney, Treasurer-Collector Richard Boucher and Bob Brown and Chris Laviolette, from R.E. Brown & Company were present for the audit discussion. Mr. Brown provided a small introduction of his firm, R.E. Brown & Company. They produced three documents, the management letter, the financial statements report and the auditor's report. r Mr. Brown explained that the town received over $2.5 million in federal aid in FY05 and that the auditors didn't find any significant findings. The town should be proud of the management letter. We have two comments that have already been addressed in FY06, so they will not appear in the next management letter. There is a third comment relative to the town establishing a disaster recovery plan. This is something to improve on in case of a fire, hurricane, etc. The town will have to work on that and noted that there is some Homeland Security money that could be available for such a plan. The financial statements are the largest documents are the town's financial statements and footnotes with other information to back up the financial statements. He noted that the financial statements are broken up into two groups, government and business-type. There are individual statements for the general fund statements, page 17 of the document. He noted that the budgeted revenue came up short, by approximately $77,000, mainly in the area of motor vehicle. Mr. McCue asked why this would be and Mr. Brown replied that there is often a large commitment at year-end, but he believes rising interest rates may influence such a trend. Mr. Dentino asked what the percentage we get back from excise taxes. Mr. Boucher replied that the town keeps 10010; nothing goes to the state. He noted that the gas tax goes to the state and we get a portion of that. r Board of Selectmen Minutes of August 16, 2006 1 , rJI Mr. Brown said that they look at future issues and pointed out that Gaspee 45 will need to be implemented next year. Mr. McCue asked if we need to hire an actuary and the r auditors replied that the town will need to hire an actuary and the town needs to estimate the liability. Mr. Dentino asked the auditors if they are recommending the funding of this plan. Mr. Brown pointed out that other towns will be and it could affect the bond rating if you do not. There is a lot more liability out there. Mr. D' Agostino said that we anticipate that it will be a significant number. If we don't have a plan to fund it, it will affect our bond rating. Mr. Boucher said that there is no legislation to allow us to put money aside as of right now. He said that if the state allows municipalities to join a state health care plan, which will certainly help. Mr. Boucher said that there are a lot of questions, but we do not have answers from the state yet. Mr. D' Agostino said that once we complete the actuarial exercise, we will then know our liability. Mr. Brown asked the Board if they have any questions. Mr. McCue noted that there are three recommendations in the management letter and asked if they have encountered any communities who do not have any issues. Mr. Brown replied that he does have a couple of clients who do not have any issues in the management letter. Mr. Brown noted that the type of comments is more esoteric, so the town has the basics well. Mr. Amoruso asked if r all of the towns have custodial credit risk. Mr. Laviolette replied that all towns have this risk in MA and pointed out that it will fluctuate. Mr. Dentino asked about the Bristol County retirement contributions from year to year. Mr. Boucher replied that that was the year the investments went down the tubes and the cities and towns in the county had to make up. It is not so much how much they are paying out in retirement systems, but it is actually a percentage. Mr. Dentino asked about the three items in the management letter that were repeats from FY04 and asked why one of the items that was not addressed this year was not listed in this year's management letter. Mr. Brown replied that he didn't deem the issue to be listed in the management letter. Mr. Brown replied that the issue has been resolved, although it doesn't mean that everything is perfect. Mr. Dentino said that in last year's Light Department audit, it stated that money was borrowed by the Town to the Light Department. Mr. Brown replied that we reconcile all transactions and added that they do not audit the Light Department. Mr. Boucher clarified the issue for the Board and pointed out that he has the authority to invest all of the town's money. r Board of Selectmen Minutes of August 16, 2006 2 Mr. McCarter asked Mr. Goldberg of the Finance Committee if it is possible for staff to provide a written response to the issues in the management letter. Mr. D' Agostino replied r that is a good idea. We will have a process in place and it should be articulated and committed to writing. The Board thanked the auditors, Ms. Kearney and Mr. Boucher for attending. Town Engineer John Sullivan was present for the discussion. Mr. McCarter said that Mr. Dentino raised some issues and that Mr. Sullivan asked to attend the meeting and address the issues raised by Mr. Dentino. Mr. Sullivan noted that he was surprised that the issue of Brown Avenue/Brown Terrace was brought up at the end of the last meeting and not during the paving update while he was present. A comment was made that the current roadway infringed on two properties. He noted that he articulated that in his letter. Mr. Sullivan noted that the easement agreement was prepared by Town Counsel and was signed by one property owner. He explained that there was an article at a Town Meeting about the possible easements of that property and since there was no agreement, we removed the article on the floor of Town Meeting. r Mr. Sullivan noted that a comment