Olivier Kozlowski and William Ross: Town Manaeer Jtreet (ADtowttz/Kozlowskr) FANZSES S:U Lee Azinheira, DPW Director, is present before the Board and noted the three Towns (Mansfield, Foxboro and Norton) have worked on the creation of this district and has finally, after six years (the first meeting taking place in February, 2008) reached an agreement. Mr. Azinheira reported that from the three Towns there is only one original member left and that is Chairman Dentine. Mr. Azinheira noted the agreement has been vetted by the three attorneys for the perspective Towns and this is the last official act. He noted the Town of Foxboro signed the agreement on Monday, June 23r1 and that Norton will sign the agreement on Thursday, June 26th. Mr. Ross stated it felt good to have this deal done as he has been heavily involved for the past four years. He noted that Representative Jay Barrows had a big role in this agreement as well. The Town's recommendation is a separate motion for each of the three documents contained within the agreement: Intergovernmental Agreement Establishing the Wastewater Treatment District, Transferring Certain Real Property and the Management and Operational Agreement. Mr. Ross noted that the Town has advertised for applicants for the Board of Directors and explained that it will be made up of seven members (two from Foxboro, two from Norton and three from Mansfield) which will be the governing body for the district, and includes the operation and maintenance of the wastewater treatment plant and a portion of the interception sewer roughly from the plant to the Norton/Mansfield line. The Town of Mansfield will continue to staff the Board Of Selectmen's Meeting June 25, 2014 Page 1 of 12 plant and Mr. Azinheira will be the Executive Director of the district providing continuity as qualified staff for wastewater plants is difficult to find. Mr. Aptowitz noted that the three members of the Board for Mansfield are actually Board of Selectmen appointments and suggested that Mr. Ross be one of those appointments. Mr. Kozlowski asked if there could be a quick overview for the residents. Mr. Ross summarized that from the construction of this treatment plant, Foxboro and Norton have been involved in bringing waste to the plant and allocated a certain percentage of the capacity of the treatment of the plant and pay their proportionate share. He noted one of the issues has been that Mansfield has completed the budget and has been managing the plant with the Board of Selectmen setting the policy. The other two communities felt, when the plant was expanded, they should have a voice in setting policy and overseeing the operation. Representative Barrows with the assistance of other representatives and our Senator introduced special legislation to allow the three communities to create this district and which was passed a number of years ago. Negotiations have been ongoing for six and a half years. One important thing of note is that Mansfield has three members and the other communities two, where it takes five votes to make any major decisions. Motion: To sign the agreement related to the establishment of the Mansfield - Foxboro -Norton Wastewater Treatment (Annino /Aptowitz) PASSES 5:0 Mr. Annino commended Chairman Dentino's work with regards to the wastewater treatment district and the protection of the Town's interests. Motion: To transferring Certain Real and Personal Property Related to the Wastewater Treatment Plant and the Interceptor Sanitary Sewer from the Town of Mansfield to the M -F -N Wastewater Treatment District (Annino /Aptowitz) PASSES 5:0 Motion: To sign the Management and Operational Agreement Between the Town of Mansfield and the M -F -N Wastewater Treatment District (Annino /Aptowitz) PASSES 5:0 Bertucci's Restaurant Present before the Board are Suzette Landry, Managing Partner, and Sean Campbell, Area Director, for Bertucci's Restaurant. Mr. Campbell explained that he had transferred the manager of record, Robert Salvas, out of the Mansfield location into its North Attleboro location. Mr. Campbell explained that Ms. Landry has been at the Mansfield location for approximately three weeks and her application in the process of being submitted. Chairman Dentino noted this all did not happen overnight to which Mr. Campbell agreed. Mr. Aptowitz asked Mr. Campbell for his title to which he noted he is the Area Director and responsible for 12 Bertuccis' locations. Mr. Aptowitz stated that owning an alcohol license is serious business and why would the Town have to call during a compliance check to determine that the manager of record was no longer there. Mr. Campbell stated it was a miscue on his part as well as his licensing department but stated the application was already in progress. Mr. Campbell stated he understands the importance. Board Of Selectmen's Meeting June 25, 2014 Page 2 of 12 Mr. Annino was extremely disappointed and wanted to be sure this would never happen again. Mr. Annino noted that if Mr. Campbell runs 12 locations then he should know better. Mr. Kozlowski