Meeting called to order at 7:35 P.M. 2. Planning Session Mary Hourigan of the Westside Benevolent Society spoke to the Planning Board briefly regarding a possible location for storage of clothing which the Society collects for needy people and distributes during the holiday season. Mrs. Hourigan stated that the Westside Benevolent Society had expressed an interest in using the basement of the Library when the new facility is complete and was under the impres- sion that this decision was made by the Planning Board. Steve MacCaffrie (Municipal Building Committee) joined the meeting at this time and explained that it is the Board of Selectmen or Town Manager that would make the choice as to who uses the facility. Mrs. Hourigan explained that the Planning Board was the first group the Society has spoken with. A suggestion was made that Mrs. Hourigan write to the Planning Board, with copies to Board of Selectmen and Town Manager, stating the needs of the Westside Benevolent Society and requesting suggestions for an adequate location. Mr. MacCaffrie explained that he had excluded all use of the basement of the Library other than record storage because it is inaccessible to the handicapped. Mr. MacCaffrie discussed possible Town offices which could be relocated to the Library. Some of his choices would be the Town Engineer, Town Manager and possibly the Health Agent and Planning Departments. He would be reluctant to suggest relocating the Building Inspector due to the amount of contact he has with the public. However, before anyone could occupy the build- ing, a sprinkler system and an elevator would have to be in- stalled. ( *Planner Sohn entered the meeting at 7:45 P.M.) Mr. MacCaffrie discussed use of the Paine School for the School Department. However, he also stated that they presently make more money renting this facility to BIK.O. The Planning Board explained that Ben Hampton had mentioned using the Park Row or Roland Green schools for this purpose. Mr. MacCaffrie stated even if the Park Row School ceased opera- tions as an elementary school tomorrow, it could not possibly be ready until 1990 for occupancy by the Town. 1 Planning Board's Minutes March 18, 1987 Page -2- Mr. MacCaffrie feels that the Roland Green School would be a better location for the Police Station. Park Row School might possibly be too large to use. Chairman Quinn stated that he hoped to have some type of draft ready by the fall and the Planning Board will make recommendations and suggestions for suitable use at Park Row School and the Library. Mr. MacCaffrie was asked to make notes if he has the opportunity, including dollar amounts for renovations, etc., and give a copy to the Planning Board. At some time in the middle of summer the Planning Board will review these planning sessions once again. The Board and Mr. MacCaffrie discussed possible locations for the Fire Department, including a satellite station in East Mansfield. 3. 8:15 P.M. - Marydee Flynn - Discussion of Recommendations for Site Plan Review and Master Plan Advisory Council - Cluster Planner Flynn reminded the Planning Board of a discussion held some time ago regarding Site Plan Review and whether it was appropriate to have the Building Inspector have complete control over this or whether it would be better for the Plan- ning Board to review Site Plans. The Master Plan Advisory Council will be making recommendations on site plan review and zoning. Planner Flynn asked if the Board would like to discuss this and make recommendations to the Master Plan Ad- visory Council as to the concerns of the Planning Board, such as the lack of information on the plan or the inappropriate- ness of the site and the fact that the Board has only two weeks to review these plans. Planner Flynn stated she feels that the Site Plan Review should be completely in the hands of the Planning Board. North Attleboro handles site plans in this manner. Planner Flynn stated that she feels Bert Cook, Building Inspector, does and admirable job but is inundated with plans, zoning regulations, building code determination=_ -, etc. The Planning Board suggested inviting Mr. Cook to a meeting to ask for his thoughts on Site Plan review. 4. 8.30 P.M. - Continuation of Public Hearing - "Northridge Estates" - Deadline: April 3, 1987 Chairman Quinn continued the public hearing for "Northridge Estates" at 8:30 P.M. Connery As- sociates will be presenting the MPAC will a zoning proposal in the near future. Planners Madan and Annino will report to the Planning Board as to what MPAC is going to do with regard to the Cluster Zoning and housing issue. Abutters are not listed on the plan. Employee parking should be shown on the plan. Lighting should be shown on the plan. Dumpster should be screened. There must be a 50' buffer shown on the plan. Planning Board advised the applicant to withdraw this site plan and resubmit after following all regulations in the Mansfield Zoning By -Laws relating to Site Plan Approval. Ap- plicant agreed to resubmit this site plan. B. "Form A's" (ANR) Plans School Street - Applicant: School Street Realty Trust This "Form A" (ANR) Plan was denied by the Planning Board on January 7, 1987 due to the fact that the checklist was incom- plete, lots 13 3, 4 and 6 cross wetlands and need an Order of Conditions from the Conservation Commission and case law may not permit lots to be configured in such a manner. Mr. Edward T. Angley, Attorney at Law, 67 Samoset Street, Route 44, Plymouth, MA and Mr. O'Leary from DelTech Engineer- ing, Plymouth, MA, were present representing the applicant to discuss the reasons this "Form A" was denied. The Planning Board explained that, due to the wetlands fronting this property, the amount of frontage is insufficient to "Form A" these lots. Attorney Angley disagreed with the Board's in- terpretation and cited case law (Smalley vs. Planning Board of Harwich) in which the Court stated that if an applicant has the frontage and square footage, applicant is entitled to have the plan designed - whether or not the lot is buildable, is not the determination of the Planning Board. Chairman Quinn explained that the Planning Board can require a nota- tion on the plan stating that "it is not a buildable lot - does not meet the zoning requirements ". After a lengthy dis- cussion as to whether or not the property had sufficient frontage, the Planning Board recommended that Attorney Angley present his case in writing, at which time the letter would be forwarded to Town Counsel. If Town Counsel agrees with Attorney Angley, then the Planning Board would reconsider this "Form A" (ANR) plan or the applicant could resubmit the plan. Jewell & Williams Streets - Applcant: Tifdan Development Corporation \ Motion:_ To approve this "Form A" (ANR) Plan for Jewell and Williams Street for Tifdan Development Corporation but not sign until the 100 -year flood plan and 5 Planning Board's Minutes March 18, 1987 Page -6- existing dwellings are shown on the plan. (Caponigro - Madan) All in favor. PASSES. Danielle Lane - Applicant: Pasco Construction Motion: To sign this "Form A" (ANR) Plan for Danielle Lane for Pasco Construction. (Caponigro - Madan) All in favor. PASSES. 9. Public Discussion (Due to the length of this meeting, Chairman Quinn changed the order of the agenda to accommodate the public.) Mr. Larry Mahoney spoke to the Planning Board regarding proce- dures he should follow to purchase Town owned land (specifically a paper street) abutting Mr. Mahoney's property on Hope Street. Mr. Mahoney stated that he had submitted an article for the special Town Meeting in October 1986, but withdrew it when other articles regarding land purchase were withdrawn. Mr. Mahoney is on the warrant again for the Town Meeting in April to purchase this land. It is possible that this piece of property is abandoned. He was advised by the Board of Selectmen to have an attorney represent him, which he has done. Mr. Mahoney was also advised to check to see if anything must be done through the Planning Board. Mrs. Wil- liams is the only abutter and she has not responded to any correspondence relative to this piece of property. The Plan- ning Board recommended that Mr. Mahoney's attorney research the property to determine whether or not the property is abandoned. 10. Around the Table Motion: To put the Clerk's Report on the agenda for next week (March 25,1987) at 7:30 P.M. to allow time to review correspondence and minutes. (Madan- Annino) All in favor. PASSES. Fire Chief Sliney wanted the Planning Board to be aware that there is a street within the "Massapoag Estates" subdivision called "Barbara Road ".
