SEP 27 Pl1 2: 09 Present: Colin Cauldwell, Chair; Paul Boyden; Jack Smith; Marq'MfJn;Y~~fb Carole Matthew; Michele Grenier, Conservation and EnvironrtfEk8a1~fflr'TTS Request is for cutting down a row of trees located approximately 20 ft. from the house, to loam and seed to establish a lawn and install a perimeter fence around the rear portion of the property for safety reasons. Trees are top-heavy and are either dead or dying. Total number of trees to be removed is 20 and they are approximately 6 to 16 inches in diameter. The stumps will be removed. There is a Conservation Restriction on this property and the proposed location of the fence will encroach on a portion of this area. The restored area will be graded to prevent any run-off. Silt fencing and hay bales will be installed and will remain in place until the lawn is established. r Michele performed a site walk on August 24. The trees that will be removed are outside the "no disturb" zone. She recommends a negative determination be issued. Plan of Record is dated 8-16-2005. Paul made the motion to issue a Negative Determination, with Michele to be called for inspection of the hay bales and fencing. Colin seconded. Passed 5-0. Request is for excavating and constructing an in-ground Gunite swimming pool to be located on the lawn area behind the house. Christopher Gaal and Robert Blain, a representative for Andrews Pools were present. The pool will be totally outside the 25 ft. "no build" zone. The wetlands were flagged and delineated by Walter Hewitson. ,r- r A Vision System, an ionization/purification system will be installed (no chemicals will be needed in the pool). Michele performed a site visit on September 9 and recommends a Negative Determination be issued and that a hay bale line be placed along the 25 ft. "no build" line, along the back area where the work will be done. Carole made the motion to accept the plan dated July 29, 2005 and to issue a Negative Determination with hay bales along the 25 ft. line. Marc seconded. Passed 5-0. Mark Cook from DPW was present. A roadway reconstruction project has been proposed by DPW for an approximately 2000 ft. length of West Street between Route 495 and the intersection of GrovelTremont Street. ~ Construction activities will include grinding the existing pavement, preparing the base material and repaving the roadway to the same elevation as now exists. The work is adjacent to wetland areas and also crosses an unnamed stream. Hay bales and silt fencing will be installed. There will be no work done on the existing sidewalk and granite curbing. The curbing and sidewalk is between West Street and the stream. Michele visited the site and photographed the area 9n /2005. The stream is dry and 15+ ft. away from any work to be performed. She would like a few hay bales placed in front of the stream and recommends a Negative Determination be issued. A motion was made by Marc to accept the plan and issue a Negative Determination. Jack seconded. Passed 5-0. Paul took over the meeting from Colin. Andrew Harchuck was present. The proposed project is to construct a two-car attached garage to the existing house within 100 ft. of BVW but outside the 25 ft. "no touch" zone. r T T r Michele visited the site. The proposed garage will be approximately 35 ft. from the wetlands. The wetlands are correctly delineated (by Mason Associates). Hay bales should be put in place around the garage prior to construction. She recommends an Order of Conditions be issued. Paul is concerned there is no topography or elevations on the plans. Jack agreed the elevations must be put on the drawing. Michele will call Ralph Maloon and remind him elevations need to be on all plans. Jack made the motion to accept the plan as drawn and to issued an Order of Conditions and that when Ralph Maloon does the "as built", he will give a copy of the plan with the elevations to Conservation. Carole seconded. Passed 4-0. Colin abstained. Meeting turned back over to Colin. r Robert Cavanaugh, the homeowner was present. The Notice of Intent is for an in- ground pool within 100 ft. of BVW, outside the 25 ft. "no touch" zone. Michele performed a site walk on 9/1/2005. The pool will be approximately 85 ft. from the wetlands and about 10ft. from the house. She does not feel hay bales are necessary; the pool will be located on the lawn, is upgradient with no possibility of run off. She recommends an Order of Conditions be issued. Mr. Cavanaugh will use the topsoil and gravel from the excavation in his yard. Marc made the motion to accept the plan as drawn and issue an Order of Conditions. Jack seconded. Passed 5-0. Kenneth and Jeanne Hagar, the homeowners and Michael Trowbridge, from Hutchins-Trowbridge Associates were present. The Notice of Intent is for construction of a single family home, utilities and septic within 100 ft. of BVW. The existing house will be removed. A portion of the house is within the 50 ft. "no touch" area, 35 ft. at its closest point. The septic is approximately 110ft. away from the wetlands. With the exception of a small portion, the driveway is as far ,~ r-- away from the wetlands as possible. There will be a detached garage, 175 ft. away from the wetlands. A pool will be 75 ft. away. Construction will begin in the fall. The Board of Health approved the septic system August 29, 2005. Siltation fencing and hay bales will be located along the 25 ft. "no touch" line. Paul- roof drainage should go into the ground. He wanted to know if all new construction requires this. Colin would like 2 drywells to be installed (as per regulations), connected to the leader pipes. Paul made the motion to accept the plan as drawn, dated August 18, 2005, with the addition of the 2 drywells connected to the leader pipes, as per regulations and to have Michael Trowbridge inspect and certify the siltation fence and hay bale line. Marc seconded. Passed 5-0. r"' Anthony Scarpellini and Jerome Carr from Carr Research Laboratory, Inc. were present. The Notice of Intent is for construction of a single-family home with sewer. This project consists of a house and sewer system to serve the home and an additional sewer line that will service all the houses on Fox Street. The proposed sewer line runs thru the 25 ft. and 50 ft. "no disturb" area and the 100 ft. and 200 ft. riverfront area. A corner of the house and septic system will be within the 50 ft. " no disturb" area. There are 5 existing degraded areas in this project area. The topsoil has been removed from the degraded areas due to excavation and filling and the areas are filled with construction debris. The applicant is proposing to restore 3 of these degraded areas, a combined area of approximately 1,800 sq. ft. The fourth degraded area is a barren cart path that was constructed 24 ft. out into the wetlands towards Robinson Brook, and at one time there may have been a wooden bridge crossing the brook at this location. This area is approximately 240 sq. ft. If the old fill is removed, the wetland area will be restored. The degraded areas will be restored will native trees and vegetation. ~. r-- Mr. Carr said he would add dry wells to the plans. Paul made the motion to accept the plan with the addition of (2) drywells and that the 3 degraded areas and the footbridge area be restored. When Mr. Carr starts to dig test holes he is to give Michele the results. The hay bale line must be certified. Carole seconded. Approved with the above conditions. Continued until September 26,2005. Colin wanted an update on the Clemmey property on South Main Street. He visited the site and feels Michele needs to call Chris Ross at DEP. Acorn Manufacturing-Michele needs to call them. Are they putting in a new sewer system? Maybe Scott Uete (Health Department) needs to get involved. r Michele will call Mr. Borghi on York Rd. about his failure to file a Notice of Intent for work already done. Colin is concerned that the boulders put at the end of Oak Street are not keeping the motorcycles, etc. out of the area. Carole would like a follow-up of Bird Road, where a pump has been draining the wetlands. Paul would like the Andy Gazzola (10 Reservoir Street) matter resolved. Michele will visit the site tomorrow. A motion was made (Carole-Marc) to adjourn at 8:55. All in favor. Date of next meeting: September 26,2005. r"' r T ~ r"' r. a /1 fb ~ /()d0/J Colin Cauldwell, Chair ~6&) D te I r T
