HomeMy WebLinkAboutBOS MINUTES 6-04-2014Board of Selectmen Minutes June 4, 2014 Present: George Dentin; Chairman, Jess Aptowitz; Vice Chairman, Doug Annino; Clerk, Frank DelVecchio, Olivier Kozlowski and William Ross; Town Manager Dentino called the meeting to order. Chairman Dentino reminded tt meeting is honoring the memory of Patrolman Walter Langley who passed in October, 1983, while on duty at the Copeland Drive underpass as he investigated a disabled vehicle. Detective Sergeant Crossman noted that thanks to the leadership of Chief Sellon and State Representatives Barrows, Poirier and Kafka, on May 22nd the Governor signed a bill naming the Copeland Drive underpass "Patrolman Walter P. Langley Memorial Underpass" Detective Sergeant Crossman noted the placement of the sign is on Town property per the Town's GIS mapping system. An outline of the proposed site for the sign was distributed to the Board for review. Detective Sergeant Crossman noted the Police Association will provide for the cost of the sign, landscaping and installation. A ceremony has been scheduled for Sunday, June 29th where the Langley family has been invited with plans for a color guard as well. Mr. Kozlowski appreciated Detective Sergeant Crossman's efforts. Mr. Annino reviewed the sign design with Detective Sergeant Crossman and asked that it be kept lower to the ground and of a durable nature. Mr. Annino, encouraged Mr. Ross to follow up with the Garden Club for expertise with the landscaping. Mr. Annino also inquired about lighting the area to which Mr. Ross would follow up on expense and resources. Mr. Aptowitz agreed with Mr. Annino on the lighting and stated Detective Sergeant Crossman always gives his best efforts towards causes in the Town and they are always successful. Motion: To approve the location and sign as presented honoring Patrolman Walter P. Langley as presented by Detective Sergeant Crossman (Aptowitz/Kozlowski) PASSES 5:0 Detective Sergeant Crossman invited the Board and Mr. Ross to attend the Second Annual Run from the Cons road race on June 22nd Rich Hucksam, Town Counsel, is present before the Board. Mr. Hucksam summarized that Town Counsel's office was provided with a memorandum from the licensee's (Foundry, LLC) attorney which asserted that the public safety fee in the licensee is not a legitimate fee. Mr. Hucksam noted that Town Counsel reviewed the license and fee and disagrees with that and has sent correspondence to the licensee's attorney explaining the Town's position. Mr. Hucksam reported that his office was informed that the licensee and their attorney would not be present at this evening's meeting and stated they would be evaluating the correspondence. Board Of Selectmen's Meeting June 4, 2014 Page 1 of I I Mr. Annino asked for Mr. Ross' recommendation. Mr. Ross had supplied a copy of the opinion to the Board previously and reminded that there are recommendations for conditions needed to be met in order to renew the license, which would be to authorize the Chief of Police to make a decision based upon Public Safety as to whether or not the details at that location were necessary during the evening commute and secondly to complete payment of detail or any other fees currently due. Mr. Ross noted that the Board could approve the license with those conditions printed on it and that the office would not release the license until that time that all outstanding detail payments to the Town were made. Motion: To approve the license subject to the two conditions (DelVecchio /Annino) Discussion: Mr. Aptowitz inquired as to the period of time that has elapsed with respect to the outstanding payments to which Mr. Ross reported since the license was renewed one year ago (April 30, 2013). Mr. Aptowitz explained to viewers that there are two pieces to the commercial parking facility licenses that provide for commuter parking at the train station: a detail fee and a license renewal fee. He further explained that Foundry, LLC has paid the renewal fee but has not paid the detail fee. Mr. Ross noted there is one other lot of this type which has made ALL necessary payments and that the Town, through its Parking Enterprise Fund, pays a proportionate share of the detail fee. Mr. Dentino asked for the arrears to which Mr. Annino stated the file showed $6,244.20. Mr. Kozlowski asked for the difference between approving the license and not issuing until the outstanding payment has been collected or not approving the license until the outstanding payment has been collected. Mr. Ross stated that if the Board approves the license while the licensee is reviewing Town Counsel's opinion and then agree to pay the outstanding payment, the license could then be issued immediately but if the Board chooses not to act on the license and the outstanding payment is made the Board would have to first meet to approve renewing the license which would cause a delay in issuing. Mr. Ross noted the license should have been renewed and issued by April 30"'. Mr. Kozlowski asked if the Foundry, LLC lot was open to which Mr. Ross reported it is