f lYtttt'r' Tr ent: Richard Feeley, Chairman, David Young, Clerk, Ken Gay (8:20 PM)
James Liddick, William Moore and Eleanor McCarter, Secretary
Attendees: Mike Ahern, Special Projects Manager
Meeting commenced at 7:45 PM.
QUALTERS MIDDLE SCHOOL
Keyes Associates —MBC was expecting Steve Chmura, Keyes Assoc. to attend this meeting and
provide an update regarding status of the project close -out. No representative from Keyes
Associates attended this meeting.
Occupancy Permit Issues
Affidavits —David Young questioned whether the Building Inspector was given all required
affidavits for the school project. MBC Secretary to follow up with Building Dept.
Handicap Rail near Electrical Panel - Committee questioned status of a request made by
MBC on January 16, 2001 to have Walter Parker install a "wood" handrail on one side
leading to cafeteria with a section left out in front of electrical panel. MBC to send follow up
letter to Lincoln Lynch regarding status of work.
MANSFIELD HIGH SCHOOL
Air Flow/Library — TCI provided written response to a complaint received from staff Librarian
on 2 -13 -01 regarding a lack of air flow in the Librarian's office and copy room. Response from
TCI was that the office and copy room are served by an existing unit HV -2 (located above new
drafting room 125B) Balancing report returned on 1 -16 -01 does not indicate air quantities for
existing units to remain. Recommendation by TCI was to have Walter Parker verify whether
existing unit is operational. If unit is running, and there is still no airflow, General Mechanical
should be contacted to find out if duct modifications were made to install new ceiling air devices.
As of January 26, 2001 MBC has received no balancing reports for this area.
Marble Slabs/Locker Room — JTC owns installation of shower -heads in gym Locker Room.
Issue was raised that the plumber can not perform work until marble slabs are installed. JTC
proposed a cost estimate of $10,400.00 to have marble slabs installed this week. MBC opinion is
that cost is excessive. Per Rich Feeley's phone conversation with Walter Parker earlier that day,
School Dept. will hire someone to install marble. Chairman noted that installation must be
completed as soon as possible to avoid cause for delay by the Contractor.
Track/Field Update - Lincoln Lynch, School Business Manager notified the MBC Office that he
would be on vacation this week and asked to be on the March 6, 2001 agenda to provide an
update. Michael Ahern, Special Projects Director attended the MBC Meeting briefly and offered
the following update regarding the Track/Field Project. Member David Young did not
participate in conversation to avoid conflicts as he is employed by CDM.
• School Business Manager and Mr. Ahern are reviewing proposals for Engineering Services
from CDM and Rizzo Associates. Final selection is expected some time next week.
Chairman questioned whether solicitation of three bids was required under MGL 30 Sec.
39M. Mr. Ahern responded that three bids were not necessary.
• Michael Ahern advised the MBC he is moving ahead with stripping loam off the existing
field behind MHS and installing bases for light poles. David Young questioned whether
plans to locate light poles are available. Mr. Ahern indicated he was advised where bases
should be installed. Track surrounding field will remain in place at this time.
• Michael Ahern commented that he has instructed Town Treasurer to immediately secure all
monies appropriated for Track/Fields Project. Mike Ahern indicated that he would be
spending about $30K out of the Track/Field monies over the next couple of weeks.
• Michael Ahern commented that the binder coat of pavement installed behind MHS /QMS
appears to be failing in some areas. MBC to follow up with JTC.
• As discussed with MBC on 12- 16 -00, School Business Mgr. and Special Projects Manager
need to provide detailed line -by -line budget to MBC for approval. MBC previously raised
concerns regarding the original estimated budget submitted that did not appear to have funds
appropriated for demolition, lighting, etc. Per conversation with Line Lynch last week, the
line -by -line budget is expected to be ready for MBC review on March 61 2001.
OTHER
Budget Evaluation/School Projects — Committee reviewed overall budget for Mansfield School
Projects (Robinson Elementary, Qualters Middle School and Mansfield High School). Jim
Liddick reported that project spending is within budget, however after verifying numbers with
accounting, the balance of remaining available funds is not as high as originally anticipated.
MBC will continue to monitor budget closely until projects are complete.
Liquidated Damages Claim — JTC's official end date for the MHS contract is August 24, 2000.
Chairmen noted that as of JTC's August, 2000 Requisition for Payment, the value indicated for
incomplete contract work is approximately one million dollars (10% of total contract).
Discussion was that the significant amount of incomplete work establishes a basis for the Town
to pursue liquidated damages. Incomplete items include paving, striping, landscaping, balancing
reports, auditorium seating, punch list, etc.
Contract Status/Keyes Associates — Bob Mangiaratti stated earlier that day that an update would
be FAXED to the MBC Office. No documentation was received.
SMI Litigation/Mediation — Rich Feeley advised the Committee of the Town's position leaning
toward mediation of the SMI dispute. Chairman reviewed a proposal from Legal Counsel that
included three scenarios based on the verdict of mediation settlement. Members expressed
support of proposal submitted by Conn, Kavanaugh, Rosenthal Peisch & Ford, however
requested that Chris Petrini ask Shannon Law Assoc. if there is a final dollar amount which SMI
would settle to prior to moving to mediation. Rich Feeley will follow up.
J/J Roof Litigation — MBC met with Board of Selectman February 14, 2001_ Max Volterra
moving toward mediation on behalf of the Town.
Meeting adjourned at 9:45 PM.
Respectfully submitted,
Eleanor McCarter, Secretary
David Young, Clerk, Date