asked for the timing of the change to which Mr. Campbell was unsure but noted it was about three weeks ago. Mr. Kozlowski inquired as to the date of the compliance check to which Ms. Whalen noted the compliance check was June 10'h. Mr. Kozlowski felt this situation to be even more careless, than if a manager just up and left, as it was a planned move of managers with no notification of the change. Mr. DelVecchio explained to Mr. Campbell that the initial step in the process is for the Town to be notified if there is a change to the license and if that had been more forthcoming then this situation would not have happened. Chairman Dentino did not feel that timing was the issue but rather that there is a responsibility when holding an alcohol license. He noted that the Board is now taking steps to inform all license holders of their role and that the Board is looking to impose fines if those steps are not followed. Chairman Dentino noted that the completed application for the new manager should be submitted and that the Board will consider that at its July 91h meeting. Mr. Aptowitz noted that the requirements for notification of a change will be printed on all alcohol licenses going forward. Mr. Kozlowski stated that alcohol license holders will have three business days to notify the Board's office of a change to the management of a license and two weeks to submit a completed application. Buffalo Wild Wings Michael Malone, General Manager, Buffalo Wild Wings, is present before the Board. Mr. Malono explained the original manager, Jamie Perreira, was relocated to the Buffalo Wild Wings Brockton location in April. Mr. Malono noted the paperwork for the change was in process during the time of the compliance check. Mr. Malono apologized for the gap and stated he understands the seriousness of the violation. Mr. Malono also noted that the completed application has been submitted to the Board's office. Chairman Dentino asked Ms. Whalen for the timing of the compliance check to which she reported the check was initiated by telephone on June 10th and that was the Town's first knowledge that there had been a change. Mr. Annino understood that Mr. Malono was new to the community and reminded him that the Town expects more from alcohol license holders. Mr. Malono would like Buffalo Wild Wings to be a bigger part of the community and has set up a fundraiser to coincide with the Duck Race. He admitted and apologized for the mistake. Mr. Annino stated not to take the alcohol license lightly. Mr. DelVecchio asked if Mr. Malono was to move to a different location how can the Board be sure the proper steps of notification are followed. Mr. Malono was unsure of whose responsibility that would fall under. Mr. DelVecchio notified Mr. Malono that would be his corporate office and asked that the message of that to be communicated. Mr. Ross noted that legally if the authorized general manager is no longer employed then alcohol should not be served. Mr. Ross understood Board Of Selectmen's Meeting June 25, 2014 Page 3 of 12 that different States have different rules and that the corporate office needs to know the law of Massachusetts. Mr. Aptowitz reiterated what Mr. DelVecchio noted earlier to be sure to notify the corporate office of the Town's policy. Mr. Kozlowski noted the Town has seen more issues with the corporate chains as they do have numerous locations in different states with changing laws. He reminded Mr. Malono of the requirements with regards to a change to the management of the license: three business days to notify the Board's office and two weeks to submit a new application. He also reiterated that this was a planned change which was disappointing. Chairman Dentino would like to see correspondence between the managers and their corporate offices notifying of the requirements with regards to changes in the management of the alcohol license as the corporate office is responsible for seeing that the regulations are followed properly. Mr. Malono assured that would be done. M -Plex Gary Beatty, General Manager, and Steve McAlear, Manager, for the M -Plex are present before the Board. Mr. Beatty apologized for the delay in submitting their application for a new manager. He explained that their former manager left some time ago, unexpectedly, and a new manager was brought in but only lasted a short time. It was Mr. Beatty's intention to apply himself for the manager of record for the alcohol license but was informed by Ms. Whalen that because he was not a U.S. citizen that he was ineligible. Mr. Beatty explained that since that time the M -Plex has had an ongoing search for a manager, which has now resulted in hiring of Mr. McAlear and will provide stability to the business. He noted they are a small business with only three full -time employees and one part -time employee. Mr. Beatty again apologized for any inconvenience and noted that the paperwork has been submitted to appoint Mr. McAlear as the manager of record of the alcohol license. Mr. Kozlowski asked how long the M -Plex has been