1. Emergency meeting to continue the public g " N " called to or-
der at 10:05 A.M. at the Paine School.
(Planner Flynn left the meeting at this time.)
2. Continuation of Public Hearing - "Windermere" - Applicant: Richard Staples -
Deadline: July 29, 1988
At 10:05 A.M., Chairman Annino continued the public hearing for "Windermere ".
At 10:50 A.M., this public hearing was closed.
The following people spoke at this public hearing:
Dale Tessier, 250 Oak Street, Mansfield.
Michael Trowbridge, Hutchins /Trowbridge Associates, Inc.
Leonard Flynn, 102 Jewell Street, Mansfield.
Marydee'Flynn, 102 Jewell Street, Mansfield.

The following motions were made at this public hearing:
Motion: To close the public hearing for "Windermere" definitive subdivision.
(Quinn- Madan) All in favor. PASSES.
Motion: To deny the definitive subdivision plan entitled "Windermere" due to
insufficient data to support the drainage calculations necessary to
insure a properly designed and operational drainage system.
Specifically:
1. The lack of a soils analysis by a professional sail testing agency
as requested by the Board in accordance with Section III.C.3.
2. A report from Town staff that an alternative drainage plan is
available to the applicant which will satisfy all concerns of the
Planning Board. The applicant is unwilling to address this option.
3. Dr. Carr's report, provided by the applicant, indicates poorly
drained soils (hardpan) on the property but does not define these
soils sufficiently well to insure a properly designed drainage sys-
tem.
4. All comments from Town staff concerning details of the plan have
not been addressed.
(Quinn - Caponigro for discussion) Planners Quinn, Sohn and Chairman
Quinn in favor. Planners Madan and Caponigro opposed. FAILS.

Motion: To approve the definitive subdivision plan "Windermere" subject to the
following conditions:
1. No lots be released until soils analysis is done by a certified
sail testing agency showing positive results and reviewed by an in-
dependent engineer who will submit his conclusions to the Planning
Board.
2. Address comments from the Town staff that have not been addressed.
3. All unsuitable material be removed within the thirty foot drainage
easement
(Caponigro - Madan) Planners Caponigro, Madan and Chairman Annino in
favor. Planners Quinn and Sohn opposed. FAILS.
Motion: To reconsider Planner Quinn's original motion to deny the definitive
subdivision plan entitled "Windermere ".
(Quinn -Sohn) All in favor. PASSES.
Motion: To deny the definitive subdivision plan entitled "Windermere" due to

Motion: Should the applicant resubmit the definitive subdivision plan entitled
"Windermere" to address the items listed in the denial of the plan,
the fees be waived with the exception of advertising costs.

(ANR) Plan
alto Trust - Maple Street and Francis Avenue (For Land Court purposes)
To sign the "Form A" plan for R. T. Realty Trust for property located
on Maple Street and Francis Avenue.
(Madan -Sohn) All in favor. PASSES.
4. Adjournment
Motion: To adjourn.
(Sohn - Caponigro) All in favor. PASSES.