as the Town held it open while Town Counsel was working on its response to the licensee's opinion, which has been approximately five weeks. Mr. DelVecchio asked for confirmation if the payment of the detail was a condition of the license originally to which Mr. Ross noted it is but the wording was different. Mr. Aptowitz noted that this has been a practice for at least ten years. Mr. Kozlowski asked if the logical extension of their argument mean that the Town cannot charge a detail fee to anyone. Mr. Hucksam explained that the licensee's specific argument is about this particular situation and set of facts. He did not believe it to be interpreted to all detail fees. Mr. Hucksam explained that the licensee is alleging that the need for the police detail at their location is not due to their lot but because of the traffic situation on Route 106. Chairman Dentino appreciated Mr. Ross' input and is aware that the Town has notified the licensee along the way but he would like to discuss a policy regarding a grace period in order to collect the fees that are in arrears before the Town takes away the license. Mr. Ross noted that technically the license does not exist as it expired on April 30tf and the Town has done what Chairman Dentino has suggested in holding off until this discussion could take place. Mr. Ross Board Of Selectmen's Meeting June 4, 2014 Page 2 of I I felt the action to be taken would be based on how the Board proceeds with the renewal of the license and then a discussion with Town Counsel. Chairman Dentino suggested a letter to be sent to the licensee notifying that they have a certain period of time (perhaps four (4) days) to make payment. Mr. Kozlowski asked when the fees were due to which Mr. Ross reported quarterly. Mr. Kozlowski stated payment due was not a surprise to the licensee to which Chairman Dentino asked was there some type of "demand" correspondence. Mr. Ross explained there was a bill seat each quarter with a response of non - payment and that he had several discussions with the licensees including one in the presence of Mr. Aptowitz. Mr. Ross noted in that discussion the Town made recommendations to change the license fees (about a year ago) where there was a small reduction in the detail fee and he felt there was an agreement in place. Mr. Ross reported that before any litigation could take place lie would speak with the Board for approval and then schedule a discussion with Town Counsel and nothing has been done like that to date. Chairman Dentino felt that both sides have operated for a number of months without one side paying and the other side not making a concerted effort to which both Mr. Aptowitz and Mr. Ross stated was untrue. Mr. Ross noted the Town has had numerous contacts with the licensee about payment and was told no and felt the real recourse would come when the license was to renew. Mr. DelVecchio asked once this payment, which is a requirement of the license, wasn't made, what is the status of the license then to which Mr. Ross stated to his knowledge the license is still valid until it expires where it cannot be renewed if there are any outstanding balances. Mr. Aptowitz compared this situation with a resident taking issue or disputing their tax bill and noted that the resident still has to pay the fiill tax bill and then apply for abatement or relief and proceed with the necessary process. Mr. Aptowitz had a problem with this fee not being paid for an entire year. Mr. Ross felt it was important to understand that details fees are a separate fund, a self - funding mechanism, so that when there is a detail there is an in and out fee and is not revenue to the Town and that the Town could possibly run a deficit to the fand at the end of the year which the DOR could then enforce the Town to reduce its Free Cash by that amount. Mr. DelVecchio asked if the recommendation from Counsel is to provide an opportunity to issue the license reflecting the conditions. Mr. Hucksam stated that this is a policy question for the Board but that is one way the Board could go. Mr. Kozlowski the Town has situation where a commercial parking facility is operating without a license. He asked if nothing moves forward this evening how does this play out in terms of the lot remaining open. Mr. Hucksam would rather not get into those specifics in this forum but as a general matter stated that when there is a license that requires renewal and it is not then the license is considered "not issued ". Mr. Hucksam explained that the license is the source of the ability to conduct a business. Mr. Annino was unsure as to the discussion as he felt it was clear the licensee has not paid the bill therefore the Board is not incumbent to renew the license. Mr. Hucksam felt that Mr. Aptowitz made an excellent analogy earlier in regards to non - payment of taxes. Mr. Ross also noted that that particular comparison had been made to the licensee as well. Board Of Selectmen's Meeting June 4, 2014 Page 3 of I t Motion: To approve the license subject to the two conditions (DelVecchio /Annino) Mr. Annino read the conditions: The Licensee shall provide all Town of Mansfield Police Details that are necessary in the opinion of the Police of Chief to assure the safety of the users of the licensed parking lot and the general public AND payment of all outstanding public safety fees are due prior to the issuance of the license. 