April 9, 2014
Present: Jess Aptowitz; Chairman, Doug Annino; Vice Chairman, Kevin Moran; Clerk, George
Dentino, Olivier Kozlowski and William Ross: Town Manager
Chairman Aptowitz called the meeting to order. Chairman Aptowitz reminded that this meeting is
being broadcast live by Mansfield Cable Access and taped for future broadcast.
Chairman Aptowitz asked for a moment of silence and offered condolences on behalf of the Town
and the Board of Selectmen to the Town of Easton and its' Police Department on the passing of
one of their police officers.
Mr. Moran read the public hearing notice into the record.
Motion: To open the public hearing (Moran/Kozlowski) PASSES 5:0
Chairman Aptowitz reported that he had spoken with the Planning Department earlier in the day
and that the Board is in receipt of a punch list conducted by Rick Alves, Town Engineer, and Mike
Ahearn, Constriction Inspector, Public Buildings and Special Projects Manager. The Chairman
felt that the items listed were nothing of concern. The Chairman then asked if there were any
residents from Camden Lane who would like to speak.
Frank Pascoli, 9 Camden Lane, noted he had sent a list of items of concern to the developer and felt
satisfied with the way things are progressing.
Ryan Gentili, 5 Camden Lane, noted he too sent a list of routine items and was satisfied with the
progression. Mr. Gentili is concerned with regards to the traffic utilizing both sides of the
cul -de -sac where some are travelling in the wrong direction. He suggested a "Keep Right" sign and
felt it was a dangerous situation. It was recommended by Chairman Aptowitz to have public safety
investigate the current flow of traffic. Police Chief Sellon was in attendance and reported that he
could have Officer Kinihan look into the situation.
Shaun Burke, Director of Planning and Community Development, reported that the punch list is
being worked through as witnessed by himself, Mr. Alves and Mr. Ahern. He explained that the
only item of note is the wearing course of pavement but that is due to the plants not opening until
next week. He noted the pavement has been marked, a few sections will need removal, binder
replaced and then the wearing course will be placed. The Board reviewed the
As- Built/Acceptance Plan. Mr. Burke felt due to the fact this is a short road — approximately 650
square feet — there would be no problem completing this prior to Town Meeting and that all
concerns from residents within the neighborhood have been dealt with.
Board Of Selectmen's Meeting April 9, 2014
Page 1 of 11
Mr. Dentine inquired as to the opening of the plant to which Mr. Burke responded about April 15 ".
Mr. Dentino reviewed items on the punch list where he had concerns notably the road work and
installation of the handicapped ramps. Stan Feck, the developer, explained that although steel
plates are typically used today his plans do not utilize them and there wouldn't be any issues. Mr.
Feck noted there are about seven or eight items on the list that cannot be completed until the
wearing course has been placed. As Mr. Dentino reviewed the punch list further Mr. Feck reported
that some of those items had been completed. It is Mr. Dentine's concern that most items on the
list cannot be completed until the wearing course is paved and questioned why these items were
not then crossed off the list.
Chairman Aptowitz was concerned that there was no signage block on the plans for the Board of
Selectmen. Mr. Ross recommended that the Board, if voting to approve Camden Lane at this
meeting, vote to approve subject to signing a revised plan at the next BOS meeting.
Mr. Annino asked if the tree plantings were completed to which Mr. Burke responded yes.
Mr. Dentino again noted the Board is looking at the report from the Town Engineer which states a
number of punch list items still to be completed and questioned why the Board would sign off at
this juncture. Mr. Burke explained there has been correspondence by his office to the necessary
Town Hall departments involved with street acceptance asking for punch list items or concerns
with the acceptance of Camden Lane and reported there has been none. Mr. Burke also noted that
he has inspected this subdivision numerous times over the past week and has been able to cross off
many items from the list currently before the Board. Mr. Burke also suggested that none of the
items on the list are fatal to street acceptance and are wrapped into paving. Mr. Burke felt failure
to accept the sheet hurts the residents of the street and that acceptance will make the Town eligible
for Chapter 90 reimbursement which is dependent upon making a street a public way. Mr. Burke
reiterated that other than the paving none of these punch list items are fatal of acceptance. Mr.