without a manager of record to which Mr. Beatty noted seven months. Mr. Kozlowski sympathized with the size of the company and the difficulty of finding the right person but in the meantime the M -Plex continued to serve alcohol and he hoped by responsible parties. He stressed the importance of the requirements of notification of three business days for any change to the license and two weeks to file a completed application. Mr. Beatty did note that both he and the other full time employee who are always on premises are both TIPS certified and consider having the license a huge privilege. Chairman Dentino would like Ms. Whalen to explain what happened with this license. Ms. Whalen explained that the Board approved a transfer of the license to BCL Premier Sports dba M -Plex in February, 2013, where Brian Coffey (manager of record) stayed on in that same role. During the renewal period in December of 2013, it was noted by Mr. Beatty that Brian Coffey had unexpectantly left and Ms. Whalen explained that a Change of Manager application would need to be submitted. When the Change of Manager application was received Ms. Whalen unfortunately could not accept it due to Mr. Beatty's citizenship status. Ms. Whalen did follow up with the M -Plex but did not receive a new application. Ms. Whalen noted this has been an ongoing process from January 2014 to present where the M -flex was trying to find the right fit for not only its business but the alcohol license as well. Board Of Selectmen's Meeting June 25, 2014 Page 4 of 12 Mr. Aptowitz stated there is no excuse to which Mr. Beatty absolutely agreed. Mr. Aptowitz noted the manager of record is ultimately responsible for what and who gets served. Mr. Annino noted this is by far the worst example of a violation this evening. Mr. Annino noted the Board tries very diligently to keep track of these liquor licenses and he is disappointed. Mr. DelVecchio asked what procedures the M -Plex will put into place so that this does not happen again. Mr. Beatty noted now having gone through this process he is more informed and now understands the requirements which he assured would be implemented into the management and staff manual. Mr. DelVecchio asked if there were owners to the business and have they been informed of this situation to which Mr. Beatty stated yes. Mr. McAlear noted the importance of communication at the facility and that it is his priority to tackle the issue which includes a documented check list. Chairman Dentino asked for the three full time staff members to which Mr. Beatty noted himself as General Manager, a Facility Manager and a Basketball Director. The Chairman asked who on the staff is TIPS trained in order to provide coverage to which Mr. Beatty noted himself and the Facility Manager. Chairman Dentino noted the Board would like to see the business succeed but felt the Board cannot sympathize with the situation of trying to find the perfect candidate and questioned if the license was necessary. Mr. Kozlowski asked for the hours of operation which Mr. Beatty stated office hours are 8:00am — 5:00pm but on court and on field activities are typically 5:00pm — 10:O0pm. He also noted that weekend hours are 8:00am to 8:00pm, where they mostly run tournaments on the weekends. Mr. Kozlowski asked if the food area was separate to which Mr. Beatty responded yes. Mr. Kozlowski followed up asking if the food area is always opened to which Mr. Beatty noted it depended on the tournament and event, especially those which are all day. Mr. Kozlowski asked about the staffing of the restaurant to which Mr. Beatty noted it could be anywhere from two to five employees, which includes cooks and servers and only those that are TIPS certified will serve alcohol. Mr. Kozlowski was just trying to get a better picture of how big a pant the alcohol license plays in the business. Mr. McAlear explained that the alcohol license is a piece that is plugged into the business and depends on the event (practices, leagues) /tournament but is not always an operating piece of the business. Mr. Kozlowski needs to be sure that when the alcohol license is plugged in that qualified people are in place. Q'Doba Mexican Grill Terri Frias, District Manager, Christopher Strong, Manager, and Jason Reed, former Manager of Q'Doba are present before the Board. Ms. Frias explained that Mr. Reed's last day at the Mansfield location was June 7, 2014. She informed the Board that the manager at the Q'Doba Cranston, RI location unexpectently left and since Mr. Reed was a mentor to that location it would be best to move him to that site. She went on to explain that Mr. Strong was just finishing training and recently moved to the Mansfield location. Ms. Frias was unaware that she was to notify the Town of the change and noted that the location has not been selling alcohol during this time period. Mr. DelVecchio stated this seems to be a recurrent theme where the person responsible for notifying the Board is unaware of the requirement. Ms. Frias noted that in the four years she has Board Of