was made about the gravel removal and noted that could be further from the truth. He noted that the roadway is in bad shape. The pavement management report, prepared in 2003, indicated that Brown Avenue/Brown Terrace had the worst pavement index. The comments also indicated that the encroachment wasn't the town's responsibility. Town Counsel has indicated that we have allowed the trespass and we have trespassed when we added the skim-coating. Nothing was done to improve the drainage system. Once we start addressing drainage, we need to provide a system that is also environmentally-sensitive. He believes he adequately addressed this issue to the Board at the June 21st meeting. Mr. Amoruso asked if the base needs to be repaired. Mr. Sullivan noted that the skim-coat made it look good, but the condition was beyond what an overlay could have done. Mr. Dentino noted that you need to consider the amount of traffic on that road and believes the overlay should be sufficient. Mr. Sullivan replied that an overlay is only as good as what is underneath. Mr. Dentino said that he didn't know about the agreement with the principal parties. Mr. Sullivan noted that he said that the town couldn't reach an agreement and pointed out that there was no signed agreement because only one owner had pulled out. Mr. Dentino doesn't want to see Brown Avenue/Brown Terrace repaved. r Board of Selectmen Minutes of August 16, 2006 3 Mr. Sullivan noted that we aren't going to do the project this year anyway. Mr. Azinheira noted that don't have the funds for next year, but will have to go back to those roads. r Mr. Dentino believes that the worst streets should be ranked 1,2,3 etc. with Mansfield Avenue at the top of the list. Mr. Azinheira replied that we need to look at factors including the amount of traffic, the amount of money available, etc. and doesn't believe that the list should be cast in stone - there needs to be some flexibility. Mr. McCarter thanked Mr. Sullivan for attending. DPW Director Lee Azinheira was present, along with John Shipe of Fairfield Green and David Weiss of Goulston & Storrs, were present. Mr. McCarter noted that our Special Town Counsel rendered an opinion on the Board's question about whether or not Fairfield's request that the Town apply for a sewer installation permit on behalf of Fairfield Green. Mr. Dentino asked what we are voting on and Mr. Azinheira replied that the vote will authorize him, as Director of Public Works, to sign and submit the MassHighway permit for the Fairfield Green sewer installation. r Mr. McCarter asked what we will get ourselves into if we submit the permit. Mr. Azinheira replied that he will not issue the road opening permit unless everything is set. Mr. Shipe noted that this plan doesn't show anything going through the water lines. Motion: To authorize the DPW Director to sign the application as described hereto for (Amoruso - Dentino) for discussion Mr. McCue asked for clarification on the wording. Mr. Azinheira said that Town Counsel is working on language. Amended motion by Selectman Dentino: At the present time, the forced main is going to be jacked under Route 495 and is not going to be going through either of the water lines, the transite or the cast iron that the town owns, so that the town can maintain lor two sleeves, of they so exist, underneath Route 495, which is advantage to the town to be able to do it. (Amoruso- Dentino) Vote: 3-1 Passes (Mr. McCue opposed) Mr. McCarter noted that he voted against the agreement but feels that voting for this is the most appropriate for the situation. r Board of Selectmen Minutes of August 16, 2006 4 Mr. Azinheira asked for a vote by the Board to authorize the Town Manager to file the SRF application to get the Town on the list. The authority to file is as follows: r AUTHORITY TO FILE Whereas, the Town of Mansfield, Massachusetts, after thorough investigation, has determined that the work activity consisting of: The Town of Mansfield Water Pollution Control Facility (WPCFLPhase I Upgrade_ is both in the public interest and necessary to protect the public health, and that to undertake this activity, it is necessary to apply for assistance; and Whereas, the Department of Environmental Protection (the "Mass DEP") and the Massachusetts Water Pollution Abatement Trust (the "Trust") of the Commonwealth of Massachusetts, pursuant to Chapter 21 and Chapter 29C of the General Laws of the Commonwealth ("Chapter 21" and "Chapter 29C') are authorized to make loans to municipalities for the purpose of funding planning and construction activities relative to Water Pollution Abatement Projects; and Whereas, the Applicant has examined the provisions of the Act, Chapter 21 and Chapter 29C, and believes it to be in the public interest to file a loan application. r NOW, THEREFORE, BE IT RESOLVED by as follows: the Board of Selectmen 1. That the Town Manager is hereby authorized on behalf of the Applicant to file applications and execute agreements for grant and/or loan assistance as well as furnishing such information, data and documents pertaining to the applicant for a grant(s) and/or loan(s) as may be required; and otherwise to act as the authorized representative of the Applicant in connection with this application; 2. That the purpose of said loan(s), if awarded, shall be to fund construction activities. 