1:4 (FAILS) Mr. Annino stated he is uncomfortable signing anything without a resolution. Mr. Kozlowski felt there was no need to take any action at this time. Both Mr. Aptowitz and Mr. DelVecchio agreed that no action should be taken. Eric Shute from TGI Fridays is present before the Board. Chairman Dentino asked for questions from the Board. Mr. Kozlowski asked Mr. Shute to provide a brief background of his history and his experience in the business. Mr. Shute stated he owned and operated a sandwich shop in Easton for 16 years before he sold the business. He got back into the restaurant business joining TGI Fridays in 2011. Mr. Shute noted he does not have experience managing an alcohol license but has received the required training through TGI Fridays. Mr. Annino inquired if there was a Manager of Record on the premises to which Ms. Whalen explained that TGI Fridays notified the Board of Selectmen's office that its manager, Rhianna Simard, was no longer employed at that location. TGI Friday's submitted one application which was denied, due to the proposed manager was not a U.S. Citizen and then TGI Friday's submitted a second application designating Mr. Shute. This process has taken about 30 — 60 days. Chairman Dentine, noted this is another example of the Board not being notified of change until well after the fact. He inquired as to the timing of the last manager leaving to which Ms. Whalen noted that TGI Friday's licensing department informed the office approximately 60 days ago but the initial application was denied due to the applicant not meeting the requirement of being a U.S. citizen. Mr. Shiite's application was then received on May 15t1i. In speaking with TGI Friday's licensing department Ms. Whalen noted they informed her that all managers were TIPS certified and that the licensed was being managed but was unsure of the former manager's exit date. Mr. Aptowitz explained to Mr. Shute that the Board takes issue with corporate chains or any establishment that does not notify the local licensing authority (Board of Selectmen) when there is a change to its license, especially a change of manager. Chairman Dentino would like to have the Board discuss a new policy where there would be some type of punishment involved if the Board is not notified of a change of manager within a reasonable amount of time. Mr. Kozlowski would like to see this discussion scheduled within the next few meetings. Mr. Aptowitz explained to Mr. Shute to convey to the corporate office the seriousness of informing the Board of a change as it has seen this time and again from the corporate chains. Board Of Selectmen's Meeting June 4, 2014 Page 4 of 11 Motion: To approve Eric Shute as the new manager for TGI Friday's (Aptowitz/Kozlwoski) PASSES 5:0 RIM " 66,171 ' .1 m 1 0 1 o' i•Ya' Fs rtx `. ' r .i F ON and hackney driver's license for the Town. He believes there is a need in the Town for an additional company as he used to be employed, for the past 8 years, at Veterans Taxi where he noted wait times for this area were upwards of one hour. Chairman Dentin noted that Mr. Dello Russo was speaking from experience and recognized that all the paperwork was in order. Mr. Annino inquired if the company would be based in Mansfield to which Mr. Dello Russo noted that at this time he is the sole proprietor and only driver. He explained that he will be operating out of North Attleboro with Mansfield as his priority area. Mr. Dello Russo hoped that business would go well and would build from there. Mr. Aptowitz asked how the business operation would work logistically to which Mr. Dello Russo explained he will have a Mansfield number which would be forwarded to him to schedule the pickup of the fare. Mr. Kozlowski commended Mr. Dello Russo for starting a new business in Town. Motion: To approve a new hackney carriage license for Paul Dello Russo dba Already Taxi (Aptowitz/DelVecehio) PASSES 5:0 Motion: To approve a new hackney driver's license for Paul Dello Russo dba Already Taxi (Antowitz/Kozlowski) PASSES 5:0 Russell Barnaby and Bob Palmer are present to discuss further refinement of the master plan for the Chocolate Factory and presented some renderings of the site and the pre - development activities. These included plans the new entrance to the building, brewery /pub, interior view of the upper floor apartments as well as a restaurant in the stone building. With regards to the storage area or "block building ", Chocolate Factory LLC would like to convert this into a two -story residential building with approximately 16 units. Mr. Burnaby also noted that with respect to the front building there is over 5,000 sq. ft. where they would like to see some type of medical or dental offices. Lastly, he noted that the Butler