The Chairman reminded everyone the meeting is beinl4 broadcast live and taped for future broadcast on Mansfield Cable. Present before the Board this evening is Luis Lopes, Superintendent of Southeastern Regional School. This is Superintendent Lopes ninth year presenting before the Board. Superintendent Lopes announced that Southeastern Regional has been classified as a Level I school based on its academic achievement and recognized staff and students for their hard work. Superintendent Lopes noted the following highlights: • Factors considered for FY16 budget include: • enrollment (up 4.4 %, with low income enrollment up 14 %) and reminded that those numbers affect the foundation budget • new this year, non - teaching staff are part of the Massachusetts State Retirement System, the same system administrators and teachers are part of, and is 100% employee funded. Superintendent Lopes noted it was discovered through a Federal Audit of the State Retirement Board that the district is to make a contribution amount which has not happened. The estimated amount totals $604,211 per year. The district has reached out to Legislators to forgive any past assessments but have budgeted the amount of FY16 as it is now clear that it is responsible to make some assessment. • Mansfield's FY16 assessment is $853,744 and is based on 77 students (previously 63) which is an enrollment increase of 22.2% over previous year • FY16 Total Budget for Southeastern Regional is $24,573,257 where the majority is based on foundation budget and have operated at minimum contribution • able to absorb half of the new state retirement obligation • although an increase in Transportation, changes have been made resulting in a reduction of 18% in Transportation Costs • Cost of Capital Acquisitions (renovation project) assessment is level as it has been for last 15 years • Chapter 40 Section 13(d) is $25,000, where almost frilly funded (future liability for vacation buyback) • Specific to Mansfield • Assessment is up $187,045, which is a 28% increase, and noted minimum contribution allowed by the State is $182,143 • Enrollment up 22% Mr. Aptowitz asked what the overall mission of the school is to which Superintendent Lopes explained is to transform students into lifelong learners (prepare kids for lifelong, well - paying careers to sustain their families). Mr. Aptowitz furthered by asking how that compares to a traditional high school to which Superintendent Lopes stated he felt it compared but what makes Southeastern Regional different is that it is career focused and programs are based on the market Board Of selectmen's Meeting March 25, 2015 Page 1 of I I and what jobs are the future. He noted more and more careers now are looking for college degrees and referenced 62 % -65% of its students further their education after graduation. Mr. Aptowitz asked for further clarification of new staff: • large increase in Haitian Creole students (mainly from Brockton) where there is a need for additional para professionals (two) to support the one teacher • need for an additional teacher in Social Studies as the class size is creeping up to 30 students per class and contractually cannot exceed that number • Legal Protective Services, Criminal Justice, Cyber Security and Computer Programming teacher • Dental Assistant teacher, as it is a new program Mr. Aptowitz noted the Town's average assessment per student is about $11,000 where the overall average assessment per student in total is about $7,000. It seemed to Mr. Aptowitz that Mansfield is subsidizing other communities. Mr. Lopes reiterated that the amount Southeastern receives is the same dollar amount per student regardless of the community. He furthered by stating the question is where it comes from: the municipality or the State and that is unfortunately based on the foundation aid formula. Mr. Aptowitz inquired what the Town needs to do to make the situation more equitable and asked when Superintendent Lopes knows the enrollment number to which he responded by November. Mr. Aptowitz asked if there was a way to keep the Town informed along the way so that it is not such a shock and the Town could better budget. Mr. Kozlowski asked for clarification with regards to the minimum increase allowed. Superintendent Lopes explained the required contribution of $806,185 is an increase of $182,143 over last year and that is the number Southeastern starts with as a minimum contribution charged by the State. Mr. Kozlowski asked if that was independent of the number of students the Town sends to Southeastern to which Superintendent Lopes stated it is not. According to the State's formula Mansfield's charge went from 2.30% to 2.91 %, hi terms of the addition of the new teacher due to language reasons, Mr. Kozlowski asked to what extent Southeastern has to have classes for that small number of students. Superintendent Lopes noted that Massachusetts is a Sheltered Emerging state (basically mainstreamed — been in country less than three years) where support services are provided through para- professionals (assist with language to aid with