Meeting started at 7:00 in Meeting Room 3 A/B 2. Request for Determination of Applicability: Gary Price Baybrook Farms Association, Baybrook Farm Road. The Request for Determination of Applicability (RDA) was for vegetation management along the sidewalks of the sub - division within 100 feet of Bordering Vegetated Wetlands. Ms. Merrill explained the work includes the maintenance of the shrub layer along the previously existing road layout in the Baybrook Farms subdivision. She said there will be limited trimming to allow for passage on the sidewalks and for visibility for traffic entering and exiting the subdivision. She walked the site several times with Gary Price, the president of Baybrook Farms Association. Mr. Price included photos of all the applicable areas. If the project is approved, Ms. Merrill will oversee the vegetation management to ensure the limit of trimming. Mr. Price will repeat these activities annually. Ms. Merrill recommended a Negative Determination for Reason # 3 be issued with a special condition that she be notified of the start and completion of work. She also recommended that the Determination be valid for five (5) years instead of three (3) years. After five years, the association will re- submit the RDA application. Mr. Marcheselli made the motion to issue a Negative Determination for Reason 43, work will not alter an Area Subject to Protection, a Notice of Intent is not required, for Baybrook Farm Road, with the following special conditions: the Agent is to be notified of the start and completion of the work; the Determination will be valid for five years instead of the standasrd three years and once expired, the Association will reapply for the vegetation management. Mr. Flanagan, the homeowner, was present. Ms. Merrill explained she reviewed the replacement of an above - ground pool under Administrative Review. Six (6) footings will be required for the deck, which will be dug by hand. All work is within the lawn area, approximately 30 feet from a Bordering Vegetated Wetland. Ms. Matthew asked about the filtration system for the pool. Mr. Flanagan said it would be a Diatomaceous Earth (DE) Filter, with backwashing onto the lawn and gravel area, away from the resource area.