Building (11,250 sq. ft.) could be utilized for the brewery he spoke of earlier. It was felt that there would be a need for approximately 400 parking spaces and the space is available but they would like to mindful of the walking distance. Mr. Burnaby reported that they are in negotiations with four separate investment partners, one of which is the Davis Companies. He also noted that they are working with BK Architects out of Brockton who has done some work in the Town and are familiar with both the Building and Planning Departments. In terms of milestones, Mr. Barnaby stated a group has been hired to assist with applying for the structure to be placed on the National Register of Historic Places, which would allow between $10412 million in historic tax credits. This money would be put back into the project as defacto equity. They are also looking to prepare a tax credit syndication package with State Street Bank Board Of Selectmen's Meeting June 4, 2014 Page 5 of 1 I but have no details at this time. Mr. Barnaby noted they expect to go to purchase and sale with ADM by mid -June. Mr. Barnaby and Mr. Palmer plan to apply for a $2.5 million pre - construction loan with a bridge loan to purchase the property. Additionally, they have hired High Point Engineering out of Bridgewater, MA to quarterback the site survey (topography and review of Phase I on the environmental side). Mr. Barnaby stated they would like to begin construction in early spring, 2015 and noted it is a 14 -18 month project. Mr. Kozlowski noted that in the original presentation the storage building was in question as if it would be kept to which Mr. Palmer explained they are still waiting for a ruling from the National Register on its historic status. Mr. Kozlowski wanted to confirm that the number of residential units would still remain the same for the entire complex since the original presentation did not have any units in this particular area. Both Mr. Palmer and Mr. Barnaby stated that the number of units would remain the same just now using different areas of the site. Mr. Aptowitz asked when the group expected to hear on the historic status to which Mr. Barnaby stated mid -July and that from experience they feel pretty good about it. Mr. DelVecchio asked how the timeline presented this evening differed from the original presentation. Mr. Barnaby reported there is more detail and it is a refinement. Mr. DelVecchio asked if the group was confident in the use of the storage building for residential units and if not does that change the sizing of the units. Mr. Barnaby did not have information regarding that and was unsure at this time. Mr. Annino asked if the signed Development Agreement stated two years to which Mr. Ross noted it did. Mr. Annino felt the dates were too aggressive and referenced mid -July for the historic designation would not happen. Mr. Annino would like to see a more realistic timeline. Mr. Barnaby noted they are aggressive but Mr. Annino reminded that the dates are already out of line with the agreement and he is concerned. He is looking for a bar chart of each phase of the project, including financing. Chairman Dentino is very pleased with the way Chocolate Factory LLC has presented themselves and the project and particularly noted the professionalism and transparency. Mr. Ross noted his office has iust been in receipt of the traffic Lee Azinheira, DPW Director, and Mark Cook, Highway Operations Manager, are present before the Board. Mr. Azinheira noted that the Town currently has 55 cul -de -sacs with islands. In preparation of this evening's meeting, Mr. Azinheira and Mr. Cook viewed approximately 15 over the past few days and distributed photos of those to the Board. He noted that the majority of the islands are maintained in some aspect by the neighborhood and vary in size and level. Mr. Azinheira stated that the Town has never maintained these islands (cul -de -sacs) nor the right of way (10 — 15 feet from the edge of road other than cutting back brush for safety reasons) as it does not have the finances or resources (staffing) to do so. Mr. Cook noted that some of these cul -de -sacs have elaborate landscaping and referenced Newell Lane as one which would be ideal as the Town moves forward when planning. It has been Mr. Board Of Selectmen's Meeting June 4, 2014 Page 6 of I 1 Cook's experience over his 26 years that the residents work on the islands and cul -de -sacs and that the DPW will then be happy to pick up any debris. Mr. Cook stated the Town has doubled its road mileage since 1985 yet have less employees. Mr. Annino read a letter into the record from Tom French, Chairman of the Planning Board, regarding the issue of maintenance of cul -de -sac islands. Joe Presti, 34 Noreen Road, is once again present to speak before the Board. He felt he is in a unique situation as he and one other home are affected by the island cul -de -sac in his neighborhood. It was his understanding that despite the rules and regulations it has not been the practice of the Town to maintain the cul -de -sacs and has been left up