transition). Chairman Dentino asked if Southeastern owns its buses to which Superintendent Lopes responded yes and reminded Southeastern is not allowed to charge for transportation and that the State reimburses about 65 % -70 %. Chairman Dentino can remember a time where Mansfield was paying less than the formula (like Brockton) and asked if when the formula changed in 2001 Nvas a municipality's ability to pay included to which Superintendent Lopes agreed. Superintendent Lopes also noted that Mansfield is one of two communities (from the nine in Southeastern's district) that are still not fully funded with regards to Target Aid. Superintendent Lopes reminded the Board that it did send a letter to the Legislature where there was an increase from 15% to 30% and now is at 45 %. Mr. Ross commented that it is frustrating that over the last five years for the Town has only been able to afford an 11% increase for its schools where it has been 92% for Southeastern. He felt the Board Of Selectmen's Meeting March 25, 2015 Page 2 of 1 I Town is robbing its own students to pay these bills and also explains part of the reason why Southeastern can recruit students. Mr. Ross went back to Mr. Aptowitz's point by referencing that the original concept of the vocational school was to prepare students for a career directly out of school and to take students that did not fit in a standard academic environment and give them that opportunity. Mr. Ross felt it appears the vocational school has turned the corner and is focusing on the academics. Mr. Ross questioned how Southeastern chooses its students. Superintendent Lopes noted the mission Mr. Ross refers to has not been its mission since the late 1940s and its mission is to prepare students for jobs of the future not jobs of the past where a lot of those jobs now require higher education. Superintendent Lopes won't apologize for challenging students academically. He went through for the Mr. Ross and the Board that it is a "blind" admission process where an application is graded on a point scale 0 — 25 on: attendance, behavior, grades and interview and recommendation from sending school, emphasizing that grades and achievements represents only a quarter of the admission process. Superintendent Lopes stated Southeastern is looking for students interested in showing up and are not in trouble and are looking to engage them in what they have an interest in (working on cars, teeth or food). Mr. Ross summarized that Southeastern is looking for the student that is motivated to attend school and leaving the ones that aren't but may need that motivation to the local schools. Superintendent Lopes commented that he cannot accept 800 students and again explained scores are received via the blind admission process (set by statute, under Chapter 74) and a line is drawn and letters are sent until a full class is achieved. Mr. Ross' point is that Southeastern is really developing a college prep school rather than a vocational school and referenced that almost 60% of those students further their education referencing 36% go to a four year college and 20% to a two year school. Superintendent Lopes reminded that he is also a public school and they do not ask for a penny more than is required by the law and took offense to the thought that they cherry pick students and is absolutely not true and referenced that Southeastern's special education enrollment is higher than anyone with over 60% of students on free or reduced lunch. Mr. Ross noted the admission process and criteria for scoring indicates Southeastern is choosing highly motivated students and referenced recruitment within the schools. Superintendent Lopes explained Southeastern educates teachers, students and parents about free public education at the school. Mr. Ross stated this will need to be worked through with the Budget Committee as cuts will need to be made in order to pay this bill. Chairman Dentin asked how the school handles its drop outs to which Superintendent Lopes noted it is based on the October Is` enrollment number. Mr. DelVecchio arrived at this point of the meeting 7:52pm Chairman Dentino appreciated Superintendent Lopes coming before the Board and understood that both Southeastern and Mansfield have no control over the mandates and referenced that as the formula has changed it hasn't been fair as there is no explanation of how the numbers are reached. Superintendent Lopes stated he is sensitive that it is a number that the Board does not want to hear and that is one of the reasons Southeastern decreased its transportation budget and absorbed the State retirement. Mr. Ross noted that he as well as Paul DeRensis, Town Counsel, Deutsche Williams, has reviewed the Warrant and was able to condense it down to 44 Articles, as a few have been combined. Board Of selectmen's Mecting March 25, 2015 Page 3 of I I Mr. Ross first discussed Article 29, the Hatheway & Patterson site, granting Activity and Use Limitation (AUL) to the Massachusetts EPA. Mr. Ross noted at this time the Town still has not received the agreement. Currently the Warrant has "drafted" language and Mr. Ross is looking to see if the Board would like to keep the Article on the Warrant without receiving the agreement first. Mr. Kozlowski asked how it affects redevelopment to the site. Mr. Ross explained the site is clean to commercial levels but as he has not seen the actual language he could not say what would be in the agreement. Mr. Kozlowski asked how Town Meeting comes into play to which Mr. Ross explained Town Meeting has to approve any use limitation that has been placed on Town property. Mr. Ross confirmed for Mr. Kozlowski that if this is taken off the warrant it would need to wait until next year or for a Special Town Meeting. Mr. Ross noted it can be kept on the Warrant and withdrawn on the floor. Motion: To leave Article 29 in -tact (Kozlowski/DelVecchio) PASSES 5:0 Mr. Ross pointed out the following with regards to the Warrant: • order of the Warrant is slightly different, at the request of the Finance Committee, where the borrowing related to the DPW/Public Safety Building be placed at the beginning of the order (Article 3) in order to maximize the number of voters present (early in the evening) and it does fit as it is a financial Article. • Mr. Ross noted the Town is rescinding all or portions of three different bond issues that have been previously approved by Town meeting because the Town is either done with the project and it doesn't need to borrow all of the money required or in the case of the Wastewater, that money has been transferred over to the MFN District. • there may be changes to Capital items as the Capital Committee will be meeting again and will be handled within the motion. Mr. Aptowitz asked if it was "all or nothing" to which Mr. Ross noted it will be handled as previous years with a motion for municipal, school, wastewater, water and parking. Mr. DelVecchio stated the motion is subject to amendment to which Mr. Ross confirm. Chairman Dentino felt "a In carte" to be a much better process. Mr. DeRensis noted from a legal point of view he likes grouping items together because the total number is what is voted as the appropriation and allows for flexibility to move items between line items in order to achieve savings. • Article 14 is the discussion regarding personal property value and should there be, a separate tax rate for small businesses. Mr. Ross reminded the solution the Board found acceptable was to increase the exemption threshold from $2,000 to maximum of $10,000 which would benefit the small business but noted the Assistant Assessor pointed out if a company has $11,000 they will be taxed on all of it. Mr. DelVecchio would be interested in knowing how many properties this Article affects. Mr. Aptowitz asked what the Board is charged with this evening. Mr. Ross noted if there is anything within the Warrant that the Board does not want on there now would he time to remove it. Mr. DeRensis suggested inserting language as it is the Board's intent to continue the meeting from the April 7 "' date. Mr. Ross noted this has been the pattern for the Town where the Town Clerk and Moderator meet on the April 7tf date, declare no quorum and declare the continuance to the date established by the Board which will be voted on later this evening. Mr. DeRensis would like to Board Of Selectmen's Meeting March 25, 2015 Page 4 of I l include the following "(to be continued to May 5, 2015)" or whatever date is proposed. Mr. Aptowitz felt this to be fine and allows for the residents to plan. Although the discussion for a Town Meeting date was scheduled for later, Mr. Ross asked the Chairman for permission to discuss now which was granted. Mr. Ross explained the Town has submitted its snow removal costs to the State in the amount of $1.2 million where the Town is just short of $1 million in direct costs just in snow and ice removal. Mr. Ross noted FEMA has stated the blizzard in January is an event eligible for funding and the Governor is submitting a request that the entire sequence of storms be considered. Mr. Ross explained the DOR has now provided direction that whatever monies FEMA determines for Mansfield for snow and ice removal will be placed in a special revenue find allowing the Town to remove an equal amount of snow and ice costs out of the General Fund and into the special revenue fund. IIe explained the budget anticipates $450,000 in Free Cash to assist with paying snow and ice bill. Mr. Ross furthered by stating if the Town knows before the Budget is adopted what the FEMA number is it can take that amount, place it in the special revenue find and thus free up that cash to assist with the Budget. If that is not known by May 5t" (proposed Town Meeting date) the money would be appropriated and the only way to change would be a Special Town Meeting therefore Mr. Ross suggested pushing Town Meeting to May 19t" to give more time to hopefully receive that number from FEMA, clearly a timing issue. Mr. Aptowitz is under the impression that Schools and Finance Committees have planned for May 5"'. Mr. Ross has spoken to Superintendent Gianetti who is fine with the later date and saw