Meeting Commenced at 7:30 PM.
QUALTERS MIDDLE SCHOOL
Keyes Manpower — Bob Vogel advised the MBC that he has left Keyes Associates and
moved to Design Partnership of Cambridge serving as a Principal for that firm. Mr.
Vogel stated that Keyes Associates is committed to fulfill their obligation to complete the
Qualters Project and that he plans to continue as our general point person for the School
Projects.
Bankruptcy Issue — Bob Vogel commented that he is meeting with remaining Keyes
partners on Wednesday (1- 10 -01), but that filing bankruptcy (Chapter 11) is imminent.
Keyes is hoping to negotiate a merger with Gale Associates in the near future. Should
the merger not happen, Mr. Vogel noted that Keyes would be forced to file Chapter 7.
Payment Issues - Rich Feeley expressed concern regarding surety of payments to Keyes
Associates'sub- contractors still working on the school projects (i.e. Wallace Floyd, TCI,
& Universal Eng., Sarkis Zeronian etc.). Mr. Feeley noted approximately $8,000 has
been paid to Keyes by the Town for services provided by Wallace Floyd. To date WFDG
has not received these funds. Mr. Vogel responded that efforts are being made to pass
through as much monies to subcontractors as possible. Rich Feeley asked Bob Vogel to
provide a reconciliation of accounts for the Qualters Project. Bob Vogel stated he would
follow up with Art Christopher (Keyes' Financial Officer) and agreed to provide account
information to the WC within one week (1- 16 -01).
Window Conflict: To date Keyes has not taken any action to resolve window conflicts
affecting 272 window units (originally installed at QMS July, 1999).
• Due to the extensive financial impact to Keyes to correct all windows, the MBC
extended a compromised solution with Keyes on Sept. 12, 2000 to correct only lower
tier windows (approximately 140 windows). Keyes was asked to respond to this offer
by November 1, 2000. No response from Keyes was given.
• Bob Vogel commented that Keyes Associates could not incur the total cost for
inoperable windows. Mr. Vogel also stated that the manufacturer could not be held
responsible for following Architect's direction on installation of windows. Rich
Feeley noted that Cheviot Corp. previously issued a Change Order Proposal related to
windows (approx. $5,000) which was not approved. Cheviot has not pursued
payment for this work.
Chairman questioned whether the value to correct windows is not included on Punch
List. Rich Feeley advised Mr. Vogel that if a satisfactory solution can not be reached,
the Town would pursue legal recourse for the value to correct "all" windows in
conflict with walls and/or partitions.
Affidavits — Chairman advised Bob Vogel that Keyes' sub - consultants (Structural,
Engineering, etc.) are refusing to provide affidavits due to Keyes non - payment. Mr.
Vogel noted verbal commitment from subs - consultants that Affidavits would be provided
per contract. Bob Vogel stated that Keyes would provide copies to MBC in one week (1-
16-01).
Occupancy Permit Issues:
• "Stamped" Egress Plan — Steve Chmura stated that he has two copies in his
possession. MBC asked that he provide a copy to Building Inspector immediately.
• Handicap Rails at Cafeteria - Variance was filed December 11, 2000. Bob Vogel to
follow up re: status with Architectural Access Board.
• Emergency Lights — Walter Parker has completed installation of lights as requested
by Building Inspector based upon egress plan prepared by Keyes Associates.
• Handicap Ramp — Phil Ricci reported that ramp work is complete. David Young
reminded JTC that all parking in front of gym door at Qualters should be marked
handicap only as per sketch. Steve Chmura to confirm with a plan.
Operation and Maintenance Manuals - Initial manuals JTC provided to School Dept. are
incomplete. Walter Parker commented that Manuals were missing mechanical As -Built
drawings as well as some electrical. Additional documents also needed from Eastern
Electric, McLaughlin Mechanical and Montle Plumbing include guarantees, warranties,
and training etc. Rich Feeley asked Steve Chmura to FAX a list of missing items to
Michael Callahan Wednesday morning (1- 10 -01) and follow up. Chairman reiterated that
the missing information is critical for warranty and maintenance on site.