Selectmen's Meeting June 25, 2014 Page 5 of 12 been the District Manager of the Mansfield location they have never been through a change therefore had no experience in that regard. Mr. DelVecchio did point out that the corporate office should have been aware. Ms. Frias also noted that this is the only location she has that has an alcohol license and that she now understands the policy. Mr. DelVecchio is interested in ensuring that the message of the policy gets to the corporate office to which Ms. Frias explained that has happened. Mr. Annino noted the common theme when corporate offices are involved as they never seem to know what is going on. Mr. Annino stated the conundrum is how does the Board impress upon the corporate office the rules and regulations of the Towns with which they operate as he is getting a little tired of dealing with the new managers as they are not fully to blame. Mr. Aptowitz inquired as to the location of Q'Doba's corporate office to which Ms. Frias responded San Diego. Mr. Aptowitz noted that Ms. Frias stated that not many Q'Doba locations sell alcohol and questioned whether it was worth the Mansfield location having a license as the license and insurance are costly. Ms. Frias could not comment on that. Mr. Aptowitz asked Ms. Frias to also copy the Board on correspondence to her corporate office of the Town's requirements with regards to any changes to the management of the license. Mr. Kozlowski asked how many locations Ms. Frias oversees to which she responded seven. Ms. Frias noted that this market (MA and RI) was a franchise that was purchased by her corporate office. She noted when new locations are opened alcohol is not included. Mr. Kozlowski reiterated the importance of corporate knowing the rules and regulations for all their locations and noted the danger of dabbling in something. Mr. Kozlowski asked, since there has been no sale of alcohol during the time of the change of manager, has there been an impact. Ms. Frias did not answer. Chairman Dentino asked Ms. Frias to send a copy of the correspondence to her corporate office to Ms. Whalen and Mr. Ross. Chairman Dentino suggested that the regulations for the Town of Mansfield be sent to all alcohol license holders and ask them to take notice and post. It was thought to have this done through the renewar process in December. Bruce Montgomery, General Manager, LiveNation is present before the Board. There was a brief discussion regarding the noise level at the Jam'n 94.5 concert from May 30, 2014. Mr. Montgomery noted that the XFinity Center did not receive any complaints. Mr. Ross explained that a resident from Norton had called into the Board of Selectmen's office to complain about the noise level but did not want to leave a name or contact number for follow up. Mr. Ross felt that it was important to inform the Board but stated this was the only phone call for that particular concert. Mr. Annino felt this to be subjective and that unless there was proof of exceeding the decibel level the Board could not act as the noise level for one person could be different to another. Mr. Kozlowski also noted that location is a factor. Bruce Montgomery, General Manager, LiveNation is present before the Board. There was a brief discussion regarding the noise level at the Jam'n 94.5 concert from May 30, 2014. Mr. Montgomery noted that the XFinity Center did not receive any complaints. Mr. Annino felt this to be subjective and that unless there was proof of exceeding the decibel level the Board could not act as the noise level for one person could be different to another. Mr. Kozlowski also noted that location is a factor. Mr. Montgomery did Board Of Selectmen's Meeting June 25, 2014 Page 6 of 12 produce the readings from the performance on May 30th from the DEP which noted they are all within the proper levels. Chairman Dentine asked for an explanation for the performance overage for that same performance (Jam'n 94.5). Mr. Aptowitz explained that he was in attendance at the Command Center for this performance and that due to inclement weather that was on the horizon, which included high winds, thunder and lightning that Police Chief Sellon consulted with Chief Boldrighini and felt that the safest route for the patrons and staff was to evacuate the area and get attendees to their vehicles. Mr. Aptowitz explained that there was concern from the XFinity management staff that depending on the time of the delay there could potentially be an time overage. Mr. Aptowitz stated that he felt it was up to both the Chiefs to make a decision that was best for the staff and attendees and that he would consider not imposing a fine but noted he was only one member of the Board. Mr. Aptowitz then contacted Chairman Dentino and filled him in on the situation. In speaking with Chief Sellon, Chairman Dentino completely agreed with his assessment and felt that once public safety steps in, that takes over. Chairman Dentino wanted the remainder of the Board to know that this was strictly a public safety issue. Mr. Montgomery would like to