3. 7:40 P.M. - "Maplewood Estates II" - Discussion
Robert E. Powers, Subdivision Supervisor, was present for this discussion. Also
present was Donald A. Baker, applicant. Mr. Powers explained that the Planning
Board, at the time of the submission of this subdivision, first denied the plan
and asked the applicant to change the detention area. The applicant changed
this detention area per the request of the Planning Board. Subsequently, this
plan was approved. This detention area is not draining properly because of the
amount of clay used around the sides. Mr. Baker stated that although he could
not speak for Mr. Mahoney, he is willing to add a pipe to control the drainage
or remove some of the rip rap, if Conservation will allow it.
The Planning Board discussed who should be responsible for filing a Notice of
Intent with the Conservation Commission and the general consensus is that the
Town should file.
Town Counsel was contacted regarding holding a Modification hearing and taking
contingencies and Mr. Query stated, if it is ready for acceptance, then no
Modification hearing should be held.
The applicant has completed everything he has been asked to do according to the
final, approved plan.
Motion: That the retention area at Lewis Road would not hold up acceptance at
Town Meeting and recommend that the Town file with the Conservation
Commission for the drainage in this area and accept Mr. Baker's
generous offer of adding a pipe and removing rip rap to control the
drainage, should Conservation approve this.

Road, Planner Flynn explained that the Board could go into Executive Session

Planner Annino - "Aye"

Planner Flynn - "Aye"
Planner Madan - "Aye"
Planner McClanahan - "Aye"
Chairman Quinn - "Aye"
At 10:45 P.M. the Planning Board returned to their regular open meeting.
Planning Director LaCasse informed the Planning Board that two preliminary plans
have been filed for subdivisions off Bird Road. Bird Road is currently involved
in pending litigation. Planning Director LaCasse feels that if the status of
Bird Road is such that the access is not adequate for a "Form A" plan, then it
is not adequate for a subdivision. Mr. LaCasse stated a settlement on Bird Road
could occur very soon, after which there will be a bond for the road. If there
is no progression, then the Planning Board could deny the preliminaries. Mike
asked if the board wished to review these plans now or wait until there is a
signed agreement. Board members agreed they should review the plans as regular
preliminary plans and offer all input possible to the applicant, addressing the
fact that Bird Road is inadequate in its present state.
Planning Director LaCasse spoke to the Planning Board regarding Land Use Legis-
lation requesting support for two bills currently before Legislature which in-
volve zoning and subdivision regulation. One is for Grandfathering of Subdivi-
sion Plans from Zoning Changes and the other regarding Impact Fees.
Motion: To send letters from the Planning Board and Planning Director to the
Joint Committee on Local Affairs and to Representative William Vernon

and Impact fees.

9. Around the Table
Planning Director LaCasse informed the Planning Board that he needed the support
of the Board for a grant with Attleboro, North Attleboro, Plainville and
Mansfield for a study similar to the Canoe River Aquifer study. This study
would concentrate on the West Mansfield area.
Motion: To support the Planning Director's efforts in securing a grant jointly
with the Towns of Mansfield, Attleboro, North Attleboro and Plain-
ville.
(Madan - Flynn) All in favor. PASSES.
Planning Director LaCasse explained the final process being discussed at the
Master Plan Advisory Council meetings at this time. The consultant is working
on a consensus plan - one map of Mansfield and a five or six page document which
explains the type of uses and general density for each zoning area. After
Master Plan Advisory Council reviews it and agrees to it, they will present it
to the boards. The consensus is to adopt a master plan supported by the Board
of Selectmen, Planning Board and Master Plan Advisory Council. Once that is
achieved, the consultant will write the zoning which accompanies it. Zoning
changes would be supervised by the Planning Board because the Master Plan Ad-
visory Council is not trained to review zoning amendments
The Planning Board discussed problems with inadequate plans for site plan
review. Planning Director LaCasse explained the Mr. Cook will be reviewing his
proposed site plan review process at the next staff meeting and, if he receives
the support of the Town Manager, will present the entire package to the Planning
Board and all others involved in this process.
Planner Caponigro stated he feels the Planning Board should seriously consider
changing the layout of catch basins within a certain range (possibly 240' to
360') to put them on the lot lines in the subdivisions and would like to request
Joseph J. Campo's opinion.
Mr. Paul J. Folkman, writing in behalf of Mr. James Vadala, asked for an opinion
of the Planning Board regarding the setting of roadway bonds /covenants for
Eastbrook Estates. Mr. Vadala would like to post a road bond for Eastbrook Road
and Marjac Way, leaving the covenant in place for Necco Road. The Planning
Board had no objections to this request.
