Present: Paul Boyden, Chair; Carole Matthew; Christine ~:~~~~TS Cauldwell; Jerry St. Hilaire; Elizabeth Leidhold, Conservation and Environmental Planner. Requesting an after-the-fact permit for clearing lot of trees within the 100 ft. buffer zone. Proposing to grade the lot within the 100 ft. buffer zone. There will be 2-4 ft. of fill. The plans submitted show the area to be filled, what the "limit of work" will be within the 100 ft. buffer. Michael Trowbridge was present, representing George Moses. The property owner was issued a cease and desist order in December, 2004 because trees were being cut within the 100 ft. buffer zone. Area in which the cutting had taken place was in the buffer zone of a wetland that had been replicated. Elizabeth observed a lot of Red Maple trees on the property. ,,-. Siltation control is in place and Elizabeth will be contacted for hay bale inspection before the grading begins. Elizabeth visited the site but could not take a soil auger because of the snow and frozen ground conditions. She doubts it meets the 5,000 sq. ft. threshold. Because the land is not hydraulicly connected to anything and the proposed grading is over 50 ft. away, Elizabeth feels it is a premittable project and that a Negative 3 Determination be issued. Colin made the motion to accept the plans with a Negative 3 Determination. Christine seconded. Passed (5-0). Ralph Maloon, RIM Engineering, and Robert Young, the homeowner, were present. The plans submitted a year ago called for a much larger house. Went to the Board of Health for a variance. The Board of Health didn't like the position of the house and wanted it moved 50 ft. from the wetlands. r' or T r' Conservation also did not like the location of the house because it was only 25 ft. from the wetlands. They were denied by ZBA. The new plans call for a house that is identical to the original but still only 25 ft. from the wetlands. Colin is concerned because it is a "no disturb" zone. In order to get machinery on the site to excavate and back fill, they would be into the 25 ft. zone. Elizabeth inspected the site. It is wet on three sides-shrub line is the wetland line-all vegetation is wet. She recommended changes to delineation-flags 6 and 7 to be moved to the perimeter of the shrub line and to connect flags 9-11, removing flag 10 and connect 11 to 13, removing flag 12. These changes should not change the septic repair location. House can be moved to the east, more toward the road but if the house is moved easterly, the area between the leaching field and the wetlands is reduced. There is no number from DEP. Elizabeth would like this project continued until she can get a soil sample in the spring. Ralph suggested that when the weather permits, he will contact Elizabeth to walk the site. r Ralph suggested that the owners clean up the site and reseed and replant. He also would like to put a living fence on the wetland line. Ralph won't go to the ZBA until the Conservation Commission is satisfied with the plans. Colin made the motion to continue until Elizabeth can certify. Christine seconded Passed (5-0). Work involved the topping off of trees and shrubs to 6 ft. (nothing else to be disturbed). Colin made the motion to issue the certificate for brush removal. Christine seconded. Passed (5-0). r' The Conservation Commission has a letter from RIM Engineering stating that the new storage building was built in substantial compliance. Elizabeth pointed out additional pavement that was not part of the original plan. r. r Elizabeth will call Mr. Hurley to tell him the certificate was not issued and that the Commission will need a clear "as built" that reflects both the original submittal and the additional pavement. Christine would also like the wetland line on the plans. Christine made the motion: No discussion until we get an "as built" with the wetland line and the parking lot on the plans. Colin seconded. Passed (5-0). Requested a continuance until March 14th. 1. Donation of land to Conservation Commission- Roy Road-open space-900 East Street. A vernal pool may exist on this property. The pool will be examined in the spring by the conservation agent to determine jurisdictional status. r Christine made the motion to accept the land. Colin seconded. Passed (5-0). 2. The Commission voted to pa~ the police department for $171.07 for the detail used at the January 10 meeting. Colin made the motion to pay the invoice. Passed (5-0). 3. Elizabeth told the commission that new regulations go into effect March 1st. Colin feels that there should be a press release for the new regulations. 4. John Sullivan will be at our March 14th meeting re: NPDES Phase " Permits. 5. Con Com needs revisions to plans for Quadrant 4/Mansfield Airport. 6. Mansfield Crossing requested a continuance until March 28th. Verify mis- Delineated bvw and call about Water Quality Cert. 7. The Commission voted to hire Horsley Witten Group as a consultant for r the Mansfield Crossing Mall project. The Commission wants to be sure ... T r' r' r .. we will be dealing with the same personnel throughout the process: Amy Ball. Colin made the motion to hire Horsley Witten Group, pending approval, and to call and request information about personnel to be involved. 8. Essex Street: Clemmey has appealed the "lack of decision" to the state. Attorney General needs to be notified about the decision. Dana Muldoon needs to be in touch with Chris Ross. 9.