note that LiveNation and the XFinity Center would never argue a decision regarding a time overage when public safety is of concern. He also noted that there is a meteorologist staffed by the XFinity Center which strictly monitors the weather for the location. Mr. DelVecchio would never second guess the Chiefs but asked why a time overage was necessary. Mr. Montgomery explained that due to contracts with the performers as well as advertising of the event, it is necessary to have all acts perform as the attendees are expecting to see what they paid for. The next item for discussion was the time overage of the Journey performance on June 13t". Both Chairman Dentino and Mr. Aptowitz were in attendance at the Command Center for this performance. As Mr. Aptowitz was leaving, Lieutenant Thompson received a phone call explaining that a member of the band was stuck in the New York area due to weather. Mr. Montgomery explained that Neal Schon the guitar player, who is a principle player, was grounded in New York and had called ahead. Mr. Montgomery noted that in the past they would use a substitute but in this case they could not. Mr. Montgomery explained that there was a discussion with the band and its management with regards to the magnitude of the fine which would be levied for a time overage and that the band agreed to pay any fine in order to complete the show. Mr. Montgomery noted the performance ended at 11:5Opm. Mr. Montgomery stated he takes the curfew very seriously. Mr. Kozlowski felt there was conceivably an option to stop at 11:00pm and the difference between this show and the Jam'n 94.5 show was that one was made due to public safety and he struggled with where to draw the line. He noted the fine structure in place is so that the longer the performance goes over the curfew the higher the fine per attendee. Chairman Dentino felt this to be cut and dry but noted the Town would be hard pressed to enforce the curfew themselves and that is the purpose of the fine structure. Chairman Dentino felt the issue was safety where there could be a backlash from the attendees in trying to convince a crowd that large that the concert they paid for but did not see was done. Motion: To impose the time overage fine with regards to the Journey performance and accept payment (Kozlowski /Annino) PASSES 5:0 Board Of selectmen's Meeting June 25, 2014 Page 7 of 12 With regards to the Backstreet Boys performance Mr. Montgomery explained there was an after show party backstage where the band made arrangements through the function manager and caterer. This function only came to Mr. Montgomery's attention the day of the event and in fact tickets had been sold to the public. Mr. Montgomery confirmed with LiveNation's lawyers that it would not be considered an after party if tickets were sold to the public but instead an extension of the performance under the Entertainment License which would be subjected to the time overage fine. Mr. Montgomery noted that LiveNation would take responsibility for this and assured it would not happen again. It was noted that there were 200 people in attendance. Mr. Montgomery closely monitored the after party, especially any neighborhood impact which he felt to be none. It was noted by Mr. Aptowitz that Mr, Montgomery contacted him regarding the after party. Mr. Aptowitz advised Mr. Montgomery to contact Chairman Dentino and Mr. Ross to inform them as well. Mr. Aptowitz appreciated Mr. Montgomery's call. Mr. Annino also received a call from Mr. Montgomery and was appreciative. He felt it was an unforeseen crazy circumstance and had no issue with levying the fine. Mr. DelVecchio asked if LiveNation had any recourse with the band to which Mr. Montgomery noted he honestly believed the band was unaware of the law. Mr. Kozlowski noted he too received a phone call from Mr. Montgomery who explained that the after party was unbeknownst to him and appreciated LiveNation taking responsibility. Chairman Dentino informed the Board that Mr. Montgomery called and advised him of the situation. The Chairman explained to the Board that at the time of the call he told Mr. Montgomery that he would like to contact Town Counsel as this was a violation of the Entertainment Contract. In order for Chairman Dentino to act on the situation he would need to include the full Board and call an Emergency Session. The Chairman then contacted Chief Sellon who advised that the after party was adequately staffed with detail officers with the addition that sound /noise was not an issue from Mr. Montgomery who was closely monitoring that aspect. Chairman Dentino explained to the Board that he did not feel that the situation required an Emergency Session and felt that the Board could take this under advisement at its next meeting. Chairman Dentino stated he was unaware that Mr. Montgomery had contacted each of the Board members and advised Mr. Montgomery not to do that as it lends itself to Open Meeting violations. Mr. Montgomery noted he has always tried to keep the Board informed. Mr. Ross stated the risk with