Dentine does want the sheet accepted for those residents but does not want to leave any items of
concern on the current list before the Board incomplete and felt it was a disservice to the Board to
have a list before them that is not up to date. Mr. Burke agreed there should have been a
supplemental memo.
Chairman Aptowitz stated the residents want an accepted street but it has to be done right. The
Chairman asked if there were any other public comments to which there were none.
Motion: To close the public hearing (Annino /Dentin) PASSES 5:0
Mr. Feck reported that the street will be paved on April 18d' and reminded the Board that there is a
bond in place. He noted the Town has approved roadways with punch lists previously.
It was the Board's decision not to vote on this item and to schedule this at next week's Board of
Selectmen's meeting in order to remove the items from the punch list that have been completed

Marianne StaDles. Town Clerk, is present to witness the Board's
Lee Azinheira, DPW Director, is present before the Board. Mr. Azinheira reported there is a gas
main (circa 1915) on Union Street that Columbia Gas has been having problems with. Columbia
Gas will need to conduct repair work from Park Row through Spring Street on the West Side. He
explained that because of the construction equipment, and the need to keep one lane open to thru
traffic, it is recommended to have no parking on both sides of Union Street from Park Row to
Spring Street from 7:00am — 5:00pm during construction (approximately four weeks).
Chairman Aptowitz asked if there were to be details to which Mr. Azinheira responded yes and
paid for by Columbia Gas. The Chairman also inquired about the street cut and paving after
completion to which Mr. Azinheira explained it would be a patch and that Columbia Gas would
maintain that until the Town paved the street.
Mr. Kozlowski asked if this was a burden to residents but Mr. Azinheira felt most residences had
ample parking and may put cars on street for convenience.
Mr. Dentino asked if there were any new tie -ins to which Mr. Azinheira stated there are a few
people in the area still on oil and noted Columbia Gas is reaching out to those to see if they would
be interested in converting while this work is being conducted.
Mr. Azinheira reported there would be flyers handed out to residents as well as postings.
Motion: To establish a parking ban on both sides of Union Street from Park Row to Spring Street
from 7:00am — 5:00pm during construction (Annino /Kozlowski) PASSES 5:0
Mr. Azinheira reported that the electric work would take place from Bird Road, all along Maple
Street to Kate Springs and the water main (upgrading to 12 inch) starts just east of Jennifer and
back to Kate Springs. He noted that once all the work is completed they would fully reconstruct
that road and where the work is electric the cost will be split with the Electric Department and
where it is water that will be split three ways (DPW, Water and Electric).
Chairman Aptowitz asked if there were any buildable lots on Maple Street to which Mr. Azinheira
reported proper notice will be given to all property owners along Maple Street.
Mr. Dentino asked if

Discussion:

Mr. Dentine asked how this would affect the Enterprise Accounts in terms of fees to which Mr.
Ross explained that the logic behind it is because we are repaving the street partially with money
from both of the Enterprise Accounts it was like double dipping to hit them with the fees.
Motion: To waive the Road Opening and Excavation permit fees for the installation of new water
main and electrical conduit on Maple Street (Moran/Annino) PASSES 5:0
Bruce Montgomery, General Manager, Live Nation Worldwide, Inc, is present
scussion.
Mr. Kozlowski noted there were not a lot of substantive changes made other than some
reconstruction that is happening in some of the police and fire areas but as far as the text it is fairly
straight forward.
Mr. Ross noted there was a discussion and work to be done in regards to pedestrians crossing on
Route 140 at locations that are dangerous and questions whether there is a need for extra detail or
working with Xfinity Center personnel to steer pedestrians to a safer area. I-Ie noted it was felt that
it did not need to be included within the license agreement but dealt with internally. He also noted
there would a relocation and expansion of both the police and triage areas, which makes it much
more convenient for everyone to perform those services and provide separation (under the new
Law) of minors under 18 from any other individuals in those areas. Finally, Mr. Ross reported
there will be additional sessions and discussions held prior to shows (especially those of with
particular issues in the past) with EMT, Town Police and Fire and Xfinity Center Security Staff to
ensure proper staffing on all sides. Mr. Ross stated that everyone felt the Information Center has
proven to be very helpful and will be continued. Mr. Ross gave Mr. Montgomery and Chairman
Aptowitz credit for relocating the EMS area.