it to be a benefit as it impacts the School Budget as well. Mr. DelVecchio was troubled that if the Town did not have the answer by then what would be the next plan. Mr. Ross noted another possible option is consider adding it to the levy and using the money from FEMA to pay down the levy. Mr. DeRensis commented that Governor Baker has introduced a House Bill with the provision that allows cities and towns not to pay the deficit for two years and the basis for that is that the FEMA payment won't come until September, 2015 (the next fiscal year) and for the offsetting of finds to work you would need to wait until the finds are received. John Stanbrook, Finance Director, commented a call needs to be made one way or another noted that he did receive notice from the DOR to Mr. DeRensis' point of splitting over two fiscal years but felt it was more of the appropriation on the tax rate and did not think the Town would want to do that. It is Mr. Ross' recommendation to move Town Meeting to May 19 °i as it buys the Town of Mansfield the greatest amount of time to receive the FEMA number. Motion: To move Town Meeting to May 19, 2015 (Kozlowski /Aiunino) PASSES 3:2 Aptowitz, DelVecchio NAY Motion: To direct Town Counsel to add language to the Warrant reflecting the continuance of the Town Meeting May 19, 2015 (DelVecchio /Annino) PASSES 5:0 With regards to the Airport's articles, Article 24 and Article 25, Mr. Kozlowski asked if all that is required is a Town Meeting vote or is the Airport required to seek FAA approval. Mr. Ross noted only Town Meeting approval is needed to grant the easement and this would authorize the Board of Selectmen, with the approval of the Airport Commission, to grant the easement and it is the Board's discretion. Board Of Selectmen's Meeting March 25, 2015 Page 5 of 1 I Mr. Stanbrook reported that with regards to Article 23 (Stabilization Fund for Southeastern), a minor editorial change needed to be made as every Article ends with "or take any action in relation thereto ". Mr. DeRensis was in agreement to that. Mr. DeRensis noted with regards to Article 21, under the explanation, "this Article, if approved, would establish a procedure ", he felt that should read "this Article, if approved, would reaffirm the procedure that the Town has in Chapter 136 of the codified General By- Laws ". Mr. DeRensis felt establish refers to something new. It was noted this would actually refer to Chapter 136, when using the codified version. Motion: To approve the change to Article 21's explanation to "this Article, if approved, would reaffirm the procedure that the Town has in use as stated in Chapter 136 of the codified General By- Laws ". (Arnino/Kozlowski) Discussion: Mr. Kozlowski noted the By -Laws have yet to be codified to which Mr. Stanbrook noted that will be completed by Town Meeting. Motion: To approve the change to Article 21's explanation to "this Article, if approved, would reaffirm the procedure that the Town has in use as stated in Chapter 136 of the codified General By- Laws ". (Annino /Kozlowski) PASSES 5:0 With regards to Article 22 (designating a list of Municipal charges), Mr. DeRensis noted the list does not appear in the Article or the explanation and asked to put the list of what the specific charges are of the types of liens. Mr. Ross was going to accomplish that in the Motion. Mr. DeRensis felt this to be technical where the voter needs to have a better understanding. Mr. Ross noted this would affect water, sewer and electric. Mr. DeRensis suggested, "including, but not limited to, water, sewer and electric ". Motion: To edit Article 22 explanation language to list the charges "including, but not limited to sewer, water and electric" (Annino /Delvecchio) PASSES 5:0 Motion: Agree to issue the Warrant as amended (Aptowitz/DelVecchio) PASSES 5:0 Mr. DeRensis and Mr. Stanbrook returned to the meeting at 9:05pm with an additional Article that was intended but left out, renumbering of the Warrant and voting on a change to Article 23. It was discovered that the codification of the By -Laws was missed as an Article. This will now be Article 21 and will read, "To see if the Town will vote to amend the Town's General By -Law as amended through May, 2014, by adopting the comprehensive codification, reorganization, renumbering and repositioning of the General By -Law as set forth in the final draft of the code of the Town of Mansfield, Massachusetts, dated January, 2015 as directed by the Town Clerk, a copy of which is on file with the Town Clerk. The General By -Law shall be codified as Chapters, up to but not including 230, of the code of the Town of Mansfield, Massachusetts or take any other action in relation thereto ". Motion: Move to reconsider the motion regarding issuance of the Warrant (Aptowitz/Kozlowski) PASSES 5:0 Motion: Move to insert new Article 21 into the Warrant and to renumber the Warrant accordingly (Aptowitz/Kozlowski) PASSES 5:0 Board Of Selectmen's Meeting March 25, 2015 Page 6 of I I Motion: To incorporate edits regarding new Article 24 (Southeastern Regional) "or take any action in relation