3. That if said award is made the Applicant agrees to pay those costs which constitute the required Applicant's share of the project cost. Motion: To so authorize the Town Manager (Amoruso - McCue) 4-0 Passes r Board I/o'electmen Minutes of August 16, 2006 5 r Mr. McCarter noted that the Board has received an application for an expansion of commuter parking for an additional 100 parking spaces. He noted that we are trying to include the neighbors in the discussion. Mr. McCarter asked for a general discussion with the Board members on expansion. Mr. D' Agostino began by stating that our Police Chief and Traffic Officer will concur with the following statements. The biggest problem is that we have an unprotected neighborhood from commuters. We had established a moratorium, which has expired, to not entertain any additional parking. The issue of access is an area of concern. From his perspective, the issue of traffic is of a major concern. We need to look at developing a plan and getting the landowners on board with a plan. There are a number of issues that need to be addressed. If the Board is inclined to approve the application, he would like to see more resident-only parking. The neighborhood shouldn't bear the burden of increased traffic. Mr. McCarter asked the Town Manager to go over the parking affected by the construction of the new train station. Prior to construction, we had 80 parking spaces at the station, we lost 24 spaces during construction 24 (80-56 temporary replacements) for a total of 96 spaces, a net gain of 16 spaces. He then went over the number of parking spaces currently held by Foundry LLC. r Mr. Dentino agrees that the neighborhood should be listened to but believes that we need a solution now relative to the increased train traffic due to the issues in the tunnels. He is unsure how this will impact the neighborhood. He believes this is a temporary fix because he feels the demand is there. Mr. McCarter asked for the applicant to make his presentation. Rob Woodland of Woodland Design Group was hired by Mr. Bill Clemmey and was present for the discussion. Mr. Clemmey explained the analysis he provided to the Board. The purpose of the license is to expand the parking at the Foundry lot without exacerbating the parking to an additional 100 spaces. He collected over a 100 signatures on a petition asking the Board for an additional 100 spaces. He believes that ridership is up and more parking is required. He noted that he had to go before the Zoning Board of Appeals and heard from abutters, particularly with respect to noise and dust. He reviewed the comments from the Police Chief with respect to traffic on Chauncy Street. Mr. Woodland made his presentation to the Board. He described the location of the 100 parking spaces, which are adjacent to the existing lot. He noted that he worked on the Home Depot project and is familiar with the community. He noted that commuters will take various trains, so he undertook a traffic utilization count and took traffic counts at ,~ Board of Selectmen Minutes of August 16, 2006 6 various points in the neighborhood. He explained how he observed that the detail was present for about 10-15 minutes when each train arrived at the station. He stopped the r traffic flow on Route 106 long enough to help with the queue in the neighborhood. He noted that there is residual traffic on either end of Route 106. Mr. Woodland explained a table in a study that was provided to the Board. He said that the cars parked in the current lot dissipate over many trains. We would expect a virtually identical traffic pattern with the additional parking spaces. He doesn't believe it will have a noticeable impact on the existing traffic. Mr. McCarter asked if Mr. Woodland counted the traffic flow for all commuter parking and Mr. Woodland replied that he did a snapshot analysis of the traffic onto Route 106. Mr. Woodland went over the accident history for the past three years by using MassHighway figures. In summary, there were approximately three accidents per year and this information was provided to the board in the study. The accident frequency is below the state average. He noted that the police officer has done a great job of managing the traffic. He doesn't believe that the additional 100 spaces will make a big impact to the traffic. Mr. McCue noted that his concern is the traffic impact and would have liked to have had the information ahead of time. He would have liked an independent analysis of this as well. r Mr. Amoruso asked if Mr. Woodland looked at accident rates at the nearest lighted intersections and Mr. Woodland replied that he didn't have a chance to do So. Mr. Amoruso noted that the count was done on 8/9 and 8/10, a Wednesday and Thursday, while a police officer was present. Mr. Woodland noted that at the peak train, this project could produce an additional 32 cars. Mr. Dentino noted his concern with the dissipation of cars in the neighborhood. He asked if there is sufficient time for those additional cars to dissipate before the next train comes. Mr. Woodland replied yes, based on his observations. Mr. Clemmey noted that Mr. Woodland's study is focused on the 100 additional cars. Mr. McCarter asked Mr. Woodland if he reviewed any of the other studies that the Town has done. He replied that he reviewed a VHB study and also a Walker study. Mr. McCarter noted that he saw approximately 20 empty spaces at the River Street lot at around 8:00am. He asked Mr. Woodland if he observed if any parking spaces were empty. Mr. McCarter pointed out that there are some seasonal parking changes that need to be taken into account. Mr. Clemmey noted that the Town operated the lot from 1990-2005 and the lot was made private in 2005. r Board of Selectmen Minutes of August 16, 2006 7 Chief Arthur O'Neill pointed out that this area was designed in the 1940s and built in the early 1950s. He noted that commuter rail is the way to go, but it comes down to safety at r the Highland/Chauncy intersection. He noted that the counts were taken by Mr. Woodland during the month of August, during vacation season. The officers know what they are doing when it comes to moving cars and pointed out that 2/3 of the year, the officer is working in the dark. As far