Mr. Dentine felt the big push was last year and was successful. Mr. Dentino commended Chief
Sellon and Chief Boldrighini as well as Mr. Montgomery for coming together to finalize the
agreement that works very well. He still wished that the grass area was removed and maybe down
the line that would happen.
Chairman Aptowitz was glad to see the compound/triage center relocated and user friendly. He
did note he is concerned with the taxi cab issue and who polices that. Mr. Moran noted this was
discussed a few years ago. Chairman Aptowitz stated that any taxi cab picking up at the Xfinity
Center should be properly licensed for the Town of Mansfield and there could be compliance
checks. Mr. Montgomery explained the danger with the taxi cab issue is that the drivers are telling
their fares to meet them across the street at a business location which is a dangerous situation and
also disrupts the traffic flow. Mr. Montgomery noted there are designated areas for taxi cabs and
limos within the Xfinity Center grounds and he will continue working with the Chiefs to help solve
that problem. Chairman Aptowitz stated it is a collaborative effort to keep everyone safe.
Motion: To approve and sign the license for the Live Nation Worldwide, Inc. Entertainment
License (Moran/Kozlowski) PASSES 5:0
Chairman Aptowitz thanked the Planning Board for their attendance at tonight's meeting. Present
are Tom French, Chair, Mike McClanahan, 104 Cottage Street, Don Cleary, Mike Feck, Cheryl
Collins, School Street and Ralph Penney.

Page 4 of I I
The Chairman bad noted that the Board had questions regarding some of the Planning Board
sponsored Articles at a previous meeting and had asked for some clarification. Mr. Annino would
like to go through all the Articles and explain their rationale.
Article 20: Transit Oriented Development
Mr. French noted this is an Article to create a revitalization overlay district in the area of the train
station. He explained it is an economic development initiative to develop a prominent and
underutilized area of the Town. He reported the Board has worked diligently this past year and last
year and the time to do this is now. Mr. French referenced that the BETA study is almost
completed with presentations to various Boards, the Board of Selectmen and the public, zoning
would be needed to obtain funding from MassWorks and other agencies to fund traffic and other
infrastructure improvements that will be needed and that elected officials need to show the zoning
to display their commitment. He explained this will be a public /private partnership.
Mr. Kozlowski questioned the need for a transit oriented development scheme. Is it just to obtain
grant money and asked does the Town need zoning that permits the uses or does it need something
of a level of what is contained within the Article. Mr. French stated a specific zoning Article like
the one the Planning Board is proposing is what is needed. Mr. Kozlowski's issues with the
Article are that some of the items seem vague or difficult to know how to comply. He noted in
particular the open air market. Mr. French stated the Article is all over the place but that Shaun
Burke did a good job working with the information from the State, SRPDD and other TODs to
create a framework (gives density) and create a special permit process. He noted it is important to
let the process work. Mr. French stated the Article provides direction and some specifics but leave
it to the point to allow some creativity like an open air market and other community based things.
Mr. Kozlowski other concern was the shared parking. Mr. Cleary stated it is not sharing of spaces
but of a structure and is meant to be, for example, three different buildings sharing one structure.
The Planning Board explained that is of a mixed use nature with business having different hours of
operation. Mr. McClanahan explained it is important to realize this is a tool to move forward but
there will be a permit process to meet the requirements. Mr. Kozlowski asked again what kind of
zoning is required to have the development and does it need to be at this level to which Mr.
McClanahan stated the key is if the MBTA is going to do something for the Town and something
like this Article needs to be in place first and this is the master plan of what the Planning Board is
trying to do. Mr. Cleary noted this Article crosses over zones and what the Planning Board is to
trying to do is create a cohesive group around the various zones. Mr. French noted the idea of the
train station within this Article is aimed at people who want to live on the train line. Mr.
Kozlowski felt that premise works in an urban area and what this Article seems to be doing is
trying to transplant something that works in Cambridge here. The Planning Board is conscious of
that and Mr. French stated it is not trying to replicate. Mr. Kozlowski felt that the live "car free"
philosophy would not work here.
