2. Notice of Intent Pob6e Hearing - 771 Ware Street - James & Carol Unger _ SE
211-702
The chair read the public hearing notice for the construction of a shed and the grading
and expansion of a rear lawn area, with grading and associated work within 100 feet of a
wetland resource area.
Michael Trowbridge, Hutchins-Trowbridge Engineering, presented a colored plan
showing a light blue area, which is a manmade ditch; a darker green area, the existing
vegetation which will be left in place; the light green area showing the area to be cleared;
and the brown area showing the new shed. The area to be cleared is currently treed.
Siltation control will be installed. The site is relatively flat, with a 2 ~ foot drop in grade.
The area where the trees will be removed has a ~ foot drop. Mr. Trowbridge explained
the ditch is a drainage ditch with a very small bank.
r"
Ms. Matthew asked if the isolated wetland pocket is a vernal pool. Mr. Trowbridge said
it is not. Ms. Matthew asked why so much area is being cleared; Mr. Trowbridge said it
would be cleared for lawn expansion.
Ms. Ready asked about a permanent fence along the wetland; Mr. Trowbridge said he
isn't proposing anything at this time. Ms. Matthew asked how big the trees are that will
be removed; Mr. Unger said there are a variety of trees, including some tall pine trees, in
the area that won't be cleared, and smaller trees and a lot of brush in the area to be
cleared.
Mr. Boyden asked about the siltation fence; Mr. Trowbridge said the area to be cleared
would be loamed and seeded, so the silt fence will protect the wetland area
Mr. Boyden read Mr. Lewis's memo, indicating this is a straightforward proposal for a
storage shed. He has visited the site, and the resource area is an intermittent stream
beyond the yard. The amount of disturbance will be minimal. His recommendation is to
close the public hearing and issue the Order of Conditions, which he had drafted and sent
to the commission for review. Mr. Boyden reviewed the Order.
Mr. Trowbridge said the work would result in a minimal change in grade. Mr. Boyden
emphasized condition #2, which says the engineer must certify the silt fences and hay
bales are placed according to the plan.
r
Ms. Matthew said the commission had asked to see contours on the plans; Mr. Boyden
noted the elevations are shown on this plan.

2 'i~ '. Request for Determination of Applicability Public Hearing -1791 West Street-
James Goyea & Joan Gagnon
The chair read the public hearing notice for the reconstruction of an existing dwelling and
the construction of a new farmer's porch with excavation and associated activity within
100 feet of a wetland resource area
Rich Leslie, Bay Colony Engineering, explained the plan for the removal of the existing
dwelling and construction of a new house in the same footprint. The existing foundation
will remain, and a farmer's porch will be added. The porch will not extend any closer to
the wetland than the existing house, and it will be on columns, so there will be no
excavation. The septic system was redone in 1997. A haybale line will be installed off
the westerly comer of the house to ensure the contractors stay inside that line. The lawn
shown on the plan already exists. The existing house is one-bedroom, one-story, but the
septic system is designed for a three-bedroom house.
Mr. St. Hilaire asked about the proposed pump chamber on the plan; Mr. Leslie said that
plan is the septic plan from 1997, and the pump chamber already exists. That plan shows
cesspools, which were abandoned and filled when the septic system was done.
Ms. Ready asked where the trucks would come in; Mr. Leslie said there is a driveway
adjacent to the house. The house is on a small peninsula of land, with the leaching field
100 feet away.
.-....,
Mr. Boyden reviewed Mr. Lewis's memo, which indicates there is an existing house at
this address, and the proposal is for the addition of a second floor. There will be very
minor work near the wetlands for the COnstruction of a farmer's porch, which will be on
footings. There will be a small amount of digging/excavation work needed. Mr. Lewis
has visited the site and recommends a Negative Three Determination.
Motion: To close the public hearing (Srnith-St. Hilaire) All in favor. PASSES
Motion: To issue a Negative Three Determination with notification to Mr. Lewis when
the haybales are installed (Plass-Matthew) All in favor. PASSES

/5. Correspondence
Ms. Flass presented a draft memo for the MEP A review for Fairfield Green. She
suggested sending the memo, indicating the commission reluctantly approved that plan
and it would likely not have been approved if it had not been a 40B project. The
members discussed and amended the memo. Consensus of the commission was to submit
it so it would be part of the public record. Ms. Ready suggested "our policy has been to
require a 50-foot setback on new construction."
Motion: To ask Mr. Lewis to submit as amended
(Ready-St. Hilaire) All in favor. PASSES
Mr. Boyden asked about the berm beside Horne Depot.
Mr. Boyden will not be here June 28; Ms. Ready will not be here June 21 or 28.
Everyone will be here June 7.

Mr. St. Hilaire said the Appalachain Mountain Club does trail maintenance on land it
doesn't own; he said he would get in touch with Mr. Lewis about that. Mr. Boyden said
Mr. Bibby put a lot of effort into the trails, and suggested the commission walk the trail
once it was done.
I"'""" The board briefly discussed 900 Maple Street and Mr. Boyden suggested the members
visit the site.
