of-way. Amtrak's VMP expired on December 31,2004. This request is for 2005-
2009.
No work is proposed within the wetland resource areas. Michele inspected the
wetland areas and the wetland line is correct. A Negative Determination can be
issued.
RWC will be doing the spraying. Herbicides to be used are Oust or Round-up.
r
Lenny Flynn was concerned about the Great Woods Area. Mr. Fair explained
that the spraying is very direct and that "sensitive area" markers are used to
make sure wetlands, public waterways, etc. are not exposed to the herbicides.
Marc made the motion to issue a Negative 3 Determination.
Carole seconded.
Passed (4-0).
Meeting turn back over to Paul.
Ralph Maloon of RIM Engineering and William Brown of Heron Crest were

Work proposed: an 8 ft. wide walking path, workout stations and a picnic area
within the 100 ft. discretionary zone and 50 ft. of the Canoe River.
Michele walked the area and the path has been staked. No trees will be
removed; the path will go around all trees. The exercise stations have been
placed where there is no vegetation except for ground cover.

r in the Determination.

Ralph said that the area is part of the common area and will be maintained by the
Condo Association.
Colin wants to be sure the area is built and maintained mechanically, not by
spraying, etc.
Carole made the motion to issue a Negative Determination.
Colin seconded.
Passed (5-0).
ESS has asked for a continuance until June 27,2005. The Commission voted to
allow the continuance (5-0).
56 Pattys' Road, Donna and Mark Levine. VlOlation-cutting down trees and
removing brush within 100 ft. of an Estimated Habitat of Rare Wildlife to make a
ball field.
r
Donna and Mark Levine were not present. They will be asked to return for the
June 2th meeting.
Paul doesn't agree with Natural Heritage. Carole feels the Levines must follow
the state regulations and the Town's BY-l.aw (2.6-100 ft. of the Estimated
Habitat). She feels no work should be allowed in this area and if we allow the
Levines to file a Notice of Intent we will be setting a precedent.

A Certificate of Compliance was neVer issued.
Michele went out to the site an~ recommends a COC be issued.
Colin made the motion to issue the Certificate of Compliance for 1386 East
Street.

Carole would like someone to go out to 531 Bird Road. A pump has been
installed on the property that is removing water from the wetlands. Michele will