Hood cover for Dishwasher — Dishwasher is in need of venting hood not included in
contract. Walter Parker has quote to install. MBC advised Mr. Parker to proceed with
order and installation. Invoice to be paid by MBC School Projects account.
Missing Tile at Expansion Joint — Repair incomplete. Phil Ricci commented that JTC
was unable to locate attic stock on site to repair three pieces of tile. Walter Parker to
check storage areas.
Unit Ventilators ( #13, #14, #15 & #16) — MBC received a letter from McLaughlin
Mechanical stating that low - pressure switches have been installed per contract and
requested work related to unit ventilators be removed from punch list. NBC advised JTC
that this work would remain on punch list until work is verified by TCI and start-up
testing is complete this Spring, 2001. No payment is authorized prior to that time.
Plumbing Issues:
• Acid Waste Neutralizing Tank/Rm. 130 — Neutralization tank located in Science
Room was improperly installed by Montle Plumbing. Montle Plumbing's did not
respond in a timely fashion, however plumbing is now corrected.
Acid Waste Neutralization Tank/Rm. 115 - Question was raised as to who owns acid
waste venting in classrooms that require it. Montle Plumbing did not provide venting
through roof since demolition was not complete at that time. Steve Chmura
commented that venting is "owned" per contract, however TCI has verified work is
"not required" per code. Mr. Chmura advised the MBC that a credit is due to Town
for contract work not performed.
• Sink Clips - School Department reported that all new sinks are missing clips that
secure sinks to countertop in Room numbers 130, 136, 223 and 243. Sinks were
supplied and installed by cabinet supplier. Discussion was that Montle owns
installation of sinks and clips. JTC to follow up.
• Leaking Hot Water Tank — Second report of leakage occurrence in newly installed
(600 gallon) water heater. Montle Plumbing needs to evaluate problem and properly
correct issue. Rich Feeley advised JTC that no monies would be authorized to pay
Montle Plumbing until leaking water heater is fixed properly.
• Guidance Room — School Dept. reported that unit ventilator in this area is very noisy.
• Hot Water Valve — Walter Parker reported that the hot water valve for cafeteria unit
ventilator needs to be installed. Johnson Controls has already supplied parts.
Suggestion was made to have School staff install valve.
• Administration — Walter Parker questioned whether a representative from
McLaughlin Mechanical would be on site to perform start up of A/C in spring.
JTC to follow up.
• Woodshop - Walter Parker noted that the Unit Ventilator in the woodshop area is not
working properly. JTC to follow up.
• Room 229 — Walter Parker informed the MBC that a transformer in Room 229 has
been burnt out for the past six months. Item is under warrantee. JTC to follow up.
Electrical — Chairman questioned when remaining electrical work would be complete.
Rich Feeley asked Steve Chmura to provide Eastern Electrical with a defined scope of
work that needs to be completed, and provide update to MBC in two weeks (1- 23 -01).
Kiln — Installation is incomplete. Still waiting for Eastern Electrical to perform work.
Carpet at Administration — Carpeting damaged during construction activity in the central
and hall area of the Administration Office has been replaced. JTC also installed door
thresholds as agreed.
Punch List — Chairman advised Steve Chmura and Michael Callahan to review status of
each item listed on the monetized punch list and determine what items JTC would not
fulfil under their contract. Upon review of a finalized list, MBC will discuss and/or
accept credit for the remaining incomplete items. Rich Feeley noted that Keyes did not
include the itemized masonry, window or landscaping Punch List with JTC's Seven -Day
Notice to Complete Work. Incomplete or unacceptable masonry, landscaping and
window installation would also be considered by the MBC for credit owed to the Town.
Sidewalk Cracking — Chairman advised Michael Callahan of severe cracking in concrete
walk at fire lane. Steve Chmura to provide JTC with type of sealer to repair cracks.
Stairwell 7 — JTC owns repair of deteriorated concrete steps at Stairwell #7. MBC agreed
to a request made by Michael Callahan, to move the concrete work necessary to repair the
steps, under the MHS Contract with the remaining concrete work.
