Tobacco Violation @ Stop and Shop Supermarket.
Michael Healey recused himself from this hearing.
Todd Hurteau, Store Manager, explained during a compliance check, a long -term associate sold a
tobacco product to a sixteen year old male. The associate asked for an ID and the buyer stated he
did not have it with him. The clerk then asked for, and the buyer gave his true birth date and the
sale was made. Mr. Hurteau noted this is a first offense for the store. He said new procedures have
been put in place: anyone under 30 years of age purchasing tobacco products will be required to
show an ID and training sessions will now be done quarterly. Mr. Hurteau said since the violation, a
new POS register system has been put in place that will not allow a sale to go forward until the date
of birth has been entered and additional signage has been added to any register used for the sale of
tobacco products. He said under the store's Plan of Action, failure to follow procedure can result in
disciplinary action up to and including termination for a first offense.
