Conservation Commission Meeting MAtr~IELD
April 10, 2006 MASSA~~USETTS
Present: Colin Cauldwell, Chair; Paul Boyden, Vice Chair; Carole Matthew; Jack
Smith; Jerry St. Hilaire; Cindy Ostrowski; Michele Grenier, Conservation and
Environmental Planner.
Robert Patneaude, representative and Thomas Walsh, the applicant, were present.
This hearing was continued from the March 27, 2006 hearing.
Mr. Patneaude met with Nick Riccio on March 28th. Nick provided a copy of the
original plan (RIM) dated October 12, 1977~item #2 in the court order.
r
Nick and Mr. Patneaude decided that a plan should be developed that would show the
current gradini along with the 1977 grading. Mr. Patneaude took the new plans to
Nick April 10 . Nick agreed with the plans (#3 bond issue)~work must be certified).
Mr. Patneaude, Nick and the Town Planner walked the site to decide, in regards to the
court order, what should be done.
Mr. Walsh mentioned that the Town took 2 of the parcels for Town well protection.
Mr. Patneaude said that the court order no longer can be applied to the land today due
to the changes made.
Because there is a possibility of a Vemal Pool on the site, the Commission requested
that Mr. Patneaude have the pool certified. Walter Hewitson, a botanist, went out to
the site with Mr. Patneaude. They observed wood frogs. No shrimp were found
because there was insufficient water to support the shrimp.
Mr. Patneaude told the Commission that the swale (condition 4 in the court order) has
been shaped and graded but has not been delineated. The swale is not near the Vernal
Pool.
r
Colin wanted to know what the applicant wanted to accomplish from this hearing.
Mr. Patneaude said they wanted to be able to loam and seed to stabilize and restore
the area (condition 6 of the court order). He said the loam is already on site.
r'
Paul wanted to know if the gradations of the swale have been put on the plan-it was
part of the court order. He feels the swale should be delineated.
Michele has spoken to Nick and she agrees with the plan.
Cindy wanted to be sure the Vernal Pool is protected and would not be affected by the
swale. Mr. Patneaude told her the elevations at the bottom of the Vernal Pool are
about the same as the swale so it will not take away from the Vernal Pool (water
won't drain from the pool). Mr. Patneaude also said most of the land around the
Vernal Pool belongs to the Town of Mansfield.
Paul made the motion to lift the Enforcement Order.
Passed 5-0.
Paul made a motion to accept the plan for the loam/seeding and grading on the Elm
Street property with the Order of Conditions to state the Vernal Pool must be
certified.
All in favor (5-0). Jack abstained.
r
This hearing is for a single family dwelling addition within an Area of Critical
Environmental Concern and a Natural Heritage and Endangered Species Area. A very
small portion of the property is within the Estimated Habitat and is not near any
BVW. The addition will be outside of the Habitat. The applicant filed because it is
in an ACEC (Canoe River Recharge Area). Michele spoke with Jenna Garvey
Monday, April lOth and Jenna said the addition will not have an adverse effect and
will be approved.
There is an existing deck and the 17x20 addition will be in the back of the house.
Michele said the area where the addition will be is all yard. She does not feel hay
bales are necessary but she wants the applicant to be aware that no debris is to be
dumped in the woods; it must be disposed of properly. The contractor said there will
be a dumpster on site.
Paul would like to see the 100 ft buffer line on the plans.
Carole wanted it noted that the house was built prior to the 1999 Mansfield By-law.
Paul made the motion to accept the plan as drawn for 2 Cooper Road and as part of
the Order of Conditions, the 100 ft. buffer is to be delineated and included on the
plan.
Cindy seconded.
Passed 6-0.

r'
Paul Jodice, representative for John Moran was present.
The existing house was built in 1991. An addition was added approximately 5 years
ago.
The proposed 2-story addition, a family roomlkitchen, with a master suite above, will
be 18xl8 ft.
Michele said the wetlands are accurately delineated but the wetlands are off-site. The
addition is within the Estimated Habitat but will be 65 ft. from the wetlands.
Colin inquired about siltation control. Hay bales will be placed at the limit of work
and must be certified.
Paul wants RIM to put the elevations of the buffer on the plan. He asked about the
slope of the lawn. Mr. Jodice said the lawn is very level. There is a slight slope in
the back but the lawn levels off again.
Carole wanted the minutes to state that the house was built before the Town of
Mansfield By-law (1999) that requires more strident setbacks.
r
Cindy was concerned that because there will be very little lawn space left after the
addition, the applicant might want to expand the lawn further. She would like to have
the Order of Conditions state that the lawn should not be extended after the addition
is built.
Paul feels that the existing limits (where the grass/chip area is today) should be
shown with the dimensions/elevations-how would anyone know 2 years from now
what is going on with the property?
Cindy made the motion to accept the plan for 15 Sturbridge Road with the following
conditions-hay bale line at the limit of work and to be certified; limit of the present
grass line and chip area are to be dimensioned and noted on the plan; elevations of the
100 ft. buffer and the wetland boundary to be noted on the plan; the present limit of
the line area behind the house is not to be expanded from where it exists today or
expanded toward the wetlands and noted on the plan.
Carole seconded.
Passed 6-0.
r
Cindy made the motion to accept the minutes as written.
Carole seconded.