Mr. Kozlowski referenced the Article calling for structures to be visually appealing and questioned
the process as visually appealing means different things to different people. Mr. Moran reiterated
that there is a permit process associated with this Article and that it can never be zoned to the "nth"
degree. Mr. Annino stated being visually related is important and is just trying to create a cohesive
community that looks nice. Mr. Kozlowski felt it is micromanaging.
Mr. Annino noted the TOD has been around for years and applauded the Board for coming
together and presenting a cohesive Article. He was concerned about the complexity of the Article
Board Of Selectmen's Meeting April 9, 2014
Page 5 of I I
and getting the residents to understand so that they can vote intelligently. Mr. French expressed
this is an economic development initiative and an opportunity to turn this into something with
mixed use (nice places to live, shopping). Mr. Annino asked for graphics.
Mr. Moran stated this to be sold as a framework and to get the residents involved and not to get
hung up on the details. Mr. Cleary again noted this is an overlay district and that no one is losing
any rights but instead will be able to take advantage of the additional zoning of the TOD and view
it as an "add on ". Mr. Annino stated that control is the key word as it could be a very large
development and could get out of hand rapidly and felt it needed structure. Mr. Annino felt that a
lot of towns on the "T's" ridership are looking aggressively at this. He specifically noted his work
in Watertown and how the area is exploding with this. Mr. Annino asked if this Article was drafted
with local developers and how much input did they have to which Mr. French noted that the
Clemmey's have been active participants. Mr. Burke explained that when putting the By -Law
together, he reached out and involved SERPDD and other communities. He noted when looking at
impacts he also looked at build out and economic development and what impact the TOD would
have on Town services. Mr. Burke utilized Xia Jin, GIS Director, in this analysis. Mr. Burke felt
that there is flexibility in the By -Law and that the timing is now.
Mr. Kozlowski asked if the Town currently has the one space per unit for parking in the downtown
to which Mr. Burke noted it is one and a half. Mr. Kozlowski asked if winter parking bans would
still be required to which Mr. Burke noted to public ways.
Mr. Dentine, noted how hard the Planning Board worked in developing the framework. It is his
opinion that residential, which is 80 % of the plan, would not be the way to help the Town. He was
glad there was money out there from State and Federal (MassWorks) but felt it these programs
only last so long and the money runs out. Mr. Dentine, asked Mr. Burke if the Town was zoning
with the same density and locations as it did three years ago. Mr. Burke explained that around
2005 there were high densities but this Article does not approach those levels. Finally, Mr.
Dentino asked about the traffic report to which Mr. French noted that most of what the Town had
before were onsite studies but that this study looked outside of the area.
Mr. Penney stated the traffic study was different in that there were plans and the hope is that plans
lead to funding.
Article 21: Adaptive Reuse of Historic Structures
Mr. French noted this is an Article that seeks to preserve and foster reuse of vacant and
underutilized non - residential buildings built prior to the adoption of the zoning in the Town in
1953 by allowing reuse of buildings in any zoning district for purposes other than those for which
they were build. It seeks to replace the existing provision with one that contains specific standards
of applicability, application and review standards and approval would be by special permit. Mr.
French noted that there are19 older buildings this Article applies to, including the Chocolate
Factory. A list of buildings was distributed to the Board.
Mr. Annino asked this differed from last year's Article to which Mr. Burke explained it is a whole
new bylaw where last year's Article (a Citizen's Petition) used the existing definition called
"Older Building Reuse" and sought to amend to clarify the use beyond municipal buildings. This
entirely new By -Law identifies the buildings prior to 1953 with a specific size and goes into much
greater detail in regards to historic, cultural significance.
Board of selectmen's Meeting April 9, 2014
Page 6 of 1 I
Article 22: 55 And Over In The RI District
Mr. French stated this is not really a Planning Board Article but theirs by proxy. Mr. Ross
explained there is a State Law called the Dover Act that relates to religious uses of property and is
fairly broad. The local United Methodist Church is proposing to purchase property on Branch
Street for a new sanctuary /church offices and as part of that to build an apartment complex for 55
and older. Mr. Ross noted the argument is that the apartment complex is part of the social mission
of the church to serve the elderly and persons with low /moderate income. Mr. Ross noted he is a
United Methodist but is not a member of this congregation. This issue has never been litigated so
there are no court decisions that would apply to this situation. Mr. Ross reported this does have
Town Counsel's blessing and is up to the Town to decide. Chairman Aptowitz lives in the abutting
subdivision.