to neighborhoods to band together. Since his last appearance before the Board Mr. Presti did reach out to his entire neighborhood but unfortunately was met with little assistance. Mr. Presti is willing to assume the responsibility to bring the island back but in the hopes of the Town providing some assistance. Mr. Aptowitz did note that he walked the island and it was not good and understood Mr. Presti's frustration. Mr. Presti did contact a landscaper and appreciated the Board's efforts in scheduling this as an agenda item. He distributed the quote from the landscaper (Guerrini Landscaping) to the Board and stated he would be happy to meet the Board more than half way. Mr. DelVecchio had asked that this discussion be scheduled and stated he now feels more informed. He stated he also drove by Noreen Road and felt that this is a policy matter about what can the Town now do. Mr. Azinheira agreed with Mr. DelVecchio and informed the Board that whatever is decided for one area will need to be followed through for all. Mr. Ross did note that Mr. Presti's situation is a unique where it is isolated with only two houses but agreed with Mr. Azinheira's concern in that once the Town starts, where will it end. Mr. DelVecchio was intrigued by the concept of the low maintenance vegetation but it doesn't seem to be applicable right away. It was his thought that if the Planning Board, as stated in its letter, will be addressing this issue over the summer, perhaps the Board should wait to hear its recommendations. Mr. Kozlowski questioned what level of involvement the Town has in assisting, guiding or helping neighborhoods that don't come together on their own. Mr. Annino stated this is a dangerous precedent especially since the Town has just been through a tax increase and the DPW is already stretched to the limit. Mr. Aptowitz commended Mr. Presti for his professionalism and level headedness. Mr. Aptowitz, working in the real estate profession understands the aesthetics of the situation but felt everyone was right involved is right. Mr. Presti asked if the Board would allow him to present a proposal where he would lay out his responsibility in regards to cleaning up the island. He assured the Board again that he would meet it more than half way. Mr. Ross asked Mr. Presti to send it directly to him. Chairman Dentino viewed Noreen as well as a few other cul -de -sacs and felt that the initial cost, if done correctly, would be relatively inexpensive but felt the Town cannot be in the contracting business and could not do anything monetarily. He felt Mr. Presti's frustration at his neighborhood but felt the Town could not force neighborhoods to create associations. He noted there were a number of beautiful ones out there where neighborhoods have exerted a great amount of time and effort. Board Of selectmen's Meeting June 4, 2014 Page 7 of 1 I Mr. Ross noted that the Town can provide assistance with picking up the debris and hauling materials away. He did not recommend looming the area but rather to place stone. He would like to view Mr. Presti's proposal and speak with Mr. Azinheira and Mr. Cook further. Mr. Cook noted that if a private landscaper were to be involved in the project that the DPW would need notification as some of these islands have underground wiring and Dig Safe would need to assess. He stated he would reach out the Mass Department of Agricultural Resources regarding products that could be used. Mr. Cook felt that perhaps the Keep Mansfield Beautiful Committee, the Garden Club or Boy Scouts would be looking for a project. Mr. Ross also noted that he had an idea from Sergeant Bain in perhaps running a contest with Keep Mansfield Beautiful on the "nicest cul -de- sacs" where there could be some tvve of reward to encourage neighborhoods pitching in. He asked the Board to consider putting "teeth" into that policy as it appears that the Board continues to relay the message but there has been no improvement. He felt businesses in Town need to respect the process, especially those large chains. A. Correspondence • Receipt of Letter from Boy Scouts of America, Troop 17 of the Annawon Council Announcing Two Scouts Promoted to Eagle Scout: Mr. Timothy M. Elofson and Mr. Michael P. Healy Mr. Ross reported that Lou Andrews, Airport Commission, brought in a schematic plan and rendering of the proposed administration building to be built at the Airport. He noted there is no changing the design of the building and that the Commission is not thrilled but it is roughly a $4 million building that the FAA and State is providing for the majority of funds. Mr. Ross reported that bids were opened last week regarding repairs on the high school gym floor. He explained that the Town became involved as originally the School Department was talking about replacing the entire floor with a high cost estimate and then asked the Town for assistance. Mr. Ross noted that with Mr. Annino's guidance, as well as Mike Ahern, Buildings and Special Projects, the cost and repairs has been kept way down where now there will be improvements to the