Valve Tags — Work is incomplete. Rich Feeley advised Michael Callahan that tagging
valves is critical item for school maintenance department and must be provided by the
contractor.
Paving Safety Issues — With winter plowing in mind the MBC had previously directed
JTC to feather asphalt cut in pavement near gym entrance, build up catch basins and
complete handicap ramp work. Phil Ricci reported that the handicap ramp work is
complete. Mr. Ricci noted that due to cold weather, JTC placed 2 "x 4" wood at catch
basins to build up this area. Saw horses have been put on the island in the rear parking
lot.
Grading - David Young commented that the existing grading levels in the rear of building
still generate pools of water in this area. David Young stressed to Michael Callahan and
Phil Ricci that JTC needs to confirm proper grades prior to paving in the Spring, 2001.
Suggestion was made to reduce punch list value of paving to $30K and move the
remaining paving required at QMS to be completed over to the MHS contract.
Miscellaneous Metals/Larkin Iron — Michael Callahan questioned status of claim
submitted by Larkin Iron. Ken Larkin had provided paperwork in the amount of
$14,164.16 to JTC in January, 2000. JTC to date has not submitted paperwork to Town
for consideration. The claim is for cost of increased weight in materials and some labor.
Steve Chmura has verified back up and the work performed. MBC agreed to authorize a
reduced amount of $5,000 as compensation for changes in lintels. Michael Callahan to
discuss offer amount with Larkin Iron & Fence and advise the MBC.
Auditorium Update
• Floor Finish — MBC agreed to accept $2500.00 credit offered by Michael Callahan,
JTC, who is refusing to finish floor properly.
• Handicap seating — Installation complete.
MANSFIELD HIGH SCHOOL
Sidewalk Issues — MBC advised JTC of new sidewalk sunken near pumping station at
bus loop and approximately 6 -8 sections of walkway that are cracked. Michael Callahan
agreed to repair properly due to warranty issue.
Pumping Station - Keyes was responsible for design of new pumping station. Per MBC,
Contractor was directed to leave structure in place and perform remaining work per
contract. Per Walter Parker, contract work is incomplete. Mr. Parker noted that the
existing sump pump was not reconnected and some lights do not work. Chairman
advised Steve Chmura to verify the initial letter from Keyes as to scope of work required
by JTC and follow up with JTC.
Locker Room Modifications — Phil Ricci reported that installation of lockers is moving
slow. Electrician manpower reduced to one man. Overall work in this area is expected to
be complete by early February, 2001.
Gym Bleachers — School Department reported a major problem with manual operation
required to open bleachers. Issue creating safety hazard for custodians due to constant
jamming. Manufacturer is expected on site Wednesday (1- 10 -01) to fix portable
bleachers. Walter Parker is exploring financial options to motorize bleacher units.
Auditorium Seating — Work is incomplete. Phil Ricci reported that the remaining seating
for the Auditorium, is scheduled to be installed on January 25, 2001.
Punch List — Phil Ricci plans to review status of completed Punch List work in the
existing building with Project Coordinator on Wednesday (1- 10 -01).
Direct Payment — Chairman questioned status of direct payment claim from RLM
Flooring in the amount of $32K. Michael Callahan will respond.
JTC/Delay Claim — JTC proposed $90K for delays caused by the project. MBC
previously asked JTC to demonstrate where delays have occurred based on written
documentation and construction schedules. Rich Feeley noted that JTC has never
provided a schedule that shows how JTC would have completed the project within the
timeframe of the contract. During instances where work may have been delayed, the
School Dept. allowed JTC advance work in other areas ahead of schedule. Phil Ricci
commented that Mechanical /Sprinkler trade work slowed down but the Electrician
always found work to continue. MBC agreed that some value may be due, but did not
agree to the $90K value proposed.
Project Coordinator Contract — Discussion was that Paul Letendre's official contract is
due to expire this week. Contract was renewable up to 24 months.
MOTION to amend the monthly renewable extension period of the Project
Coordinator's contract to from 24 months to 30 months based on the current
payment rate of $32.50 per hour. MBC Secretary to forward written notification to
