Proposing an in-ground pool and spa within the 100 ft. buffer zone of Bordering Vegetated Wetlands. There will be a silt barrier and hay bales in place, maintained throughout the installation process. There will be no filling of wetlands and any additional material not used for backfilling will be removed from the site. The pool will be equipped with an oversized 450 sq. ft. "cartridge filtration system." The filtration system will be connected to a "Saft Generator" completely eliminating the need for chlorine or shocking of the pool water. South Shore Gunite will be doing the work. r Michele visited the site and agrees with the BVW line. The 25 ft. no "touch line" will be observed. Land wilt be cleared up to the 25 ft. zone. Michele recommends issuing an Order of Conditions with the addition of a living fence along the 25 ft. zone. Mr. McDevitt will have a fence around the pool installed and will also be putting in a living fence for aesthetic reasons. Mr. McDevitt also asked if he could put up a small shed. The Building Department has told him that he needs to be 6 ft. off the property line and 10ft. away from the house. The Commission said it is ok as long as he observes the 25 ft. no "touch zone." Marc made a motion to approve the Order of Conditions, with Michele to be notified when the hay bales are in place for an inspection. Paul said an engineer must certify that the hay bales are properly placed during excavation. Jerry seconded. Passed (4-0). The applicants were not present. r- r T r They are proposing to build an unattached garage (26x30) with a workshop (10x20) attached to the side. They will be putting the new garage on the same footprint as the old garage. The existing garage will be removed. The garage will be approximately 90 ft. from the wetland line. The wetlands are not on their parcel of land. Michele-hay bales should be in place. She recommends a Negative Determination be issued. Marc made the motion to issued a Negative 3 Determination, with hay bales- Mrs. Greco needs to come in and put the hay bale line on the drawing and initial it. The plan will then be the plan of record. Jack seconded. Passed (4-0). Continued indefinitely. Michele talked to John Parmentier, from Dunn McKenzie. They have scaled down to one small building. They will be going back to the Planning Board. The r engineer will contact Conservation 2 weeks before submitting any new plans, probably late August, early September. Michele says they will probably have to notify the abutters again. Continued to August 22, 2005. Enforcement Order-Barry MacLean, 13 Oak Leaf Drive. Trees, shrubs, herbs cut and the BVW also pushed back into the woods. The extent of alteration is estimated to be over 5,000 sq. ft.
