Motion to Approve the Consent Agenda:
Healey /Wall Motion passed 4 -0 -0.
Visitor: Eric Arvedon, Chairman of the Town of Foxboro Board of Health, discussed Foxboro's decision to
raise the age to legally purchase tobacco products from eighteen to twenty -one. He said they made this
change one year ago after hearing from concerned parents and from a presentation in support of the
campaign "Tobacco 21" by Dr. Lester Hartman, Senior Pediatrician at Westwood - Mansfield Pediatrics.
While initially there were concerns about the economic impact on tobacco retailers, Mr. Arvedon said
after one year no measurable difference in the sales of tobacco products has been reported. He noted
the regulations can be modified or rescinded at any time and asked that the Mansfield Board of Health
consider amending the age to legally purchase tobacco products from eighteen to twenty -one.

Article 3, Section 1. A.:

Article 4, Section 1:

sales permit, the Board of Health may consider all violations in granting the permit ".
2
Article 9: Effective Date: January 1, 2016
Motion to accept the May 21, 2015 draft of the Regulation Affecting Smoking and the Sale, Vending
and Distribution of Tobacco and Nicotine Delivery Products as amended, to be adopted January 1, 2015.
(Wall /McClean).
Discussion:
Mr. Healey said he would vote to accept the regulation but his concern is, if passed, the new
regulation would prohibit anyone nineteen or twenty years of age who, as an adult has made the
decision to smoke, from legally purchasing tobacco products in the Town of Mansfield starting
January 1, 2016. He would like a transition period.
Ms. Memory asked if the implementation date should be increased to a year. She noted that as the
state sales tax and the cost of cigarette smoking increases, the rate of smoking goes down.
Dr. McClean said by raising the age to legally purchase tobacco products, the chance that a person
nineteen years old would ever start to smoke might be reduced. He said on a population level there
would be benefits because people would be less likely to start to smoke and he feels it is the Board's
responsibility to be thinking about the public health of the community.
Ms. Memory said it is a very difficult decision. She said while the information presented was excellent,
it is a struggle to balance the health needs of the population and the rights of the citizens with the
existing laws.
Motion passed 2- 1- 1(Wall /McClean in favor; Healey opposed; Memory abstained).
4. New Business:
Mr. leite said the Board of Health has received the grant of $1,800.00 from the Massachusetts
Association of Health Boards, Inc. to purchase two kiosks for sharps /medical waste disposal. The kiosks
will be located at the fire station.
