The continuation of Richard Thompson's hearing from November 20, 1984 w a s begun. Motion ma de by Nr. Butler and seconded by Mr. Flynn to continue the hearing until the conclusion of the discussion with Town Counsel, All were in favor. The scheduled hearing"for Mercury International Trading Corp, was cancelled and rescheduled for January 14,;1984. The Board met with Town Counsel John Dwyer and Building Inspector Bert Cook 'regarding the Variance granted Anthony,Pellegrini. Mr. VJojtkiewicz stated the facts the Board had knowledge of as interpreted from the public hearing and subsequent meetings. Town Counsel stated that since there were no restrictions placed on the Variance by the Board then what Mr.'Pellegrini has erected is not in 'violation, and that the Board must be more specific in future Decisions. Discussion with Town Counsel and Building Inspector also included establishment of mother -in law apartments.' The 'Board is concerned that granting a variance for mother -in -law apartment will permanently establish a two ;family residence in a single family zone. Town Counsel stated that some townsgrant these by special permit, since a variance runs with the land, from title to title, thus the house could be sold as a two family unit. The 'special 'permit' ' would be ;gone when the person residing there no longer :needs 'it, then it would revert 'back to single family. Town Counsel suggested a meeting with the 'Planning Board and have them propose a change at Town Meeting for allowing mother -in -law apartments, limiting it to ,someone whi is related by :blood or marriage to occupy a seperate dwelling that is attached to the main house The hearing for Richard Thompson was continued at this point.' He is requesting a variance for 'an addition with a`mother -in -law apartment which meets all other requirements._ Mr. Thompson stated that a_ the Building has g issued him a buildin g permit for the 'addition unfinished He 'would yr e b filling to have the Board put any restrictions it wanted on the variance. The Board advised him to submit ae'.ailed drawings of the f _ h first and .second floor interior for the next meeting. Motion made by Mr. Butler and seconded by Mr. Eagan to 'grant the side yard variance for Alain Meyer of 8.8 feet. Motion made by 1 2 Mr. Flynn and seconded by Mr.',Riccio that it is not a seperate unit because it shares a common existing :hall with the existing house as per the plan and therefore is not a seperate unit as per the BOCA code, The Board will write letter to the Building Inspector as follows: we want to clarify the above variance request for two variances, one for sideyard and one for in -law apartment. The Board feels that a variance is not necessary for an in -law apartment, as per discussion with you on ;December 18,;1985. Could you please give a written opinion on this based on your previous remarks to the Board regarding common hall uses, for our January 3, 1985 meeting." Mr. Flynn withdrew his motion. Meeting adjourned at lOpm. Respectfully submitted,' Eric E. Butler, Clerk l i I