Article 23: Create New Zoning District B4 (presently zone B3)
Mr. French noted this is a similar Article to what was originally presented as a Citizen's Petition
two years ago and last year as a Planning Board Article that just fell short of the two - thirds needed.
This Article would create a new zoning district, B4 Gateway Business District, which will include
the Copeland Drive/Route 106 business area (presently zoned B3). Mr. French noted there are no
changes proposed to other areas of the Town Zoned B3, which was a confusing factor previously.
He went on to explain the purpose is to increase the allowed building density in this Copeland
Drive /Route 106 — increase maximum floor area ratio in order to create more economic
opportunity. The Planning Board felt that the current floor area ratio of .25 was not significant
enough to encourage reinvestment in buildings and felt it appropriate to increase the density.
Article 24: Medical Marijuana
Mr. French explained this is an Article to propose regulations where these dispensaries (recently
approved by the State) can go. The Article defines it and stipulates where it can be located. Mr.
French noted it would be out in the industrial area somewhere. Chairman Aptowitz clarified that
the Town can't say no to a dispensary but can say where it can be located. Mr. French then read the
setback requirements: 1,000 feet from a residential zone, 1,000 feet from residential use, 1,200
feet from public /private school and 1,200 feet from a daycare facility.
Article 25: Airport
Mr. French noted that Lou Andrews from the Airport Commission approached Mr. Burke to work
on this Article. The Airport Commission would like to work in some potential uses, such as a
restaurant, retail store, ect., within the Airport area to better coordinate the zoning By -Law with the
Airport Master Plan.
Article 26: Architectural Projections And To Set Backs Into Residential Zones
Mr. French explained that the intent of the amendment is to allow minor projections such as stairs,
chimneys, foundations and to require set- backs, which provides a little more leeway for builders
or people building additions on homes. Mr. French noted it is to provide a little more freedom and
also to cut down visits to the Zoning Board of Appeals.
Mr. Annino asked if this was coordinated with State Building Code to which Mr. Burke reported
no as it is a local option. Mr. Annino would like to see that reviewed as the Building Code allows
projections beyond the lot line and would be nice to have that in line. Mr. Burke noted the only
location allowed for zero lot lines is downtown (BI and B2) and this Article speaks mostly to
Residential Zones and the Article is mostly a zoning issue than a building code issue.
Board Of Selectmen's Meeting April 9, 2014
Page 7 of 11
Article 27: Residential Compound
Mr. French explained that this Article is to delete Section 5.7 Residential Compounds from the
Zoning Ordinance. Mr. French defined a Residential Compound as an alternative to conventional
enclustered type subdivision. It is allowed in the RI district by special permit by the Planning
Board for not more than six lots. Residential Compounds allows lots to be constructed on a private
shared driveway rather than street and is a private road. Private roads are not constructed to Town
standards and not inspected by the Town during construction and that the Town holds no bond or
surety on a Residential Compound driveway. The concept of a Residential Compound is to
provide a low cost flexible alternative to a conventional or cluster subdivision. Mr. French
explained that the concern with Residential Compound driveway is the uncertain construction
standards and quality to quality of construction of the roadway, Town emergency vehicles and
school buses using these driveways must be maintained by the lot owners including plowing of
snow and maintenance of the driveway surface and repairs to the base of the driveway. He noted
there is a question as to the ownership of the underground utilities and problems in the past with
developers not properly completing the roadway and that potential always exist.
Chairman Aptowitz asked if this Article were to pass would existing compounds become
preexisting non - conforming to which Mr. French answered the use is protected by the special
permit which has been granted. Mr. French noted that per Mr. Ross, language could be introduced
to grandfather in already existing compounds. Mr. Ross stated that Mr. DeRensis has suggested
language and will prepare an amendment for Town Meeting that would grandfather all of the
existing compounds.
Mr. McClanahan noted that no formal vote has been made from the Planning Board at this point.
Mr. Penney noted there was a lot of push back at their public hearing regarding this issue.
