Conservation Commission Meeting
August 22, 2005
Town of Mansfield Municipal Department-Proposed East Mansfield Substation.
Chris Cox, Electrical Engineer, and Gary Babin, MMED Director were present.
Two public meetings were held last year to discuss available parcels where the
substation might be located. Sites were analyzed and discussed in these
meetings based on MMED's analysis of the area as well as on feedback from
neighbors in the first meeting.
One of the sites considered and promoted by the neighbors in attendance, is
Parcel 39-8, off Bird Road (also known as the George Fram Estates) a 50+ acre
lot owned by the Town of Mansfield and managed and controlled by the
Conservation Commission of the Town of Mansfield.
r
Michele does not feel the Commission should approve this parcel because there
is a Restriction Order on this property and it would take an act of Congress to
remove the restriction (Article 97 Land Disposition Policy, sub-paragraph IV).
Carole made the motion to oppose the lifting of the restriction on the Bird Road
Parcel for the substation.
Paul seconded.
Passed 5-0.
Tree removal in rear and on the side of the lot. Trees are top-heavy, leaning
towards the house, roots exposed and trunks are rotted. Some of the trees have
fallen down in the last weeks.
Lisa contacted Michele about the wetlands on the property and what she needed
permission to do concerning the trees. Michele Visited the site and
recommended Lisa hire an arborist to determine which trees needed to come
down and what can be done to save others.
r
r
Michele spoke with the arborist and agrees with him that the trees are dead,
dying and dangerous and need to be removed. She recommends a negative
determination be issued.
Tree Tech will be doing the work. The work will not be done until Sept.
A motion was made and to accept a negative determination and passed 5-0.
Paul wanted to know how close the wetlands the trees to be removed were
(Michele said the trees are about 60 ft. to 70 ft. He would like hay bales around
the trees to be removed that are closest to the wetlands
Construction of a residential building with related grading, driveway and utilities.
No work will occur within the 100ft. buffer zone. Siltation control to be staked in
place prior to construction and is to be maintained until construction is complete
and the grass is stabilized. Ralph Maloon, RIM Engineering.
The house will be out of the 100 ft. buffer zone. Hay bales are proposed on the
100 ft. buffer line, which will also be the limit of work.
Paul said Michele should be contacted before the work starts and that the hay
bales need to be certified.
.r"
Paul made a motion to accept the submitted plan as drawn with the hay bales to
be certified by an engineer and Michele to be contacted before the start of any
work.
Jack seconded.
Passed 6-0,
Walter Palladino was present.
Proposed work is to replace an existing stonewall that is crumbling (on the lake
side) with a new one. Property is on Lake Greenwood.
Michele visited the site and the wall is in need of replacement. She would like
the work to be postponed until the water is at a low level, late August or early
September. She recommends the Order of Conditions be issued with this
stipulation.
Walter has contracted Landscape and Stone of North Attleboro to do the work.
The new wall will consist of modular concrete blocks to a maximum height of 4 ft.
,--
The new wall will be put in front of the old wall, which will remain in place.
Approximately 60 ft. of wall will be replaced.
r
Carole made the motion to accept the plan to replace the wall on Lake
Greenwood with the work to be done when the water level is low. Michele will
also contact the contractor about siltation control and how the wall will be
constructed.
Jerry seconded.
Passed 6-0.
Paul feels Walter needs to check to see if in fact the wall is on his property and if
it is on the property deed.
Kevin Walker, of K & J Engineering, Inc. presented.
Proposed construction of a portion of a driveway and underground utilities in the
buffer zone to a Bordering Vegetated Wetland. The area is part of an approved
residential compound called Roy Road. The Conservation Commission voted to
accept the 5+ acres of open space.
r
The existing house will remain. Lot 2 is designed to not need a filing. It has
been designed as far away or totally out of the buffer zone. At the present time
nothing is proposed for Lot 2.
Michele has visited the site and recommends issuing the Order of Conditions.
Signage will be needed for boundary of the open space. Colin would like this put
on the deed(s). He also wanted Kevin to be aware of the 50 ft. "no touch" for
new construction.
Kevin said that right now the erosion control line is at about 40 ft. He will revise
the plans to maintain the 50 ft. "no touchll.
Paul made the motion to accept the plan with signs to be put along the whole
perimeter of the open space, 50 ft. apart, on posts, not trees, to read
"Environmentally Sensitive Area"-No Disturb. This is to be recorded on the
deed(s). Kevin will revise the plan to maintain the 50 ft. no touch as referenced
in the Mansfield By-Law. A letter of certification of the placement of erosion
control will be sent to the Conservation Agent stating that K & J Engineering has
surveyed and staked the erosion control.
Marc seconded.
Passed 6-0.

r
Repairing the septic system that has failed. Hodges Brook is in the rear of the
property.
Siltation fencing will be in place along the house. The system is, at the closest
point, 97 ft. away from the wetlands.
Michele performed a site visit. The septic system is in need of repair (this is an
upgrade) and this is the only location for the septic system. She recommends an
Order of Conditions be issued.
Carole made the motion to accept the plan for the septic upgrade at 11 Lantern
Lane. Hay bales to be certified by an Engineer and Michele will to be notified.
Jerry seconded.
Passed 6-0.
Enforcement Order-13 Oak Leaf Drive, Barry MacLean -altering Bordering
Vegetated Wetlands in the back yard. Has not filed a Notice of Intent as of today.
Michele will check with Barry MacLean.
r
Violation: 114 Rumford Avenue-Alteration of Riverfront. Ian Carr, the home
owner will be filing a Notice of Intent. Michele feels the excavator should have
known better. There is a lot of debris in the yard (fly ash, large pieces of
concrete and asphalt, glass) that Mr. Carr was trying to remove, with out a permit.
Michele wants him to restore the first hundred feet that has been altered. He will
replant.
71 Marshall Avenue, Tom Conner-tn-ground swimming pool within the 100 ft. BZ
of BW/ and a stream. He will come in Friday to file an After the Fact Notice of
Intent.
Michele wanted the Commission members to know she has received numerous
calls and walk-ins from potential buyers for Lot 1020 West Street-two parcels
together that are all wet and are also within the 200 ft. riverfront. She wondered
if there was anything that could be done before someone, unaware, buys the
property. The "For Sate" sign is still up.
Marc made a motion to accept the minutes of July 11, 2005.
Carole seconded.
Passed 5-0, Jerry abstained.