that is that the Board could then begin calling one another to discuss the situation, which is a violation. Motion: To oppose a fine on the Xfinity Center for the Backstreet Boys after party event based upon the number provided (Aptowitz/Annino) PASSES 5:0 Mr. Montgomery noted the Board as a whole has always acted in the primary interest of the residents in Mansfield but has also been fair and reasonable with the business when carrying out their duties. He suggested extending the hours past 6:00pm to attract the later commuters or possibly moving to the North Common. Mr. Aptowitz felt it would be up to the Farmer's Market to make that decision and request in writing. Mr. Annino would like to see it remain downtown. Mr. Ross noted parking would be difficult. Motion: To approve use of the public parking lot for the Farmer's Market — every Thursday 2:00pm — 6:00pm from July I dh through October 9111 (Aptowitz/Kozlowski) PASSES 5:0 D. Event Approval Final Approval for the Downtown Business Association's Family Fun Night, July 15, 2014 Motion: To approve the Downtown Business Association's Family Fun Night (Kozlowski /DelVecchio) PASSES 5:0 E. Mr. Ross reported that the Town received a check today from Nitor Development, developer of land at Lincoln Place, where they chose to pay $180,450 in lieu of providing an affordable lot in the development. The Town does give the option where they can provide an affordable lot or pay an amount calculated based upon the By -Law. He noted the check will be deposited into the Affordable Housing Trust which will now have a balance of $459,604.23. Mr. Ross stressed the importance of filling vacancies on the Housing Corporations so the Town can begin utilizing these funds. To date there hasn't been much interest but the Town will make another push for recruitment. Mr. Aptowitz asked about the North Main Street condominium project (Cunningham) where they were told to set aside an affordable unit. Mr. Ross believed they were also given both options but would follow up on that. Board Of Selectmen's Meeting June 25, 2014 Page 10 of 12 Mr. Ross noted that in the area of the Town's Worker's Compensation renewal insurance the Town's modification was 1. 17, which means the Town paid 17% over the standard rates because of the Town's loss history. He explained that is a rolling three year average. He noted the Town has been working very hard on safety with employees and that this year's rate is now at .9 1, which means the Town is nine tenths below the standard and is a savings of $99,548 on the Town Worker's Comp bill. This does not include Police and Fire. Mr. Ross reminded the Board that a few months ago they considered some new financial policies. He reported that those policies are now being reviewed by the School Department and distributed a copy of the policies to Mr. DelVecchio as he was not on the Board at that time. Mr. Ross noted that National Grid has been doing some tree trimming on Carpenter Avenue and the surrounding area. He explained that National Grid has a small transmission line that runs through the Town. Mr. Ross noted there have been complaints from residents on the poor job of the trimming and stressed the work is not being done by the Town. The Town did follow up with National Grid and expressed their concern that it was not of the Town's quality of work. National Grid did return to clean up some of those areas. The Town began training on the new phone system yesterday (June 24d) with the School Department. Town Hall employees will have training July 8 —10. Mr. Ross noted that the School employees are especially thrilled with the switch. Mr. Ross noted the Town had an especially tough weekend. He summarized that the Town dealt with a bomb hoax, three XFinity Center shows (one of which was difficult), three serious vehicle crashes and the tragic train accident. He reported that with all that was going on, especially the train accident, the Public Safety Departments implemented all the training, planning and professionalism and felt it really paid off. He wanted to commend to the Board the performance of Chief Sellon and Chief Boldrighini as well as all the other emergency management areas that assisted (MEMA and other agencies). Mr. Kozlowski echoed Mr. Ross' thoughts and noted in the midst of all that the Police Department still was able to put on a 5K (Run from the Cops) which benefitted Special Olympics. He commended Detective Sergeant Larry Crossman for his leadership. Mr. DelVecchio noted how professionally the Town's officials handled themselves publically, especially under such pressure and felt it indicated such a great quality of effort. Mr. Annino has always felt that the Town has the best in terms of Public Safety and noted that it does come from the top and thanked Mr. Ross for his guidance. Mr. Aptowitz noted he attended the press conference and felt that Chief Sellon and Deputy Chief Puleo handled themselves professionally in such tragic circumstances. Mr. Aptowitz sent his condolences to those families who lost their loved ones.
