Mr. Kozlowski said the license would have to come back to the board if it was transferred, but he understands the pledge is required for the bank. Mr. Aptowitz commended Mr. Kuplast on his business. Mr. Ross said he has spoken with representatives from the ABCC, and this is a regular process. Motion: To approve the application to pledge the all - alcohol license (Aptowitz- Annino) All in favor. PASSES Mr. Lowney said the ABCC will get copies of the pledge application. He said he plans to send his comments to the Board of Health for its public hearing on June 4 and asked if the board would like to send comments. Board Of Selectmen's Meeting June 3, 2015 Page I of 5 Mr. Dentin said communities raising the minimum age at which people are allowed to buy tobacco products has been gaining momentum around the state. Mr. Aptowitz said he doesn't smoke, but doesn't think a committee should make this decision, which would effect a lot of people and businesses. I-Ie said if the state or federal government makes that law, he would be fine with it. Mr. Kozlowski said there are studies about the effectiveness of keeping tobacco away from young people, but he said at age 18, a person is legally an adult who is capable of making decisions. He said to have an appointed board substitute its judgement for people doesn't sit well with him. He the proposal doesn't allow supplying or selling to people under 21, but doesn't say anything about them smoking. He said if the state passed a law forbidding selling tobacco products to people under 18, that would be different, but under this regulation, a person could simply go to an abutting town to buy tobacco. He said he appreciates that the Board of Health is concerned and giving the issue a public hearing. Mr. DelVecchio said there are legal standards for 21 being the legal age for other things, like drinking, which he said has saved lives. He said he read a report from Needham showing a decrease in smoking since that town raised the minimum age to buy tobacco. Mr. Kozlowski said he discussed that with Mr. Leite, who said that report has largely been discredited. Mr. DelVecchio said the Board of Health is given its powers by the Commonwealth, and the members have studied this issue and have professional staff advising them. He said he would be inclined to be in favor of this kind of regulation if its efficacy could be proven. Mr. Kozlowski said the increased minimum age has been adopted only in a handful of towns. Mr. Annino said he doesn't know if the Board of Selectmen should be addressing this issue as a group rather than as individuals. He said lie has confidence in the Board of Health and lie isn't comfortable with the Board of Selectmen taking a stand. Mr. Aptowitz said he is concerned about individual towns adopting the age limit; be said he thinks it would be more effective if the legislation came from the Commonwealth. Mr. DelVecchio said the issue seems to be gaining momentum, but be would like to know how effective it would be. Mr. Kozlowski said he will probably submit something in writing to the Board of Health. Consensus was not to send a recommendation from the board.