Mr. Ross noted there will be three meetings tomorrow evening (April 10 "') regarding the budget:
Capital Improvement Committee, where there will be no modifications needed for the current
year's Capital Improvement however, in reviewing the previous meetings minutes, there was a
motion on all the Municipal items but no action on the Schools due to questions of moving items.
Secondly, there will be a Budget Sub - Committee meeting and Mr. Ross reported that he, John
Stanbrook, Brenda Hodges and Ed Vozzella have a balanced budget ready to present to the
Sub - Committee and addresses both needs of the Municipal and School sides. Mr. Ross
summarized the budget in terms that it does not include all of the staff originally presented and that
there are some reductions, particularly elementary ages, due to the decrease in enrollment. The
School Committee voted to approve that budget at its meeting on April 8tf. Finally, the Finance
Committee will also meet tomorrow (Thursday, April I Od ).
Chairman Aptowitz noted there has been talk around Town that the Board has repaired and
renovated both the South and North Commons but have forgotten the roads and sidewalks. He
explained that there is a list/schedule by fiscal year, held at the DPW and Town Manager's Office,
regarding streets where repairs are needed and the projected cost associated with each area. Mr.
Ross noted there is additional money coming to the Town from the Governor's office ($40 million
State wide, $10 million to be used by Mass Highway), which is about $114,000 to be used this
spring intended towards road repairs and equipment during the winter. Additionally, the Town is
working towards a project for the summer of 2015 on East Street (school area) regarding safe
routes to school program (sidewalk improvements, parking and repaving).
Board Of Selectmen's Meeting April 9, 2014
Page 8 of 1 I
Mr. Kozlowski asked if the $40 million the Governor is releasing separate and distinct from the
$100 million that the Legislature authorized for cities and towns that he held back. Mr. Ross stated
Mr. Feck, 494 Stearns Avenue, was still in attendance and would like to comment on a few of the
Planning Board Articles. First, regarding the TOD, Mr. Feck felt it is an important Article and the
Planning Board has worked very hard on it. Mr. Feck felt it is an important tool for the future and
there should be incentives for that area, (noted parking — case by case basis). He noted it is a
framework and if the Town is to have any control over the area, this Article would address it.
Mr. Feck stated he is not a fan of the Article regarding Residential Compounds. He felt
Residential Compounds needed to be revamped but to just totally take them away without
replacing it with something would not be in the Town's best interest. He would rather see two to
three lots on a private driveway than have to build a 500 — 600 foot road that the Town will have to
maintain and would create a deficit in the balance of taxpayer money.

Mr. Ross reported the Town will be expediting and moving forward on utilizing the State's funds
on road and pot hole repairs as previously noted in the meeting.
Mr. Ross noted there will be Budget Sub - Committee and Finance Committee scheduled for
Thursday, April 10'h. Mr. Ross would like to schedule the Board's votes on all Town Meeting
Articles over the next few weeks.
Mr. Ross reported that the House Budget was released today and contained the same dollar
amounts as what the Town utilized in its budget.
Mr. Ross stated there will be a link on the Town's website regarding the Northeastern University
presentations.
Finally, Mr. Ross noted there will be a meeting tomorrow morning (April 10'h) regarding the North
Common and moving according to plan.
Mr. Moran noted that, as he has been away on business in Memphis, the roads in that area are
worse than here and that it is an issue all across the country.
Mr. Annino felt the Northeastern students did an outstanding job and felt the Board should show
their appreciation in terms of a letter of thanks. He noted they did extensive thought into
circulation in and around North Main Street through Forbes with valuable ideas.
Mr. Annino would like the Chairman to schedule a downtown walk before the summer season.
Mr. Annino would like to see movement on the signage program. He did not want to lose sight as
to the School awards and a designated area for that.
Mr. Annino was impressed with the promo film for the Chocolate Factory and would like to see the
Town do something along those lines to promote the Town.
Mr. Annino asked for the final Snow Budget to which Mr. Ross noted there are a few bills still
needed before the Town has a final number. He felt it would not run as high as anticipated.
Chairman Aptowitz received calls from residents on Morgan and Pinto regarding road repairs and
thanked the DPW for their quick response and encouraged residents to call with concerns and
asked for patience.
