Elizabeth Vieira, the homeowner, was present. The Vieiras'removed a mature Red Maple tree and gravel was placed within an area of Bordering Vegetated Wetland. A vinyl fence was also installed. Brush and the trunk and logs from the tree were placed near wetlands. Brush and logs have been piled on the opposite side from where the tree was cut in another low lying wet area, possibly not even their land. r Michele would like the wetlands delineated by a professional wetland scientist and for the Vieiras' to file an After the Fact Notice oflntent. Colin agreed. Michele will give Mrs. Vieira a list of wetland scientists for the delineation. Mrs. Vieira explained that the house had been staked when it was built in 2000. She was told by the builder they could do work up to the staked area. The gravel has been there for 2 years. The Vieiras' did not add more gravel to the area-the gravel has been spread out into the wetlands. Michele told the Commission that the entire driveway is in the wetlands according to GIS. Elizabeth said the tree and brush has already been removed. Jerry wanted to know if the Commission would require signage to be put on the wetland line. Cindy agreed signage should be required. Cindy made the motion to ratify the Enforcement Order. Carole seconded. Passed 5-0. r' /~ ( Colin explained to Mrs. Vieira that when the requirements the Commission has asked her to do are completed the Commission would vote to rescind the Enforcement Order. Cindy made the motion to require the Vieiras' to hire a wetland scientist to flag the wetland areas on the property, to require signage on posts with 50 ft. centers on the wetland line, the signage to read "Environmentally Sensitive Area-Do Not Disturb", and from this time forward, no disturbance (building, cutting or treelbrush disposal) of the wetlands within the 25 ft. no disturb zone. Jerry seconded. Passed 5-0. John Sullivan, Town Engineer and Rick Alves, Senior Engineer were present. The request is for the repair of a 30-inch culvert and the installation of a 60-inch culvert under Mill Street. The work is to improve the roadway drainage system. This is considered a limited project. r' An inspection of the exiting 30-inch culvert, in the area of a sinkhole, revealed that the culvert had collapsed. In addition, the inspection of the 60-inch corrugated metal pipe revealed that the pipe was severely corroded and also in need of replacement. John said they would be removing the 60-inch pipe and replacing it with a concrete pipe along with removing and replacing a section of the collapsed 30-inch pipe, in the same location and at the same elevation. The repair of the 30-inch pipe will be done first without impeding the flow through the area during construction. Staked hay bales and siltation fencing will be put in place at both ends of the 30-inch pipe to prevent siltation from entering the stream. Sand bags will be used to divert the water to the repaired 30-inch culvert during the installation of the 60-inch culvert and the repair of the existing stone headwall. The work is to be done by the DPW this summer but John said the work may have to be subcontracted out. Jack made the motion to accept the plan as drawn and to issue a Negative 2 finding. Carole seconded. Passed 5-0. This filing is for the construction of a 2-car garage/mudroom and a deck. Matt r Kanavos, the applicant and Bob Fasano, the representative were present. ~ Michele said the construction has already been started because the Assistant Building Inspector told Mr. Fasano he could start the work. Construction is on existing lawn that has been cleared. There are no wetlands within 100 ft. of the proposed construction. Because the house is within an Estimated Habitat of Endangered Species, Natural Heritage has been notified. Michele received a verbal ok from Jenna Gravey (Natural Heritage does not have a problem with this project). Colin told Mr. Fasano that Conservation still needs a letter from Natural Heritage. Cindy made the motion to accept the plan as drawn for 16 Bird Road for a garage/mudroom and deck, noting that Jenna Gravey of Natural Heritage, in a phone conversation with Michele, said there is no problem with the plan because it is on an existing lawn area. Jerry seconded. Passed 5-0. Paul arrived at 7:15. ,r' John Rendall and Rick Zeroka of CH2Hill were present. The Notice of Intent was filed for removal of 8,900 sq. ft. of contaminated soil fill, backfilling and site restoration (grading and re-vegetation) within the buffer zone of Bordering Vegetated Wetlands and within the 200 ft. Riverfront Area of the Rumford River on residential property belonging to Thomas and Dawn Ryan of 15 Dane Street and on Sasol property. Of the 8,900 sq. ft., approximately 5,500 sq. ft. is located on the adjacent residential property at 15 Dane Street. 3,400 sq. ft. is located on the Sasol property. An additional area of up to 5,000 sq. ft. could be impacted depending on the extent of contamination. This area is not within the BVW. The limit of work is the BVW resource area boundary. CH2Hill wants to remove industrial fill from 15 Dane Street and restore with clean fill. The area will be re-vegetated with native species-blueberry bushes, Sugar and Red Maple trees. Mr. Rendall said they would work with the Ryans as far as the plantings are concerned. The soil will be removed up to six feet below the existing ground surface. The contaminated soil would be disposed of at an approved landfill. All equipment used for the removal of the soil, clearing and restoration will enter the area on the Sasol property r-- r-. Paul would like a reading on the ground water. He said there is a limit as to how far you can go down-you have to stay a certain amount of feet (4 or 5 ft.) above the ground water level. Colin asked that Mr. Rendall share the results of the testing of the ground water with the Commission. There should be some form of sediment control and Michele would like to be called when it is installed for an inspection. Mr. Rendall said silt fencing and hay bales will be placed along the boundary. Paul made the motion to accept the plan as drawn with the stipulation about the ground water reading and the installation of silt fencing, Michele to be called when in place so she can do an inspection. Cindy seconded. Passed 6-0. r This filing is for an Amended Notice oflntent for the relocation of the replication area and driveway crossing as per the recommendations of the Department of Environmental Protection at 175 Essex Street. Dan Clemmey was present. Jack recused himself. The purpose of the project is to provide access to the Clemmey Farm. The existing roadway started out as a farm path but cannot accommodate large farm vehicles due to the narrowness of the roadway. The driveway crossing is unavoidable because there are no other entrance points along Essex Street because of private property and wetlands. The applicant agreed to restrict the width of the roadway to 24 ft. and to remove an existing 18-inch PVC pipe. The roadway will be re-graded and re-sloped to minimize any impacts to the adjacent wetlands. A box culvert, as requested by the Commission, will be installed. The area of the crossing will be 20 ft. with a 2 ft. berm on each side. The applicant will also shift the replication area to the west. The replication area of 3,168 sq. ft. of wetland will compensate for the alteration of2,736 sq. ft. of wetlands. Hay bales will be placed on the 25 ft. no touch line. The replication area will be re-seeded this spring. r Michele agrees with the changes made and is satisfied with the plan. ,~ r r- Jerry made the motion to amend the original Order of Conditions dated 2-6-2006 and incorporate the DEP requirements. Michele will attach the amended conditions, dated 4-25-06, to the original Order. Carole seconded. Passed 5-0. Motion was made to adjourn at 8:00 (Paul/Jack). Passed 6-0. Next meeting will be May 15th at 6:30 pm. ~~#~ r T