as the detail, the town funds 2 days a week and the other 3 days are covered by shift officers. He loses 12 personnel hours per week. He is going to let Lance Lawson speak to the specifics. Traffic Safety Officer Lance Lawson said that it is a traffic safety issue in the area. He noted that 25,000 cars per day go through that intersection. The queuing is significant from South Main Street past Copeland. He noted that there are 6 moving lanes of traffic. His main concern is the un-signalized intersection, increased pedestrian volumes, etc. His recommendation is that until there is an infrastructure plan in place for that area, hold off on additional parking/traffic volume until a course of action is decided. The Route 106 underpass reconstruction is also an issue that needs to be considered. Charlene Giblin, 18 Draper Avenue: Asked about the parking spaces that the MBTA has requested. Mr. Clemmey replied that the MBTA would have to go to the Town for additional spaces. Her other concern is the traffic through the neighborhood and the high rate of speed with which they travel. She fears a major accident. She asked about the buffer and who would maintain that. Mr. Clemmey replied that they would be responsible r for the maintenance. Donna Harrington, Highland Avenue: She believes that the parking was supposed to be capped at 800, so she was surprised that there are currently over 900 spaces. She noted that there are actually seven lanes of traffic in that intersection. Her other question was if other parking spaces were being added at any of the other train stations. Lawrence Malsky, 26 Draper Avenue: He would like to echo the previous comments and found the Police Department's comments very helpful. He believes this additional parking would make a bad situation already worse. He wonders why signalization has not already occurred. Mr. D' Agostino said that the signalization will take place when we have the money, as it is costly. We are anticipating grant money from the federal or state government to upgrade the intersection. Mr. Malsky believed that another access to the lot is key. Mr. Malsky asked if this application is approved, how will it affect the overall train station project. Mr. Clemmey replied that he doesn't want to be in the parking business and they are working with the town on the overall project. Mr. D' Agostino noted that the Cecil Group study didn't include a full-blown traffic study. Karl Clemmey, 750 South Main Street: Offered his historical perspective on what the traffic situation was like in Mansfield in the 1940s-60s. r Board of Selectmen Minutes of August 16, 2006 8 Mr. Woodland said that the traffic study was to quantify the traffic impact if the 100 r- spaces were to be added and summarized his findings to the Board. Mr. McCarter said that if the Board grants the license, can anyone take advantage of these spaces. Mr. Clemmey replied that we will reserve 50 for Mansfield residents. He also plans to reserve some spaces for late arrivals. Mr. McCarter noted that his first priority is for Mansfield residents. He is concerned with policing the number of parking spaces that are allocated to Mansfield residents. Chief O'Neill noted that the Parking Officer's job is not to police private lots. Until the Route 106 has a major rehabilitation, he requests that none of the three entities increase the parking. He is asking for a day and a half of police detail per week should the license be issued. Mr. Clemmey said that he would be willing to share in the pay of the detail. Mr. Amoruso asked Officer Lawson how many cars go through on a minute. Officer Lawson replied that he doesn't have a count down to that small on an amount. He noted that he can do a count by hour and by kind of car. Mr. McCarter noted that the Zoning Board granted variances but they have no authority to grant a license and pointed out that the Planning Board gave a negative recommendation. r Mr. Clemmey summarized his presentation to the Board. Motion : To accept the 100 spaces (Dentino - no second) Mr. Amoruso suggested that we vote on this at the next meeting, as he would like to review the Woodland Design Group's analysis and review the numbers from the Police Department. Mr. McCue appreciates the need for more parking as well as the need for the moratorium. K. Clemmey pointed that Mr. Ditchman rents the property. Mr. McCue noted that there was an application to increase parking at the Ditchman lot during the moratorium and this application was received, it is possible that they could come back for more spaces. Motion: To table this matter until the next meeting, where will consider (Amoruso - McCue) 4-0 Passes r Board of Selectmen Minutes of August 16, 2006 9 r . He was told that the Town Manager said that he would need to get a vote of the Board. Mr. D' Agostino said that information is not readi Iy available and he believes that the organizational chart should list specific employees. Mr. McCarter noted that there is a debate as to what an organizational chart actually is. Mr. Dentino takes exception to the statement that he needs to get a vote of the Board and Mr. D' Agostino replied that he feels that the request is above and beyond a typical request. Mr. D' Agostino read the portion of the operating procedures relating to Board of Selectmen Communications, as adopted by the Board of Selectmen in April 1999. Mr. McCarter doesn't believe that Mr. Dentino needs a vote of the Board to get the information. Mr. Dentino asked for the listing of town employees whose positions are on the organizational chart. Mr. D' Agostino then asked why the information is so important to him. Mr. Dentino replied that he would like to know why Mr. D' Agostino feels it is important to conceal who works for the town and in what position they work.
