Attendees: Attorney Sue Jacobs - Volterra, Mangiaratti, Goldberg and Jacobs
Meeting commenced at 7:30 PM.
QUALTERS MIDDLE SCHOOL
Window Claim — Attorney Jacobs discussed status of the window issue at QMS with the MBC.
• Site Visit Investigation - Attorney Susan Jacobs reported she had recently visited the school
to view window installation. Photos were taken in various areas of inoperable windows in
conflict with columns or wall partitions.
• Documentation — Attorney Jacobs asked MBC to provide copies of Project Coordinator Daily
Logs.
• Shop Drawings — Attorney Jacobs asked about status of a Shop Drawing said to have a
written directive noted by Ron Ashton to "Verify in Field ". David Young responded that the
MBC had requested a copy of this drawing on numerous occasions, however no such
drawing was ever provided by Keyes Associates. MBC will check Keyes' files forwarded
when they folded.
• Legal Action — Attorney Jacobs has prepared claims to be filed on behalf of the Town of
Mansfield against former Keyes Associates representatives, Ron Ashton, Robert Vogel and
Steve Chmura. Ms. Jacobs advised MBC that the General Contractor Q.T. Callahan & Sons,
Inc.) should also be included in this claim in addition to window manufacturer and installer.
• Damages — Attorney Jacobs asked MBC to assign a cost value to correct the current window
installation. MBC to ask WFDG as current Architect and Gale Associates to generate a cost
estimate to include removal and replacement of entire window system. Jim Liddick noted
that demolition would change esthetic look of the building and that patching would also be
needed. Work is also time sensitive now that school is fully occupied.
• Architect's Insurance — Since Keyes Associates had filed bankruptcy, Attorney Jacobs will
pursue Keyes Associates' insurance company to cover the cost of correcting inoperable
window installation.
• Future Payment to Contractor — Attorney Jacobs requested copy of Contractor's last
payment requisition for review and stated that no further payments should be made to JTC on
the QMS Project until claim is resolved. MBC Chairman asked Ms. Jacobs to forward a
written legal opinion advising MBC that no further payments be made to J.T. Callahan &
Sons, Inc.
• Fuhire Payment to Keyes Associates — Town of Mansfield is holding four outstanding
invoices from Keyes for a total amount of $27K. With the exception of one invoice, MBC
argued that Keyes Associates did not provide the services for which the Town was billed and
that another Architect (WFDG) was hired to complete the unfinished work.
Unit Ventilators — Ken Gay provided a general update about inoperable unit ventilators at QMS.
• Johnson Controls has not provided revised plans to TCI for review as previously requested.
• Units are still shutting down on freezestat.
• TCI generated a new sequence of operation.
• TCI still needs to verify status of controls on roof top unit. Member Gay noted that a
meeting previously scheduled with TCI for last Friday (9 -7 -01) did not occur because Dick
Carney (TCI) was not present at that time.
David Young suggested that MBC forward a letter to JTC noting that as of this date, air
conditioning issues at QMS are not resolved. Since the cooling season is now past, MBC has no
choice but to hold future payment for this work until unit can be tested in Spring, 2002.
OTHER
J/J Roof Update —Settlement Agreement has not been signed. MBC still waiting to review copy
of the draft Agreement from Attorney Max Volterra.
Meeting adjourned at 9:15 PM.