thereto" ( Aptowitz/ Kozlowski) PASSES 5:0 Motion: To delete prior explanation and insert new explanation for new Article 24 as read by Finance Director John Stanbrook (Aptowitz/Kozlowski) PASSES 5:0 Motion: To close the Warrant and issue it (Aptowitz/Kozlowski) PASSES 5:0 ontlnne- D scussio nd .os e - - °e ►oI2ega etmS`ale =of PropertyBy_Mr AndEIr• _- Mr. Aptowitz reported he has read through the analysis prepared which summarized the recalculation of taxes and is fine with that. Mr. DelVecchio appreciated the analysis and asked what the plan was going forward with regards to the property as there is Conservation land involved. Mr. Ross explained there was no plan provided but it was his understanding that the purchaser was looking to build residential compound of four to five lots on the upland portion and then offer to make the remainder available to the Town for Conservation purposes. Bob Saquet was present before the Board and referred it to the map provided within their packets. He assumed there would be some type of access to the land through the proposed residential compound. He noted that through Chapter 61A Forest Management Land, once a firur offer is in hand, which it is, the Town has the first right of refusal. Chairman Dentino asked if the Town received an assessed value to which Mr. Ross noted the Town's assessed value is $211,000. Mr. Ross further noted that the Town would have to pay the offer which is $300,000 in order to purchase. Chairman Dentino asked why the Town would not want to have some type of appraisal to which Mr. Kozlowski felt it would only serve as a check to the assessed value. Motion: To not exercise the Town's First Right of Refusal and authorize the Town Manager to execute and file any necessary documents (Aptowitz/Kozlowski) PASSES 4:1 Dentino NAY ot m1t_isu5ion Ari4ons4derf;fAprgnce Ulm T9b Descrptlon ror The ICIansfield IYlumcipal Electric Dpartmen -#--_ -¢ ,_ — Gary Babin, Director of the Mansfield Municipal Electric Department, is present to answer any questions with regards to the new job description. Chairman Dentine, reminded the Board that it had requested the previous job description for this position in order to compare prior to approval. Mr. Babin noted what has been found in reviewing a lot of these older job descriptions are that most are over 20 years old and somewhat cryptic in that they don't explain specific duties and some of the requirements such as specific licenses and training. Mr. Babin pointed out in this case apprentices are required to attend lineman's training school, which is a four -year course which they attend three week per year and that was missing in the older job description. Mr. Babin furthered that the new description is enhanced by the addition of a personnel description such as "ADA ", which includes knowledge, skills and ability, equipment used along with physical demands of the job. Mr. Ross noted that what Patti Firing, HR Director, is working towards are getting job descriptions up to date and reflect work that is actually being done. He noted some are almost 20 years old and for the Board to expect to see more of these. IIe felt it was important to have a consistent format as well. Board Of Selectmen's Meeting March 25, 2015 Page 7 of 11 Mr. Annino was in favor of the new description, format and the language. Chairman Dentino referred to the requirement of attending NEPA Lineman Training to learn proper work technique as well as obtaining CDL license and one year to achieve MA Dept. Public Safety license and asked what if there is failure to meet those requirements. Mr. Ross explained that there will be a probationary period within the contract where if the hire is not moving in that direction they can be subject to termination within six months which can also be extended an additional six months at the discretion of the Director. Chairman Dentin moved to the portion which required available to work long hours at any time to which Mr. Ross explained the position can be called in at any time. Mr. Babin explained this group is extremely dedicated an held one another accountable. Chairman Dentino felt the position needed much more than a high school diploma. Mr. Ross noted this is an apprentice position and is limited in its working with high voltage until training is received as would be with any other apprentice position. Chairman Dentino felt this to be a safety issue for the apprentice as well as the other crew members. Mr. Babin explained they look for candidate with a high mechanical aptitude, electrical trade school training and look for direction from the current linemen. Mr. Ross felt this to be reflected in crew the Town currently has who all started as apprentices. There is currently one apprentice on staff. Mr. Ross noted today he received word that the renewal of the Delta Dental contract has decrease in the rate amounting to a $21,000 savings. He also reminded the Board of his last report where Waste Management has given a $100,000 credit to use over five years. Mr. Ross felt the "wild card" will be how to handle the snow None. a.