ventilation around the floor and floor repairs. Mr. Ross reported that patching work was conducted on Main Street on Monday (June 2nd) as it is one of the slower days. Work was started earlier in the morning and was mostly complete by 12:00pm. Work on sidewalks will also be started over the summer as well as new banners which includes the Town's new standardized font. Mr. Ross reported that he as well as the Board received a letter from the Brookside neighborhood and associated streets regarding chip sealing. He has visited the area and is drafting a letter to the residents with Mr. Azinheira and will share that with the Board upon completion. Mr. Ross noted that Mr. Cook has recently done some spring street sweeping of the area. Mr. Ross met with the MBTA this morning regarding the ramps over at the train station area. Mr. Ross noted he addressed the question of who owns the underpass area to which they felt it belonged to the Town. Mr. Ross noted that at that same meeting Frank Gay from GATRA Board Of Selectmen's Meeting June 4, 2014 Page 9 of I I reported that in 2001 as part of the train station construction the Town granted some easements to the MBTA from Town Meeting. Mr. Ross and the MBTA were not aware of that and both parties are unsure if these easements line up with where the MBTA would like to put the ramps. They will review the map distributed but noted they will likely use eminent domain. Mr. Ross noted that beginning on Friday, June 61", the new carpet will be installed throughout Town Hall, He also reminded the Board that bids will be opened soon on exterior work at the Library and Council On Aging and that there is a need to budget money to replace the carpet at the Library. Mr. Ross gave a brief overview of the Manager's Summer Conference in Lenox that he attended where one of the primary subjects was the strategic planning process in Oclair, Wisconsin where he reported the process was identical to Mansfield's but their cost was much higher. He noted that one of things they are proposing, that Mansfield is also doing, is bringing Dr. Mullen back to review the plan, conduct community meetings and meet with the advisory committee to make adjustments and incorporate the plan as a living document. Finally, Mr. Ross noted that the Board should consider the following as upcoming agenda items: change of manager policy, social media policies, discussion of personnel policies and Fales site. Mr. Aptowitz noted he visited the first night at the Xfinity Center where the weather was a challenge as was the crowd. He thanked Chief Sellon and Chief Boldrighini for their work that evening. Mr. Aptowitz visited the Brookside neighborhood after receiving a resident's letter, noted earlier by Mr. Ross, and felt the area to be in much better shape than other areas in Town. Mr. Aptowitz wanted all residents to know that the Board is aware of their concerns and although the Town does not have the money to reconstruct every road it is working on putting down safe and effective products. Mr. Aptowitz would like to set a firm date for the next Light Commissioner's meeting. The Board settled on Monday, June 16 "'. Mr. Annino expressed concern over the volume of signs coming into Mansfield from Foxboro on Route 106. He noted that some of the signs have faded are not legible and asked Mr. Ross to work on taking some of those down. Mr. Annino also inquired as to the status of the renovations to Memorial Hall to which Mr. Ross reported that the study is complete and he would get Mr. Annino a copy. Mr. Annino was unhappy with the design for the Airport Building and felt it did not reflect the character of the community. Board Of Selectmen's Meeting June 4, 2014 Page 10 of I l Mr. Annino has been researching web sites for municipalities and would love to see more promotional items on the site, especially video. He would also like to see the site be easier to navigate. Mr. DelVecchio was glad to hear that the Board will be discussing the IDC versus EDC at its next meeting but would like to add that the topic was also suggested by Mr. Annino and Mr. Aptowitz. He is also looking forward to the discussion on the Town's web site. Mr. DelVecchio noted he was able to meet with Department Heads on Friday (May 30"i) and also toured the Highway Garage and Wastewater Treatment Plant. He also noted he would be attending new Selectmen training on Saturday (June 7t1'). Mr. DelVecchio was honored to present a scholarship award last evening (June 3`d) at Scholarship Night at Mansfield High School. He was impressed with the dozen of students who were able to receive financial assistance in their higher education. Mr. DelVecchio also stated he was very impressed with the Town's assistance, especially Mr. Annino's, in regards to the gymnasium floor at the High School. He noted it saved the School Department a great amount of money. Mr. Ross also noted that Mike Ahern played an integral part in those savings. Chairman Dentino stated he would like a copy of the DPW building plans. Mr. Ross believed he had that file electronically. None.
